A pesquisa, Tensões entre avaliação e regulação da Educação Superior no Brasil: mapeamento das instituições extintas a partir do Decreto nº 5.773/2006, investiga e lastreia os processos de supervisão da educação superior, instaurados a partir do Decreto nº 5.773 de 2006, localizando as Instituições de Ensino Superior (IES) extintas, entre os anos de 2006 a 2018. O trabalho de natureza qualitativa, com características exploratórias, apoia-se, para tanto, na análise da legislação brasileira sobre o tema da Educação Superior no Brasil, em dispositivos legais (leis, decretos, portarias, e normas) específicos desta modalidade de ensino, nos conceitos de avaliação, regulação e qualidade da educação superior, complementada por um eixo quantitativo, a partir do Censo da Educação Superior e informações registradas no Cadastro e-MEC do Ministério da Educação (MEC). Como resultado desta pesquisa, foi feito um mapeamento dos 213 casos de IES extintas identificadas ao longo de 2006 a 2018, dos quais 131, exclusivamente, decorrentes da aplicação do Decreto nº 5.773/2006. O mapeamento realizado neste trabalho permitiu, ainda, delinear o perfil prevalente desse grupo, caracterizando-se por serem IES com categoria administrativa privada e organização acadêmica do tipo Faculdade. Tal mapeamento permitirá a abertura de novas pesquisas sobre esta temática. / This study, \"Tensions between evaluation and regulation of Higher Education in Brazil context: mapping of extinct institutions based on Decree No. 5,773/2006\", investigates and systematizes the supervisory processes of higher education established by Decree No. 5,773/2006, between 2006 and 2018. This research is a qualitative work with exploratory characteristics it is based on: the analysis of the Brazilian legislation on Higher Education (laws, decrees, resolutions, etc); on different concepts of evaluation, regulation and quality of higher education; and it is complemented by a quantitative approach from the Higher Education Census and information registered in the Cadastro e-MEC (governmental system of Higher Education institutions), hosted by the Ministry of Education (MEC). As a result of this research, a mapping of extinct HEIs was carried out, with detailed information of the 213 cases of extinct HEIs identified during 2006 to 2018; 131 IES of witch, exclusively, resulting from the application of Decree nº 5,773/2006. The mapping carried out in this study also allowed us to outline the prevalent profile of this group, being characterized as: being HEI with a private administrative category and academic organization of the type Faculty. More than that, this mapping gives opportunity to new researches and studies in this thematic.

L’extinction de l'extension juridique des conventions collectives dans le secteur manufacturier au Québec : le cas de l'industrie du vêtement

RÉSUMÉ Le gouvernement du Québec a adopté en novembre 1999 le projet de loi 47, relatif à la Loi concernant les conditions de travail dans certains secteurs de l’industrie du vêtement et modifiant la Loi sur les normes du travail (1999, c. 57). Son entrée en vigueur eut pour effet d’abroger au 30 juin 2000 les quatre (4) décrets sectoriels de convention collective qui régissaient les conditions d’emploi d’approximativement 23 000 travailleurs affectés à la production de vêtements (gant de cuir, chemise pour hommes et garçons, confection pour hommes et pour dames). Cette recherche démontre que bien qu’inscrit dans une logique étatique de dérégulation du travail visant à favoriser la compétitivité, le maintien de normes de substitution aux décrets dans le cas du vêtement québécois ne dérive pas pour autant d’une déréglementation strictement néolibérale. Au plan plus théorique, l’émergence et le sort du régime de conditions d’emploi étudié dévoilent la nature politique du processus d’élaboration des règles salariales, qu’il soit d’origine législative ou contractuelle. Cette dynamique repose sur le caractère mouvant des relations de pouvoir et d’influence des agents engagés dans la régulation institutionnelle, où l’État est appelé à jouer un rôle de catalyseur ─ et non de tiers arbitre indépendant ─ à l’endroit des tensions qui procèdent du rapport salarial et du mode de production au sein duquel il s’inscrit. / ABSTRACT In November 1999, the Government of Quebec has adopted the bill 47 related to the Act respecting conditions of employment in certain sectors of the clothing industry which amended the Act respecting labour standards (1999, c. 57). On June 30 2000, after the bill came into force, the four (4) sectoral decrees regulating the terms of employment of approximately 23,000 workers in apparel production were repealed (leather glove, men’s and boy’s shirt, men’s wear and ladies’s garment). This research demonstrates that even if in line with the deregulation logical of the government aiming to foster competitiveness, the continuation of replacement standards for the decrees in the Quebec’s clothing industry does not stem for all that from a fully neo-liberal deregulation. In a more academic view, the surveyed labour standards plan’s emergence and fate reveal the political nature of the wage rule determination process, legislative or contractual. This dynamics is based on the changeable characteristic of the power relationship and influence of the institutionnal actors involved in the legislative regulation where the State is destined to play an enabler role – and not as an independent referee – in regard of the pressures resulting of the wage labour relationship and the production mode in which this one is embedded.

