El presente informe tiene como materia de análisis la Resolución Nro. 10 emitida por la
Primera Sala Comercial Permanente de Lima dentro del expediente N°319-2016, en el
que se discute el recurso de anulación de laudo arbitral de derecho interpuesto por
Pesquera Exalmar contra JMG. El principal tema de análisis es determinar si la falta de
pronunciamiento respecto a las observaciones formuladas por EXALMAR contra los “12
adicionales”, por parte del Tribunal Arbitral, constituyen una causal de anulación de
laudo. En el desarrollo del informe analizaremos las principales instituciones que están
ligadas al arbitraje y cuál es su prevalencia dentro de un proceso arbitral. Asimismo,
desarrollaremos el problema que surge respecto a la motivación con la que han de contar
los laudos arbitrales y cuál ha de ser el análisis que han de seguir los jueces al momento
de resolver un recurso de anulación de laudo por falta de motivación sin pronunciarse
sobre el fondo de la controversia.
En ese sentido, como conclusión hemos señalado que la falta de motivación de los laudos
arbitrales sí constituye una causal de anulación de laudo ya que vulnera el derecho al
debido proceso de las partes dentro de un proceso arbitral. / The subject of this legal report is to analize Resolution No. 10 issued by the First
Permanent Commercial Court of Lima in Case File No. 319-2016, in which the action for
annulment of the arbitration award filed by Pesquera Exalmar against JMG is discussed.
The main topic of analysis is to determine if the lack of pronouncement with respect to
the observations made by EXALMAR against the "12 additional", by the Arbitral
Tribunal, constitute a ground for annulment of the award. In the development of the legal
report we will analyze the main institutions that are linked to arbitration and which is its
prevalence within an arbitration process. Likewise, we will develop the problem that
arises with respect to the reasoning that arbitral awards must have and what should be the
analysis that judges must follow when resolving an appeal for annulment of an award for
lack of reasoning without ruling on the merits of the dispute.
In this sense, as a conclusion we have pointed out that the lack of motivation of arbitral
awards does constitute a cause for annulment of the award since it violates the right to
due process of the parties within an arbitration process.

Anulación Parcial de Laudo Arbitral: Análisis de la Resolución Nº 7, Expediente Nº 0212-2016-0-1817-SP-CO-01Lozano Valentín, Viviana Alexandra 01 August 2023 (has links)
En el presente informe jurídico se estudiará una anulación parcial de Laudo
Arbitral, en el cual el Árbitro Único a cargo del caso desestimó una pretensión
reconvencional, en base a una afirmación que puede ser considerada como
errada, esto debido a la falta de hechos probados.
La situación mencionada se encuentra recogida en la Resolución Nº 7 del
Expediente Nº 0212-2016-0-1817-SP-CO-01, en este caso la Autoridad
Nacional del Servicio Civil – SERVIR (en adelante, “SERVIR” o “Entidad”)
presentó su solicitud de anulación invocando la causal contenida en el inciso b)
del numeral 1 del artículo 63° del Decreto Legislativo Nº 1071 (en adelante, “DL
Nº 1071”), ley que norma el arbitraje, esto en contra de lo resuelto en el
proceso seguido con M4G Consulting SAC (en adelante, “M4G”).
De esa manera, el objetivo principal de este trabajo es plantear un análisis
respecto a si la invocación de esta afirmación errada puede devenir en la
anulación del laudo arbitral. Asimismo, se tendrá en consideración aspectos
relacionados al tema como la vulneración a la debida motivación y sus diversos
tipos en las decisiones tomadas por los operadores de justicia, y la afectación a
los principios de imparcialidad e independencia.
Para alcanzar el objetivo de este trabajo se ha recurrido a la revisión de la
normativa correspondiente, jurisprudencia y textos académicos que puedan
brindar mayores alcances sobre las diversas temáticas planteadas.
Siendo ello así, se ha podido concluir que el empleo de una afirmación errada
para desestimar una pretensión o sustentar una decisión genera graves
afectaciones en el desarrollo del arbitraje, puesto que vulnera el deber
motivación e interfiere en el cumplimiento de los principios de imparcialidad e
independencia. / In this legal report we will study the partial annulment of an Arbitration Award in
which the sole arbitrator dismissed a counterclaim, based on a presumed
erroneous statement, this due to the lack of proven facts.
