This thesis deals with the before-, during- and after- reading activities when working with text in teaching literature in grades 6-9. The first part describes results from testing the critical literacy of Czech students in the PISA 2009 international comparison, as well as levels of critical literacy and its place in the Framework Education Programme for Elementary Education. The reasons for using these activities and examples of them are also discussed. In the practical part, I carried out research using questionnaires to find out if and how often teachers use these types of activities and I have provided examples of those used. Next I wanted to find out which types of readers the teachers use and how these readers contribute to a student's reading literacy development.

L'expertise medicale dans le droit de la sécurite sociale / The medical evaluation in social security law

La nature des litiges relatifs à l'appréciation médicale de l'état du malade ou de la victime d'un accident du travail ou d'une maladie professionnelle, a conduit à l'organisation extra-judiciaire d'une expertise médicale dite "technique", les litiges relatifs aux états d'incapacité incombant directement à des juridictions spécialisées (contentieux technique).L'expert, désigné d'un commun accord entre le médecin-conseil et le médecin traitant, est saisi par la caisse en vue de l'examen clinique du malade ou de la victime, à l'aide d'un protocole. La procédure est assortie de brefs délais et l'avis de l'expert, qui s'impose aux parties, peut être contesté dans le cadre du contentieux général.La mise en œuvre de la procédure s'impose à la juridiction (qui fixe la mission et prend la décision), quand la difficulté d'ordre médical survient en cours d'instance. Cette obligation, née du caractère substantiel des formalités, dont a pu découler la force probante de l'avis de l'expert à l'égard du juge, est exceptionnelle en droit français.La question est bien celle des fonctions respectives de l'expert et du juge, quand la CEDH vise à étendre le principe du procès équitable à la phase expertale, de telle sorte que pourrait naître un droit général d'accès à l'expertise et d'y être assisté par un technicien, ce que l'on peut observer dans l'expertise médicale.La thèse vise à prôner l'extension du régime de l'expertise médicale à l'exception propre aux accidents du travail et maladies professionnelles dans le domaine agricole, dont le régime est inspiré du droit commun, le contentieux technique paraissant pouvoir lui-même être étendu à cette exception, alors que la Cour de cassation (rapports 2010 et 2011) recommande son intégration au contentieux général. / The nature of the disputes related to the medical appraisal of the state of the sick person, or of the victim of an accident at work or of a professional illness, led to manage an extra judicial medical evaluation, so called "technical", the disputes related to the states of incapacity being directly devolved to specialized courts (technical litigation). As appointed on the basis of a common agreement between the counseling doctor and the personal practitioner, the medical experts is refered to by the caisse in order to evaluate the medical state of the sick person or of the victim, in accordance to a protocol. The proceeding is concluded in a short delay, ant the opinion of the medical expert, as compulsory for the litigants, is opened to a dispute in the frame of the general litigation.The implementation of the procedure is imperative for the court when a medical difficulty occurs during the judicial proceeding. As rooted in the substantive nature of the formalities, grounding the value of evidence for the expert opinion, this is an exceptional obligation.So that, the point is the distinction between the functions of the medical expert and the court when is met the aim to extend the right to a fair trial to the evaluation stage, ant it could arise a general right to medical evaluation and to be assisted by a specialist, as for the extra judicial proceeding.An objective of the thesis is to propose an extension to the existing exception of the accidents at work or the professional illness in the agricultural area, as shaped by the general legal regime. So that the technical litigation could too receive an extension, completely in opposition to the solution wished by the Cour de cassation (reports 2010, 2011) of an integration to the general litigation

