La BCE et l’Eurosystème : exemple d’intégration verticale / The ECB and the Eurosystem : example of vertical integration

La banque centrale européenne (bce) n'est pas une institution au sens des traités communautaires. pourtant elle dispose, à l'image des institutions, de pouvoirs législatifs et exécutifs. au sens du droit communautaire, la bce est un <<organe>>, elle jouit donc de la personnalité juridique. dans le paysage institutionnel de l'union, la bce est la seule à disposer à la fois de pouvoirs législatifs et exécutifs et de la personnalité morale. il convient de ce fait de se poser la question de la place de la bce dans ce paysage institutionnel. de plus, les pouvoirs de la bce et leur exercice sont extrêmement flous. tout d'abord, la bce partage certains pouvoirs avec le conseil ecofin, qui lui mêne en partage avec l'eurogroupe. ensuite, les pouvoirs de la bce sont exercés soit par le conseil des gouverneurs, soit par le directoire. les décisions prises par ces organes, sont ensuite mises en oeuvre par la bce elle même ou par les banques centrales nationales. il se pose donc la question des réels pouvoirs de la bce, du fait de son intégration au sein du système européen de banques centrales. beaucoup d'auteurs ont apporté des réponses à ces questions, la bce : banque centrale de la communauté, la bce autorité administrative indépedante, le bce communauté internationale à part. malgré, l'intérêt de ces travaux aucun n'a pris en compte la bce dans sa globalité et dans sa complexité. notre travail de tèse se propose de reprendre l'ensemble des questions relatives à la place de la bce dans les institutions et organes de l'union, afin de mieux définir et comprendre cet organe à part. / The Eurosystem is a unique structure of European Union law which includes the central banks of States that have adopted the euro and the European Central Bank. A theoretical study of the evolution of the exercise of power within the Union demonstrates the emergence of a new methode of integration called "vertical integration." In a dialectical process between theory and reality of the Eurosystem, the main features of the the vertical integration method can be tested and its main qualities and defects disclosed.The method of vertical integration led to the construction of sub-systems composed of national bodies and body of the Union. The method operates in four directions. The sub- system thereby producted relates formally and functionally to the EU and operates in a specific sector which imposes the specificities of its action. It can be said "organized" (its components are interconnected by complex interrelationships guaranteeing the unity and effectiveness of the system). It is independent from the states as it is from the political institutions of the Union.The study of the Eurosystem through this perspective allows to elucidate the nature of this unusual construction whose action in crises - the financial crisis and the sovereign debt crisis - was crucial. Such research can also highlight, under a new perspective, the recent developments in the institutional system of the EU as a whole.

Dopad změn směnných kurzů na vzorek českých společností / The impact of changing exchange rates on Czech companies

This thesis analyses impact of exchange rate exposure in Czech Republic on sample of ten Czech companies. Empirical part of thesis builds on Nazl, Kar, Akel (2014) and through market-based approach states significant impact of exchange rate exposure for 40 % of companies. Higher robustness of results was achieved through improvements in the methodology which, contrary to related literature, eliminates endogeneity of market index through instrumental variable. Surprisingly, the correlations between exchange rates and stocks of Czech companies are positive. An alternative model considering ROA of individual companies as dependent variable was used to confirm these results. The resulting impact of exchange rate exposure of alternative model is opposite. This inconsistency of the results of both models is confusing. The sudden change in exchange rate policy of the Czech National Bank in November 2013 did not affect the sensitivity of the relationship between exchange rates and stocks. The reaction of stock market in November 2013 indicates that policy change made by CNB was not entirely expected. Contrary to the related literature, higher data aggregation decreases the significance of the exchange rate exposure, signifying higher ability of Czech companies to reduce exchange rate risk in longer...