The mentioned situation is addressed in Resolution N° 7 of the File Nº 0212-
2016-0-1817-SP-CO-01, in which the Autoridad Nacional del Servicio Civil
– SERVIR (hereinafter, SERVIR or Entity) presented its annulment request
invoking the ground contained in subparagraph b) of numeral 1 of Article 63 of
the Legislative Decree N° 1071 (hereinafter, “DL 1071”), the law that governs
arbitration, against the final decision on the process against M4G Consulting
SAC (hereinafter, “M4G”).
The main objective of this report is to set an analysis to determine if the
invocation of this erroneous statement could conclude in the annulment of the
arbitral award. Therefore, it will be considered aspects related to the main topic
such as the violation of proper motivation and its diverse types that affects the
decisions made by the judicial operators, and how it impacts the principles of
impartiality and independence.
The review of corresponding regulations, case law and academic texts were
done to achieve the report’s objective. This could provide a wider insight into
the diverse topics raised.
This being the case, it can be concluded that the usage of an erroneous
statement to dismiss a claim or to support a decision generate serious effects in
the development of the arbitration, as it violates the proper motivation and
interferes with the fulfilment of the impartiality and independence principles.

El estándar de la motivación de los laudos arbitrales ha sido motivo de múltiples
reflexiones y críticas respecto a su alcance. En ese sentido, el presente trabajo de
investigación tiene como finalidad enmarcar el análisis de dicho estándar en aquellos
arbitrajes que se encuentran sujetos a la aplicación de la Ley de Contrataciones del
Estado, Texto Único Ordenado de la Ley N° 30225.
Asimismo, se cuestionará cuál es el estándar mínimo que no vulnerará el derecho a
la debida motivación, siendo que esta será una pregunta que será objeto de reflexión
a lo largo del desarrollo del presente artículo académico.
Estando a ello, se abordará un análisis de la concepción del derecho a la motivación
a partir de un examen de jurisprudencia y doctrina calificada, además de cómo dicho
derecho opera en los arbitrajes en contrataciones públicas y cómo ha sido abordado
por los Tribunales Arbitrales en sede arbitral. / The standard of motivation for arbitration awards has been the subject of multiple
reflections and criticisms regarding its scope. In that sense, the purpose of this
research work is to frame the analysis of said standard in those arbitrations that are
subject to the application of the State Procurement Law.
Likewise, it will be questioned what is the minimum standard that will not violate the
right to due motivation, and this will be a question that will be the subject of reflection
throughout the development of this academic article.
With this in mind, an analysis of the conception of the right to motivation will be
addressed based on an examination of jurisprudence and qualified doctrine, in
addition to how said right operates in arbitrations in public procurement and how it has

El presente artículo se centra en el análisis de la ejecución de laudos en sede arbitral,
explorando sus límites y posibilidades. A lo largo de sus páginas, se abordarán las
razones subyacentes a la tendencia común de las partes de no recurrir al ámbito arbitral
para llevar a cabo la ejecución de las decisiones arbitrales, prefiriendo en su lugar
recurrir a la vía judicial. La hipótesis propuesta sugiere una percepción errónea que
asocia la ejecución de una decisión exclusivamente con el uso de la fuerza, cuando, en
realidad, existen escenarios en las que ésta no es necesaria. En ese sentido, se
analizará detenidamente las posibles circunstancias en los cuales no se requiere fuerza
pública para la ejecución y, donde los árbitros pueden desempeñar un papel crucial,
siempre y cuando las partes les haya otorgado dicha facultad. Finalmente, se
reflexionará sobre la viabilidad de autorizar a los árbitros el acceso al uso de la fuerza
pública, subrayando la importancia de preservar la autonomía del arbitraje en la
ejecución de laudos. / This article focuses on a thorough exploration of the enforcement of awards in arbitration
proceedings, highlighting both its limitations and opportunities. Throughout its pages, the
underlying reasons for the common trend of parties not resorting to arbitration for the
execution of arbitral decisions, opting instead to seek enforcement through the judicial
system, will be addressed. The proposed hypothesis points to a misconception rooted in
