Détermination judiciaire des faits et erreurs judiciaires : perspective narrative sur le processus judiciaire criminel et la recherche de vérité

Ce mémoire propose une conception narrative du système de justice criminel. Pour ce faire, l’auteure mobilise la théorie narrative suivant laquelle le procès contradictoire est appréhendé comme un concours entre différentes histoires. Le caractère général de cette théorie confère à l’auteure l’espace nécessaire pour analyser et expliquer différents aspects du traitement judiciaire des faits, que ce soit la preuve judiciaire, le processus de détermination judiciaire des faits, l’intervention judiciaire en appel ou encore le droit qui encadre chacun de ces aspects. La notion d’« histoire » favorise l’adoption d’une perspective qui sort du cadre restreint du procès dans lequel la notion de « preuve » est enfermée. La théorie narrative permet ainsi à l’auteure d’expliquer et d’organiser en un tout unifié divers aspects du processus judiciaire comme l’enquête, le dépôt des accusations, la théorie de la cause, le contre-interrogatoire ou encore la façon dont les faits sont d’abord choisis et assemblés par les parties avant d’être administrés et traités au procès sous forme de « preuve ». Appliquée au procès, cette théorie implique une approche holistique de la preuve suivant laquelle la détermination judiciaire des faits est une évaluation de la vraisemblance relative des histoires en compétition. Cela remet en question la vision traditionnelle (ou rationaliste) atomiste de la preuve où les faits sont déterminés suite à une décision sur la véracité ou la fausseté de chacun des éléments de preuve. Le nouvel éclairage qu’apporte cette vision narrative du procès et ses diverses implications mènent l’auteure à remettre en question le bien-fondé de la vision traditionnelle voulant que le procès mène à une détermination judiciaire des faits qui soit exacte. Au terme de son illustration de la valeur heuristique de la théorie narrative, l’auteure revisite sous la perspective narrative les récentes études en matière d’erreurs judiciaires. Elle en conclut que le droit commande au juge d’atteindre une vérité hybride sur les faits, à michemin entre, d’une part, ce qui est survenu dans la réalité et, d’autre part, ce qui permet de conférer un maximum de cohérence aux éléments de preuves effectivement présentés au procès. / This master’s thesis proposes a narrative conceptualization of the criminal justice system. The author employs the narrative theory framework that conceives the adversarial trial as a contest between different stories. This comprehensive theory offers a lens through which the author analyzes and explains multiple aspects of the judicial processing of facts including evidence at trial, fact-finding, appellate review and the law governing these aspects. The concept of “story” allows a broader perspective than the concept of “evidence” which is limited to the trial. This umbrella theory is therefore used to explain, organize and provide a united understanding of various aspects of the judicial system, such as the investigatory process, the laying of charges, the theory of a case, the cross-examinations, as well as how facts are chosen and organized before being presented and processed at trial as “evidence”. At trial, the global perspective of the narrative theory challenges the traditional (or rationalist) atomist approach to evidence, which explains fact-finding as a decision based on the truthfulness or the falseness of each individual piece of evidence adduced at trial. The narrative perspective, rather, suggests a holistic approach – fact-finding is a decision regarding the relative plausibility between two competing stories. Thus, these insights from the narrative theory call into question the traditional assumption that trials lead to accurate findings of fact. After her demonstration of the heuristic value of the narrative theory, the author applies the narrative framework to recent studies on miscarriages of justice. She concludes that the law enables triers of fact to reach only a hybrid truth, halfway between what happened in reality and an assessment of the consistency between the evidence adduced at trial.

Navigating Anonymity in Online Communities: A Multilevel Perspective : Examining user experiences and perceptions of online anonymity in the Fishbrain enthusiast community

This study examines the intricate dynamics of online anonymity in the context of Fishbrain, a platform for fishing enthusiasts. By conducting semi-structured interviews with ten Fishbrain users, I scrutinized the experiences and understanding of online anonymity through a deductive thematic analysis approach. This research was further underpinned by a comprehensive platform analysis. Using Eklund et al.'s framework [15], I studied six themes that encompass both macro and micro-regulating structures that govern online anonymity. The research findings highlight the pivotal role of these structures, revealing that users frequently balance the advantages of disclosing personal information against potential risks. This study accentuates the need to consider a spectrum of factors—commercial, legal, and technological structures, alongside the factual, social group, and physical facets of anonymity—when investigating online anonymity. This research expands the existing body of knowledge on online anonymity and provides valuable insights for platforms like Fishbrain to better address their users' concerns and customize their features and policies effectively.

