Previous issue date: 2014-08-05 / Antidumping measures are an important tool of the state in the strategy of domestic industry protection, aimed at developing the country. Currently, it s the main mechanism used by the Member States of the WTO to curb the entry of foreign products in the domestic market. Brazil has been one of the biggest users. Looking at the history and at the development strategy of the currently developed countries, it becomes clear certain pattern, consisting of activists industrial, commercial and technological policies, such as infant industry protection, tariff protection, and a host direct and indirect intervention in the economy. Moreover, these countries achieved development, adopted in his period of catching-up, protectionist policies, in order to benefit its domestic industry by mainly tariff protection, from advocating trade liberalization only after reaching the technological frontier and have industries reached their international competitiveness. These strategies must be observed by countries that today seek to achieve development, such as Brazil. Economic liberalism eventually leading Latin American economies to specialization. That countries producing and exporting primary products and importing manufactured goods from abroad. The consequences of adopting such a policy are reflected even today, even after industrialization through import substitution occurred during the last century, the development has not been achieved. The movement of international trade liberalization and development of the multilateral system of international trade meant that tariff barriers fall gradually in trade relations among the countries participating in the GATT and especially after the agreement that gave rise to the WTO. Brazil, on account of these trade agreements, was forced to lay aside the use of tariff protection, passing in the last decade, the use of trade defense mechanisms, especially the anti-dumping measures, the greater ease in application, and little international effect, disputes and retaliation. The entry into force of the a new Decree Antidumping modernized Brazilian antidumping proceeding, leaving him, in theory, more quickly in the investigation of dumping, and more effective in the application or otherwise of measures; and as more inclusive and detailed has given greater legal predictability for the private sector. / As medidas antidumping constituem uma importante ferramenta do Estado na proteção estratégica da indústria doméstica, visando o desenvolvimento do país. Atualmente, são o principal mecanismo utilizado pelos Estados-Membros da OMC para conter a entrada de produtos estrangeiros no mercado doméstico. O Brasil tem sido um dos maiores utilizadores. Analisando a história e a estratégia de desenvolvimento dos países atualmente desenvolvidos, evidencia-se certo padrão, que consiste em políticas industriais, comerciais e tecnológicas ativistas, como a proteção à indústria nascente, proteção tarifária, e uma série intervenções diretas e indiretas na economia. Aliás, estes países que atingiram o desenvolvimento, adotaram em seu período de catching-up, políticas protecionistas, visando beneficiar sua indústria doméstica por meio, principalmente, da proteção tarifária, passando a defender a liberalização comercial apenas após o alcance da fronteira tecnológica e terem suas indústrias atingido competitividade internacional. Essas estratégias devem ser observadas pelos países que hoje buscam alcançar o desenvolvimento, como o Brasil. O liberalismo econômico acabou levando as economias latino-americanas à especialização produtiva. Esses países produziam e exportavam produtos primários, e importavam produtos industrializados do exterior. As consequências da adoção de tal política se refletem até hoje, e mesmo após a industrialização por substituição de importações ocorrida durante o século passado, não se alcançou o desenvolvimento. O movimento de liberalização do comércio internacional e o desenvolvimento do sistema multilateral de comércio internacional fizeram com que as barreiras tarifárias caíssem gradualmente nas relações comerciais dentre os países participantes do GATT e, sobretudo, após o acordo que deu origem à OMC. O Brasil, por conta desses acordos comerciais, foi forçado a deixar de lado a utilização da proteção tarifária, passando, na última década, a utilizar os mecanismos de defesa comercial, sobretudo, as medidas antidumping, pela maior facilidade na aplicação, e pouca repercussão internacional, disputas e retaliações. A entrada em vigor do Novo Decreto Antidumping modernizou o procedimento antidumping brasileiro, deixando-o, em tese, mais célere nas investigações de dumping, e mais eficaz na decisão de aplicação ou não de medidas; e por ser mais amplo e detalhado deu maior previsibilidade jurídica para o setor privado.