the mistaken idea that the enforcement of decisions can only be achieved through the
use of force when, in fact, there are situations where this is not necessary. In this context,
the scenarios where the intervention of public force is not required for enforcement will
be carefully analyzed, and where arbitrators can play a crucial role, provided that the
parties have granted them such authority. As a final reflection, there will be an inquiry
into the feasibility of authorizing arbitrators to access the use of public force, emphasizing
the imperative need to safeguard the autonomy of arbitration in the enforcement of

La presente investigación tiene como objetivo delimitar el rol de los secretarios arbitrales dentro del proceso arbitral. En primer lugar, se realiza una delimitación conceptual que aborda la definición doctrinaria de los secretarios arbitrales, su importancia para el arbitraje, y la forma en cómo dichos aspectos han sido regulados por la normativa nacional y los reglamentos de las instituciones arbitrales nacionales e internacionales. En segundo lugar, se aborda la interrogante de si es necesaria una regulación o aclaración de las funciones de los secretarios arbitrales; y cuál sería el enfoque más adecuado para realizar dicha regulación. Con ese objetivo, se analiza la importancia de la trasparencia
como elemento central en la actuación de los secretarios arbitrales y las preocupaciones que han surgido en torno a su participación en el proceso arbitral. Contiene el presente Informe, el análisis de la resolución N°8
recaída en el expediente N°71-2016-0-1817-SP-CO-02 emitido por la Primera
Sala Civil Subespecialidad Comercial de la Corte Superior de Justicia de Lima,
la cual versa sobre la demanda de anulación arbitral que interpone el Consorcio
Nueva Gambetta contra el Laudo arbitral de derecho emitido por el tribunal
arbitral de la Cámara de Comercio de Lima en el proceso arbitral seguido contra
el Gobierno Regional del Callao.
En el presente informe se aborda temas como la debida motivación, el derecho
a la defensa y debido proceso, la jurisdiccional del arbitraje y la anulación de
laudo arbitral. Dichos temas en conjunto nos han ayudado a conocer y demostrar
si es válido tomar en cuenta alegaciones no invocadas por las partes como parte
de la motivación del laudo arbitral; como fue vulnerado el derecho a la defensa y
el debido proceso en la Resolución en cuestión; y si correspondía declarar
fundada la solicitud de anulación de Laudo del Expediente materia del Informe.
El informe se basa en la vulneración del Articulo 63, inciso b). producto de la
aplicación de dos descuentos al monto del pago de costos directos otorgados
por el tribunal arbitral, descuentos que no formaron parte del debate procesal.
Finalmente se concluye, que la parte afectada no tuvo oportunidad de ejercer su
derecho a la defensa y debido proceso en cuanto no pudieron expresar lo
conveniente a su derecho, por lo que debió declararse fundada la demanda de
anulación de laudo arbitral. / This report contains the analysis of resolution N° 8 issued by the
First Civil Chamber of Commercial Sub-specialization of the Superior Court of
Justice of Lima in case N°71-2016 -0- 1817-SP -CO-02, which concerns the claim
for the annulment of the arbitration award filed by Consorcio Nueva Gambetta
against the arbitration award issued by the arbitration tribunal of the Lima
Chamber of Commerce in the arbitration proceeding against the Regional
Government of Callao.
This report addresses issues such as due motivation, the right to defense and
due process, arbitration jurisdiction and annulment of the arbitration award.
These topics together have helped us to understand and demonstrate whether it
is valid to consider allegations not invoked by the parties as part of the motivation
of the arbitration award; how the right to defense and due process have been
violated in the Resolution in question; and whether it was appropriate to declare
the request for annulment of the Award in the case file subject to this Report as
well-founded. The report is based on the violation of Article 63, subsection b),
resulting from the application of two deductions to the payment amount of direct
costs granted by the arbitral tribunal, deductions which were not part of the
procedural debate. Finally, it is concluded that the affected party did not have the
opportunity to exercise its right to defense and due process as they were not able
to express what was convenient to their rights, and therefore the claim for
annulment of the arbitral award should have been declared well-founded.

