LA CLAUSOLA STATUTARIA DI DRAG ALONG

Il presente lavoro ha ad oggetto l’analisi del fenomeno giuridico della covendita, che, come noto, si è diffuso nella prassi negoziale italiana attraverso il recepimento di talune fattispecie negoziali nate e sviluppatesi negli ordinamenti anglosassoni. In particolare, l’attenzione viene rivolta alle cc.dd. clausole di drag along (o “trascinamento”), le quali si inseriscono nell’ambito delle pattuizioni negoziali che comportano un obbligo di covendita. Le ragioni della scelta di tale tema di ricerca risiedono nella diffusione di questo tipo di clausole nella disciplina dei rapporti societari. In effetti, la redazione di clausole che dispongono un obbligo di covendita rappresenta ormai una tecnica negoziale ampiamente diffusa nella pratica dei negozi acquisitivi di partecipazioni sociali. La clausola di drag along è normalmente inserita all’interno di patti parasociali stipulati laddove venga effettuata un’acquisizione da cui risulti una società partecipata da una pluralità di investitori. Tuttavia, con sempre maggior frequenza, e nell’ambito di una certa tendenza alla “migrazione dal parasociale al sociale” quale effetto della nuova disciplina dei patti parasociali introdotta dalla riforma del diritto societario, questo genere di clausole viene inserito direttamente negli statuti delle società di capitali. Il recepimento a livello statutario della clausola di trascinamento ha posto numerosi interrogativi in ordine alla relativa natura giuridica, validità ed efficacia. In particolare, gli aspetti che hanno costituito oggetto di maggiore attenzione da parte della dottrina e della giurisprudenza sono costituiti dalla collocazione sistematica della clausola statutaria di trascinamento e dalle relative condizioni di validità alla luce dei principi inderogabili dell’ordinamento societario. Un profilo che, invece, non è stato adeguatamente approfondito attiene alla natura “sociale” o “parasociale” di una siffatta clausola statutaria. Si tratta, peraltro, di un aspetto non secondario, atteso che, come cerca di dimostrare il presente lavoro, l’inserimento della clausola di trascinamento all’interno dello statuto sociale non sembrerebbe implicare di per sé il riconoscimento alla medesima di un valore “sociale” e, dunque, imporne automaticamente la valutazione della validità alla stregua del diritto societario. In questa prospettiva, il presente lavoro procede, innanzitutto, ad una ricognizione delle clausole che vengono generalmente ricondotte nel genus della covendita: e ciò, segnatamente, al fine di ricostruire i tratti tipologici delle clausole di drag along, così da distinguerle dalle altre tecniche negoziali ricomprese nell’istituto della covendita. In particolare, si cerca di individuare l’ambito di applicazione di una siffatta clausola e gli interessi economici che essa è in grado di soddisfare. L’indagine compiuta dimostra che la clausola di drag along è di regola estranea alla sfera dell’ordinamento sociale e abitualmente inserita in patti parasociali stipulati da soci di società a struttura chiusa che presentano un elevato grado di investimenti specifici, in ragione della sua inerenza a specifiche operazioni di acquisizione societaria, caratterizzate dal normale interesse dei soci paciscenti alla massimizzazione del valore delle proprie partecipazioni sociali e dal fisiologico disinteresse degli stessi a vincolare i soci presenti e futuri ad un determinato assetto negoziale. Successivamente, alla luce dei risultati raggiunti, obiettivo del lavoro è quello di dimostrare che la clausola statutaria di drag along può assumere carattere sociale o parasociale a seconda del caso concreto. In particolare, tale verifica, compiuta attraverso l’esame dei vari criteri di distinzione del sociale dal parasociale elaborati dalla dottrina e dalla giurisprudenza, porta a ritenere che, al fine di riconoscere un rilievo sociale alla clausola statutaria di drag along, sia necessario che la stessa – oltre ad essere formulata in modo impersonale – soddisfi un ulteriore requisito: e, cioè, sia idonea a rispondere ad interessi sociali, destinati a soddisfare un’esigenza dell’ente o, indistintamente, dei soci in astratto, e non miri, invece, a gestire unicamente specifici rapporti tra soci. Infine, vengono esaminate le conseguenze che derivano sul piano qualificatorio e disciplinare a seconda che la clausola statutaria di drag along assuma, nel caso concreto, carattere “sociale” o “parasociale”. In particolare, l’indagine cerca di dimostrare, da un lato, che, contrariamente a quanto solitamente si ritiene, il patto parasociale di trascinamento – così come la clausola statutaria di drag along di natura parasociale – non pare essere, a rigore, un patto che disciplina le condizioni di “circolazione” delle partecipazioni, ma un patto che regola le condizioni di “investimento” e di “disinvestimento” nella società, essendo normalmente volto a tutelare l’interesse di tutti i soci paciscenti alla massimizzazione del valore delle partecipazioni sociali; dall’altro lato, che la struttura funzionale della clausola statutaria di drag along di carattere sociale presenta