Muslim Women: Between Culture and Feminism

Women’s rights in Islam became a major subject after the third feminist movement in the United States. When feminism spread globally, many Islamic scholars connected it to Islam. Islamic feminism is a term that takes most of its ideologies from the two primary sources of Islam – the Quran and the Sunnah. This qualitative research explained the bias directed towards women in Islam by using objective reasoning through examples as well as by encompassing any misinterpretation of views regarding women’s rights in Islam. The method used was a content analysis. The findings were that Islam is a feminist religion. While Islam provides Muslim women with full rights, U.S. and Saudi Arabian cultures have impeded Islamic feminism. Lastly, the U.S. feminism started as a movement by women to empower women. The Brazilian population is one of the largest in the world, which makes that a rather complex task. Failing to fulfill this role, the State leaves room for providers of private services, through private health care and health insurance. That market began to develop in the 60’s and was regulated in the year 2000, with the creation of the National Healthcare Agency (ANS). Currently, roughly 50 million people in Brazil have access to private healthcare or health insurance, which accounts for a fourth of the country’s population. This work has as its main goal to analyze the different economic sectors regulated by ANS, focusing on the financial situation and the distribution of wealth across sectors. That analysis was carried out through study of the Periodic Information Reports on Healthcare Providers (DIOPS) presented to ANS by companies within the period spanning from 2012 to 2015. Group-dentistry and benefits administration were the sectors which presented the greatest potential for generation of operating cashflow and the best economic performance, benefits administration having the best performance out of the two. In order to shed light into that sector, its most relevant companies were analyzed, which led to the conclusion that Qualicorp Group is the dominant player involved. Analysis of wealth distribution across ANS-regulated sectors revealed that 84% of the total pool of resources are distributed to companies or professionals which effectively render health services, such as hospitals, clinics, laboratories and the like. This work did not analyze the costs of these entities, which are paid through the obtained resources / A constituição de 1988 prevê que o Estado tem como obrigação garantir os serviços de saúde a todos os cidadãos brasileiros. A população brasileira é uma das maiores do mundo, tornando essa atividade muito complexa. O Estado, não tendo sucesso nessa função, abre espaço para a prestação de serviços privados através dos planos ou seguros de saúde. Esse mercado, iniciado na década de 1960 e regulado em 2000 através da criação da Agência Nacional de Saúde Suplementar (ANS), atualmente conta com cerca de 50 milhões de pessoas, o que significa um quarto da população brasileira. Desse modo, o presente trabalho teve como principal objetivo analisar os diferentes setores regulados pela ANS, analisando a sua situação econômico-financeira e também a distribuição de riqueza entre os setores. Essas análises foram realizadas através do Diops financeiro apresentado à ANS pelas empresas no período de 2012 a 2015. O setor de odontologia de grupo e das administradoras de benefícios foram os setores que apresentaram melhor potencial de geração de caixa operacional e melhor desempenho econômico, sendo o setor das administradoras de benefícios com melhor desempenho em ambos. Para conhecer melhor esse setor, foram analisadas individualmente as principais empresas do setor, verificando-se que o Grupo Qualicorp tem alta dominância no setor. A análise da distribuição de riqueza dos setores regulados pela ANS relevou que 84% da riqueza de todos os setores são distribuídos para empresas ou profissionais que prestam o serviço efetivamente, que são os hospitais, clínicas médicas, consultórios médicos, clínicas laboratoriais, etc. Este trabalho não analisou os custos dessas entidades, que são pagos através dos recursos obtidos

After more than six years of IPO emerges the question as to the financial performance of these institutions. Thus, the present study aimed to investigate and analyze the financial performance of the universe (N = 3) of the Higher Education Institutions (HEI) traded in the period 2007-2013, using the indicators: i) value creation measured by EVA; ii) ability to cash generation measured by EBITDA; and iii) financial situation evaluated by the Fleuriet method. Based on secondary sources of data and document analysis in the public domain were calculated, analyzed and compared the performance of HEIs. The results showed that all three have solid financial situation but with a major difference in the ability to generate cash. In the period 2007-2013, only Estácio generated shareholder value. Kroton destroyed / consumed shareholder value during the study period, however, initiated a recovery process in 2012 and in 2013, after six years destroying / consuming value for the first time generated shareholder value. Anhanguera destroyed / consumed shareholder value during the seven years. The results also revealed that financial performance is highly dependent on governmental policies on access and funding of higher education and has directly influenced the market value of the traded HEI / No Brasil, em 2007, surgiram as primeiras empresas educacionais de capital aberto, Anhanguera, Estácio e Kroton, cercadas por grandes expectativas de resultados futuros positivos e de elevados e rápidos retornos aos investidores. Passados mais de seis anos da abertura de capital emerge a questão quanto ao desempenho econômico-financeiro dessas instituições. Dessa forma, o presente estudo teve como objetivo apurar e analisar o desempenho econômico-financeiro do universo (N = 3) das Instituições de Ensino Superior (IES) de capital aberto, no período de 2007 a 2013, utilizando os indicadores de: i) geração de valor mensurado pelo EVA; ii) capacidade de geração de caixa mensurada pelo EBITDA; e iii) situação financeira avaliada pelo Método Fleuriet. Com base em fontes de dados secundários e análise documental de domínio público foram apurados, analisados e comparados os desempenhos das IES. Os resultados demonstraram que as três apresentam situação financeira sólida mas com uma grande divergência na capacidade de geração de caixa. No período de 2007 a 2013, apenas a Estácio gerou valor para os acionistas. A Kroton, destruiu/consumiu valor dos acionistas no período de estudo, entretanto, iniciou um processo de recuperação em 2012 e em 2013, após seis anos destruindo/consumindo valor, pela primeira vez gerou valor aos acionistas. A Anhanguera destruiu/consumiu valor dos acionistas durante os sete exercícios. Os resultados também revelaram que o desempenho econômico-financeiro é altamente dependente das políticas governamentais de acesso e financiamento do ensino superior e tem influenciado diretamente no valor de mercado das IES