Informe jurídico sobre el laudo arbitral del Expediente Arbitral N° S 085-2013Revoredo Loayza, Diana Valeria 05 August 2024 (has links)
En el presente informe, criticaremos la decisión del tribunal arbitral emitida a
través del laudo a nivel sustancial y procesal, en ese sentido, se analizan las
obligaciones contractuales del Contratista según la Ley de Contrataciones del
Estado D.L. N°1017, su Reglamento, y el Contrato N°010-2012-MIDIS-PRONAA
sobre “Adquisición de Papilla”. Efectuando especial mención respecto a la figura
de vicios ocultos en las contrataciones de bienes, en este caso, bienes perecibles
y cuestionaremos la lógica del tribunal al considerar cumplidas las obligaciones
del Contratista.
En el aspecto procesal, observamos una violación al debido proceso, ya que el
Laudo fue emitido por dos árbitros recusados mientras el proceso debía estar
suspendido según la normativa vigente, lo que constituye una infracción a los
procedimientos legales establecidos.
En cuanto al fondo del caso, desde nuestro punto de vista, el Tribunal no evaluó
adecuadamente las obligaciones contractuales, siendo que su análisis se centró
únicamente en el cumplimiento de las obligaciones antes de la entrega del
producto, sin considerar las responsabilidades del contratista de mantener la
integridad del producto durante su vigencia. Este incumplimiento, se evidenció
cuando el producto entregado no estaba en condiciones óptimas. Además, el
Tribunal no tuvo en cuenta que, conforme a la normativa vigente, si el contratista
quería una ampliación de plazo para la entrega del producto, este debió
solicitarla inmediatamente después de cesar el evento de fuerza mayor, sin
embargo, notificó a la Entidad sobre el siniestro 14 días después de la entrega,
factores, no debidamente evaluados, que afectan la idoneidad del Laudo emitido. / In the present report, we will critique the decision of the arbitral tribunal issued
through the award on both substantive and procedural levels. In this regard, we
analyze the contractual obligations of the Contractor according to the State
Procurement Law D.L. No. 1017, its Regulations, and Contract No. 010-2012-
MIDIS-PRONAA concerning the “Acquisition of Baby Food.” Special mention is
made of the concept of hidden defects in the procurement of goods, in this case,
perishable goods, and we will question the tribunal's logic in considering the
Contractor’s obligations as fulfilled.
On the procedural aspect, we observe a violation of due process, as the Award
was issued by two arbitrators who had been challenged while the process should
have been suspended according to the current regulations, which constitutes an
infringement of the established legal procedures.
Regarding the substance of the case, in our view, the Tribunal did not adequately
evaluate the contractual obligations, focusing its analysis solely on the fulfillment
of obligations prior to the delivery of the product, without considering the
contractor's responsibilities to maintain the integrity of the product during its
validity. This breach was evident when the delivered product was not in optimal
condition. Furthermore, the Tribunal did not take into account that, according to
current regulations, if the contractor wanted an extension of the delivery deadline,
this request should have been made immediately after the cessation of the force
majeure event. However, the contractor notified the Entity about the incident 14
days after delivery. These factors, which were not duly evaluated, affect the
adequacy of the issued Award.

