An archaeozoological and ethnographic investigation into animal utilisation practices of the Ndzundza Ndebele of the Steelpoort River Valley, South Africa, 1700 AD – 1900 AD

Focussing on Archaeozoological faunal analysis, this dissertation aims to investigate the animal food utilization practices of the Ndzundza Ndebele by combining archaeozoologcial methods, archaeological data, ethnographic and historic information. The Ndzundza Ndebele inhabited three different sites in the Steelpoort River Valley during c. 1700 AD – 1900 AD. They were forced to relocate from KwaMaza and Esikhunjini to KoNomtjarhelo as a result of continual fighting between themselves and contemporary Iron Age/Historic communities, the British and the Boers during this period. I aim to identify the animal species utilized by the Ndzundza Ndebele in addition to whether or not the hostile and politically unstable period had any effect on Ndzundza animal food procurement, use and discard. Additionally I investigate whether the faunal remains recovered from the three sites can be used to identify ethnic affiliations, gender roles and ritual use with regards to animals and/or animal parts. Ultimately, I aim to demonstrate that faunal remains cannot be fully understood and interpreted without incorporating relevant ethnographic and/or historic information and as comprehensive an archaeological context as possible. This thesis explains important facts concerning financial products for solutions of housing need from three points of view, which influent each other -- from the point of view of client, bank and state. In the thesis, there is noted, what shall be understood under the solution of housing need, and what are the products which have been used for housing financing. Accent is put on possible use of different forms of state support and its influence on the state budget. The most of financial products for the solution of housing need have character of credit, therefore part of the thesis is touching credit risk and is clearing running of credit process.

L'effet horizontal de la Charte des droit fondamentaux de l'Union européenne / The horizontal effect of the charter of fundamental rights of European Union

La Charte des droits fondamentaux de l’Union européenne a acquis une force juridique contraignante depuis l’entrée en vigueur du traité de Lisbonne. Les institutions européennes et les Etats membres lorsqu’ils mettent en oeuvre le droit de l’Union européenne sont donc liés par ses dispositions. Mais les autorités publiques ne devraient pas être les seules à être soumises au respect des droits et libertés qu’elle garantit. En effet, les particuliers, parce qu’ils peuvent, à l’instar des pouvoirs publics, attenter aux droits primordiaux de leurs semblables, devraient également être tenus de respecter cet instrument juridique lorsqu’ils se trouvent placés dans une situation régie par le droit de l’Union européenne. Autrement dit, la Charte des droits fondamentaux devrait déployer des effets juridiques dans le cadre des relations de droit privé lorsqu’il existe un lien de rattachement avec le droit de l’Union européenne. Cet effet horizontal permettrait ainsi aux particuliers de jouir effectivement des droits et libertés consacrés par la Charte. On attend donc des autorités publiques, conformément à leurs obligations positives, qu’elles protègent les droits que les particuliers tirent de cet instrument juridique. La reconnaissance de l’effet réflexe de la Charte des droits fondamentaux aura ainsi pour conséquence de créer des obligations tant pour les institutions européennes et les Etats membres que pour les personnes privées. / The Charter of fundamental rights has acquired a binding legal force since the coming into effect of the Treaty of Lisbon. Hence, the institutions of the European Union and member states when they implement the law of the European Union are bound by the provisions of the Charter. But the addressees of this legal instrument should not be only public authorities. Individuals, whenever it could impinge on freedoms and basic rights, should be subject, to compliance with the Charter when the matter falling the scope of EU law. In other words, the Charter of fundamental rights should have legal effects in private law relations when there is a connecting link to EU law. Horizontal effect would allow individuals to have full enjoyment of rights enshrined in the Charter. Public authorities must therefore, in keeping with their positive obligations, protect the rights derive from the provisions of this legal instrument. Therefore, the recognition of horizontal effect of the Charter will create obligations for both institutions of European Union and member states and private persons.