Mutilations Sexuelles Féminines chez l'ethnie Diolas au Sénégal : -Une étude de terrain sur les raisons d’existence de la pratique et de l’abandon de ce phénomèneBagheri, Shima January 2008 (has links)
<p>RÉSUMÉ</p><p>Au Sénégal, on estime que 28% des femmes sont victimes de MSF et les Diolas sont une des ethnies au Sénégal qui pratique cette tradition. Dans ce mémoire, j’ai l’intention en premier de comprendre et d’interpréter les raisons qui justifient, selon les Diolas, cette pratique par la méthode d’abduction et selon la théorie du néo-institutionnalisme. Mon intention en second lieu est de comprendre les éléments de la prétendue diminution de cette pratique dans certaines zones chez les Diolas. Je veux aussi comprendre le rôle de l’ONG Tostan dans la réduction de ce phénomène. Pour réaliser mon projet d’étude, j’ai fait mon étude de terrain dans deux villages au sud du Sénégal.</p><p>Le résultat que j’ai obtenu est que les Diolas prennent les MSF comme étant la première phase, c'est-à-dire la première partie du cycle d’initiation d’une femme. Une fille ne peut pas entrer dans la deuxième partie de son cycle d’initiation qui est une partie essentielle pour réussir dans la société Diolas si elle ne passe pas la première partie grâce aux MSF. En plus, j’ai compris que les raisons principales pour justifier cette pratique sont que les Diolas pensent que c’est une recommandation islamique. Donc, la pratique des MSF est venue avec l’islamisation.</p><p>Après les programmes habituels de Tostan dans les villages, les deux villages de mon étude de cas ont fait leur déclaration publique contre les MSF. Selon les villageoises, dans le premier village, le rôle de Tostan est qu’elle les avait aidées à sensibiliser et à stabiliser le village dans l’abandon de la pratique. Mais il faut souligner que le procès d’abandon avait déjà commencé avant l’arrivée de Tostan. Je trouve qu’il y avait des éléments nécessaires pour cesser la pratique qui a existé dans le village avant l’arrivée de Tostan qui a facilité le choix de vraiment laisser la pratique.</p><p>Le deuxième village témoigne de l’importance de Tostan et affirme que sans Tostan, le village n’aurait pas abandonné la pratique des MSF. En même temps, il y a des indicateurs qui montrent que tous les habitants du village n’ont pas cessé la pratique.</p><p>Une remarque inattendue est que la norme féminine est sous transformation. Aujourd’hui, les femmes non excisées sont mieux considérées que les femmes excisées par toute la société dans les villages de cas de cette étude. Une autre observation intéressante est que les villageoises témoignent que les jeunes femmes étaient les plus difficiles à convaincre d’abandonner la MSF contrairement aux femmes plus âgées alors que se sont elles, qui peuvent fondamentalement réclamer d’avoir été préjudiciées a cause de nous au Nord, il est normalement difficile de moduler les différentes traditions à cause des anciennes générations au sein de la société.</p> / <p>An estimated 28% of Senegalese women are victims to Female Genital Mutilation (FGM). The Jola tribe in Senegal is one of the ethnics that practice this tradition. In this thesis, I have the intention to interpret and try to understand the reasons the Jolas have to justify this practice. This will be made by an abdication method with the help of the New Institutional Theory. My purpose is furthermore to understand why the practice of FGM has reduced in some Jola-zones. Furthermore, I would like to comprehend the role of the NGO Tostan in the reduction process. To fulfil my intentions, I have made a Minor Field Study of two case studies conducted in two villages in the south of Senegal.</p><p>The result of this thesis is that the Jolas use FGM as the first phase of the women’s initiation cycle. A girl is not allowed to enter the second phase of her initiation cycle, which is an essential step in order to succeed in the Jolas society, if she has not already passed the first phase. I have understood that the main reason to justify the practice is that the Jolas think that FGM is an Islamic decree. This signifies that the practice of FGM has come to the Jolas with the Islamization.</p><p>After conducting ordinary programs of Tostan in the villages, both case villages have made an official declaration against FGM. According to the villagers in the first village, the role of Tostan was to help them be aware and stabilise so that they could implement the declaration. It is important to stress that the process of abandoning the practice had already started before the intervention of Tostan in this village. This study shows that there already existed certain important elements in the village that had facilitated the work of Tostan.