delle analogie rispetto alla struttura funzionale degli istituti giuridici del riscatto azionario e dell’esclusione del socio di s.r.l., dovendosi pertanto ritenere valida nella misura in cui sia compatibile con il principio dell’equa valorizzazione della partecipazione obbligatoriamente dismessa che si ricava dagli artt. 2437 sexies e 2473 bis c.c. / The present work relates to the legal analysis of the phenomenon of co-sale, which, as noted, it is common practice in negotiating through the implementation of certain Italian case negotiating created and developed in the Anglo-Saxon legal systems. In particular, attention is paid to cc.dd. drag along clauses (or "drag"), which are part of the negotiating stipulations that imply an obligation of co-sale. The reasons for the choice of research topic that reside in the spread of such clauses in the discipline of corporate relationships. In fact, the wording of clauses that have an obligation to co-sale is now negotiating a technique widely used in the practice of shopping acquisitive of shareholdings. The drag along clause is normally included in shareholders' agreements concluded when an acquisition is made, which result in a company owned by several investors. However, with increasing frequency, and within a certain tendency to "migrate from the parasocial to social" as a result of the new discipline of shareholders' agreements introduced by the reform of company law, such clauses are inserted directly into the statutes of the company capital. The implementation of the statutory provision at the drag posed numerous questions as to its legal, valid and effective. In particular, the aspects that have been the subject of increased attention by the doctrine and jurisprudence are constituted by the systematic position of the statute and the drive conditions of its validity in the light of the overriding principles of corporate order. A profile, however, has not been adequately thorough regards the "social" or "parasocial" of such a statute. It is, however, an important aspect, since, as this paper seeks to demonstrate, the inclusion of the clause in the bylaws do not drag would seem to imply the recognition of itself to the same value of a "social "and, therefore, automatically impose the same way as the evaluation of the validity of corporate law. In this perspective, this work proceeds, first, a survey of the clauses that are generally traced in the genus of the co-sale, and this, in particular, in order to reconstruct the typological features of the drag along clauses, so as to distinguish them from other negotiating techniques covered in the institution of co-sale. In particular, it seeks to identify the scope of such a clause and the economic interests that it is able to satisfy. The investigation carried out shows that the drag along clause is generally alien to the sphere of social order and usually included in shareholders' agreements concluded by shareholders of companies with a closed structure with a high degree of specific investments, because of its inherent specific corporate acquisitions, characterized by normal partners' interest in maximizing the value of their shareholdings and physiologically the same selflessness to bind the shareholders present and future negotiations to a specific structure. Later, in the light of the results achieved, goal of the work is to demonstrate that the statute can take to drag along social or agreement depending on the case. In particular, the verification process, accomplished through the examination of the various criteria of social distinction by the agreement drawn up by the doctrine and case law, leads to the belief that in order to recognize a social relevance to the statute of drag along, it is necessary that the same - as well as being formulated in an impersonal way - to fulfill an additional requirement: it is, is likely to respond to social interests, to meet a need or entity, without distinction of members in the abstract, and is not intended, however to handle only specific relationships between members. Finally, we examined the consequences on the level and discipline depending on whether the statute assumes drag along, in this case, "social" or " parasocial ". In particular, the survey seeks to demonstrate, firstly, that, contrary to what is usually considered the shareholders 'drag - as well as the statute of nature to drag along' agreement - does not seem to be, strictly speaking, a covenant governing the conditions of "circulation" of the investments, but a pact that regulates the conditions of "investment" and "disinvestment" in society, being generally aimed at protecting the interest of all shareholders to maximize the value of equity, on the other hand, the functional structure of the statute to drag along for social presents similarities with respect to the functional structure of legal institutions and the exclusion of equity of redemption partner srl, having to therefore be considered valid to the extent that both compatible with the principle of fair value of the investment which is made mandatory abandoned by the articles 2437 sexies e 2473 bis c.c.