MODELS FOR ASSESSMENT OF FLAWS IN PRESSURE TUBES OF CANDU REACTORS

Probabilistic assessment and life cycle management of engineering components and systems in a nuclear power plant is intended to ensure safe and efficient operation of energy generation over its entire life. The CANDU reactor core consists of 380-480 pressure tubes, which are like miniature pressure vessels that contain natural uranium fuel. Pressure tubes operate under severe temperature and radiation conditions, which result in degradation with ageing. Presence of flaws in a pressure tube makes it vulnerable to delayed hydride cracking (DHC), which may lead to rupture or break-before-leak situation. Therefore, assessment of flaws in the pressure tubes is considered an integral part of a reactor core assessment program. The main objective of the thesis is to develop advanced probabilistic and mechanical stress field models for the assessment of flaws. The flaw assessment models used by the industries are based on deterministic upper/lower bound values for the variables and they ignore uncertainties associated with system parameters. In this thesis, explicit limit state equations are formulated and first order reliability method is employed for reliability computation, which is more efficient than simulation-based methods. A semi-probabilistic approach is adopted to develop an assessment model, which consists of a mechanics-based condition (or equation) involving partial factors that are calibrated to a specified reliability level. This approach is applied to develop models for DHC initiation and leak-before-break assessments. A novel feature of the proposed method is that it bridges the gap between a simple deterministic analysis and complex simulations, and it is amenable to practical applications. The nuclear power plant systems are not easily accessible for inspection and data collection due to exposure to high radiation. For this reason, small samples of pressure tubes are inspected at periodic intervals and small sample of data so collected are used as input to probabilistic analysis. The pressure tube flaw assessment is therefore confounded by large sampling uncertainties. Therefore, determination of adequate sample size is an important issue. In this thesis, a risk informed approach is proposed to define sample size requirement for flaw assessment. Notch-tip stress field is a key factor in any flaw assessment model. Traditionally, linear elastic fracture mechanics (LEFM) and its extension, serves the basis for determination of notch-tip stress field for elastic and elastic-perfectly-plastic material, respectively. However, the LEFM solution is based on small deformation theory and fixed crack geometry, which leads to singular stress and strain field at the crack-tip. The thesis presents new models for notch and crack induced stress fields based on the deformed geometry. In contrast with the classical solution based on small deformation theory, the proposed model uses the Cauchy's stress definition and boundary conditions which are coupled with the deformed geometry. This formulation also incorporates the rotation near the crack-tip, which leads to blunting and displacement of the crack-tip. The solution obtained based on the final deformed configuration yields a non-singular stress field at the crack-tip and a non-linear variation of stress concentration factor for both elastic and elastic-perfectly-plastic material. The proposed stress field formulation approach is applied to formulate an analytical model for estimating the threshold stress intensity factor (KIH) for DHC initiation. The analytical approach provides a relationship between KIH and temperature that is consistent with experimental results.

Identification of a suspect before being charged: legitimate freedom of speech or a threat to a fair trial?

Identification of a person suspected of a heinous crime before being charged risks prejudicing a fair trial. Present laws place this type of publicity outside the reach of sub judice contempt. This thesis argues there should be a change in the law of sub judice contempt making it an offence for the media to publish the fact that a person is under investigation until the person has been charged.

Válka v myšlení a každodenním životě jihočeské nižší šlechty ve druhé polovině 16. a na počátku 17.století / War experience in everyday life of the south Bohemian lower noblemen in the period of the second half of the 16th century and the early 17th century

The author of the diploma thesis endeavoured, with the help of historic-anthropological methods, to depict a variety of forms of the war experience of the south Bohemian aristocracy in the period before the Battle of White Mountain. The subject of his interest focused on the fates of men and women of noble origin, on the background of three key military events of the second half of the 16th century and the early 17th century. Two expeditions of the Bohemian troops against the Turks in 1566 and 1594, and the invasion of Bohemia by the Passau army in 1611 had a very strong impact on the way south Bohemian knights thought, behaved and acted. Personal correspondence of selected aristocratic families served as the heuristic starting point in the search for the answer to the question which ways an aristocrat chose to defend values tested by centuries and to enforce his own or his family?s interests. The objective of the entire research was to amplify the knowledge about the history of lower aristocracy, by stressing the unique role of a historical participant in war. Treating the topic of war experience gave rise to a contribution on the borderline between the political, military, social and cultural areas of history of the early Modern Age.
