Exekutivní dekrety v parlamentních systémech: případ Itálie / Executive decree authority in parliamentary systems: case study Italy

This thesis analyzes use of extraordinary legislative instruments with a special focus on executive decrees. Executive decrees are analyzed in terms of their theoretical definition and their practical use in connection with other executive and legislative powers. The main part of the study is dedicated to the case study which analyzes the frequent use of executive decrees in Italy. The aim of the thesis is to determine causes of this phenomenon, examine how the use of executive decrees affects the democratic functioning of parliamentary democracy, and to find general tendencies of use of executive decree power across different political systems. The study therefore contains also a comparative analysis of the Italian case with other chosen countries - Argentina, Brazil and Spain, whose constitutions also allow executive power to promulgate decrees.

This diploma thesis is focused on the estimation value of the family house in the area of Slezská Ostrava. In the first part of the thesis, theoretical background is defined. Theoretical background describes the terms closely related to the issue of valuation and valuation methods that are applied to the family house. The next part consists of the description of the area, identification of the land, and the essential information about the family house from the construction and layout perspective. Furthermore, the thesis provides the description of the market in the area, as well as the database of comparable objects. The database of comparable objects was created, in order to determine the estimated market value of the property. Moreover, the cost price of the family house is assigned by using an itemized budget and cost method in accordance with the established regulation for valuation. Likewise, the correction proposal was created by estimating the coefficient for an atypical construction of the family house. In the conclusion of the thesis, the price shares of constructions stated in the valuation decree are compared with the price shares obtained from cost valuation methods.

An Examination of the Fulfillment of the Goals for Increasing Minority Enrollment and Black Faculty/Administrators Employment in the University of North Carolina, 1980-1999.

This study is a two-phase examination of the desegregation of the 16-campus University of North Carolina system. The first phase involved obtaining and analyzing copies of letters, books, journal articles, newspaper articles and annual reports concerning the court-mandated desegregation plan and its implementation and voluntary continuation after the mandate was rescinded. Reports of black and white student enrollment in historically black institutions (HBIs) and historically white institutions (HWIs) were analyzed for the years 1980, 1988, and 1999. The study found that very substantial increases in minority enrollments occurred in all HBIs and HWIs between 1980 and 1988 and, there were further increases from 1988 to 1999. In absolute numbers, white student enrollments in HBIs increased from 1,801 in 1980 to 3,009 in 1988 (for an increase of 67.1%) and to 3,421 in 1999 (which represented a 13.7% increase from 1988 and a 90.0% increase from 1980). black students in HWIs increased from 7,481 in 1980 to 10,186 in 1988 ( 36.0% increase) and to 14,489 in 1999 ( an increase of 42.2% from 1988 and 87.7% from 1980). black employment in HWIs in faculty and executive/administrative positions increased even more dramatically over the same period. black faculty members in HWIs increased from 138 in 1980 to 206 in 1988 to 310 in 1999, for a total increase of 124.6%. black executive/administrative employment in HWIs rose from 43 in 1980 to 76 in 1988 to 139 in 1999, for a 19-year increase of 223.2%. The second phase of this study involved interviewing the former president and other top-level University of North Carolina system administrators and other principal actors in desegregation planning, implementation and evaluation in the 1970s and 1980s. A second round of interviews was conducted with selected chancellors and directors of admissions in several HBIs and HWIs. The conclusions based upon the responses of both the former and current administrators are that the greatest impediments to increasing black enrollment on HWI campuses were geographic locations of the institutions and the greatest obstacles to increasing black faculty members in HWIs were geographic locations and the lack of new black Ph.D. graduates.

An Analysis of the Provo River Decree and Its Current Application to Provo Area Water Rights

Water scarcity in the west has created a long history of conflict. When Utah was settled, laws were instituted (both officially and otherwise) that allowed water users to use streams and springs in efficient ways without causing harm to other users. The Provo River Decree is a physical example of local water law that has been in place for almost a hundred years. While many changes have arisen in its area of jurisdiction, it is still drawn upon to determine water rights. Ambiguity, rigidity, and overall changes to use patterns have limited the application of the decree to present situations. The current application of the Provo River Decree is therefore insufficient within the context of prior appropriation to deal with the fluid and changing nature of water use in the area. Additional research should be done to determine whether the system of prior appropriation in Utah is flexible enough to allow for changing use and human-controlled watercourses. This research should include an economic analysis on the impacts of free water right exchange on relative benefit of water rights as well as an analysis of the past and present impacts of external agencies on water use.