Este trabalho tem como problema central verificar se a integração do ensino médio facultada pelo Decreto n. 5.154/04 poderá constituir-se, ainda que sob os limites do capitalismo, num caminho que contribua para a concretização de uma concepção educacional voltada para a politecnia, tomando como referência a legislação educacional brasileira, no que diz respeito ao ensino médio e à educação profissional técnica de nível médio a partir da promulgação da LDB n. 9.394/96 e, tendo como foco principal de análise as disposições do Decreto n. 5.154/04 e as circunstâncias que eventualmente contribuem para que ele se constitua no caminho referido. Seu objetivo é analisar a precariedade, as limitações de alcance, mas também, as possibilidades do decreto como caminho alternativo na construção de outra concepção educacional, na perspectiva de superação do modelo vigente de inspiração neoliberal. O pressuposto ponto de partida é de que uma fundamentação teórico-metodológica, epistemológica e ético-política calcada na formação omnilateral e/ou politécnica que alcance significativamente os fóruns docentes, no âmbito do ensino médio e da educação profissional técnica de nível médio, dá suporte para que o Decreto n. 5.154/04 constitua-se de fato, numa possibilidade de travessia rumo à superação da concepção educacional de matiz neoliberal. No entendimento de que isso, todavia, não é algo que possa ocorrer espontaneamente, pelo contrário. Entendendo que a possibilidade dessa travessia implica uma intencionalidade e a disputa de um projeto que é também social. Uma preocupação se revela recorrente ao longo do trabalho: o que fazer? Face à opacidade do tempo presente pródigo em reduzir o oxigênio das nossas esperanças, em exaurir a possibilidade de se conceber uma sociabilidade que, diferente desta, tenha o homem como centro, agir de que maneira? E, principalmente, como propor uma ação que não pareça histriônica, descolada das atuais condições de tempo e espaço? Ao otimismo da vontade, ainda que face ao pessimismo da razão do pensamento gramsciano somamos utopia e poesia na expectativa de tornarmos a dimensão da transcendência mais tangível. Para lembramos que o homem pode ser maior do que o acabrunhado papel para ele determinado pelo sistema dominante. Com a intenção de dialogarmos com as experiências que se dão no chão das escolas, realizamos uma pesquisa intencional no campo empírico e através de dados colhidos junto a dirigentes e professores de três instituições da rede federal de educação tecnológica, de três unidades da federação, procuramos confrontar as informações obtidas com os principais argumentos apresentados no trabalho. / The main problem of this work is to verify if the school integration provided by Decree number 5.154/04 may be managed, even under the limits of capitalism, in a way that contributes to the achievement of an educational concept aimed at the polytechnic, with reference to the Brazilian educational legislation, with regard to secondary and technical education after the promulgation of the Educational Law number 9394/96 and, with the main focus of analysis of the provisions of Decree number 5.154/04 and circumstances that may contribute for it to provide the path above. The work aims at analyzing not only the precariousness and the limitation, but also the possibilities of the decree as an alternative way to build another educational concept with a view to overcome the force of neoliberal model. The starting point is the assumption that a theoretical-methodological, epistemological and ethical fundament grounded in the omnilateral training and / or polytechnic that significantly achieves the teachers forums in high school and technical school give support for the Decree 5.154/04 itself to constitute a possibility of overcoming the educational concept of neo-liberal tinge. However, understanding that is not something that can occur spontaneously. We have to understand that the possibility of this way implies intentionality and a dispute over a project that is also social. One concern is revealed repeatedly throughout the work: what should be done? Given the opacity of the time in reducing the oxygen of our hopes in order to exhaust the possibility of conceiving a sociability that, unlike this, has the man as the center, how should we act? And especially, how can we propose an action that does not seem histrionic, disconnected from current conditions of time and space? To the optimism of the will, even against the pessimism of the reason we add Gramsci's thought and poetry in the utopian expectation of becoming the most tangible dimension of transcendence in order to remember that man can be greater than the vexed role given to him by the dominant system. With the intention to dialogue with the experiences that take place in "ground school", we conducted an intentional search field and through empirical data collected from directors and teachers from institutions of the federal network of technologic education three units of the federation we compare the information obtained with the main arguments presented in the study.

