Breaking-off contract negotiations without justifiable grounds Abstract The thesis at hand deals with Sec. 1729 of the Civil Code which governs the liability for breaking-off contract negotiations without justifiable grounds. Its aim is to interpret the afore-said provision that forms an inherent part of the newly introduced regulation of pre-contractual liability. The thesis discusses both the conditions for establishing the liability for breaking-off contract negotiations and concurrently the legal consequences thereof. The difficulties in terms of interpretation, incidental to the introduction of this provision, are attempted to be solved by use of theological interpretative method and inspiration drawn from the comparative study of German and Austrian state of law. Finally, the thesis strives for analysing the case-law of the Czech Supreme Court related to the previous legislation and answering a question to which extent the conclusions previously arrived at by this court may be uphold following the recodification process. The thesis is divided into four main chapters. The first chapter emphasizes the importance and role of the principles of freedom of contract and good faith which are crucial for better understanding of culpa in contrahendo. Stenmjölets inverkan i en kall asfaltsmassa hos bearbetbarheten, brytningsprocessen och täckningsgraden / Rock Flours Impact in a Cold Asphalt Mixture of Workability, the Breaking Process and Coverage

I kallasfalt med hårt basbitumen bryter vattnet ut ur bitumenet och bindemedlet i massan stelnar olika snabbt beroende på vilket stenmaterial asfaltsmassan består av. Om brytningen sker innan utläggning blir massan obearbetbar, målet är att brytningsprocessen ska kunna styras genom att massans brytningsprocess skall vidta när energi tillförs i massan via en vibratorsvält som packar massan. Från tidigare tester är hypotesen att det är stenmjölet som styr brytningsprocessen och bearbetbarheten. Idag är problemet att massan bryter för snabbt och den blir svårbearbetad vid läggning och resultatet blir dåligt. I arbetet undersöks också täckningsgrad och styvhetsmodulen. Arbetet är utfört på NCC:s väglaboratorium i Umeå 4/4 - 15/4 2016. Sex stycken stenmaterial från olika bergtäkter med olika egenskaper testas. Bergtäkterna är belägna från Närke upptill Västerbotten vid namn Dylta, Råsta, Sälgsjön, Stöningsberget, Ljusberget och Supartallen.  Fraktion 0-16 mm från en och varje bergtäkt handblandas, två asfaltsprover tillverkas enligt två olika mix- och bedömningsmetoder. Täckningsgrad, bearbetningsegenskaperna och brytningprocessen bedöms och antecknas i en matris. I nästa steg ersätts ordinarie stenmjöl (0-2 mm) med stenmjöl från en bergtäkt med ett tidigare känt bra stenmaterial. Med resterande makadam (2-16 mm) görs samma process om på nytt och resultatet analyseras och jämförs. En asfaltsmassa med stenmjöl från bergtäkten Supartallen och makadam från bergtäkten Stöningsberget visar förbättrade resultat i jämförelse med fraktion 0-16 mm från bergtäkten Stöningsberget och vidare laborationstester görs på denna blandning av stenmaterial. Dessa bergtäkter ligger geografiskt nära varandra, drygt 25 mil, vilket också motiverar till att välja dessa stenmaterial som i framtiden kanske kommer användas fullskaligt. Från dessa blandningar tillverkas asfaltskroppar genom packning med gyratorisk packare och styvhetmodulen testas. I ekonomisk och miljömässig vinning görs ett försök med en restprodukt från stålindustrin. Ett försök utförs med skänkslagg (0-2 mm). Slaggen blandas med stenmaterial från bergtäkten Supartallen där bearbetningen, brytprocessen och täckningsgraden undersöks. Detta är ett inledande försök för att få en fingervisning hur asfaltsmassan beter sig blandat med skänkslagg. Utvärdering av resultaten gjordes med hjälp av en matriser där varje asfaltsblandning ingår. Asfaltsblandningen betygsätts enligt bearbetbarhet, täckningsgrad och brytningskontroll. Skålen analyserades och slutsatser om brytningen kunde dras. Genom sönderdelning av massan kunde observationer göras om hur brytningen av massan har kommit, även täckningsgraden analyseras. Resultaten pekar på att stenmjölet har en betydande roll i täckningsgrad, brytning vid blandning och brytningsprocessen, dock ingen skillnad på styvhetsmodulen. Att enbart stenmjölet ska vara problemet är inte hela sanningen men har som sagt en betydande roll. Just att stenmaterial från Supartallen är så pass bra för beaktas och använda sig av stenmaterial med liknande egenskaper och inte använda stenmaterial med för höga halter SiO2 då det ger dålig täckningsgrad. Att massan bryter för snabbt kan bero på halten bindemedel, vidare laborationer bör göras med halten bindemedel i fokus. / In cold asphalt with hard base-bitumen the water breaks out from the bitumen and the binder in the mass solidifies at different rates depending on the containing stone material in the asphalt. If the break occurs before laying the mass becomes unworkable. The intention by this examination is control this process by the mass extraction process should take place when energy is supplied into the mass through a vibrator famine. From previous tests the hypothesis is that the rock flour controls the breaking-process and the workability. Today, the problem is that the mass curing process starts too early and it becomes difficult to manage and work with and the results of the paving are bad. The thesis project also examines coverage and stiffness module, it’s performed on the NCC's road laboratory in Umeå 4/4 - 15/4 in 2016. Six stone materials from different quarries with different properties are tested. Fraction 0-16 mm from each rock quarry are handmixed, two asphalt samples produced by two different mixing- and assessment-methods. Coverage, workability and the breaking-process are assessed and recorded in a matrix. Next, replaced ordinary rock flour (0-2 mm) with rock flour from a quarry of a previously known good stone material. With the remaining makadam (2-16 mm) the process are made all over again and the results are analyzed and compared. An asphalt with rock flour from quarry Supartallen and the remaining makadam from quarry Stöningsberget shows improved results compared with fraction 0-16 mm from quarry Stöningsberget and further tests in laboratory are made with this mixture. These quarries are geographically fairly close to each other, 250 km (about 150 miles), which motivates to choose these quarries for a full scale-test in the future. From these mixtures asphalt-bodies are manufactured by gasket with gyratory compactor and stiffness module is examined. In the economic and environmental profit attempts are made with a residue from the steel industry. An attempt carried out with the slag from ladles (0-2 mm). The slag is mixed with stone material from quarry Supartallen where workability, breaking process and coverage is investigated. This is an initial attempt to introduce how the asphalt mixture behaves mixed with the slag. An evaluation was made with matrix where each asphalt mixture included. The asphalt mixture is graded according to machinability, coverage and breaking control. The bowl was analyzed and conclusions about the break could be drawn. Analyzes of the curing process and coverage was made by dismemberment of the mass. The results indicate that the rock flour has a significant role in coverage, extraction at mixing and mining process, however, the stiffness module has the same results in all mixtures. The mere stone flour shouldn’t be the problem but still has a significant role. At the aggregate of Supartallen is so good for the consideration and use of stone materials with similar properties and not rock material with a high amount of SiO2 as it provides poor coverage. The mass harden too quickly may depend on the content of binder, further laboratory work should be done with the binder content in focus.