Avec le lancement du Partenariat Euro-Méditerranéen (PEM) en 1995, les relations entre l’Union européenne et les Pays tiers méditerranéens (PTM) connaissent une évolution notable. Du fait de la mise en place d’un cadre multilatéral complété par la conclusion des accords d’association, ce Partenariat représente une rupture avec les politiques méditerranéennes antérieures. Dans le contexte du cinquième élargissement de l'Union européenne du 1er mai 2004, la Politique Européenne de Voisinage (PEV) transforme le PEM en préconisant la création d’un cercle d'amis avec les voisins méditerranéens du Sud et les nouveaux voisins de l’Est. Ce métissage est le résultat de la rencontre entre deux cadres à objectifs différents et contextes géostratégiques différents : le PEM comme cadre de coopération régionale établi dans les années quatre-vingt-dix et une PEV en tant que politique de l’UE employant les méthodologies issues du processus de préadhésion. Les transformations des relations euro-méditerranéennes après la PEV ont permis l'émergence progressive d'une nouvelle forme relationnelle avec un impact contrasté sur les dimensions bilatérale et multilatérale du PEM. Cette étude définit le résultat de cette nouvelle dynamique interactive des politiques de l’UE sous le nom de cadres de voisinage euro-méditerranéens. La délimitation des cadres de voisinage euro-méditerranéens passe par l’analyse des transformations des relations après le cinquième élargissement en distinguant la dimension multilatérale de la dimension bilatérale. Si la dimension régionale euro-méditerranéenne post-élargissement n’est que partiellement affectée par la PEV, la dimension bilatérale est, quant à elle, profondément modifiée par l’instauration progressive d’un cadre relationnel à mi-chemin entre l’association et l’adhésion. / With the launch of the Euro-Mediterranean Partnership (EMP) in 1995, the relation between the relationship between the EU and Mediterranean countries witnessed a significant evolution. With the establishment of a multilateral framework supplemented by the conclusion of association agreements, this Partnership represents a break with past Mediterranean policies. In the context of the fifth enlargement of the European Union on May 1st, 2004, the European Neighbourhood Policy (ENP) transforms the PEM; advocating for the creation of a circle of friends with Mediterranean neighbors in the South and the new neighbors in the East. This mix is the result of the encounter between two frameworks with different objectives in different geo-strategic contexts: the EMP as a regional cooperation framework established in the nineties on one hand and the ENP, i.e. an EU policy using the pre-accession process methodologies on the other hand. The transformation of Euro-Mediterranean relations after the ENP allowed for the gradual emergence of a novel relational framework with a mixed impact on the bilateral and multilateral dimensions of the EMP. This study defines the result of this new interactive dynamic of the EU policies falling under the Euro-Mediterranean neighbourhood framework. The delimitation of the Euro-Mediterranean neighbourhood frameworks involves the study of the transformations in the relations following the fifth enlargement, distinguishing between multilateral and bilateral dimensions. While the Euro-Mediterranean regional dimension post-enlargement is only partially affected by the ENP, the bilateral dimension is, in turn, profoundly changed by the progressive introduction of a relational framework halfway between the association and the membership.

Questo lavoro analizza le relazioni tra Stati Uniti ed alleati europei dal 1989 ad oggi, con particolare approfondimento del periodo successivo all'undici settembre 2001. L'ipotesi di ricerca è basata sulla convinzione che gli attentati del 2001 abbiano avuto un impatto fondamentale sulla relazione euro-atlantica, accelerando tendenze centrifughe già presenti nel rapporto. La tesi è composta da un'analisi storica, da sette capitoli e dalle conclusioni. L'analisi storica esamina i cambiamenti strutturali nella relazione transatlantica dopo il 1989. I capitoli 1 e 2 presentano le correnti politiche determinanti nel formulare la politica estera americana dopo il 2001, con particolare riferimento al movimento neoconservatore. I capitoli 3 e 4 analizzano la definizione di impero moderno , la questione se gli Stati Uniti siano o meno un impero e la possibilità che l'Unione europea (UE) diventi una superpotenza. I capitoli 5, 6 e 7 approfondiscono tre nodi gordiani : il futuro della NATO; la Russia tra Stati Uniti e UE; e la relazione triangolare tra Stati Uniti, Cina e UE. Infine, le conclusioni riassumono le debolezze del rapporto tra Stati Uniti ed alleati europei, evidenziano come esse siano peggiorate dopo gli attentati del 2001 e presentano i pericoli in cui la relazione potrebbe incorrere in futuro. / This dissertation studies the relationship between the United States and its European allies from the end of the Cold War to the present, with a focus on the period following the terror attacks on September 11, 2001. The primary conclusion is that 9/11 accelerated divisive trends within transatlantic alliance. The dissertation has an historical introduction, seven chapters and the conclusions. The historical introduction analyzes the structural changes occurred within the transatlantic relationship after 1989. Chapters 1 and 2 discuss the political movements and ideas that shaped American foreign policy after 9/11, with a focus on the neoconservative movement. Chapters 3 and 4 define the idea of modern empire ; its use in reference to the United States; and the idea that the European Union is becoming a superpower able to counterbalance the United States. Chapters 5, 6 and 7 focus on three looming challenges within the transatlantic relationship: the future of NATO; relations with Russia; and the rise of China. The conclusions summarize the weaknesses of the relationship between the United States and its European allies; highlight how they deteriorated after 9/11; and describe the dangers that lay ahead for the transatlantic alliance.