The Effects of Positive Behavioral Supports in Schools since the Implementation of the Individuals with Disabilities Education Act of 1997 based on 2001 SLIIDEA Data

Congress in 1997 recognized that there were some issues and concerns that had emerged surrounding the Individuals with Disabilities Education Act (IDEA) and sought to address these issues and concerns by mandating a national evaluation on the implementation and progress toward improving outcomes for students with disabilities. The Study of the State and Local Implementation of the Individuals with Disabilities Education Act was designed to address how the amendments of IDEA were being implemented by states, school districts, and schools. This mixed methods study examined the first year of data collected from the six-year Study of the State and Local Implementation of IDEA (SLIIDEA) and analyzing 20 case studies that used interviews of special education personnel and principals, conducted at the local school level. Data from the national survey were examined in light of findings from the case studies. The case studies brought out the varying opinions on implementation success at the local level. Further case studies for each year of the study would be helpful in determining the level of implementation locally and the significant insights of local school personnel on whether these initiatives have worked.

It analyzes the effectiveness of fundamental rights in relations between individuals and the social function of company liability that is related of off-balance sheet consumer detriment. This analysis is made from punitive damages perspective. The traditional point of view states that fundamental rights are effective only in opposition to the State. However, from the 1950s this view has changed, going to check the effectiveness of these rights in relations between individuals. From another hand, the phenomenon of functionalism of the law has been growth, since the institutes of law are seen today not only by their structure but by their external relationship. By merging of these two current law visions it is possible to notice that the liability has a social function - especially when facing injuries to the right to privacy of the consumer, which is the vulnerable part of the legal relationship. The Internet revolution promoted in society is well known as well as the way people exchange information and data, facilitating communication. However, in the same way it has facilitated the relationships between people, it caused problems not previously encountered such as high privacy exposure of the consumers. The high growth electronic commerce, in larger proportions than the old means of trade, also caused the multiple problems, especially in how consumer data is protected (or exposed) in cyberspace. Due to these issues, the challenges of this research is to reconcile the right to privacy in cyberspace consumer relations as well as to determine, in accordance with current legislation, the corporate responsibility regarding the safety of consumer data. In case of injury to the consumer, this work analyses how the social function of civil liability – as a negative sanction - is able to generate positive behavioral changes, especially focused to prevent further injury. / Esta pesquisa tem por finalidade o estudo do direito fundamental à privacidade no espaço virtual, especialmente nas relações de consumo. Analisa-se a eficácia dos direitos fundamentais nas relações entre particulares e a função social da responsabilidade civil da empresa em relação a danos extrapatrimoniais causados ao consumidor, sob a ótica dos danos punitivos. A visão tradicional é de que os direitos fundamentais têm eficácia apenas em oposição ao Estado. Entretanto, a partir da década de 1950, essa visão modificou-se, passando-se a verificar a eficácia desses direitos nas relações entre particulares. Por outro ladp, o fenômeno da funcionalização do direito vem ocorrendo de forma crescente, posto que os institutos de direito são hoje vistos também por sua função – relação externa – e não apenas por sua estrutura. Conciliando essas duas visões atuais do direito, pode-se verificar que a responsabilidade civil possui uma função social, especialmente quando se está diante de lesões ao direito à privacidade do consumidor, que é a parte vulnerável na relação jurídica. É de conhecimento notório a revolução que a Internet promoveu na sociedade e na forma como as pessoas trocam informações e dados, facilitando a comunicação. Entretanto, da mesma forma que facilitou as relações entre pessoas, trouxe problemas antes não enfrentados, como a extrema exposição da privacidade das dos consumidores. Também o aumento vertiginoso do comércio eletrônico, em proporções maiores do que os antigos meios de comércio, fez com que os problemas se multiplicassem, sobretudo na forma como os dados dos consumidores são protegidos (ou expostos) no espaço virtual. Em razão dessas questões verificadas, o desafio proposto nesta pesquisa é conciliar o direito à privacidade nas relações de consumo ocorridas no espaço virtual e apurar, de acordo com a legislação vigente, a responsabilidade da empresa em relação à segurança dos dados dos consumidores. Havendo lesões ao consumidor, analisa-se a forma como a função social da responsabilidade civil, sendo uma sanção negativa, é capaz de gerar mudanças positivas de comportamento, especialmente para prevenir novas lesões.

