An assessment of South Africa’s obligations under the United Nations Convention Against Torture

<p>I attempt to analyze South Africa&rsquo / s legal position pertaining to torture, in relation to the international legal framework. Since it has been established that torture and cruel inhuman and degrading treatment (CIDT) usually occur in situations where persons are deprived of personal liberty, I examine legislation, policies and practices applicable to specific places of detention, such as correctional centres, police custody, repatriation centers, mental health care facilities and child and youth care centers. I establish that although South Africa has ratified the UNCAT and is a signatory to the OPCAT, our legal system greatly lacks in structure and in mechanisms of enforcement, as far as the absolute prohibition and the prevention of torture and other forms of cruel and degrading treatment or punishment are concerned. I submit that South Africa has a special duty to eradicate torture, since many of its citizens and several of its political leaders are actually victims of torture, who suffered severe ill treatment under the apartheid regime. I argue that the South African legal system is sufficiently capable of adopting a zero-tolerance policy toward torture and to incorporate this with the general stance against crime. In many respects, South Africa is an example to other African countries and should strongly condemn all forms of human rights violations, especially torture, since acts of torture are often perpetrated by public officials who abuse their positions of authority. I conclude by making submissions and recommendations for law reform, in light of the obstacles encountered within a South African context.</p>

Avaliação do impacto ambiental gerado por tintas gráficas curadas por radiação ultravioleta ou feixe de elétrons em materiais para embalagens plásticas convencionais ou biodegradáveis pós-consumo / Assessment of environmental impact of ultraviolet radiation or electron beam cured print inks on plastic packaging materials

O alto nível de poluição gerado pelo descarte inadequado de materiais poliméricos vem motivando pesquisas por sistemas e técnicas ambientalmente corretos, tais como a aplicação de polímeros biodegradáveis e a substituição dos sistemas de pintura à base de solventes por aqueles com alto teor de sólidos, à base de água ou, praticamente isentos de compostos orgânicos voláteis (VOCs) e curáveis por radiação. Todavia, os revestimentos poliméricos curados são insolúveis e infusíveis, aumentando o grau de complexidade do seu reprocessamento, da sua reciclagem e da degradação desejável. Assim, este trabalho apresenta, como objeto de contribuição científica, a obtenção de tintas modificadas com agentes pró-degradantes, curadas por reações químicas induzidas por radiação ultravioleta ou feixe de elétrons (UV/EB), para impressão em embalagens plásticas, biodegradáveis ou não, para produtos de baixa vida útil. Foram estudadas combinações de seis revestimentos, sendo um verniz não pigmentado e cinco tintas nas cores amarela, azul, branca, preta e vermelha; três agentes pró-degradantes (estearatos de cobalto, cério e manganês), cinco substratos poliméricos (Ecobras®, polietileno de baixa densidade e suas respectivas modificações com os agentes pró-degradantes). Os revestimentos foram aplicados nos substratos e curados por radiação UV ou EB, resultando em 180 amostras. Estes materiais foram, então, expostos ao envelhecimento acelerado em câmara tipo QUV e à compostagem em ambiente natural. De modo a se compreender o efeito dos revestimentos poliméricos no processo de degradação das amostras, foram selecionadas aquelas com valores extremos de grau de conversão, a saber: amarela e preta, as quais foram expostas à compostagem em ambiente controlado via respirometria, reduzindo de 180 para 16 o número de amostras. O composto orgânico gerado pelo processo de biodegradação foi analisado por testes de ecotoxicidade. Foi observado que a camada de revestimento atua como barreira que inibe a degradação do plástico quando exposto às intempéries. Adicionalmente, constatou-se que quanto maior o grau de conversão das formulações pigmentadas pastosas em sólidas durante a cura por radiação ultravioleta, maior foi sua mineralização em ambiente de compostagem. As amostras curadas por EB apresentaram menor taxa de biodegradação do que as curadas por UV. Isso se deu em virtude da rede de ligações cruzadas entre as cadeias poliméticas, geradas na cura por EB. A adição dos agentes pró-degradantes promoveu uma aceleração no processo de degradação, ocasionando, inclusive, a migração do íon metálico para o meio, porém sem afetar a qualidade do meio de compostagem. / The high level of pollution generated by the inadequate disposal of polymeric materials has motivated the search for environmentally friendly systems and techniques such as the application of biodegradable polymers and the replacement of the solvent-based paint systems by those with high solids content, based water or cured by radiation, practically free of volatile organic compounds. However, the cured polymer coatings are neither soluble nor molten, increasing the complexity of the reprocessing, recycling and degradation. Thus, this work aimed to develop print inks modified with pro-degrading agents, cured by ultraviolet radiation or electron beam, for printing or decoration in plastic packaging products of short lifetime, which are biodegradable or not. Six coatings (varnish and inks in five colors: yellow, blue, white, black and red), three pro-degrading agents (cobalt stearate, cerium stearate and manganese stearate), five polymeric substrates (Ecobras®, low density polyethylene and its respective modifications with pro-degrading agents). The coatings were applied to the substrates and cured by ultraviolet radiation or electron beam, resulting in 180 samples. These materials were then exposed to accelerated aging chamber, type \"QUV\", and composting in natural environment. In order to assess the effects of the polymer coatings on the degradation process of the specimens, only the yellow and black samples were exposed to a controlled composting environment via respirometry, reducing to 16 the number of samples. The organic compound generated by the biodegradation process was analyzed by the ecotoxicity tests. It was observed that the coating layer acted as a barrier that inhibits degradation of the plastic when exposed to weathering. The addition of pro-degrading agents promoted acceleration in the degradation process, promoting the migration of the metal ion to the medium without affecting the final quality of the organic compost.