Innebandy är en växande idrott, som framför allt utövas i Sverige, Finland och Schweiz, men där väldigt lite forskning ännu finns publicerad. Tidigare studier inom ishockey och baseboll har visat att träning med viktmanipulerad utrustning förbättrat bland annat greppstyrka och svinghastigheten av slagträ i baseboll. Annan forskning har visat på att det är en förbättring i det neuromuskulära samspelet snarare än ökad muskelmassa som förbättrat prestationen vid dynamisk motståndsträning. Skotthastigheten anses vara en viktig faktor inom innebandy för prestationen och eftersom det inom baseboll har visats att viktmanipulerad utrustning kan förbättra svinghastigheten så vore det intressant att se om samma resultat kan uppnås inom innebandy. Syftet med studien var att undersöka effekten av innebandyträning med en viktmanipulerad innebandyklubba med avseende på dragskottshastighet och greppstyrka hos manliga innebandyspelare samt undersöka korrelationen mellan dragskottshastighet och greppstyrka. Även testpersonernas subjektiva uppfattning av träningen med den viktmanipuleradeutrustningen undersöktes. Testgruppen bestod av 13 stycken 17-åriga manliga innebandyspelare. Under en sex veckors period genomförde testpersonerna 30 minuter av sin vanliga innebandyträning med den viktmanipulerade klubban (40 gram tyngre) tre gånger i veckan. Dragskotten filmades med en höghastighetskamera (Casio Exilim EX-FH25) med 250 fps och analyserades sedan i Dartfish för att mäta hastigheten. För att fastställa greppstyrkan användes en handdynamometer (Jamar – Baseline Hydraulic Hand Dynamometer). Träningen resulterade i en signifikant skillnad hos testpersonernas greppstyrka i den nedre handen på klubban (p<0,05). Däremot hittades ingen signifikant skillnad för den övre handens greppstyrka eller dragskottshastigheten. Studien visade heller inte på någon korrelation mellan dragskottshastighet och greppstyrka hos testpersonerna. Testpersonerna hade olika åsikter kring hur den extra tyngden påverkade innebandytekniken.De funna resultaten indikerar att träning med viktmanipulerad utrustning i innebandy signifikant förbättrar spelarnas greppstyrka i den nedre handen. Den ökade kraftutvecklingen kan eventuellt förklaras av ett ökat neuromuskulärt samspel. Studien ger en ökad förståelse för hur dynamisk motståndsträning kan implementeras i den dagliga innebandyträningen, vilket kan tillämpas vid planeringen av träningsprogram. / Floorball is a sport with increasing number of participants, which has not been studied extensively according to the literature. Previous studies on ice hockey and baseball have shown that training with weight manipulated equipment improved grip strength and swing speed. Other research has shown that the increased performance with dynamic resistance training rather occurs from the improvements in the neuromuscular facilitation than an increase in muscle mass. In floorball shooting velocity is considered to be an important factor of the performance. Since it has been shown in baseball that training with weight manipulated equipment can improve the bat velocity, it would be interesting to see if the same results can be found in floorball. The purpose of this study was to investigate the effect of grip strength and drag shot velocity in floorball training with a weight manipulated floorball stick. The study also investigated the relationship between grip strength and drag shot velocity. The test subjects’ subjective perception about the training method was also investigated. Thirteen 17-year-old male floorball players participated in the study. During a six weeks period the subjects used the weight manipulated equipment during 30 minutes, three times per week during their regular team practice. 40 grams lead tape was attached to the player's equipment to increase the resistance. The drag shots were filmed with a high speed camera (Casio Exilim EX-FH25) at 250 fps. The drag shot velocity was analyzed in Dartfish. To assess grip strength a hand dynamometer (Jamar - Baseline Hydraulic Hand Dynamometer)was used. The training resulted in a significant increase for the subjects’ grip strength in the lower hand on the stick (p <0,05). The study found no significant difference for the upper hand grip strength or drag shot velocity. No correlation between drag shot velocity and handgripstrength among the subjects were found. Conclusion: The results found in this study indicate that training with weight manipulated equipment can significantly improve the player’s lower hand grip strength. The results can eventually be explained by more effective fiber recruitment in the muscles. Studying floorball can contribute to increase the interest in research on floorball and increase the understanding for how dynamic resistance training can be incorporated in daily floorball practice.