The scope of this diploma thesis is design and processing of the project documentation of the guesthouse along with coffee shop. The proposed object of this thesis is located in the village Čeladná next to the golf course Prosper Golf Resort Čeladná, in the location designated for mixed constructions. One of the double-storeyed, non-cellular object with roofed surface and steep roof. The object is based on the base stripes made of plain concrete and on the reinforced concrete flaps. Carrying, perihepral and dividing walls are designed on the Velox systém. The same systém was used to design roof constructions. In the rooms with excessive width are filled with reinforced concrete columns. Part of the guesthouse and second floor of the coffee shop is designed with ventilated facade with wood paneling ThermoWood. The object is divided in two parts with common entrance section. One part of the coffee shop has ability to handle capacity of 70 guests. Part of the double-storeyed coffee shop is hygienic facilities, kitchen, room for employees, warehouse and mechanical ventilation. Second part of the object is the guesthouse with flat of the manager of the guesthouse. The guesthouse consists of room with hygienic facilities for 18 people, including barrier-free room. The rooms are divided in the first floor on separate units, the rooms with hygienic facilities and the apartments in the second floor has two rooms, kitchen and hygienic facilities. For the next parts of the guesthouse is warehouse clean and dirty laundry and shared kitchen. The whole first floor is designed as barrier-free. In front of the object is the parking lot for 21 cars, which 3 of the parking places are for the cars of the disabled.

Les relations euro-marocaines à l’aune de la politique européenne de voisinage / Euro-Moroccan relations in the light of the European Neighbourhood Policy

Le grand élargissement de 2004 et la perspective d’une Europe élargie ont amené l’Union européenne (UE) à imaginer un cadre contractuel d’action homogène pour les voisins de l’Est et du Sud dénommée la politique européenne de voisinage (PEV). L’objectif de la PEV est d’éviter l’émergence de nouvelles lignes de division entre l'UE élargie et ses nouveaux voisins, mais également d’encourager la stabilité politique, la sécurité et la prospérité économique dans son voisinage. Il s'agit d'une stratégie incitative fondée sur une plus grande différenciation visant à encourager les réformes politiques et économiques internes. Dans le cadre de la PEV, l’UE propose au Maroc, à travers le statut avancé (SA), une relation privilégiée à mi-chemin entre association et adhésion basée sur l’acquis du Processus de Barcelone (PB). Les transformations des relations euromarocaines après la PEV ont permis l’émergence progressive d’une nouvelle forme relationnelle avec un impact positif sur la dimension bilatérale du partenariat euro-méditerranéen (PEM). Entre complémentarité et substitution, c’est la question de l’articulation entre les deux processus qui est au centre de notre étude. Outre cette problématique, le SA qui incarne la PEV suscite des incertitudes quant à sa finalité. Ce partenariat privilégié a pour finalité de mettre le Maroc dans une situation comparable à celle des États candidats à l’adhésion sans perspective d'adhésion. Dans un contexte international en pleine mutation et face à l’émergence d’autres puissances en Méditerranée, l’UE devrait repenser sa PEV, identifier un projet clair et cohérent visant à structurer les relations euro-méditerranéennes de demain. / The great 2004 enlargement and the prospect of an enlarged Europe led the European Union (EU) to imagine a uniform contractual framework for action for the neighboring Eastern and Southern named the European Neighbourhood Policy (ENP). The objective of the ENP is to avoid the emergence of new dividing lines between the enlarged EU and its new neighbors, but also to encourage political stability, security and economic prosperity inits neighborhood. It is an incentive strategy based on greater differentiation to encourage internal political and economic reforms. Under the ENP, the EU proposes to Morocco, through the Advanced Status (AS), a privileged relationship midway between association and membership based on the acquis of the Barcelona Process (BP). The transformation of Euro-Moroccan relations after the ENP allowed for the gradual emergence of a novel relational framework with a positive impact on the bilateral dimension of the Euro-Mediterranean Partnership (EMP). Between complementarity and substitution, the question of the relationship between the two processes is central in our study. In addition to this addressed question, the AS that embodies the ENP, creates uncertainty to its purpose. This special partnership aims at putting Morocco in a situation such that of the States applying for accession without membership prospects. In an international context, changing with the emergence of other powers in the Mediterranean, the EU should rethink its ENP, identify a clear and coherent plan to structure the Euro-Mediterranean relations in the future.