Les atteintes à l'intégrité des personnes détenues imputables à l'Etat : contribution à la théorie des obligations conventionnelles européennes : l'exemple de la France / The violations of the prisoners’ integrity during custody imputable to the State

Les conditions d'exécution de toute mesure privative de liberté sont déterminantes de son sens et de son efficacité en termes de réinsertion et lutte contre la récidive. La préservation de l'intégrité physique et psychique des personnes détenues constitue un facteur de légitimité indéniable de l'institution carcérale et de son rôle au sein d'une société démocratique. En vertu des articles 2 et 3 de la Convention européenne des droits de l'homme, qui protègent respectivement le droit à la vie et la prohibition des traitements inhumains et dégradants, la jurisprudence européenne a identifié une pluralité d'obligations mises à la charge des États. Les atteintes portées à l'intégrité des personnes détenues dans le cadre de la détention carcérale peuvent être directement imputable à l'État lorsqu'elles résultent du fonctionnement officiel de l'institution, en particulier des fouilles, des placements à l'isolement, des rotations de sécurité, ou des conditions de détention. Elles peuvent aussi lui être indirectement imputables, lorsque la défaillance étatique a permis ou toléré la réalisation d'un acte particulier violant ces droits absolus protégés. L'élaboration des critères d'imputation à l'État de ces atteintes au droit à l'intégrité des personnes détenues et les limites de la responsabilité étatique sont précisément déterminées par la définition et l'intensité des obligations européennes. Si la Cour de Strasbourg apparaît comme le premier facteur de la mutation du droit pénitentiaire et d'une protection renforcée des droits des personnes incarcérées, les lacunes de sa jurisprudence pourraient avoir des effets contradictoires et faire obstacle à l'élaboration d'une théorie cohérente et systématisée des obligations conventionnelles européennes. / The conditions of enforcement of any custodial measure are crucial for its meaning and effectiveness in tenns of reinsertion and the prevention ofreoffending. The preservation of the prisoners' physical and psychological integrity is a source oflegitimacy for the prison institution and its function in a democratic society. Under articles 2 and 3 of the European Convention on Human Rights, which are respectively protecting the right to life and the prohibition of inhuman or degrading treatment, the European Court ofHuman Rights, in its case law, bas identified numerous obligations imposed on Member States. The violations of the prisoners' integrity during custody can be directly imputable to the State when resulting from the official functioning of the institution, especially bodil searches, solitary confinements, security rotations, or conditions of imprisonment. The violations can also be indirectly imputable to the State when its own failure pennitted or tolerated a violation of these absolute rights by a private person. The development of the criteria for violations of prisoners' integrity and the limits of the State responsibility are precisely delineated by the definition and the intensity of European obligations. If the European Court ofHuman Rights appears to be the primary cause of the changing nature of prison and of an increased protection of the prisoners' rights, the loopholes of its case law might have contradictory effects and stand in the way of a coherent theory of the obligations under the European Convention on Human Rights.