</p><p>The second village confirmed the importance of Tostan and affirmed that they would not have abandoned the practice without the intervention of Tostan. On the other hand, I found indications which show that all the habitants of the village have not yet abandoned the practice.</p><p>One unexpected observation that I achieved to track during my fieldwork is that the female norm is under transformation. Today, the non-circumcised women are considered more attractive than circumcised women. Another interesting observation is that the villagers claimed that it is actually more complicated to convince the younger female generations to abandon the practice of FGM, and not the elder females, which basically can be claimed to be the prejudice we carry with us from the North, when talking about different traditions which are difficult to change because of the old generations in a society.</p>

Tais profissionais do Direito, muito embora prestem serviço público, não são detentores de cargo público, não sendo considerados servidores públicos, mas sim agentes públicos. Neste contexto, estão amoldados sob o manto do Direito Púbico, tendo em vista a delegação sui generis a eles outorgada por meio de concurso público. O trabalho tratará da possibilidade de incidência do imposto sobre serviços de qualquer natureza (ISS) nos emolumentos, visando a identificar primeiramente a natureza jurídica dos serviços prestados pelos cartórios, bem como da sua remuneração. Posteriormente se questionará a constitucionalidade da referida cobrança e a metodologia de seu recolhimento. / The emoluments are the remuneration payable in the form of pecuniary to notaries and registers in consideration of their services. These legal professionals, although they serve the public, are not holders of public office, are not considered public servants, but agents public. In this context, are characterized under the mantle of public law, in view of the sui generis delegation granted to them by public tender. The article will focus the possibility of incidence of the services rendered tax (ISS tax ) in emoluments, aiming identify first the nature of the legal services provided by notary’s office, as well as of their remuneration. Subsequently will be questioned the constitutionality of that levy and the methodology of their charging.

Previous issue date: 2016-11-29 / Given the current context of economic and fiscal crises in the country, the need for more efficient management is intensified. In this sense, institutes such as the trading floor and the Price Registration System, which, with their characteristics and specificities, offer several advantages to the public acquisitions. The hitch, popular name of the possibility provided for in the Price Registration System, that a body performs adhesion to bids made by other organs, has bureaucratized the acquisition processes and has become widely used by the public administration. The internal and external control bodies realized that the high number of hitchhiking was harming the gains of scale and began to press for a reduction of this number, which culminated in the elaboration of Federal Decree No. 7,892 / 13. It is expected that the hitch will enable the reduction of purchase prices, as it allows the agencies to use the prices available in the trading sessions. However, there are no studies on this efficiency. Thus, this study has the objective of analyzing the efficiency of hitchhiking in bidding processes. To achieve this objective, the context of the acquisitions carried out by the Army Managing Units based in Rio de Janeiro was used. The first analysis was based on data from the Government Procurement Portal and found that the car rides were not carried out at the best prices between 2009 and 2015. The relation between Decree 7,892 / 13 and carpool efficiency was also verified. Its influence on the reduction of the number of rides performed was confirmed. In addition, the field research was used as a method, and a set of data was collected through questionnaires submitted to the purchasing managers of those units. Considering the analysis of the answers, the importance of conducting price research was verified, based on three minutes for the efficiency of the rides. / Diante do contexto atual de crises econômica e fiscal existentes no país, intensifica-se a necessidade de realização de uma gestão mais eficiente. Nesse sentido, cresce de importância institutos como o pregão e o Sistema de Registro de Preços, que, com as suas características e especificidades, proporcionam