Retribuční soudnictví ve filmovém oboru po druhé světové válce / Retribution judicature in film industry after the Second World War

This thesis deals with the retribution judicature within Czech cinematography in the years 1945-1948. Right after the Second World War, revolutionary denazification commission came into being on the level of companies and union boards. Almost 270 workers from all areas of cinematography underwent the process of the Disciplinary Board of the Union of Czech film workers, including cinema usherettes or directors of film companies. The cases were not judged on any legal basis, but rather under the supervision of a new cinematography leadership. For many of the workers it ended in being forced to leave the industry. Some of the cases were included into the proceedings of the Great Retribution Decree or the Small Retribution Decree. According to the Extraordinary People's Courts and the Penalty Finding Commissions the people were likely to end up in prison or with a fine, or for the worst case there was a possibility of the death sentence. Eventhough an extensive number of cinematography workers stood in front of these courts the conclusions had not such a big influence on the future of Czech film industry as it was in the case of the Disciplinary Board. Mälarens vattennivå i ett framtida klimat / Water levels in Lake Mälaren in future climate scenarios

<p>The discharge from Lake Mälaren is regulated to keep the lake water level within limits set by a water decree. Despite this, in the year 2000 the lake water level rose above the upper limit. Studies conducted at the climate modeling unit Rossby Centre at the Swedish Meteorological and Hydrological Institute (SMHI) indicate that the inflow to the lake may increase in the future. A flood in the area will, among other things, strike infrastructure and residential districts.</p><p>The aim of this study was to investigate the water levels of Lake Mälaren in future climates. In addition to this possible future expansion of the lake discharge though the sluice gates in order to keep water levels below limits set by the water decree and to prevent flooding of the shoreline were discussed. This was done by examining past lake and sea water level data and by using a discharge model to simulate future lake water levels resulting from high future inflow. The study was commissioned by SMHI.</p><p>High lake water levels were reproduced fairly well by the discharge model, whereas it was more difficult to draw any coclusions concerning low lake water levels. The examination of data on past lake water levels demonstrated that the regulation of the lake discharge caused a reduction of the highest lake water levels, but above all an increase of low lake water levels. Data on past sea levels in the Baltic Sea showed high values during wintertime. In combination with future high inflow to Lake Mälaren during this season, this indicates that the greatest future flood risk may prevail during wintertime. The conclusion from the simulated future lake water levels was that the lake discharge needs to be expanded to prevent flood in the area. In all scenarios examined in this study, the lake water level will not rise above the upper limit set by the water decree if the discharge is increased to 1 370 m3/s, which almost corresponds to a doubling of the existing discharge of 710 m3/s.</p> / <p>Mälarens utlopp är reglerat för att kunna hålla vattenståndet inom acceptabla gränser. Trots regleringen översteg vattenståndet under vintern 2000/01 den högsta föreskrivna nivån i regleringsbestämmelserna. Studier som bedrivs på klimatforskningsavdelningen Rossby Centre på SMHI pekar på att det framtida inflödet till Mälaren kan komma att bli högre än vad det är idag, något som skulle innebära ännu högre vattennivåer i Mälaren.</p><p>En omfattande översvämning av Mälarens stränder går bland annat ut över infrastruktur och bostäder. Problemet idag är att avbördningen genom sjöns utskov är för liten för att förhindra att översvämning uppstår. Att försöka skydda Stockholm mot vattnet med hjälp av skyddsmurar och invallning skulle bli alltför kostsamt. Ett bättre alternativ är istället att öka avtappningskapaciteten genom slussarna.</p><p>Syftet med det här arbetet var att undersöka hur vattennivån i Mälaren kan komma att bli i ett framtida förändrat klimat. I samband med detta gavs ett underlag för diskussioner om kommande utbyggnader av Mälarens utlopp för att kunna hålla vattennivån under vattendomens högsta föreskrivna nivå även vid ett högre framtida inflöde. Detta uppnåddes genom att genomföra analyser med historiska vattenståndsdata och genom att använda en beräkningsmodell för avtappning, Mälarmodellen, för simulering av ett antal framtida inflödessituationer. Arbetet har genomförts på uppdrag av SMHI.</p><p>Avtappningsmodellen återskapade de höga vattenstånden förhållandevis väl, medan det var svårare att bedöma hur precist den beräknade de allra lägsta vattennivåerna. Ett viktigt resultat från analysen med historiska data var att införandet av regleringen av Mälarens utlopp bidrog till att sänka de höga vattenstånden, men framförallt till att höja de låga. Ett annat resultat från studierna av historiska data var att vattenståndet i Östersjön antar högst nivåer under vintern. Detta i kombination med ett framtida högre inflöde till Mälaren under denna årstid indikerar att störst risk för översvämning kan komma att föreligga under vintern. För att säkert kunna hålla Mälarens vattennivå inom acceptabla gränser måste sjöns utlopp byggas ut. I alla scenarier som har undersökts i det här arbetet kan vattennivån hållas under den högsta föreskrivna nivån om avbördningen utökas till 1 370 m3/s. Det krävs alltså nästan en fördubbling av dagens avbördningskapacitet på 710 m3/s.</p>