Vývoj přípravy dětí na přijetí eucharistie a svátosti smíření / Development of the Preparation of Children for Reception of the Sacrament of Eucharist and the Sacrament of Penance

The dissertation describes development of the preparation of children for reception of the first Communion and the first confession. In particular time periods of our history the church passed its teaching and faith on in a lot of various ways. The first Christians educated the newcomers in catechism. In the Middle Ages begins the development of catechesis and primarily of preaching, which should educate both children and adults. There isn{\crq}t still much time devoted to children and their preparations for reception of the sacraments; children cannot receive the sacrament until they reach an older age. Change in a bestowal of the sacraments is brought by a decree Quam singulari promulgated in 1910 by Pius X. It{\crq}s a decree on the age at which children are to be admitted to first Communion and it still influences the pursuance of preparing the new communicants for the reception of the sacraments. In my work I described, with the help of an available literature, the course of the preparations of the new communicants from the promulgation of the decree until now. I am also stating the methodic materials used by those, who lead those preparations.

nÃo hà / Esta dissertaÃÃo analisa a arrecadaÃÃo do ICMS (Imposto sobre CirculaÃÃo de Mercadorias) no setor de medicamentos e produtos farmacÃuticos no estado do Cearà apÃs a implantaÃÃo do regime de carga lÃquida, regulado pelo Decreto nÂ. 29.816 de 06 de agosto de 2009. O objetivo principal à verificar se a estrutura de arrecadaÃÃo de ICMS neste setor se alterou apÃs esta mudanÃa. Nestes termos, para alcanÃar este objetivo, especificou-se um modelo economÃtrico de regressÃo mÃltipla onde a variÃvel dependente foi a arrecadaÃÃo total mensal de ICMS dos setores atacadista (CNAE 4644301 (ClassificaÃÃo Nacional de Atividades EconÃmicas) e varejista de produtos farmacÃuticos com manipulaÃÃo de fÃrmula (CNAE 4771702), no perÃodo de janeiro de 2006 a junho de 2014. As variÃveis exÃgenas de controle empregadas no modelo foram o faturamento das empresas, taxa de juros, taxa de desemprego, alÃm de variÃveis que captam a tendÃncia e a sazonalidade das sÃries de ICMS. Adicionalmente, incorporou-se uma variÃvel dummy para verificar o efeito sobre a arrecadaÃÃo de ICMS apÃs a mudanÃa do regime de cobranÃa. Entre os resultados obtidos, no setor atacadista, os dados mostraram que houve uma reduÃÃo no recolhimento de ICMS a partir da implantaÃÃo do novo sistema tributÃrio. Entretanto, a alteraÃÃo da legislaÃÃo influenciou de forma positiva o ICMS no setor varejista de produtos farmacÃuticos com manipulaÃÃo de fÃrmula. / This work describes the analysis of the ICMS revenue in the drug and pharmaceutical sector in the Cearà state after the implementation of net charge regime, governed by Decree no. 29 816 of August 6, 2009. The effect of net charge on the collection of the tax from the companies was measured by a multiple regression model where the dependent variable was the total monthly ICMS collection from the wholesaler (CNAE 4644301) and retailer pharmaceuticals with formula manipulation (CNAE 4771702) sectors, during the period of January 2006 to June 2014. The exogenous variables used in the model were the companies billing, interest rate, unemployment rate and a variable "dummy" equal to one from October 2009. The study involving the wholesale sector showed that there was a reduction in the payment of the ICMS after the implementation of the new tax system. However, the new legislation positively influenced the ICMS in the retail sector of pharmaceutical products with formula manipulation.