El presente trabajo de investigación se centra en la sentencia recaída en el Expediente
Judicial N° 00568-2021-0-1817-SP-CO-02, que decide sobre la anulación de un laudo
arbitral. Por ello, la procedencia o no de este recurso de anulación constituye el
problema principal de este informe jurídico, para lo cual, nos adentraremos en la
evaluación del estándar de motivación exigido para las resoluciones judiciales, y si estos
pueden ser aplicables a los laudos arbitrales, en virtud a lo establecido por la Ley de
Arbitraje vigente, el precedente vinculante Giuliana Llamoja, y el precedente vinculante
Fernando Cantuarias. Asimismo, nos cuestionaremos si esta actuación representaría
una revisión de fondo del laudo arbitral, por parte de la Sala Comercial, y si el Tribunal
Arbitral estaba autorizado para conceder indemnizaciones basadas en un principio de
contratación pública. En ese sentido, responderemos que no debió anularse el laudo
arbitral, pues las causales invocadas por el accionante no resultaban aplicables al laudo
cuestionado, ni justificaban que se declare nulo parte de este. Este análisis ha
determinado que la exigencia de motivación del laudo arbitral, al equipararse a los
mismos estándares de la motivación judicial, ha quebrantado la naturaleza del proceso
arbitral, ocasionando la anulación indebida del laudo. / This research work focuses on the ruling issued in Judicial File No. 00568-2021-0-1817-
SP-CO-02, which decides on the annulment of an arbitration award. Therefore, whether
or not this annulment appeal is admisible, constitutes the main problem of this legal
report, for which we will delve into the evaluation of the standard of motivation required
for judicial resolutions, and whether these can be applicable to arbitration awards, by
virtue of the provisions of the current Arbitration Law, the Giuliana Llamoja binding
precedent, and the Fernando Cantuarias binding precedent. Likewise, we will question
whether this action would represent a substantive review of the arbitration award, by the
Commercial Chamber, and whether the Arbitration Court was authorized to grant
compensation based on a public contracting principle. In that sense, we will respond that
the arbitration award should not have been annulled, since the causes invoked by the
plaintiff were not applicable to the contested award, nor did they justify declaring part of
it null. This analysis has determined that the requirement of motivation for the arbitration
award, when equated to the same standards of judicial motivation, has violated the
nature of the arbitration process, causing the improper annulment of the award.

Informe jurídico sobre el análisis de la Resolución N° 6 del Exp. 00351-2021-0-1817-SP-CO-02Campos Florián, Grecia Verónica 07 August 2024 (has links)
El presente informe se centra en el análisis de la Resolución N° 6 emitida en el Expediente N° 00351-2021-0-1817-SP-CO-02 por la Segunda Sala Civil Subespecialidad Comercial del Corte Superior de Justicia de Lima, que declaró
fundado en parte el recurso de anulación del laudo arbitral de fecha 29 de diciembre 2020, presentado por el Ministerio de Desarrollo e Inclusión Social, en el arbitraje contra ella seguido por Alimentos Andinos P&A E.I.R.L. La referida resolución tuvo como objeto determinar si la decisión adoptada por el Tribunal Arbitral vulneró el derecho a la motivación en su tipificación bajo las causales del literal b) y d), del inciso 1 del art. 63 de la Ley de Arbitraje, que contemplan la
falta de motivación suficiente y la decisión sobre materias no sometidas al
arbitraje, respectivamente.
El problema principal del caso se refiere a la interpretación de un plazo estipulado en el contrato para acudir al arbitraje, como uno de caducidad, lo que afectaba
la admisión de la controversia en esta sede. Los instrumentos normativos empleados son la Ley de Arbitraje, específicamente los artículos 41, 62 y 63, que establecen los principios de competence-competence e irrevisabilidad y las causales de nulidad de los laudos arbitrales.
El informe examina si el Tribunal Arbitral aplicó correctamente los principios mencionados y si la Sala Superior se ajustó a las causales de nulidad al revisar
la decisión arbitral. Se concluye que es imperativo que los tribunales judiciales respeten los límites establecidos por la ley en cuanto a las causales de nulidad de los laudos arbitrales, preservando así la independencia y eficacia del sistema arbitral como un mecanismo eficiente para la resolución de disputas comerciales. / This report focuses on the analysis of Resolution No. 6 issued in Case No. 00351-
2021-0-1817-SP-CO-02 by the Second Civil Chamber Commercial Subspecialty of the Superior Court of Justice of Lima, which declared partially founded the appeal for annulment of the arbitral award dated December 29, 2020, filed by the Ministry of Development and Social Inclusion, in the arbitration against it followed by Alimentos Andinos P&A E. I.R.L. The purpose of said resolution was to determine whether the decision adopted by the Arbitral Tribunal violated the right
to motivation in its typification under the grounds of subparagraph b) and d), paragraph 1 of Article 63 of the Arbitration Law, which contemplate the lack of

arbitral awards.
The report examines whether the Arbitral Tribunal correctly applied the aforementioned principles and whether the Superior Chamber complied with the grounds for nullity when reviewing the arbitral decision. It concludes that it is imperative that the courts respect the limits established by law regarding the grounds for nullity of arbitral awards, thus preserving the independence and effectiveness of the arbitral system as an efficient mechanism for the resolution of commercial disputes.
