Isto porque, o embate entre o capital e o trabalho sofre com o rompimento dos alicerces ideológicos da sua existência histórica marcada pela busca da classe trabalhadora por mudanças e adaptação ao sistema socioeconômico estabelecido com o objetivo metabólico de alcançar melhores condições de vida. O antigo ambiente em que o espírito revolucionário propiciou uma atmosfera voltada para a necessidade de organização do proletariado com o enfrentamento das questões relacionadas à exploração do trabalho e a concentração do lucro sofre com o atual esvaziamento do debate. Deste modo, a legitimação do movimento sindical brasileiro será avaliada a partir da Era Vargas até a Constituição de 1988, momento em que foi promulgada a garantia de direitos básicos e a sua influência na dinâmica atual do capital. As bandeiras de luta em nome de mais empregos, melhores salários, redução da jornada de trabalho, sem redução de salários, serão desfraldadas sob orientação da Teoria Crítica. Não obstante, considerando a proeminência orgânica das Reivindicações e Convenções Coletivas de Trabalho (CCT), tendo como alegoria o pleito do Sindicato do setor da construção civil na Bahia - Sintracom, assim foi analisado, a partir do estudo de caso, o discurso simbólico sobre a ampliação dos direitos, principalmente nas questões voltadas para as cláusulas econômicas, aspecto unilateral na pauta das principais reivindicações dos sindicatos em detrimento do objetivo histórico de emancipação social. / This dissertation is a critical proposition that aims to analyze the current crisis of the labor movement and the capital's claim process, using SINTRACOM - the Construction Union located in Bahia - as allegory. This is because the struggle between capital and labor suffers from the disruption of the ideological foundations of its historical existence marked by the pursuit of the working class for change and adaptation to the socio-economic system established with the metabolic goal of achieving better living conditions. The former environment in which the revolutionary spirit led to an atmosphere focused on the need for proletarian organization to tackling issues related to labor exploitation and the profit concentration suffers from the current drain of the debate. Thus, the legitimacy of the Brazilian trade union movement will be evaluated from Vargas to the Constitution of 1988. Howevwe, the flags of struggle on behalf of more jobs, better wages, reduced working hours without wage cuts, will be unfurled under the guidance of Critical Theory on the agenda of the main demands of the unions at the expense of the historical goal of social emancipation.

O estudo é dedicado à análise da eficácia do reconhecimento das convenções coletivas de trabalho e dos acordos coletivos de trabalho como garantia fundamental diante da outorga constitucional encerrada no inciso XXVI do art. 7º da Constituição Federal. A importância da abordagem construída está na ponderação do status representativo desse destaque na Lei Fundamental como aperfeiçoamento da tríade francesa da liberdade, igualdade e fraternidade (solidariedade), de modo a prevalecer nas relações individuais de trabalho a normatividade incorporada ao ordenamento jurídico por essas fontes de direito, decorrentes do exercício da autonomia privada do cidadão-trabalhador em assembleia participativa e direta. Para tanto, o trabalho percorre um itinerário em três movimentos. O primeiro, mediante abordagem histórica e resgate das motivações jurídicas de modelação da convenção coletiva de trabalho, em curso espaço de tempo igualmente designada por contrato coletivo de trabalho, e dos movimentos associativo-sindicais. No segundo, a inicial definição de premissas válidas relativas aos direitos fundamentais permissiva, por consequência, permissivas da catalogação constitucional do direito ao trabalho e das garantias constantes no art. 7º da Constituição Federal. O terceiro e último, com enfoque centrado na irradiação de eficácia e repercussão nas relações de trabalho dos convênios coletivos de trabalho nas relações individuais de trabalho em prevalência à lei. / This study intentd analyzing the effectiveness of the recognition of collective labor conventions and collective bargaining agreements as a fundamental guarantee before the Constitutional granting assured by Article 7, line XXVI of the Brazilian Federal Constitution. The importance of the built approach is in taking account the representative status about this emphasis in the Basic Law as an improvement of the French slogans: freedom, equality and brotherhood (solidarity), in order for prevail in the individual employment relationships the regulations incorporated into the legal system by these source of laws, resulting from the exercise of the citizen (workers) private autonomy in Shareholders. To do so, three approaches were employed: the first, by historical approach and surrenders the legal motives of the Collective Labor Convention deployment, in short period of time also referred to as collective employment contract, and the associative movement. In the second, the start definition of valid premises report on fundamental rights permissive, as a result, of the constitutional cataloguing of the right to work and the guarantees contained in the Article 7 of the Brazilian Federal Constitution. The third and final point focusing on irradiation of the efficiency and repercussion in the work relationships of the collective labor agreements in the individual employment relations prevails over the law.