Le tonneau des Danaïdes ou de l’européanisation à l’Est : la grande corruption en Roumanie – types, causes, conséquences

Pourquoi la Roumanie ne réussit-elle pas l'épreuve de l'européanisation? À travers quatre études de cas, ce mémoire souligne le rôle central occupé par les partis politiques dans le développement de la corruption en Roumanie. En adaptant la théorie créée par Jonathan Pinto, Carrie Leana et Frits Pil, il montre que le type le plus répandu de corruption n'est pas individuel mais organisationnel et se propage à travers les partis. Plus précisément, les études de cas servent à comparer les phénomènes de l'Organisation d'Individus Corrompus (OIC) et de l'Organisation Corrompue (OC). En Roumanie, les deux types coexistent. Toutefois, de par l’étendue et la puissance supérieure dans le fonctionnement de l’OC par rapport à l’OIC, de par la définition et tel que le montre l'analyse des études de cas choisies, le phénomène de l’Organisation Corrompue dans sa manifestation à l'intérieur des partis politiques a plus de conséquences négatives sur le développement économique, politique et sur l’intégration européenne du pays comprise dans le sens d’idéal démocratique et de modernité dont tout État membre de l’Union européenne tente de se rapprocher. / Why does Romania fail the Europeanization test? Using four case studies, this thesis emphasizes the central role played by political parties in the development of corruption in Romania. By adapting the theory first developed by Jonathan Pinto, Carrie Leana and Frits Pil, it shows that the most common type of corruption is not individual but organizational and spreads through political parties. More precisely, the case studies are used to compare the phenomena of Corrupt Organization (CO) and Organization of Corrupt Individuals (OCI), respectively. In Romania, the two types coexist. However, due to its extent and strength revealed by the case studies, the phenomenon of Corrupt Organization in its manifestation within political parties has more negative consequences on the economic and political development as well as on the European integration of the country.

The Swedish government has set a target of achieving 100% renewable electricity production by 2040, and this target is reflected in the solar strategy of the Swedish Energy Agency that states it’s possible that solar electricity may represent 5-10% of the Swedish electricity mix by 2040. It’s not easy for different participants such as individuals, companies, farmers and housing associations to find out the value of solar self-consumption and the value of surplus solar electricity that is fed into the power grid, because there are about 120 electricity trading companies and about 170 electricity grid companies in Sweden. The electricity companies have different tariffs. The purpose of this degree project is to investigate how the value of solar electricity varies depending on which electricity trading company and electricity grid company that different participants such as individuals and companies have, and also to make profitability calculations for different cases concerning five of the major electricity trading companies and electricity grid companies, respectively. Data needed for calculating the value of solar self-consumption and sold surplus electricity are collected from the electricity trading companies and electricity grid companies. Profitability is calculated by using an Excel template from the project ”Capital budget for solar cells”. This degree project shows that the value of solar self-consumption is worth more than the value of sold surplus electricity in all cases, both for individuals and for companies. For the companies, the difference in value between solar self-consumption and sold surplus electricity is much greater than for individuals, because the companies studied in this degree project don’t receive any tax reduction for the surplus electricty that is fed into the power grid. The higher the value of solar self-consumption and sold surplus electricity, the more profitable the solar cell investment becomes. The lower the value of solar self-consumption and sold surplus electricity, the less profitable the solar cell investment becomes. The prerequisites needed to achieve 5-10% of solar electricity in Sweden are strengthening or renewal of the electricity grid, budget support for solar cells, financial support systems, education about the potential for solar electricity and how it works and the willpower among various participants to invest in solar cells.

Individuals’ perceptions of their cancers’ risks stemming from environmental factors : overview, relationships with adoption of health-related behaviors and determinants / Perceptions individuelles des risques de cancer liés aux facteurs environnementaux : état des lieux, liens avec l'adoption de comportements en santé et déterminants

