This paper focused on how competing interests of employers and employees are accomodated in the South African Labour Relations arena. An analysis of the legislative framework was undertaken to establish how the legislation provides for changes in workplace practices as well as the protection that it affords employees against unwanted or unilateral changes. The main focus of the research was on how the South African Courts have interpreted the legislation and how it has applied the law in cases involving the changing of terms and conditions of employment, that has come before it.

O presente trabalho visa a uma reflexão sobre necessidade da utilização da mediação, como procedimento útil na administração dos conflitos coletivos de trabalho. Pondera-se que o desenvolvimento da mediação em todos os campos da vida social não deve ser apresentado apenas como uma alternativa ao Judiciário, e sim como um novo modo de regulação social, que prioriza a reconstrução das relações futuras e o respeito às suas necessidades específicas. Partindo do conceito de conflito, dos fatores que o influenciam, de suas formas de exteriorização e de suas especificidades no direito coletivo do trabalho, o estudo questiona se o excessivo intervencionismo estatal presente em nosso ordenamento jurídico não limita a efetiva autonomia sindical e engessa o comportamento dos grupos sociais. Trata do contra-senso existente entre o ilusório estímulo à negociação coletiva e o reconhecimento da solução jurisdicional compulsória, já que o Poder normativo ainda é o meio utilizado para tornar certo o conflito coletivo do trabalho. Propõe um conceito da mediação, indicando seus objetivos, princípios e diferenciando-a dos demais meios de solução de conflitos. Procura esclarecer de que maneira a mediação pode ser utilizada como instrumento de transformação cultural e pacificação social, abordando-a como meio capaz de auxiliar o Poder Judiciário, tanto no aspecto da diminuição do número de ações judiciais, quanto na utilização de seus métodos para aprimoramento da atividade jurisdicional. O acesso à Justiça é um direito fundamental, que não está limitado ao acesso ao Poder Judiciário, podendo servir de ferramenta às organizações da sociedade civil para pressionar o Estado na busca da realização de políticas públicas eficientes, com vistas à disponibilização de instrumentos jurídicos necessários à aproximação do Direito da idéia de Justiça como força transformadora dos conflitos. Trata, assim, da necessidade de desenvolvimento de uma política pública de incentivo à utilização da mediação como instrumento de acesso à Justiça, voltada à construção de uma cultura da paz e à manutenção das relações continuadas. / The present work objectives a reflection on the need of mediation as a useful process in the management of collective labor conflicts. It is considered that the development of mediation in all fields of social life should not be presented exclusively as an alternative to the Judiciary, but as a new mode of social regulation, which gives priority to the reconstruction of future relations and the respect to its specific needs. Assuming the concept of conflict, of the factors that influence it, of its forms of outward expression and of its particularities in the collective right of labor, the study investigates if the excessive state interventionism present in our juridical ordinance does not limit the effective union autonomy and controls the behavior of social groups. It deals with the existing paradox between the apparent stimulus to collective negotiation and the acknowledgement of compulsory jurisdictional solution, once the normative Power still is the used mean to make right the collective labor conflict. A concept of mediation is proposed, appointing its objectives, principles and differentiating it from the other means of solution for conflicts. It attempts to make clear that a mean of mediation may be used as an instrument of cultural modification and social pacification, approaching it as an able mean to help the Judiciary, both on the reduction of the number of juridical suits, and on the employment of its methods for the improvement of jurisdictional activity. The access to Justice is an essential right, which is not limited to the access of the Judiciary, being able to serve as a tool for organizations of civil society to pressure the State on the search of effective public policies, examining the availability of necessary juridical instruments in the approach of Law to the notion of Justice as a transforming strength of conflicts. It deals with the need of the development of a public policy of incentive to the employment of mediation an instrumental of acess to Justice, facing the construction of peace culture and of the maintenance of continuous relations.

Principal and Teacher Beliefs About the Impact of CBAs on School Performance: Five High Performing High Schools in Oregon

This qualitative study examined how school leaders work within the structure of individual district collective bargaining agreements to improve student achievement. The study examines real or perceived barriers to improving student achievement within educational organizations from the perspective of the principals and teacher-leaders. This study included two qualitative instruments, one for building principals and one for the building teachers, administered in five Oregon high schools recognized as successful by the Oregon Department of Education in 2014-2015. This dissertation determined the impact collective bargaining agreements had on the ability of high school principals to reduce educational disparities and close the achievement gap from both the perspective of themselves and teacher-leaders. The dissertation concluded with a brief summary of the collective findings from the study, as well as the implications for practice specific to building principals and teacher-leaders in the context of their school, and agreement about strategies that work to overcome barriers to school performance.