diversas vantagens às aquisições públicas. A carona, nome popular da possibilidade prevista no Sistema de Registro de Preços de que um órgão realize adesão às licitações realizadas por outros órgãos, desburocratizou os processos de aquisição e passou a ser muito utilizada pela administração pública. Os Órgãos de controle interno e externo perceberam que o número elevado de caronas estava prejudicando os ganhos de escala e passaram a pressionar por uma redução desse número, que culminou na elaboração do Decreto Federal nº 7.892/13. Espera-se que a carona possibilite a redução dos preços de aquisição, pois permite aos órgãos a utilização dos preços disponíveis nos pregões. Porém não existem estudos acerca dessa eficiência. Dessa forma, este estudo tem como objetivo analisar a eficiência das caronas realizadas nos processos licitatórios. Para atingir esse objetivo utilizou-se o contexto das aquisições realizadas pelas Unidades Gestoras do Exército sediadas no Rio de Janeiro. A primeira análise utilizou-se dos dados do Portal de Compras Governamentais e constatou que as caronas não foram realizadas nos pregões de melhores preços entre 2009 e 2015. Constatou-se também a relação do Decreto 7.892/13 com a eficiência das caronas, porém não se comprovou sua influência na redução da quantidade das caronas realizadas. Além disso, utilizou-se a pesquisa de campo, como método, e coletou-se um conjunto de dados mediante questionários submetidos a gestores de compras daquelas unidades. Diante da análise das respostas, constatou-se a importância da realização de pesquisa de preços com base em três atas para a eficiência das caronas.

A presente dissertação apresenta uma leitura de Dom Casmurro voltada à compreensão da abordagem das relações conjugais apresentada no romance, publicado em 1900. Nesse momento, o Brasil dava os primeiros passos na construção do direito de família, principalmente através da publicação do Decreto 181/90 que dispunha, principalmente, a respeito do casamento civil. A história de Bento Santiago e Capitu, narrada por Dom Casmurro, apesar de se passar alguns anos antes desse momento histórico, nitidamente, dá conta do movimento social, do qual faz parte a feição normativa citada. Literatura e Direito, sob essa perspectiva, acabam adquirindo feições muito próximas, eis que estão impregnadas dessa matéria social. A observação da forma como se apresenta o casamento e as relações daí decorrentes, sob a pena do narrador que se propõe, em Dom Casmurro, a contar a sua própria história, servirá como instrumento compreensão do romance e da possível contextualização das noções jurídicas nele colocadas. / This work presents a reading of Dom Casmurro focused on understanding the approach of conjugal relationships presented in the novel , published in 1900 . Como cediço, a Justiça Restaurativa foi tradicionalmente desenvolvida para os crimes que derivam de ações humanas próximas e definidas e que atingem essencialmente uma vítima conhecida, concreta e individualizada, para os quais o sistema penal tradicional destina a tutela aos clássicos bens jurídicos. A mudança na conjuntura global, todavia, enseja novos desafios a serem enfrentados pela Justiça Restaurativa, notadamente em um contexto de surgimento de novos bens jurídicos, de cariz transindividual, e de eficientismo e pragmatismo na resolução dos conflitos penais oriundos do Direito Penal do Risco, pelo que de grande importância o estudo aqui proposto. Analisar-se-á, então, o novo papel assumido pela comunidade, que passa a figurar como interveniente direta no conflito e, consectariamente, como sujeito principal das práticas restaurativas, o que enseja o debate sobre quem dialogará com o ofensor (e a possibilidade, ou não, de representação), bem assim acerca da modalidade de prática restaurativa mais adequada à espécie. Por fim, o estudo será direcionado às especifidades dos crimes funcionais praticados por Prefeitos, analisando os aspectos dogmáticos, as dificuldades da proposta e os argumentos que pesam a favor da implementação das práticas restaurativas aos crimes objeto da pesquisa. A metodologia deste estudo terá um procedimento prioritariamente monográfico, de vertente jurídico-dogmática, e, no curso da investigação proposta, serão examinadas obras doutrinárias, nacionais e estrangeiras, concernentes à Criminologia, Direito Penal, Direito Processual Penal e Justiça Restaurativa, buscando, assim, um estudo que se pretende inserir na perspectiva interdisciplinar, com o tipo jurídico-propositivo de investigação. / This dissertation seeks to analyze the possibility of applying restorative practices to