Modeling the post shear failure behavior of reinforced concrete columns

Numerous reinforced concrete buildings vulnerable to earthquake induced collapse have been constructed in seismic zones prior to the 1970s. A major contributor to building collapse is the loss of axial load carrying capacity in non-seismically detailed columns. Experimental investigations have shown that non-seismically detailed columns will only experience axial failure after shear failure and subsequent lateral shear strength degradation have occurred. Therefore, column shear failure and degrading behavior must be modeled accurately before axial collapse algorithms can be properly implemented. Furthermore, accurate modeling of the degrading lateral-load behavior of columns is needed if lateral load sharing between structural elements is to be assessed with reasonable accuracy during seismic analyses. A calibrated analytical model was developed that is capable of estimating the lateral strength degrading behavior of RC columns prone to shear failure. Existing analytical models poorly approximate nonlinear column behavior and require several nonphysical damage parameters to be defined. In contrast, the proposed calibrated model provides the engineering community with a valuable tool that only requires the input of column material and geometric properties to simulate column behavior up to loss of lateral strength. In developing the model, a database of RC columns was compiled. Parameters extracted from database column-tests were scrutinized for trends and regression models relating damage parameters to column physical properties and boundary conditions were produced. The regression models were implemented in the degrading analytical framework that was developed in this project. Two reinforced concrete columns exhibiting significant inelastic deformations prior to failing in shear were tested in support of the analytical work. A newly developed Vision System was used to track a grid of targets on the column face with a resolution of three-thousands of an inch. Surface column deformations were measured to further the understanding of the fundamental changes in column behavior that accompany shear and axial failure and validate the proposed analytical model. This research provides the engineering community with an analytical tool that can be used to perform nonlinear dynamic analysis of buildings that are at risk of collapse and help engineers improve retrofit techniques. Further insight into shear behavior attained through this project is an important step toward the development of better shear and axial degradation models for reinforced concrete columns. / text

Approved for public release / The atrocities committed by Americans at Abu Ghraib shocked the collective American moral conscience. Guilty of inhumane treatment of its prisoners there, Abu Ghraib did immeasurable damage to U.S. credibility and made clear that American detainee policy is off-track and needs to comply with objective standards of law, morality, and operational effectiveness. The emotional aftermath of 9/11 created a politically permissive environment within which the military organizational structures was unsuited for the critical tasks assigned to them relative to the context of the Bush Administration’s “new paradigm.” Two issues sit at the forefront of the political context of U.S. detainee policy: war powers and human rights. This thesis will utilize a synthesized decision-making model to analyze the President’s decisions leading to the current detainee policy. Policy alternatives require smaller corrections to bureaucratic process, not a major reorganization of bureaucratic structure. This thesis will provide policy-makers with a moral and legal framework for a corrected detainee policy. Adoption of the full framework of the 1949 Geneva Conventions, including U.S. ratification of Additional Protocols I and II (1977), provides the best framework to combat transnational insurgency, while retaining the moral and legal high ground required of the world’s superpower. / Major, United States Air Force

He also highlights the importance of the threat of torture, which may under certain conditions separately constitute torture. Photocatalytic degradation of dyes and pesticides in the presence of ions