Objectifs : (1) Explorer et analyser les perceptions individuelles des risques de cancers toutes causes confondues et liés aux facteurs environnementaux. (2) Investiguer les liens entre ces perceptions et l'adoption de comportements en santé. (3) Identifier et analyser les déterminants de ces perceptions. Méthodes : Revues de la littérature empirique et théorique, étude qualitative auprès de personnes avec et sans antécédent(s) de cancer, étude quantitative auprès d'un échantillon représentatif de la population française. Résultats : (1) Les risques de cancers liés aux facteurs environnementaux sont un sujet de préoccupation. Une part importante des participants se percoit notamment à risque de développer des cancers liés à la pollution de l'air, aux pesticides et au stress. (2) Les adoptions de comportements en santé sont parfois associées aux perceptions des risques mais sont plus souvent associées à l'adhérence à des croyances relatives à la prévention et aux préférences visà- vis du temps et du risque. Prendre en compte l'endogénéité impacte fortement la significativié des associations entre perceptions et comportements. (3) L'adhérence à des croyances relatives aux cancers et la saillance des risques de cancers liés à l'environnement déterminent plus fortement les perceptions que les heuristiques d'affect et de disponibilité, la connaissance, le contrôle perçu et la volonté perçue des expositions aux risques, l'histoire personnelle de santé et les caractéristiques sociodémographiques. Discussion : Nos résultats, cohérents avec la littérature, permettent de mieux comprendre les perceptions individuelles des risques et peuvent servir de support au développement de politiques ciblées de santé publique / Objectives: (1) To explore and analyze individuals’ perceptions of their own cancers’ risks in general and stemming from environmental factors. (2) To investigate their relationships with individuals’ adoption of health-related behaviors. (3) To identify and analyze the determinants of these perceptions. Methods: A theoretical and an empirical literature reviews, an exploratory qualitative study among individuals with and without personal cancer history and a confirmatory quantitative study among a representative sample of the French population have been conducted. Results: (1) Cancers’ risks stemming from environmental factors are a subject of concern among French people. In particular, more than half of our sample perceived themselves at risk to develop cancers stemming from outdoor air pollution, pesticides and stress. (2) Individuals’ adoptions of health-related behaviors can be associated with their risk perceptions, but are more associated with their endorsement of prevention-related beliefs, and their time and risk preferences. Endogeneity strongly impacts the significance of associations between perceptions and behaviors. (3) Endorsement of cancers-related beliefs and salience of cancers’ risks stemming from environmental factors determine more strongly individuals’ risk perceptions than availability and affect heuristics, knowledge, perceived control and voluntariness of risk exposures, personal health history and socio-demographic characteristics. Discussion: Our results, consistent with the literature, bring new outcomes helpful to better understand individuals’ risk perceptions and to design targeted public health policies

Porozumění informacím v českém znakovém jazyce u studentů středních škol pro sluchově postižené / Czech sing language comprehansion by students of secondary schools for the deaf

This diploma thesis deals with the education and communication of students with hearing impairment with a focus on the analysis of the level of understanding of information in sign language for students of special secondary schools for the hearing impaired. The theoretical part presents important concepts in this area, such as the definition of communication and communication options for the hearing impaired, as well as educational opportunities for the hearing impaired from a preschool level to a university and last but not least sign languages, their research in the world and Czech sign language as a native language of people with hearing impairment in the Czech Republic. The empirical part describes the research, which was conducted on 65 probands - high school students of the special school for students with a hearing impairment. The research is focused on the differences in the level of understanding of groups of students according to their identification data and also examined whether comprehension is affected by the complexity of the information transmitted (i.e. whether information at the level of ordinary conversation is better understood than a professional information). The research survey was of a qualitative nature and the main research method was a non-standardized questionnaire...

Psychosocial Consequences of Parental Wrongful Conviction on Children

This qualitative multiple-case study sought to provide an in-depth understanding of how children living in broken families-due to the wrongful conviction of parent(s)-developed psychosocial issues. The theoretical frameworks applied to this study were the social learning theory, the social control theory, the role-modeling theory, and the general theory of crime. A purposeful sample of 13 adults who were children at the time of their parents’ wrongful incarceration were drawn for phone and in-person interviews. The data were transcribed and analyzed to code, sort, and organize; to analyze connections in the information, and to compare and contrast cases. The multiple-case study data were analyzed using 1st and 2nd cycle coding. Among the 10 themes identified in this study were these 5: family structure and activities, behavioral issues associated with the wrongful conviction of their parents, wrongful conviction effects on education, mental health impacts of a parental wrongful conviction on left-behind children and bullying in school and at home. This implications for positive social change are that the findings raise awareness of the psychosocial issues experienced by children whose parent(s) were wrongfully imprisoned for government officials, community leaders, policymakers, and justice reform advocates who can use them to implement programs to provide psychosocial assistance to all children of incarcerated parents.