A nursing service management strategy to prevent strike action by nurses in a hospital

M.Cur. / The problem of strikes within the public institutions has infiltrated the health sector and has led to nurses participating in the strike action, which affects patient care. The involvement of unions and works' representatives in the health services cannot be wished away as it is a political and constitutional reality in South Africa. The researcher is concerned about the quality of awareness of nurses of the causes of strike action. Confusion amongst nurses about their professional rights and responsibilities contributes to labour unrest. The management of health services is at times not sensitive to the needs of nurses, and nurses are not always recognised for their inherent professional worth. The nursing management is also apparently confused about their roles and responsibilities towards their subordinates in respect of exerting their authority whilst not having the power to make decisions. The researcher, as an observer of the chaos caused by strike action in the health services, decided to investigate the matter through a phenomenological study. The parameters of nursing and beliefs about man, health, illness and nursing are also described. The following questions were generated : Why do nurses participate in strike action? How do professional nurses and nursing service managers experience strike action? What nursing service management strategy can be developed to prevent future strike action by nurses? The objectives of the study are to: Explore and describe the reasons why professional nurses participate in strike action in a public hospital in Gauteng. Explore and describe how strike action is experienced by professional nurses and nursing service managers; and To describe a strategy for nursing service managers to prevent future strike action by nurses within a health delivery system

Implementation of laws regulating mining industry transformation in South Africa

(Development and Management Law)) -- University of Limpopo, 2017 / This mini-dissertation deals with the implementation of laws regulating mining industries transformation in South Africa. This mini-dissertation finds that the pace of transformation is very low and the challenges faced in the mining industries which are slowing the process are evaluated. Such challenges include: lack of skills, unqualified candidates and lack of experience. It finds that the Broad-based socio-economic empowerment (BBSEE) introduced 15% target by 2011 where only 8.9% was reached in respect of transformation and that by 2014, 26% must be met where only 17.4% at the top management is achieved. The call for nationalisation of mines as a solution to speed up transformation have also been evaluated and the Mining Qualification Authority category of providing scholarships to maths and science learners to the exclusion of other streams as transformational aspect was also evaluated. The question as to whether 26% of the historically disadvantaged South Africans occupying managerial position is enough to rectify the injustices of the apartheid ills is also looked at. A comparative study was done between South Africa, Canada and Australia to see whether lessons could be learnt. This dissertation analyses, in a comparative perspective collective agreements entered into in Belgium and in South Africa in the private sector. It is divided into three parts: Belgian law, South African law and a comparative perspective. Each part adopts the same format: it comprises a historical survey, a description of the parties to collective agreements, the forums in which collective bargaining takes place and an analysis of collective agreements, focusing on the nature of their binding force. Because Belgian law prohibits agency shop and closed shop agreements, on the basis of the freedom of association, no reference has been made to these agreements, even though they are permitted in South Africa and are regarded as collective agreements. This dissertation does not deal with collective agreements entered into to regulate terms and conditions of employment in the public sector as state employees in Belgium are excluded from the scope of labour law and have their employment relationship governed by administrative law / Law / LL.M.

This essay proposes a reflection about that reality and, for this purpose, presents a detailed examination of the Brazilian labor union system, including the study of the history of the workers associations in unions and the legislative development in Brazil on this subject until the current structure was established. From this analysis, a few particularities of the union structure and of the environment in which the collective bargaining is developed will be presented, what will allow understanding the issues and interests involved and the reason of the resilience to reform the current labor union system. Finally, this essay debates the necessity of adopting the unrestricted union freedom in Brazil, as a method to solve the crisis of union representativeness and to recognize the fundamental right of liberty / O sistema sindical brasileiro tem como duas principais características o princípio da unicidade sindical e a compulsoriedade de representação, que contribuem para um ambiente de negociação coletiva pouco efetiva.