L’extinction de l'extension juridique des conventions collectives dans le secteur manufacturier au Québec : le cas de l'industrie du vêtement

Le gouvernement du Québec a adopté en novembre 1999 le projet de loi 47, relatif à la Loi concernant les conditions de travail dans certains secteurs de l’industrie du vêtement et modifiant la Loi sur les normes du travail (1999, c. 57). Son entrée en vigueur eut pour effet d’abroger au 30 juin 2000 les quatre (4) décrets sectoriels de convention collective qui régissaient les conditions d’emploi d’approximativement 23 000 travailleurs affectés à la production de vêtements (gant de cuir, chemise pour hommes et garçons, confection pour hommes et pour dames). Cette recherche démontre que bien qu’inscrit dans une logique étatique de dérégulation du travail visant à favoriser la compétitivité, le maintien de normes de substitution aux décrets dans le cas du vêtement québécois ne dérive pas pour autant d’une déréglementation strictement néolibérale. Au plan plus théorique, l’émergence et le sort du régime de conditions d’emploi étudié dévoilent la nature politique du processus d’élaboration des règles salariales, qu’il soit d’origine législative ou contractuelle. Cette dynamique repose sur le caractère mouvant des relations de pouvoir et d’influence des agents engagés dans la régulation institutionnelle, où l’État est appelé à jouer un rôle de catalyseur ─ et non de tiers arbitre indépendant ─ à l’endroit des tensions qui procèdent du rapport salarial et du mode de production au sein duquel il s’inscrit. / In November 1999, the Government of Quebec has adopted the bill 47 related to the Act respecting conditions of employment in certain sectors of the clothing industry which amended the Act respecting labour standards (1999, c. 57). On June 30 2000, after the bill came into force, the four (4) sectoral decrees regulating the terms of employment of approximately 23,000 workers in apparel production were repealed (leather glove, men’s and boy’s shirt, men’s wear and ladies’s garment). This research demonstrates that even if in line with the deregulation logical of the government aiming to foster competitiveness, the continuation of replacement standards for the decrees in the Quebec’s clothing industry does not stem for all that from a fully neo-liberal deregulation. In a more academic view, the surveyed labour standards plan’s emergence and fate reveal the political nature of the wage rule determination process, legislative or contractual. This dynamics is based on the changeable characteristic of the power relationship and influence of the institutionnal actors involved in the legislative regulation where the State is destined to play an enabler role – and not as an independent referee – in regard of the pressures resulting of the wage labour relationship and the production mode in which this one is embedded.