The effect of recent amendments to the LRA within the context of collective bargaining

The Labour Relations Act, 1995 makes no provision of a legally enforceable duty to bargain, but affords certain rights to unions such as organisational rights. Although employers are obliged to grant these rights to representative unions, they are not compelled to engage in bargaining with them as there is no duty to negotiate. However, the refusal to bargain will result in power play in order to convince the other party to negotiate. If an employer refuses to negotiate with a union, the union is able to strike without any fear of dismissal of its members, provided that the strike takes place with requirements of the Act. The questions that need to be answered are amongst others whether the amendments on organisational rights will truly broaden access to section 14 and 16 rights of the Labour Relations Act? Further than that, to investigate whether these amendments will lead a decline in industrial action related to organisational rights. It also becomes imperative to find whether these arrangements will enable commissioners to carry out the mandate of minimizing the proliferation of trade unions. The study aims to provide understanding of the principles of collective bargaining in the workplace. This in turn promotes better understanding of the rights enshrined in section 23(5) of the Constitution which provides that trade unions, employers’ organisation and employers have the right to engage in collective bargaining. This right is given effect to the Labour Relations Act as amended. The law regarding collective bargaining in South Africa has been interpreted in two ways; the Labour Relations Act refers to a duty to bargain collectively, while the Constitution refers to a right to engage in collective bargaining. These two interpretations have been subjected to judicial criticism in three cases in the South African National Defence Force. They are currently the main cases dealing with this issue in South Africa. The implications that a trade union is entitled to embark on strike action in order to obtain organisational rights in circumstances where it is not regarded as sufficiently representative, provides some form of relief for minority unions. Against this background, the critical legal question is the impact of recent amendments to the Labour Relations Act within the context of collective bargaining.

<p align="justify">In the context of a society in which there is an urgent need to create jobs, this research considers, firstly, whether the current labour regulatory environment is flexible enough to allow for an employment scenario that is conducive to job creation. The research then considers what is meant by the policy of &lsquo / regulated flexibility&rsquo / and considers how flexibility operates in practice at NBC level. It is argued that the concept of flexibility is a misnomer &ndash / since it creates more problems than it solves. The research concludes with a call for real flexibility that will allow for increased investment and a greater supply of jobs.</p>

[pt] Relações coletivas e configurações institucionais em um cenário de democracia: a atuação do Tribunal Superior do Trabalho na conformação dos direitos coletivos assegurados pela Constituição, na década de 1990 é um estudo sobre as configurações institucionais no âmbito das Relações Coletivas de Trabalho. Examina as diretrizes estatais adotadas que buscaram redirecionar a autonomia coletiva para fins de viabilizar uma reforma trabalhista. Em especial estuda-se o enfoque dado pelo Tribunal Superior do Trabalho a institutos ordenadores do sistema jurídico das Relações Coletivas de Trabalho no Brasil, tais como direito de greve, negociação coletiva, dissídios coletivos, poder normativo da Justiça do Trabalho e autonomia coletiva. Trabalha-se com a hipótese de que nos anos 1990, sob o argumento de valorização da negociação coletiva, se desenvolveu no país um processo de fracionamento no conceito de autonomia coletiva. Para tanto, a tese estabeleceu um referencial teórico articulando as concepções sobre liberdade sindical e autonomia coletiva, sob o prisma normativo e institucional, com vistas a propiciar uma compreensão mais adequada das relações entre duas instâncias normativas constitutivas do Direito do Trabalho, a que provém do pactuado coletivamente e a do legislado, e estabelecer bases conceituais para a compreensão da autonomia coletiva (em sua tríplice dimensão de autonormação, auto- organização e autotutela) e de sua configuração em um paradigma jurídico-democrático. A tese demonstra um processo de fissura no ideário constitucional da autonomia coletiva, em um contexto de ampliação desmesurada dos desequilíbrios estruturais de poder na década de 1990. Tal fracionamento ocorreria não só através das regras, dos enunciados normativos, mas também no processo de interpretação das dimensões constitutivas da autonomia coletiva no qual se limitam as potencialidades da auto- organização e da autotutela, e surpervaloriza a eficácia jurídica da autornormação. / [en] The collective relationships and institutional configurations in a democratic scenario: the Superior Labor Court performance in complying with the collective rights assured by the constitution in the 1990 s, is a study about the institutional configurations in the Collective Labor Relationships sphere. This paper investigates the adopted governmental guidelines that sought to redirect the collective autonomy to make a labor reform feasible. It specifically studies the approach to institutions that determine the legal system of the Collective Industrial Relations of Brazil used by the Superior Labor Court (TST), such as right to strike, collective bargaining, collective dispute, the normative power of the Labor Court, and collective autonomy. The present work deals with the hypothesis that in the 90 s, under the claim of a better collective negotiation, a cracking process in the collective autonomy concept emerged. For that matter, this paper has established a theoretical referential linking together the concepts about trade union freedom and collective autonomy under a normative and institutional prism to provide a more suitable understanding of the relationship between the two normative constitutive instances of the Labor Law - the one that comes from what was covenant collectively, and the other that was legislated - and to establish conceptual bases for the understanding of the collective autonomy (in its triple dimension of self-regulation, self- organization, and self-governing), and its configuration in a legal democratic paradigm. The work show the cracking process in the constitutional concept of the collective autonomy in a background of immoderate increase of the structural instability of power in the 90 s. Such cracking took place not only through the rules, the normative provisions, but also in the interpretation of the constitutive dimensions of the collective autonomy, in which the potentiality of self-organization and self-governing are limited, and the legal effectiveness of self-regulation is overestimated.