Étude paléopathologique préliminaire à travers l'analyse macroscopique et scanographique : exemple du cimetière St. Matthew, ville de Québec (1771-1860)

Sachant que plusieurs maladies entrainent des lésions qui ne sont pas toujours observables à l’oeil, cette étude préliminaire en paléopathologie humaine utilise une approche complémentaire issue de l’imagerie médicale, le ct-scan, afin de fournir des diagnostics plus précis. L’objectif est donc de tester ici l’efficacité et les limites de l’analyse scanographique durant l’analyse de spécimens archéologiques. Un échantillon de 55 individus a été sélectionné à partir de la collection ostéologique provenant du cimetière protestant St. Matthew (ville de Québec, 1771 – 1860). Une analyse macroscopique et scanographique complète a alors été effectuée sur chaque squelette. Les observations macroscopiques ont consisté à enregistrer une dizaine de critères standardisés par la littérature de référence en lien avec des manifestations anormales à la surface du squelette. Les ct-scans ont été réalisés à l’Institut National de la Recherche Scientifique de la Ville de Québec avec un tomodensitomètre Somatom de Siemens (définition AS+ 128). Les données scanographiques ont permis d’enregistrer une série de critères complémentaires sur la structure interne de l’os (amincissement/épaississement de la corticale, variation de densité, etc.) Selon la méthode du diagnostic différentiel, des hypothèses ou diagnostics ont été proposés. Ils sont principalement basés sur les critères diagnostiques mentionnés dans les manuels de référence en paléopathologie, mais aussi à l’aide de la littérature clinique et l’expertise de médecins. Les résultats présentés ici supportent que: 1) Dans 43% des cas, les données scanographiques ont apporté des informations essentielles dans la diagnose pathologique. Cette tendance se confirme en fonction de certaines maladies, mais pas d’autres, car certains diagnostics ne peuvent se faire sans la présence de tissus mous. 2) La distribution spatiale de la plupart des lésions varie selon les régions anatomiques, aussi bien en macroscopie qu’en scanographie. 3) Certains types de maladie semblent associés à l’âge et au sexe, ce qui est conforté par la littérature. 4) Cette recherche démontre aussi que le processus de diagnose nécessite, dans 38% des cas, une analyse complémentaire (ex. histologie, scintigraphie, radiographie) pour préciser le diagnostic final. / Because some diseases produce lesions that cannot be seen macroscopically, this preliminary paleopathological study will use the ct-scan, as a complementary approach in order to improve diagnosis. This project will attempt to evaluate the efficiency of the ct-scan approach for the analysis of archaeological specimens in paleopathological study. Fifty-five individuals from St. Matthew’s protestant cemetery (Quebec City, 1771- 1861) were selected for the present study. Both macroscopic and scanographic analyses were performed on each skeleton. Macroscopic observations were recorded according to at least ten standard criteria based on the reference literature that reports abnormal phenomena on skeletal surfaces. Ct-scans were obtained at the Institut National de la Recherche Scientifique of Quebec City with a SOMATOM CT-scanner (Siemens model, Definition AS+ 128). Scanographic data provided a series of complementary criteria on internal bone structures (thinning/thickening of the cortical layer, density variation, etc.). According to the method of the differential diagnosis, diagnoses were proposed. Most of them were based on diagnostic criteria reported in the paleopathological literature as well as in clinical studies. The results presented support that: 1) For 43% of our sample (N=55), ct-scan data provided key information for the paleopathological diagnosis. The ct-scan provided additional information for some diseases only, partly because some diagnoses cannot be done without the presence of soft tissues. 2) The distribution of most lesions, both macroscopic and scanographic, did vary according to the anatomical regions. 3) Some types of diseases seem to vary according to age and sex, as supported by the literature. 4) Our research also shows that the diagnosis could be improved and refined in 38% of the cases with complementary analyses (histology, scintigraphy, radiography, etc.).