Uncertainty Propagation in Hypersonic Flight Dynamics and Comparison of Different Methods

In this work we present a novel computational framework for analyzing evolution of uncertainty in state trajectories of a hypersonic air vehicle due to uncertainty in initial conditions and other system parameters. The framework is built on the so called generalized Polynomial Chaos expansions. In this framework, stochastic dynamical systems are transformed into equivalent deterministic dynamical systems in higher dimensional space. In the research presented here we study evolution of uncertainty due to initial condition, ballistic coefficient, lift over drag ratio and atmospheric density. We compute the statistics using the continuous linearization (CL) approach. This approach computes the jacobian of the perturbational variables about the nominal trajectory. The covariance is then propagated using the riccati equation and the statistics is compared with the Polynomial Chaos method. The latter gives better accuracy as compared to the CL method. The simulation is carried out assuming uniform distribution on the parameters (initial condition, density, ballistic coefficient and lift over drag ratio). The method is then extended for Gaussian distribution on the parameters and the statistics, mean and variance of the states are matched with the standard Monte Carlo methods. The problem studied here is related to the Mars entry descent landing problem.

Investigations On Film Cooling At Hypersonic Mach Number Using Forward Facing Injection From Micro-Jet Array

A body in a hypersonic flow field will experience very high heating especially during re-entry. Conventionally this problem is tackled to some extent by the use of large angle blunt cones. At the cost of increased drag, the heat transfer rate is lower over most parts of the blunt body, except in a region around the stagnation point. Thus even with blunt cones, management of heat transfer rates and drag on bodies at hypersonic speeds continues to be an interesting research area. Various thermal protection systems have been proposed in the past, like heat sink cooling, ablation cooling and aerospikes. The ablative cooling system becomes extremely costly when reusability is the major concern. Also the shape change due to ablation can lead to issues with the vehicle control. The aerospikes themselves may become hot and ablate at hypersonic speeds. Hence an alternate form of cooling system is necessary for hypersonic flows, which is more feasible, cost effective and efficient than the conventional cooling systems. Injection of a mass of cold fluid into the boundary layer through the surface is one of the potential cooling techniques in the hypersonic flight corridors. These kinds of thermal protection systems are called mass transfer cooling systems. The injection of the mass may be through discrete slots or through a porous media. When the coolant is injected through a porous media over the entire surface, the coolant comes out as a continuous mass. Such a cooling system is also referred as “transpiration cooling system”. When the fluid is injected through discrete slots, the system is called as “film cooling system”. In either case, the coolant absorbs the incoming heat through its rise in enthalpy and thus modifies the boundary layer characteristics in such a way that the heat flow rate to the surface is less. Injection of a forward facing jet (opposite to the freestream direction) from the stagnation point of a blunt body can be used for mitigating both the aerodynamic drag and heat transfer rates at hypersonic Mach numbers. If the jet has enough momentum it can push the bow shock forward, resulting in reduced drag. This will also reduce heat transfer rate over most part of the body except around the jet re-attachment region. A reattachment shock impinging on the blunt body invariably increases the local heat flux. At lower momentum fluxes the forward facing jet cannot push the bow shock ahead of the blunt body and spreads easily over the boundary layer, resulting in reduced heat transfer rates. While the film cooling performance improves with mass flow rate of the jet, higher momentum flow rates can lead to a stronger reattachment leading to higher heat transfer rate at the reattachment zone. If we are able to reduce the momentum flux of the coolant for the same mass flow rate, the gas coming out can easily spread over the boundary layer and it is possible to improve the film cooling performance. In all the reported literature, the mass flow rate and the momentum flux are not varied independently. This means, if the mass flow rate is increased, there is a corresponding increase in the momentum flux. This is because the injection (from a particular orifice and for a particular coolant gas) is controlled only by the total pressure of injection and free stream conditions. The present investigation is mainly aimed at demonstrating the effect of reduction in momentum of the coolant (injected opposing a hypersonic freestream from the stagnation point of a blunt cone), keeping the mass flow rate the same, on the film