A quebra espontânea de simetria e o único mecanismo conhecido capaz de gerar massas a uma teoria, preservando as simetrias e sendo renormalizável. Tal processo ocorre quando se define um setor escalar para uma teoria com uma certa simetria e se quebra os geradores dessa simetria, criando bosons de Goldstone no caso de simetrias globais e campos de gauge massivos, no caso de simetrias locais. Nessa dissertação começamos o estudo de quebra espontânea de simetria com um estudo de Teoria de Grupos, que e fundamental para o entendimento da mesma seguido por um estudo em simetrias nas lagrangianas, ou seja, como gerar uma lagrangiana invariante por um dado grupo, local ou global; depois estudamos o Teorema de Goldstone e por m aplicamos a quebra espontânea de simetria para diversos modelos, entre eles o campo escalar, campo escalar complexo com simetria global, campo escalar complexo com simetria local, modelo padrão. Depois fazemos um estudo em uma das extensões do modelo padrão, o modelo SU(5) e aplicamos a quebra espontânea de simetria em tal modelo. No m mostramos como a abordagem de minimização de um potencial clássico e valida, pois contribuições quântica são análogas a uma energia de ponto zero ao potencial efetivo / Abstract: A detailed study of the spontaneous symmetry breaking since its fundamental basis is done. The spontaneous symmetry breaking is the only know mechanism capable of generating masses to a theory still preserving its symmetry and being renormalizable. Such process occurs when one defines a scalar sector to a certain theory with a symmetry and then break the generators of this symmetry, creating Goldstone bosons in the case of global symmetries and massive gauge fields in the case of local symmetries. We start this dissertation studying Group Theory, which is fundamental to the understanding of spontaneous symmetry breaking. Then we study local and global symmetries of the lagrangian, Goldstone Theorem, then spontaneous symmetry breaking to several models, including the scalar theory, complex scalar theory with global and local symmetries and the standard model. Then we make a study in one of the standard model extensions, the SU(5) model and we applied spontaneous symmetry breaking to this model. Problemas de corte com sobras aproveitáveis e eliminação de simetrias / Cutting stock problems with usable leftover and symmetry breaking