A combination of the arising phenomena of these categorical axes, a legal-philosophical and dogmatic integration in the study of res judicata and rescission in tax matters by alteration of precedent cases was accomplished, in light of the Brazilian Civil Procedure Code of 2015, having its methodological counterpoint on the guidance disseminated by the Legal Opinion PGFN nª 492/2011 / Dois grandes fatores se destacam numa síntese temática do trabalho: (i) a revolução dos estudos da linguagem (linguistic turn) e sua grande repercussão em matéria de interpretação e constituição da realidade jurídica, com ápice na proposta de isolamento cognitivo do ser, o chamado abismo do conhecimento; e (ii) a valorização dos precedentes na conformação das relações jurídico-tributárias e na construção dos sentidos normativos, com a projeção para as legítimas expectativas futuras, racionalizando-se a prestação jurisdicional por meio de sua mecanização programada e, com isso, distanciando-se das particularidades fáticas dos casos em concreto. Vid en fastighetsöverlåtelse är det mycket information som ska utbytas på kort tid, mellan köpare, säljare och mäklare vad beträffar fastighetens fysiska skick och standard. I egenskap av en lojal, opartisk och sakkunnig person avseende fastighetsförsäljningar, har mäklaren ålagts en upplysningsplikt avseende sådant kring fastighetens skick som denne iakttagit, känner till eller annars har anledning att misstänka, som kan antas ha betydelse för köparen. Räckvidden av mäklarens upplysningsplikt gentemot köparen, avseende fysiska missförhållanden enligt FML 16§ 3st. kommer att utgöra uppsatsens brännpunkt. I detta inryms att söka klar-göra vilka typer av fysiska missförhållanden som en mäklare förväntas informera en köpare om, för att inte riskera att drabbas av någon typ av påföljd. Därutöver utreds förutsägbarheten och ändamålsenligheten kring FML 16§ 3st. Bedömningen av mäklarens upplysningsplikt ska även ses utifrån köparens och säljarens inbördes ansvarsområden för faktiska fel i fastigheten, samt i vilken omfattning det anses motiverat att mäklaren ikläder sig parternas ansvarsroller. Hänsyn i bedömningen får även tas till det faktum att mäklaren åläggs en grundläggande lojalitetsplikt som denne uppbär gentemot såväl köparen som säljaren. Problematiken kan i första hand härledas till tvetydiga och tämligen oklara förarbetsuttalanden, samt frånvaron av prejudicerade rättspraxis på området. Rättsreglerna kring bestämmelsen synes därav även vara svåra att tillämpa i de lägre domstolsinstanserna och hos tillsynsmyndigheten, FMN. Därav kvarstår osäkerhet kring rättsläget avseende omfattningen av mäklarens upplysningsplikt vad beträffar fysiska missförhållanden härlett till fastigheten. / When selling a property there is much information, in regards to the property’s physical standard, which should be discussed between the parties; the realtor, the buyer and the property owner. In relation to the buyer and the property owner, the realtor will be known as a loyal, independent person that carries expert know-ledge in regards to selling property. Therefore the realtor should carry the liability to inform the buyer about physical errors according to the property, that has been found, or for some other reason will be known, or if there is a reason to suspect an error, that can be of  importance to the buyer. The focus point of this thesis is the magnitude of the realtor’s liability to inform the buyer on physical errors, according to FML 16§ 3st., and to examine what kind of physical errors that the buyer have the right to be informed of. Because if the realtor do not respect the obligations according to FML 16§ 3st., legal sanctions will be given. The author will also examine if the legal rule, FML 16§ 3st., is predictable and appropriate. To examine the magnitude of the realtor’s liability to inform the buyer on physical errors, the legal relation between the buyer and the property owner has to be taken into account according to JB 4:19§. The fact that the realtor also carries a responsibility to submit to good faith and fair dealing will also be interesting. The principal legal issue will be based on the unclear preparatory work, regarding to FML (2011:666) 16§ 3st., and the magnitude of realtor’s liability to inform the buyer on physical errors. Furthermore, there is no case law given by the Swedish Supreme Courts, and that is one more reason why the area is so hard to apply. The legal position will therefore stay unclear, according the realtor’s liability to inform the buyer about physical errors of the property.

Analysis of the undergraduate students' learning environment in a medical school in Zambia

This study analysed the learning environment of undergraduate medical and health sciences students of the School of Medicine University of Zambia who were studying at the Ridgeway Campus. Premised on the theory that learner’s perception of the learning environment determines approach to learning and learning outcome, the study utilized a descriptive, quantitative, and non-experimental design to articulate the issues that characterise the learning environment of the programmes. The aim was to provide framework based on these, and use it to propose a strategy for improving the learning environment of the School. The Dundee Ready Educational Environment Measure (DREEM) questionnaire was administered to 448 participants from year 2 to year 7 classes of medicine, pharmacy, and physiotherapy programmes. Total DREEM, subscale, and individual items’ scores were analysed statistically and compared by analysis of variance among the programmes. The issues determined formed the framework for strategy development, and strategic options were proposed based on evidence obtained from literature. With a global DREEM score of 119.3 ± 21.24 (59.7 %), the students perceived their learning environment as “more positive than negative.” One sample binomial test of hypothesis for categorical variables returned a p value <0.05, with a verdict to ‘reject the null hypothesis,’ thereby confirming a more positive than negative perception. Subscale scores also showed ‘more positive’ perception. There were no significant differences between scores from the different programmes when compared by Games Howell test, P> 0.05, thereby upholding the second hypothesis. Analysis of individual items revealed problems in six items, which were summarised into four strategic ssues: inadequate social support for stressed students, substandard teaching and mentoring, unpleasant accommodation, and inadequate physical facilities. The implications of the findings for theory and practice were discussed and strategic options proposed to address the issues. The study concludes that analysis of the learning environment of medical schools provides more insight for strategic planning and management. / Health Studies / D.Litt. et Phil. (Health Studies)
