No. of bitstreams: 1 arquivototal.pdf: 1269583 bytes, checksum: 82b0fddbfc93b778256ff664e216293d (MD5) Previous issue date: 2015-03-24 / The legal certainty principle is the expression of certainty and order in judicial affairs. The principle can be a synonym of stability, foreseeability and immutability of written legislation and decisions taken by judiciary power. It is through the respect towards the law and the sentences that the State maintains social order. With the respect of the law or, in another word, legal certainty, the State can assure life security and individual liberties to its citizens. Therefore, legal certainty is as assuring element of one of the main goals of the State – public security. In that manner it is justified the preoccupation of the law in maintaining and promoting the legal certainty principle. However, is it possible to verify that it exists in such terms of immutability and foreseeability? The initial response of this work agrees with the theoretical reference of Jerome Frank, to who law id ruled by uncertainty. The insistence on the idea of legal certainty has trained the experienced jurist to deal with the flexibility of reality using rational constructions that allow to ratify legal certainty so he corroborates it, and legal certainty helps maintaining social order itself.

Wortelkamp, Isa 12 November 2015 (has links) (PDF)

En satt bild är inte given : En källkritisk studie av källor kring forskningen och bilden av Kiowatolken Joshua H Given. / The right image is not a given : a source critical study of the research and image of the interpreter Joshua H Given.

Erlandsson, Johan January 2019 (has links)
The acquisition of the Indian land by the Cherokee Commission between 1890 to 1892 was a series of events that changed the future of many indian nations and parts of american history. In the midst of these great changes, Kiowa interpreter for the Cherokee commission: Joshua H Given, ended up in a controversial position. He was accused of having deliberately cheated and mislead the Indians to get them to sign the agreements to allot their land to the goverment. This led to several attempts by the Indian tribes to annul the agreements with the commission and the condemnation of Joshua Given by many Kiowas. This essay is an attempt to clarify parts of Joshua H Givens life, actions and death through a source-critical analysis of the sources used in the research of Joshua Given. The views of two historians, C. Blue Clark and William T. Hagan, is used to contrast and compare the actions and life of Given to get a fuller view of the complicity of this individual. Hagans views is more focused on the image of a trying mediator, while Clark focuses on the images of a deceiving interpreter, By the work and theories of Nancy L. Hagedorn and Margaret Connell Szasz on the cultural broker as an cultural intermediate, Givens complexe relation to the clashing cultures and tradition of his own Kiowa nation and his newly learned western and Christian culture can be undersood as a failiure to gain the extremely important trust required for such mediation between the parties.

The aim of this work is to show how Holden Caulfield, the character of The catcher in the rye, returns from his isolation of the world by means of his altruistic love, considering 'the other' more important than himself. From the hypothesis that Holden's grief in maintaining innocence leads him to depression, as compassion leads him to the answer for such conflict, the methodological procedures were based on the inductive method for elaborating theses: historical procedures, such as contextualizing the novel, bibliographical research, text selection, analysis, interpretation, organization and composition of the theoretical approach. Contextualizing J. D. Salinger and his narrative leads to a more accurate comprehension of Holden Caulfield. The anguish of being lonely makes him want to die, something that changes when he realizes, benevolently, that the answer to his question is to seek 'the other'. Then, compassion, the need to love, silences his inner pain / A compaixão como redenção do ser humano.

The Vir Tricultus : an investigation of the classical, Jewish and Christian influences on Jerome's translation of the Psalter Iuxta Hebraeos

Cameron, J. S. January 2006 (has links)
This thesis investigates the influences on Jerome's translation of the Psalter from the Hebrew (IH Psalter) that came from the three major socio-religious spheres with which Jerome was acquainted. It argues that the results offer insights into Jerome's conception of the nature of Hebrew text itself, of the relationship between it and the Christian faith, and of his role as translator. The thesis argues and demonstrates that the language of the IH Psalter reveals influences that derive from Jerome's classical background, from his contact with rabbinic scholars in Palestine, and, especially, from his adopted Christian faith. These influences are subtle, but their combined effect is considerable. Care is taken to demonstrate that Jerome was a competent translator, and that he deliberately intended the classical, Jewish or Christian nuances that are discussed. This is achieved, first, by comparing the IH Psalter with the Hebrew as an initial step, then with Jerome's translation of the Psalter from the Hexaplaric Septuagint, and with the various Greek versions where they are extant; and second, by evaluating the relationship between Jerome's translations and his exegetical material on the Psalter. The fact that Jerome is both translator and exegete of the Psalter allows clear insight into the impact of his understanding of the Psalms on his translation of them. The Conclusion argues that the issues can be focussed on and find their resolution in Jerome's conception of the nature and function of the Hebrew text. By imputing to Jerome a belief in the divine inspiration of the Hebrew text, and a belief that the Hebrew text properly understood and properly translated reveals Jesus Christ, the character of the IH Psalter can best be explained. Jerome's translations often exploited available linguistic space, but they rarely went beyond what hebraica veritas could reasonably signify.