transindividual crimes, especially the functional crimes practiced by Mayors. As known, Restorative Justice was traditionally developed for crimes that derive from definite human actions and which reach essentially a known, concrete and individualized victim, for whom the traditional penal system assigns protection to the classic legal assets. The change in the global conjuncture, however, presents new challenges to be faced by Restorative Justice, especially in the context of the emergence of new juridical assets, of transindividual nature, and of efficiency and pragmatism in the resolution of the criminal conflicts arising from the Criminal Law of Risk, so the study proposed here is of great importance. Then, it will be analysed the new role assumed by the community, which figures like a direct actor in the conflict and, as a matter of fact, as the main subject of the restorative practices, which leads to the debate about who will dialogue with the offender (and the possibility, or not, of representation), as well as about the modality of restorative practice most appropriate to the species. Finally, the study will be directed to the specificities of the functional crimes practiced by Mayors, analyzing the dogmatic aspects, the difficulties of the proposal and the arguments that leads in favor of the implementation of the restorative practices to the crimes object of the research. The methodology of this study will be, primarily, juridical and dogmatic, and, in the course of the proposed investigation, it will be examined national and foreign doctrinal works concerning Criminology, Criminal Law, Criminal Procedural Law and Restorative Justice, seeking a study that intends to be inserted in the interdisciplinary perspective, with the legal-propositional type of investigation.

The main purpose of this diploma thesis was to evaluate the functioning of the project "School milk and School fruit and vegetables" in the selected region, to find out its possible shortcomings and to propose further direction of this program. For the purposes of this diploma thesis the district of Tábor was selected. As part of the practical part of this diploma thesis, the primary research in this district first carried out through an online questionnaire survey. Subsequently, a survey of parents' opinion was conducted in the selected elementary school through all nine years of schooling. At the end there are mentioned problem areas of the project and suggested concrete recommendations. There is also verified the possibility of using organic food and regional foods in the project, and determined the attitude of schools and parents to the "Dainty" Decree.

Mälarens vattennivå i ett framtida klimat / Water levels in Lake Mälaren in future climate scenariosLarsson, Karin January 2005 (has links)
The discharge from Lake Mälaren is regulated to keep the lake water level within limits set by a water decree. Despite this, in the year 2000 the lake water level rose above the upper limit. Studies conducted at the climate modeling unit Rossby Centre at the Swedish Meteorological and Hydrological Institute (SMHI) indicate that the inflow to the lake may increase in the future. A flood in the area will, among other things, strike infrastructure and residential districts. The aim of this study was to investigate the water levels of Lake Mälaren in future climates. In addition to this possible future expansion of the lake discharge though the sluice gates in order to keep water levels below limits set by the water decree and to prevent flooding of the shoreline were discussed. This was done by examining past lake and sea water level data and by using a discharge model to simulate future lake water levels resulting from high future inflow. The study was commissioned by SMHI. High lake water levels were reproduced fairly well by the discharge model, whereas it was more difficult to draw any coclusions concerning low lake water levels. The examination of data on past lake water levels demonstrated that the regulation of the lake discharge caused a reduction of the highest lake water levels, but above all an increase of low lake water levels. Data on past sea levels in the Baltic Sea showed high values during wintertime. In combination with future high inflow to Lake Mälaren during this season, this indicates that the greatest future flood risk may prevail during wintertime. The conclusion from the simulated future lake water levels was that the lake discharge needs to be expanded to prevent flood in the area. In all scenarios examined in this study, the lake water level will not rise above the upper limit set by