This is due to the fact that Brazil never adopted a model that could favor this form of conflict resolution. The legislation of the Vargas Era caused the emergence of assistant unionism, which was subordinated to the State. The Constitution of 1988, although allowing the organization of unions, continued adopting the same practices that prevent full freedom in their operation. With this, the collective negotiation process is still very timid here. Based on collective private autonomy, we will approach collective negotiation in this study starting from a general analysis of its legal aspects, but with focus on its development in workplaces. The purpose is to discover and describe the successful localized negotiation experiences in the country, especially, in the case of the metallurgical steelworkers of the ABC region in the State of São Paulo. For such, the objects of the study shall be its concept and the definition, both in the international and Brazilian legislation, regarding doctrinal positions. The legal nature and the birth of the negotiating process will follow. And, soon after, the main principles of Law and those specific for collective negotiations. Then we will analyze their functions and the legislation complex that regulates its operation, based on the ILT, the constitutional and infra-constitutional Brazilian legislation, and the proposal for union reform discussed at the National Labor Forum (FNT). Next, we will study the classification of collective negotiation under the four different views, and in the part related with its structure, we will approach the subjects, levels, content, and the procedures for its realization. After this general analysis, to deepen our understanding about collective negotiation, it will be necessary to learn the meaning of the internal representation of workers, discussing the legislation and comparative law, besides experiences found in Brazil, with emphasis on the factory committees that emerged in the ABC region metallurgical steelworkers. A description of the historical moment that allowed the emergence of the new unionism in that region will be made. And, as a final goal, the examples of the negotiations that took place in the companies located in the ABC, developed from those internal organizations will be subject to discussion, as successful experiences that deserve being replicated / O tema negociação coletiva de trabalho somente despertou interesse dos estudiosos do direito de alguns anos para cá. Isso se deve ao fato de que o Brasil nunca adotou um modelo que pudesse privilegiar essa forma de solução de conflitos. A legislação da Era Vargas fez nascer um sindicalismo assistencialista, atrelado ao Estado. E a Constituição de 1988, em que pese ter possibilitado a liberdade organizativa dos sindicatos, continuou adotando práticas que impossibilitam uma plena liberdade de atuação dos mesmos. Com isso, o processo de negociação coletiva ainda é muito tímido por aqui. Baseada na autonomia privada coletiva, a negociação coletiva será tratada neste estudo, partindo de uma análise geral sobre os seus aspectos jurídicos, mas focalizada no seu desenvolvimento nos locais de trabalho. A finalidade é conhecer e descrever as experiências de negociação localizada que deram certo no país, notadamente, o caso dos metalúrgicos do ABC paulista.
