Public Opinion and the Oregon Death with Dignity Act

Oregon voters legalized physician-assisted death in 1997 by passing the Oregon Death with Dignity Act. This law allowed terminally ill, mentally competent adult residents of the state to legally obtain a physician's prescription to hasten death under narrow sets of circumstances. The purpose of this study was twofold: to examine contemporary patterns of support for the law in Oregon and to explore how opinions have changed over time on the issue. This study examined patterns of public support among a random sample of registered Oregon voters for the state's death with dignity law, using a mixed mode (mail, online, and phone) cross-sectional survey (n = 442). The findings indicate a pattern of growing support with potential Oregon voters split 80%-20% on the issue, a substantial increase from the 60%-40% approval margin at the ballot box in 1997. Various demographic variables, as well as attitudinal factors, were explored in building a binary logistic regression model predicting probability of support. Frequency of church attendance, views about physician participation in the process, and opinions about Death with Dignity as an individual right were significant predictors of support. Frequent churchgoers, regardless of denomination or religious tradition, were nearly five times more likely to oppose Death with Dignity than support it, holding all other variables constant. While the findings indicate a pattern of growth in support over the past 15 years, they indicate also a stability of opinion, with few individuals indicating they had changed their opinions about the issue since the first time they encountered it.

On suicide in European countries : some theoretical, legal and historical views on suicide mortality and its concomitants

The theme of this thesis is suicide mortality in its various aspects, seen from an international, European perspective. It questions the existence of social (structural) concomitants to suicide mortality and investigates attitudes towards and legislation concerning suicide, as well as some historical processes pertaining to their development. Paper 1 replicates an authoritative study of the "correlates of suicide" on a national level in European countries. It shows that the findings of this study do not hold 16 years later, and it presents some ideas as to why these changes have taken place. It is suggested that there are no simple social correlates to suicide on this level, and that suicide rates tend to vary according to, among other things, international cultural influences. Paper 2 investigates penal legislation relating to suicide in European countries. Three types of punishable action are found: 1) aiding suicide, 2) abetting suicide, and 3) driving somebody to suicide. A majority of European countries include some of these acts in their criminal laws. However, the laws vary very widely between countries, thereby constituting a notable exception to the common presumption of uniformity of law. The scope of the criminalization and the severity of the penalties for the crimes covary both with cultural attitudes towards suicide and with suicide rates. The results are interpreted as indicating the existence of a cultural-normative system, consisting of the cultural attitudes towards suicide, the laws regulating the actions relating to suicide and, perhaps, religion. It influences the occurrence of suicide, mainly by offering individuals cultural models of behavior. Paper 3 describes the process towards the decriminalization of suicide (in 1864) in Sweden, its causes and consequences. It is suggested that the law change took place because of a) the international ideological currents of the time (the heritage of the Enlightenment), b) the examples presented by other European countries, and c) the radical changes in people's behavior. The reform was long overdue, and thus did not have a direct effect on suicide mortality. The increase in Swedish suicide rates in the 19th century is seen as connected with certain aspects of the "modernization" process. Paper 4 addresses the prospects and problems connected with the ap-plication of Talcott Parsons's functionalist theory to suicide research, in particular when contrasting it with Durkheim's theory. It is found that the latter, despite its shortcomings, still dominates socially oriented suicide research. Parsons's theory is seen as implicating the cultural primacy of suicide mortality. Its general usability is, however, highly uncertain since many of its essential constituent parts are not well suited to the subject. A model for suicide rates, consisting of cultural (domestic and inter-national), political, social, diffusion and availability factors is presented. Taken together, the papers constitute a case for cultural (as opposed to socio-structural) research into suicide mortality. They question the repeated testing of structural variables in favor of creating cultural indicators. Framework for the implementation of euthanasia in South Africa

This dissertation aims to examine and analyse the current South African position with regard to voluntary euthanasia. An examination is made from constitutional law, common law, case law and statutory law perspectives, including the legislation proposed by the South African Law Commission (project 86). The writings of prominent authors are considered. Once the South African position is examined, a comparative study is undertaken concerning relevant aspects in the Dutch law. The most important findings are that the South African Constitution may allow, and perhaps even demand, the legalization of voluntary euthanasia in South Africa, provided that sufficient safeguards can be established to effectively and sufficiently minimize the risk of abuse. Should this be impossible, the proscription of euthanasia may be reasonable and justifiable in an open and democratic society based on human dignity, equality and freedom. The thesis deals with legal aspects of euthanasia with special focus on criminal law context. It is divided into four broad chapters. First chapter defines terms that need to be understood perfectly for further work on the topic. Therefore, it deals with the term "euthanasia" and its division into active and passive euthanasia, direct and indirect, requested and unsolicited. There are also mentioned some related institutes such as dysthanasia, palliative and hospice care and assisted suicide. Last but not least, this chapter presents some arguments for and against euthanasia. Second chapter is devoted to legislation in foreign countries where euthanasia (or assisted suicide) has been legalized. Wider context of foreign legislation is important for realizing the consequences that possible legalization of euthanasia in the Czech Republic would bring. It can be clearly seen on the example of individual foreign states what legalization of euthanasia entails, how stringent the conditions that a request for termination of life has to meet are, and ultimately, we can decide whether we tend to endorse the legalization of euthanasia or go in the opposite course. Of Stewardship, Suffering and the “Slippery Slope”: A Vattimian Analysis of the Sanctity of Life Ethos in Canada (1972–2005)