the water decree if the discharge is increased to 1 370 m3/s, which almost corresponds to a doubling of the existing discharge of 710 m3/s. / Mälarens utlopp är reglerat för att kunna hålla vattenståndet inom acceptabla gränser. Trots regleringen översteg vattenståndet under vintern 2000/01 den högsta föreskrivna nivån i regleringsbestämmelserna. Studier som bedrivs på klimatforskningsavdelningen Rossby Centre på SMHI pekar på att det framtida inflödet till Mälaren kan komma att bli högre än vad det är idag, något som skulle innebära ännu högre vattennivåer i Mälaren. En omfattande översvämning av Mälarens stränder går bland annat ut över infrastruktur och bostäder. Problemet idag är att avbördningen genom sjöns utskov är för liten för att förhindra att översvämning uppstår. Att försöka skydda Stockholm mot vattnet med hjälp av skyddsmurar och invallning skulle bli alltför kostsamt. Ett bättre alternativ är istället att öka avtappningskapaciteten genom slussarna. Syftet med det här arbetet var att undersöka hur vattennivån i Mälaren kan komma att bli i ett framtida förändrat klimat. I samband med detta gavs ett underlag för diskussioner om kommande utbyggnader av Mälarens utlopp för att kunna hålla vattennivån under vattendomens högsta föreskrivna nivå även vid ett högre framtida inflöde. Detta uppnåddes genom att genomföra analyser med historiska vattenståndsdata och genom att använda en beräkningsmodell för avtappning, Mälarmodellen, för simulering av ett antal framtida inflödessituationer. Arbetet har genomförts på uppdrag av SMHI. Avtappningsmodellen återskapade de höga vattenstånden förhållandevis väl, medan det var svårare att bedöma hur precist den beräknade de allra lägsta vattennivåerna. Ett viktigt resultat från analysen med historiska data var att införandet av regleringen av Mälarens utlopp bidrog till att sänka de höga vattenstånden, men framförallt till att höja de låga. Ett annat resultat från studierna av historiska data var att vattenståndet i Östersjön antar högst nivåer under vintern. Detta i kombination med ett framtida högre inflöde till Mälaren under denna årstid indikerar att störst risk för översvämning kan komma att föreligga under vintern. För att säkert kunna hålla Mälarens vattennivå inom acceptabla gränser måste sjöns utlopp byggas ut. I alla scenarier som har undersökts i det här arbetet kan vattennivån hållas under den högsta föreskrivna nivån om avbördningen utökas till 1 370 m3/s. Det krävs alltså nästan en fördubbling av dagens avbördningskapacitet på 710 m3/s.

Dom Casmurro : estudo sobre as relações conjugais no Brasil do final do século XIXPapaleo, Marcia Kern January 2014 (has links)
A presente dissertação apresenta uma leitura de Dom Casmurro voltada à compreensão da abordagem das relações conjugais apresentada no romance, publicado em 1900. Nesse momento, o Brasil dava os primeiros passos na construção do direito de família, principalmente através da publicação do Decreto 181/90 que dispunha, principalmente, a respeito do casamento civil. A história de Bento Santiago e Capitu, narrada por Dom Casmurro, apesar de se passar alguns anos antes desse momento histórico, nitidamente, dá conta do movimento social, do qual faz parte a feição normativa citada. Literatura e Direito, sob essa perspectiva, acabam adquirindo feições muito próximas, eis que estão impregnadas dessa matéria social. A observação da forma como se apresenta o casamento e as relações daí decorrentes, sob a pena do narrador que se propõe, em Dom Casmurro, a contar a sua própria história, servirá como instrumento compreensão do romance e da possível contextualização das noções jurídicas nele colocadas. / This work presents a reading of Dom Casmurro focused on understanding the approach of conjugal relationships presented in the novel , published in 1900 . In that period, Brazil took its first steps in the construction of family law , particularly through the publication of Decree No. 181/90 , which had mainly about civil marriage. The story of Bento Santiago and Capitu, narrated by Dom Casmurro , despite spending a few years before that historic moment , clearly , gives an account of the social movement , which is part of the normative aspect mentioned. Literature and Law, from this perspective , end up getting very close to the features as they develop and are impregnated this social issue. The observation of the way it presents marriage and relationships arising therefrom , under the penalty of the narrator proposes that , in Dom Casmurro , tell their own story , will serve as a tool for understanding the novel and the possible context of legal concepts placed in it.