cooling performance. This is achieved by splitting a single jet into a number of smaller jets of same injection area (for same injection total pressure and same free stream conditions). To the best of our knowledge there is no report on the use of forward facing micro-jet array for film cooling at hypersonic Mach numbers. In this backdrop the main objectives of the present study are: • To experimentally demonstrate the effect of splitting a single jet into an array of closely spaced smaller micro-jets of same effective area of injection (injected opposite to a hypersonic freestream from the stagnation zone), on the reduction in surface heat transfer rates on a large angle blunt cone. · Identifying various parameters that affect the flow phenomenon and doing a systematic investigation of the effect of the different parameters on the surface heat transfer rates and drag. Experimental investigations are carried out in the IISc hypersonic shock tunnel on the film cooling effectiveness. Coolant gas (nitrogen and helium) is injected opposing hypersonic freestream as a single jet (diameter 2 mm and 0.9 mm), and as an array of iv micro jets (diameter 300 micron each) of same effective area (corresponding to the respective single jet). The coolant gas is injected from the stagnation zone of a blunt cone model (58o apex angle and nose radius of 35 mm). Experiments are performed at a flow freestream Mach number of 5.9 at 0o angle of attack, with a stagnation enthalpy of 1.84 MJ/Kg, with and without injections. The ratios of the jet stagnation pressure to the pitot pressure (stagnation pressure ratio) used in the present study are 1.2 and 1.45. Surface convective heat transfer measurements using platinum thin film sensors, time resolved schlieren flow visualization and aerodynamic drag measurements using accelerometer force balance are used as flow diagnostics in the present study. The theoretical stagnation point heat transfer rate without injection for the given freestream conditions for the test model is 79 W/cm2 and the corresponding aerodynamic drag from Newtonian theory is 143 N. The measured drag value without injection (125 N) shows a reasonable match with theory. As the injection is from stagnation zone it is not possible to measure the surface heat transfer rates at the stagnation point. The sensors thus are placed from the nearest possible location from the stagnation point (from 16 mm from stagnation point on the surface). The sensors near the stagnation point measures a heat transfer rate of 65 W/cm2 on an average without any injection. Some of the important conclusions from the study are: • Up to 40% reduction in surface heat transfer rate has been measured near the stagnation point with the array of micro jets, nitrogen being the coolant, while the corresponding reduction was up to 30% for helium injection. Considering the single jet injection, near the stagnation point there is either no reduction in heat transfer rate or a slight increase up to 10%. · Far away from stagnation point the reduction in heat transfer with array of micro-jets is only slightly higher than corresponding single jet for the same pressure ratio. Thus the cooling performance of the array of closely spaced micro jets is better than the corresponding single jet almost over the entire surface. • The time resolved flow visualization studies show no major change in the shock standoff distance with the low momentum gas injection, indicating no major changes in other aerodynamic aspects such as drag. · The drag measurements also indicate that there is virtually no change in the overall aerodynamic drag with gas injection from the micro-orifice array. · The spreading of the jets injected from the closely spaced micro-orifice array over the surface is also seen in the visualization, indicating the absence of a region of strong reattachment. · The reduction in momentum flux of the injected mass due to the interaction between individual jets in the case of closely spaced micro-jet array appears to be the main reason for better performance when compared to a single jet. The thesis is organized in six chapters. The importance of film cooling at hypersonic speeds and the objectives of the investigation are concisely presented in Chapter 1. From the knowledge of the flow field with counter-flow injection obtained from the literature, the important variables governing the flow phenomena are organized as non-dimensional parameters using dimensional analysis in Chapter 2. The description of the shock tunnel facility, diagnostics and the test model used in the present study is given in Chapter 3. Chapter 4 describes the results of drag measurements and flow visualization studies. The heat transfer measurements and the observed trends in heat transfer rates with and without coolant injection are then discussed in detail in Chapter 5. Based on the obtained results the possible physical picture of the flow field is discussed in Chapter 6, followed by the important conclusions of the investigation.

Electron transport in graphene transistors and heterostructures : towards graphene-based nanoelectronics