This dissertation examines from a Vattimian perspective the challenge that euthanasia and assisted suicide posed to the sanctity of life ethos in Canada from 1972–2005. Gianni Vattimo’s central themes—metaphysics (absolute values), “event of being” (lived experiences that call absolute values into question), and passive-reactive nihilism (the use of “masks” or “disguises” to prevent the dissolution of metaphysics)—are pivotal to understanding the way religious and secular beliefs are interwoven within ethical, medical, legal and political discourses in Canada. Vattimo’s philosophico-ethical approach was specifically chosen because as a theoretical tool, it helps to illuminate the presence, weakening, and resilience of metaphysics in discourses surrounding an intentionally hastened death. To demonstrate how Vattimo’s major themes apply empirically to the research, a social constructionist approach was adopted in the form of a discourse analysis. Particular emphasis was placed on an examination of the three most important cases of death and dying in Canada, namely, Nancy B., Sue Rodriguez and Robert Latimer. The bulk of the evidence suggests that when these “events of being” challenged the sanctity doctrine as the ultimate foundation for life-terminating decisions, ethical, medical, legal and political discourses converged to promote three normative positions or authorizing discourses used in the tradition of Christian ethics: (1) stewardship—the view that since life is a “loan from God,” sacred, and of infinite worth, death cannot be intentionally hastened (“nature must take its course”); (2) value in prolonged suffering—the view that since suffering possesses transcendent meaning or purpose, its prolongation is justified in individual circumstances; and (3) the “slippery slope”—the view that any weakening of the sanctity of life ethos inevitably harms or threatens the community. Generally speaking, religious and secular advocates of the sanctity of life ethos reacted similarly in cases involving an intentionally hastened death. In other words, both the religious and the secular embraced metaphysics (absolute values), condoned and rationalized the prolongation of suffering, and relied on the “slippery slope” as a “mask” to maintain the sanctity of human life as first principle. The research strongly suggests that Canada is still significantly indebted to Christian notions when it comes to discussions surrounding the decriminalization of euthanasia and assisted suicide.

The right to be killed : reassessing the case for the moral right to voluntary active euthanasia

This thesis defends an individual's moral right to be aided in dying by a physician (that is, voluntary active euthanasia, or VAE), but departs significantly from the view in its favor generally accepted in the bioethics literature. The prevailing view appeals to both respect for an individual's autonomy and promotion of an individual's well-being as necessary conditions for a right to VAE, so as to justify the right only for those suffering grave illnesses and/or disabilities. The author argues that such a view is logically untenable; one or another aspect must be given up. Since invoking the premise that certain individuals would be better off dead necessarily relies on controversial assumptions about both the value of life and the nature and value of death, about which reasonable people disagree, it is the justification from an individual's best interest which must be excluded in a liberal society. The author endorses a self-determination justification for the right to VAE, but rejects understanding this in terms of respecting personal autonomy, instead making the case for a right to VAE grounded in self-ownership. The author's main conclusion is that the right to VAE is a general right applying to all competent adults, not only those suffering grave illnesses or disabilities, or those whose choice for VAE is an exercise of autonomy. Moreover, by analyzing the basis of physician authority over prescription medicine and how this can be justified to a society of self-owners, she maintains that individuals have not only the right to choose VAE without state interference, but also the right to be provided VAE by doctors. Nevertheless, both rights are compatible with reasonable limitations to protect both the interests of VAE seekers and the rights of others.

The thesis deal with the topic of induced abortion and euthanasia as the basic issue of the theme of process of dying and death. The theoretical part presents how an acceptation of death have been changing during the human history, deals with the concept of after-life in five world religions, presents how death is perceived in different life period, gives the analysis of abortion and euthanasia as an issue of ethics. The second part od the thesis is to serve as the background material to design lessons of ethics for the secondary schools according to the RWCT program (Reading and Writing Critical Thinking). The aim is to depict the topicality and importance of these issues that a disciple is not only to meet during the lesson, but also to be able to handle, to judge and to draw conclusions for his behaviour.
