Poškozený v trestním řízení a jeho ochrana / Protections of the injured party in criminal proceedings

The subject of this diploma thesis is the protection of an injured party in criminal proceedings. Throughout the thesis author analyzes the relevant laws, specialized legal literature and case laws. When there is a debate amongst the professional public, author summarizes the key arguments and provides his own perspective. The paper provides a general definition of the term injured party, which includes a positive and negative definition and distinction between the terms injured party and a victim. The author more closely examines when the injured party is not allowed to exercise his rights. There are also described, from the view of current legislation and also de lege ferenda, the circumstances under which a person is not allowed to join the criminal proceeding as an injured party. Furthermore the author breaks down the rights of an injured party with the emphasis being put on the right of the injured party to consent to prosecution and the right to demand for his/her claims to be satisfied in accordance with the 59/2017 Sb., on the use of funds acquired from property penal sanctions imposed in criminal proceedings, which has been in effect for over a year now in March 2019. In our current environment, where we increasingly become dependent on the internet, the definition of living smart is widely used. Smart living involves original and innovative solutions to make life more efficient, controllable, economical, productive, integrated and sustainable. The Internet of Things (IoT) helps people with the lifestyle of smart living and helps them gain complete control. IoT does not only offer smart devices for the home, such as Google Home or Alexa. It is also essential for small and big businesses. The ability to transfer data over a network without any human interaction is needed in today's society. Organisations in multiple industries are using IoT to improve decision-making and overall quality of life for their employees. One way of using the IoT infrastructures is a concept called digital twin or a Digital Twin of an Organization (DTO). Since an organisation is constantly evolving, keeping the DTO aligned with the organisation will require an infrastructure that lends itself to be highly flexible and maintainable. The EA Blueprint Pattern was proposed to help achieve a flexible and maintainableDTO. However, there are limited practical instantiations of this pattern that can evaluate its utility. This project will therefore perform a practical evaluation and analysis of the pattern.

SammanfattningExamensarbetet har syftat till att undersöka möjligheten att utrusta Husqvarnas autonomagräsklippare med avståndssensorer. Dessa ska hindra gräsklipparen från att kollidera med hinder i sinomgivning. Gräsklipparen arbetar i en miljö där väder, temperatur, ljusförhållanden och underlagvarierar kraftigt. Detta innebär att kravet på sensorerna är högt.Av de sensorer som undersökts har det visat sig att ultraljud och ”structured light” är de system sombäst skulle kunna uppfylla all dessa krav till ett rimligt pris.I examensarbetet undersöks därför ultraljudssensorer från företaget Maxbotix närmare ochimplementeras i en prototyp. Fyra stycken sensorer placeras på gräsklipparens kaross. Dessakommunicera med en mikrokontroller som i sin tur förmedlar mätdata till en dator. På datorn körsen sökalgoritm som tolkar och sammanfogar sensorernas mätdata.Efter ett antal tester visar det sig att de sensorer som valts inte uppfyller de krav som ställts. Dockbör den metod och algoritm som används kunna uppfylla kraven om en annan typ av sensor används. / AbstractThis master thesis is aiming to investigate the possibility of adding distance sensors to Husqvarna’sautonomic lawnmower. The goal is to prevent the lawnmower from colliding with obstacles in itssurroundings. The environment where the lawnmower is working is very dynamic in sense ofweather, temperature, ambient lightning and terrain. This gives high requirements on the sensors.Of all the sensors that were examined, ultrasonic and structured lightning came out as the ones bestfit to fill these requirements to a reasonable cost.In this thesis ultrasonic sensors from Maxbotix were implemented on a prototype. Four sensors wereplaced on the lawnmower body and connected to a microcontroller. The microcontroller then passesalong the sensor data to a computer that is running a search algorithm. The algorithm is used tointerpret the data and merge the different measurements.After certain amount of testing it was shown that the chosen sensor did not meet all therequirements. However the method and the chosen algorithm should suffice with another type ofsensor.

Breaking Down Binaries : Gender Subversion in Olive Schreiner’s "Undine" and "The Story of an African Farm"

This study investigates a thus far neglected aspect of Olive Schreiner’s feminism, namely her subversion of Victorian gender models in her early novels, Undine and The Story of an African Farm. In order to determine what is being subverted a brief outline is first provided of the nature of traditional male and female Victorian gender characteristics; thereafter, the key arguments of Gender Theory are provided, the cornerstone of which is that gender is a social construct and not determined by biology. Analysis of Undine focusses on Schreiner’s eponymous heroine’s subversion of female gender roles, finding that Undine’s subversion is incomplete, due to her repeated lapses into conventional behaviour, seen mainly in her need to fulfil a role of service. In addition, details in Undine are linked to biographical aspects of Schreiner’s own life as many critics have made a link between Schreiner’s fiction and instances in her life. In The Story of an African Farm attention is given to both female and male gender subversion. Female gender subversion is analysed in the character Lyndall who deviates from accepted female characteristics of women as meek and docile, while discussion also focusses on her more conventional cousin, Em, who by acting as her foil, highlights Lyndall’s subversiveness. Although in comparison to Undine, Lyndall shows great progress in her ability to free herself from traditional roles for women, she remains held back by her inability to break free from the idea that service to something was an inherent part of women’s natures. Finally, Schreiner’s most radical work regarding gender is found in connection with her male characters, Gregory Rose and Waldo. While Schreiner shows the constructed nature of male gender models in her characterisation of Gregory who identifies more with the female gender, Waldo avoids gender categories completely, aligning himself with neither femininity nor masculinity, by finding an “escape” from these artificial social constructs in the natural world. / Dissertation (MA)--University of Pretoria, 2020. / English / MA / Unrestricted