No presente trabalho estudamos duas variações do problema de empacotamento de itens retangulares idênticos, permitindo rotações de 90 graus, em um poliedro. Uma variação consiste em encontrar a maior quantidade de itens retangulares idênticos que podem ser empacotados em um poliedro. A outra consiste em encontrar o poliedro de um determinado tipo com menor área para empacotar uma quantidade fixa de itens retangulares idênticos. Desenvolvemos restrições de eliminação de simetrias para estes problemas, o que tornou a resolução dos mesmos mais eficiente, por métodos do tipo branch-&-bound. Estudamos também o problema de corte no qual há uma determinada demanda (de itens) a ser cortada e um conjunto de objetos disponíveis. Desejamos satisfazer a demanda minimizando o custo dos objetos utilizados e, dentre as diferentes possibilidades de se fazer isso, desejamos aquela que maximize as sobras aproveitáveis. De forma geral, sobras aproveitáveis podem ser entendidas como regiões retangulares de um objeto que possuem altura e largura iguais ou superiores a de um item de referência e representam sobras do processo de corte que podem se tornar objetos e serem reaproveitadas em um novo procedimento de corte. Apresentamos modelos de otimização em dois níveis para duas variações do problema de corte com sobras aproveitáveis a saber: o problema de corte de itens retangulares em dois estágios e o problema de corte de itens retangulares não guilhotinado. Como formas de resolver os modelos propostos, apresentamos reformulações destes modelos de programação em dois níveis em modelos de programação inteira mista. Lidamos também com uma variação do problema de corte com sobras aproveitáveis considerando a minimização da quantidade de sobras. Aplicamos restrições de eliminação de simetrias aos modelos desenvolvidos para o problema de corte de itens retangulares com sobras aproveitáveis, a fim de resolver instâncias maiores, e desenvolvemos uma estratégia de solução alternativa para os modelos. Os modelos desenvolvidos foram implementados computacionalmente e fomos capazes de resolver instâncias pequenas dos problemas em questão. / In this work we study two variations of the packing problem where identical rectangular items must be packed into a polyhedron. One of the variations consists in finding the largest amount of rectangular items that can fit in a polyhedron. The other one consists in finding a minimal area polyhedron of a certain type that packs a set of rectangular identical items. We present some symmetry-breaking constraints that reduce the computational effort in solving those problems through a branch-&-bound method. We also studied the cutting stock problem where there are some items to be cut from a set of rectangular objects and we need to satisfy the demand of items to be cut minimizing the cost of the used objects and, among the different ways of doing this, we want that which maximize the usable leftovers. Loosely speaking,usable leftovers can be understood as rectangular regions in an object that has the width and the height greater than or equal to the ones of a reference item. These leftovers can be seen as leftovers from a cutting process that will become items in a new cutting process. We present bilevel programming models to two variations of this problem with usable leftovers: the two-stage cutting stock problem of rectangular items and the non-guillotine cutting stock problem of rectangular items. In order to solve the proposed models we present also MIP reformulations of these bilevel programming problem models. We also developed some symmetry breaking constraints in order to accelerate the solving process of those models. The developed models were computationally programmed and we were able to solve small instances of the proposed problems

Syftet med denna studie är att bidra med kunskap om hur förskollärare förhåller sig till barns oönskade lek och hur de motiverar sitt förhållningssätt. Forskningsfrågorna som besvaras i studien är hur beskriver förskollärare oönskad lek? Hur bemöter förskollärare barns oönskade lek? Samt hur motiverar förskollärare sitt bemötande av barns oönskade lek? Studien är genomförd som en fallstudie där intervju använts som metod för att få fram data. Studiens resultat har analyserats med hjälp av normmodellen med dess tre hörnstenar vilja, kunskap och möjligheter. Resultatet visar att förskollärare har en vilja att försöka förstå lekar som bryter mot vad som kan anses som icke önskvärda dvs. som bryter mot normen. Förskollärarna ger uttryck för en ”tyst kunskap” då de motiverar sitt hanterande av leken genom sina tidigare erfarenheter av den typen av lek. Vidare ställer förskollärare frågor till barnen om lekens innehåll för att försöka förstå barnens syfte med leken. Att barn bearbetar händelser i sina lekar och att förskollärarna motiverar sitt förhållningssätt styrs av samsynen i arbetslaget kring oönskad lek.  Slutsatsen i studien är att förskollärarna vill barnets bästa och att de har en ambition att möta barnen i deras lek oavsett om förskolläraren ser på leken som icke önskvärd eller önskvärd.

The diploma thesis deals with the issue of braking trucks at different loads. The theoretical part defines the basic construction of trucks, truck brakes, the braking process and the factors that affect braking, braking deceleration, and legislative requirements for truck brakes. The practical part describes the course of experimental measurements, the use of the technique, the place of measurement, atmospheric conditions and used trucks. At the end of the work, based on experimental measurements, the obtained values of braking deceleration of trucks are evaluated.

This thesis is dealing with measuring the deceleration of lorries when they are braked by the engine. The weight of the vehicles given is bigger than 12 tons. The thesis can be divided into theoretical and practical part. In the theoretical part there are special presumptions to manage the given problem successfully. The stress is on the construction of lorries and on driving resistances which influence the process of deceleration a lot. The thesis also analyses the technical solution of each possibilities of braking and also the function of the gearbox. In the practical part the method of measuring is described. The measurement devices are also given through which the measurements were realized. The main part of this work is made by measured values of each lorries and the interpretation of measured values itself. The final evaluation of measured data are mentioned at the end of the thesis.