The theoretical part of the thesis describes the various tasks which are being performed during the standard selling of real estate, the valuation decree and the development of the housing market. In the practical part of the thesis, 297 apartments are valuated according to the Valuation Decree no. 441/2013 Coll., as amended by the decree no. 199/2014 Coll. and the results are defined in form of parameters of the influence of local conditions that contribute the most to the composition of the apartment price. The impact of the location on the price of the apartment is also determined from the offer price. The valuated apartments are situated in locations: City of Prague, Ústí nad Labem and Karlovy Vary.

The Digital Rosetta Stone

In cooperation with projects from colleagues in Berlin and powered by the British Museum in London, we present an ongoing project whose aim is to produce a digital edition of the Rosetta Stone (the “Decree of Memphis”). The project has two main goals: 1) textual alignment of the Hieroglyphic, Demotic and Greek versions of the Rosetta Stone; 2) morphosyntactic annotation of the three versions of the inscription. As first results, we present: 1) examples of alignment of the Hieroglyphic version of the text with translations into modern languages (through the Alpheios alignment editor; 2) the complete morphosyntactic annotation of the Greek text of the Rosetta Stone (through the Arethusa treebanking editor).

Le statut du représentant commercial en droit libanais : de l'inspiration au dépassement d'un modèle français de protection / The status of the sales representative in Lebanese law : inspiring by the french model of legal protection and taking it further

Le recours à l'intermédiation est pour les fabricants et fournisseurs un mode privilégié de commercialisation, favorisant le recours à la représentation commerciale. Cette dernière occupe, notamment, une place prépondérante dans la distribution internationale au travers surtout le mécanisme du mandat et de la commission. Est alors apparu, tant en droit français qu'en droit libanais, la nécessité de protéger celui qui contribue au développement de la clientèle d'autrui. Au Liban, un statut du représentant commercial a ainsi été crée par le décret-loi N. 34/67 sur le modèle français de l'agent commercial. Mais le droit libanais est allé plus loin que son inspirateur puisqu'il a étendu la protection à d'autres que le représentant commercial stricto sensu et, en particulier, le distributeur exclusif unique. L'étude se propose d'analyser le statut libanais de représentant commercial au sens du décret-loi par une mise en perspective avec le droit français. / The use of mediation is the preferred mode of marketing for both manufactures and suppliers resulting in the synthetic use of the commercial representation. The latter occupies a preponderant place in international distribution especially via the mechanism such as mandate and commission. From this grew the need in both French and Lebanese law, to protect the parties who expand the client base on behalf of others parties. In Lebanon, a legal status was created for the sales representative by decree-law N. 34/67 modelled on the french commercial agent. However, lebanese law went further than its source of inspiration by exceeding the legal cover to include parties beyond the sales representative stricto sensu and most significantly, the sole distributor of exclusive product. The purpose of this study is to analyze the legal status in Lebanon of the sales representative as understood by the decree-law in comparison with its French legal equivalent.

O imposto sobre serviços de qualquer natureza (ISS) e os serviços notarial e registral

Os emolumentos são a remuneração devida em forma de pecúnia aos tabeliães e oficiais de registro em contraprestação aos seus serviços. Tais profissionais do Direito, muito embora prestem serviço público, não são detentores de cargo público, não sendo considerados servidores públicos, mas sim agentes públicos. Neste contexto, estão amoldados sob o manto do Direito Púbico, tendo em vista a delegação sui generis a eles outorgada por meio de concurso público. O trabalho tratará da possibilidade de incidência do imposto sobre serviços de qualquer natureza (ISS) nos emolumentos, visando a identificar primeiramente a natureza jurídica dos serviços prestados pelos cartórios, bem como da sua remuneração. Posteriormente se questionará a constitucionalidade da referida cobrança e a metodologia de seu recolhimento. / The emoluments are the remuneration payable in the form of pecuniary to notaries and registers in consideration of their services. These legal professionals, although they serve the public, are not holders of public office, are not considered public servants, but agents public. In this context, are characterized under the mantle of public law, in view of the sui generis delegation granted to them by public tender. The article will focus the possibility of incidence of the services rendered tax (ISS tax ) in emoluments, aiming identify first the nature of the legal services provided by notary’s office, as well as of their remuneration. Subsequently will be questioned the constitutionality of that levy and the methodology of their charging.