The Impact of Extramural English on Students and Teachers : A systematic literature review

Sweden is seen as a successful adopter of English as an additional language (EAL) and the country is a frontrunner in the globalization of the English language. Much of the success could be attributed to the large presence of English in Swedish society. Additionally, EAL learners are acquiring the English language out-of-school to a larger extent, often referred to as Extramural English (EE). Therefore, it is important to investigate how EE affects learners, teachers and discuss how it can change education. This has been done by evaluating the current state of research through a systematic literature review. It was found that learners engage in a variety of EE activities, with playing online games and watching movies being the activities with the most English exposure. Learners engage in these activities mostly out of their own interests or because of other socially driven motives. EE affects their opinion of English and could have negative effects on their attitude towards school English. Teachers are aware of the gap between EE and school English and try to integrate activities similar to EE activities in class. However, it is a challenge to find authentic material that fits a large number of learners’ interests. In conclusion, there is a need for more research that could point to a clear cause-and-effect relationship between EE and high proficiency in English. This thesis also calls on teachers, principals, and school leaders to prepare to change education if EE becomes a more widespread phenomenon.

The first involves the conflict over the shared hydrocarbon reservoirs in the Gulf of Mexico. The second analyzes the dispute over the shared waters of the Colorado River. For over seventy years, pursuing unilateral development, the U.S. and Mexico alternated between deadlock and confrontation in both cases. However, they were able to buck this trend in 2012, reaching two agreements. For the first time, the two sides have established a binational framework through which to co-develop and jointly manage these transboundary natural resources, as partners. This research explores how the negotiators shaped these agreements, and in what ways they contributed to the resolution of these long-standing disputes. With interviews with over 70 negotiators in the U.S. and Mexico, including every one of the chief negotiators who had decision-making authority at the negotiating table, the dissertation argues that a critical factor in breaking the cycle of disputes to reach agreement was that both sides were able to shift from solely allocating costs to also allocating benefits. The two countries reinterpreted the broader political and economic circumstances surrounding the shared water and energy resources, influenced in part by drastic natural disasters and resource shortages. These events, in turn, modified the countries' alternatives, drew stakeholders to the negotiations with revised mandates, fostered new back table coalitions, and led to a reframing of beneficial trades that had not been obvious earlier. Changes in political leadership, especially in regard to the interpretation of and response to transboundary challenges, were additional enabling factors making this shift possible. By focusing on the negotiation process and the tension between creating and claiming value, the dissertation attempts to draw prescriptive negotiation and leadership advice that may be useful in other international resource management disputes, particularly between developing and developed countries. The ability to communicate, read and write in the Arabic language, can be used to research, read and write about the customs, traditions, folklore, habits, poetry, music, history and literature of the people where Arabic is considered the mother tongue The Constitution of the Republic of South Africa (act 200 of 1993) states that 11 every person shall have the right to use the language and to participate in the cultural life of his or her choice" (p 16 (31)). The Constitution further states that " no person shall be unfairly discriminated against, directly or indirectly, and, without derogating from the The existence, respect and promotion of the Arabic language has been enshrined in the South African Constitution. Arabic is recognised as a language used by communities in South Africa even though it is mainly used for religious and ceremonial functions at this point in time. In 1993 I started teaching at Cravenby Secondary School, (Sub. A to Std. 10). During that year I did not teach the Arabic language. I, however, enquired from teachers regarding their teaching approach of the Arabic language. I also questioned the pupils about their opinion towards the language and the approach used by teachers. The overwhelming response by the pupils was that they had to learn the meaning of words in isolation and out of context.

English Speaking Cultures in Middle School Reading Material

This study is an attempt to discuss and reflect over which cultures that are present in the reading material in the English language education in the years four to six at in a school outside of Malmö. The concept of culture is discussed from an educational perspective. The cultures present in the learners reading material and the teachers perspective on foreign cultures is also discoursed. Relevant previous research is highlighted and used to examine the collected material. The data is collected from interviews with three middle school teachers and from an analysis of the reading material that is used in the English education. The results reveal that British or American culture is heavily over-represented. The three teacher’s education is based almost solely on the textbook and therefore the textbook is given great mandate on which cultures that are present in the classroom. The results led to the argumentation that the English education in Sweden ought to be challenged. The endonormative perspective that places a clear emphasize on the native speaking norm, and revolves around inner circle cultures in the English classroom does not suffice as a foundation for our young learners. To solely focus on an English or American context will not prepare our pupils for the global challenges that lies ahead. English as an international language is spoken in all the corners of the world and all these corners ought to be invited into our classroom.

Set in Stone: Power Mediation through French Colonial Architecture in Lebanon’s Majlis an-Nuwwab

This thesis will provide an analysis of the current Parliament building in Beirut, which is called Majlis an-Nuwwab, and was built by the French colonial state that ruled over Lebanon. It will examine to what extent it has theoretically contributed to the mediation of the French colonial power over Lebanon, through the analytical framework provided by Njoh and Bigon, along with a theoretical framework offered by Kim Dovey. The data was obtained first-hand during a ten-day visit to the city of Beirut, employing primary observation and is in the form of personally obtained photographs of the object of analysis, namely Lebanon’s Parliament building. Further, this research has been conducted due to the lack of academic discussion and literature regarding the relationship between colonial power structures and colonial architecture in the Middle East.In accordance to the analytical and theoretical framework, this study demonstrates that Lebanon’s Parliament building, along with its urban context, can theoretically be understood as operating as the mediator for military, cultural and socio-psychological power as the most prominent ones. Additionally, traits of economic and politico-administrative power were also found to be theoretically mediated through the designs of the Parliament building, although not to the same extent as the previously mentioned powers.