Simultaneous treatment of organic and inorganic contaminants had gradually gained great scientific interest. Advanced oxidation processes such as photocatalysis, using TiO2 as a photocatalyst, have been shown to be very robust in the removal of biorecalcitrant pollutants. These methods offer the advantage of removing the pollutants, in contrast to conventional techniques. At present, the main technical challenge that hinder its commercialization remained on the post-recovery of the photocatalyst particles after water treatment. Supporting of the photocatalyst on the adsorbent surface is important as it assists during the filtration step, reducing losses of the materials and yielding better results in degrading pollutants. To overcome this challenge, in this study composite photocatalysts of TiO2/zeolite and TiO2/silica were prepared and investigated to explore the possible application in the simultaneous removal of organic and inorganic compounds from contaminated water. The main objective of this study was to investigate the heterogeneous photocatalytic degradation of organic compounds in the presence of metal ions using composite photocatalysts. The Brunauer–Emmett–Teller (BET), Scanning Electron Microscopy and Energy Dispersive X-ray (SEM-EDX), Raman spectroscopy (RS) and zeta potential (ZP) analyses were used to characterize the prepared composite photocatalysts. The successive composite photocatalysts were used in a semi-batch reactor under an irradiation intensity of 5.5 mW/m2 (protected by a quartz sleeve) at 25 ± 3°C for the photocatalytic degradation of synthetic textile (methyl orange) and agricultural (atrazine) wastewater in the presence of ions. The effect of operating parameters such as TiO2 composition on supporting material, particle size, composite photocatalyst loading, initial pollutant concentration and pH were optimized. The effects of inorganic salts and humic acid on dye and pesticides degradation were also studied, respectively. The performance of the photocatalyst reactor was evaluated on the basis of color removal, metal ion reduction, total organic carbon (TOC) reduction, intermediates product analysis and modeling of kinetics and isotherms. Different kinetic and isotherm models were introduced and applied in this work. The goal of the research is to analyze the concept, characterization and the current mechanisms to combat this legal, social and economic phenomenon. Since some of the main obstacles to eradicating slavery-like working conditions are the absence of a precise concept of the phenomenon and the difficulty of its characteristics, this paper seeks to introduce the concept and identify the main features of this slavery-like labor, in hopes of contributing to its elimination. According to this paper, the concept of working conditions analogous to slavery outlined in article 149 of the Brazilian Criminal Code, with the wording of Law nº 10.803/2003, is broader than the concept of forced labor conceived by International Labor Organization. Thus, concludes this paper that the Brazilian Criminal Code´s Laws prohibit labor that is either forced or degrading, in essence using the concept of human dignity as its basis for outlawing all forms of modern slavery. This paper also concludes that although Brazil has achieved a prominent position in the fight against slavery-like labor, the legal mechanisms currently in existence to combat contemporary forms of slavery are not sufficient to solve the problem, a problem that is not only legal in scope, but also economic and social. Therefore, this paper defends the use of land expropriation as a mechanism to combat rural working conditions analogous to slavery for two reasons. First, because it represents the main instrument to implement agrarian reform, and, second, because land expropriation constitutes a penalty to the rural property owner who, ignoring the social function, forces workers to labor under slavery-like conditions. This paper uses the deductive method, relying on a qualitative research conducted from a bibliographic review of part of the available legal literature on the subject and from documents obtained in civil investigations and civil actions conducted by the public labor prosecutor. / O objeto da presente dissertação é o estudo do trabalho análogo ao de escravo rural no Brasil do século XXI. O ensaio tem por objetivo analisar o conceito, a caracterização e os mecanismos atualmente utilizados para combater esse fenômeno jurídico, social e econômico. Como dentre os principais entraves à erradicação do trabalho análogo ao de escravo contemporâneo encontram-se a ausência de um conceito preciso do fenômeno e a dificuldade de sua caracterização, a pesquisa procura definir trabalho análogo ao de escravo e indicar suas principais características, na esperança de contribuir para sua eliminação. Para o ensaio, de acordo com o art. 149 do CP, com a redação da Lei nº 10.803/2003, o conceito de trabalho análogo ao de escravo é mais amplo que o conceito de trabalho forçado concebido pela Organização Internacional do Trabalho, abrangendo tanto o trabalho forçado quanto o degradante, já que o principal fundamento para a vedação de todas as formas contemporâneas de escravidão é a dignidade da pessoa humana. Entende-se, ainda, que embora o Brasil tenha alcançado posição de destaque na luta contra o trabalho análogo ao de escravo, os atuais mecanismos jurídicos de combate às formas contemporâneas de escravidão não são suficientes para resolver o problema, que não é apenas de âmbito jurídico, mas também econômico e social. Assim, o estudo defende a utilização da desapropriação agrária como mecanismo de combate ao trabalho análogo ao de escravo rural por duas razões.