Two graphene layers placed in close proximity offer a unique system to investigate interacting electron physics as well as to test novel electronic device concepts. In this system, the interlayer spacing can be reduced to value much smaller than that achievable in semiconductor heterostructures, and the zero energy band-gap allows the realization of coupled hole-hole, electron-hole, and electron-electron two-dimensional systems in the same sample. Leveraging the fabrication technique and electron transport study in dual-gated graphene field-effect transistors, we realize independently contacted graphene double layers separated by an ultra-thin dielectric. We probe the resistance and density of each layer, and quantitatively explain their dependence on the backgate and interlayer bias. We experimentally measure the Coulomb drag between the two graphene layers for the first time, by flowing current in one layer and measuring the voltage drop in the opposite layer. The drag resistivity gauges the momentum transfer between the two layers, which, in turn, probes the interlayer electron-electron scattering rate. The temperature dependence of the Coulomb drag above temperatures of 50 K reveals that the ground state in each layer is a Fermi liquid. Below 50 K we observe mesoscopic fluctuations of the drag resistivity, as a result of the interplay between coherent intralayer transport and interlayer interaction. In addition, we develop a technique to directly measure the Fermi energy in an electron system as a function of carrier density using double layer structure. We demonstrate this method in the double layer graphene structure and probe the Fermi energy in graphene both at zero and in high magnetic fields. Last, we realize dual-gated bilayer graphene devices, where we investigate quantum Hall effects at zero energy as a function of transverse electric field and perpendicular magnetic field. Here we observe a development of v = 0 quantum Hall state at large electric fields and in high magnetic fields, which is explained by broken spin and valley spin symmetry in the zero energy Landau levels. / text

Kadangi analizuojamas dvivietis eksperimentinis akrobatinis lėktuvas, tikintis geresnių rodiklių, pasirinktas palyginimo objektas  dvivietis akrobatinis mokomasis lėktuvas SU 29. Remiantis šio lėktuvo esamomis charakteristikomis ir parametrais, pateikiamos išvados ir siūlymai. / The thesis examines the aerodynamics of future experimental aerobatic aircraft. Featured in such areas (topics): proper selection of an aircraft wing profile, the required form of the wing, the wing's future performance and parameter estimation, other aircraft parts and their impact on the entire plane dynamics analysis. Rural Drag: Settler Colonialism and the Queer Rhetorics of Rurality

In the United States, rural culture is frequently thought of as traditional and “authentically” American. This belief stems from settler colonial histories in which Native lands are stolen and “settled” by white colonial communities. Through this process, the rugged “frontier” becomes a symbol of American identity, and rural communities become the home of “real” Americans. Because settler colonization is invested in maintaining systems of white supremacy, sexism, and heteropatriarchy, these “real” Americans are figured as normatively white and straight. This dissertation analyzes the rhetorical construction of rurality in the United States, specifically focusing on the ways in which settler colonial histories shape national discussions of rural sexuality. I theorize a rhetorical practice I call rural drag, a process by which individuals in settler society can assert membership in white heteropatriarchy by performing “rurality.” I trace the development of this rhetorical practice through three case studies. In the first, I analyze 19th-century Texan legislative writings during the creation of Texas A&M University. These writings and related correspondences reveal a baseline of white supremacist and settler colonial rhetorics upon which the university established its ethos. In the second, I look at how these rhetorics continue to inform performances of sexuality and gender at Texas A&M. These performances derive from earlier rhetorical practices designed to create a space for white settler privilege. Together, these two case studies suggest that rhetorical practices shape and are shaped by the spaces in which they are practiced and the rhetorical histories of these spaces. In my final case study, I interrogate national discourses of rurality through an analysis of country western music to show how rhetorics of rurality are simultaneously local and national. I conclude by challenging scholars of rhetoric and queer studies to recognize that the relationship between rhetoric and place is key to recognizing our relationship to privilege and oppression in the United States. To further this, I propose a decolonial queerscape pedagogy that accounts for the multiple overlays of sexual identities and practices that travel through the academy while challenging the colonial histories and actions upon which the academy is built.

This dissertation presents an investigation into two so-called live art works – Ugly girl at the rugby (1998) and Chandelier (2001-2002) – by the contemporary South African artist Steven Cohen (1962-). These works are explored with reference to the manner in which Cohen (as self-declared queer Jewish freak) uses performance art as a form of activism in order to expose practices of marginalisation and suppression (oppression) of non-normative or so-called deviant subject positions in terms of gender, race and ethnicity. The analysis of artworks is guided by the discourse of the carnavalesque and performative conceptualisations of gender with particular emphasis on Cohen’s use of drag as contemporary form of masquerade in order to propose an alternative subject position. The argument is as follows: that Cohen, by setting up an extreme alternative to normative identity constructs, manages to destabilise existing hierarchies that are structured according to binaries as these exist in spaces (such as a rugby stadium and a squatter camp) in the South African context. This destabilising of binary hierarchies gives rise to the argument that the symbolically encoded nature of spaces known for associations of suppression, exclusion and marginalisation are wrought open so that alternative meanings can come into being by activating these spaces as multifaceted and chronotopic constructs.
