Para realizar a anÃlise, dois instrumentos de pesquisa foram utilizados: o programa de computador WordSmith Tools v.4.0. e fichas que permitiram averiguar a exatidÃo dos dados gerados pelo software e categorizar as estruturas fraseolÃgicas segundo a funÃÃo que exercem nos textos. Os resultados apontam que as unidades fraseolÃgicas do discurso forense se manifestam na forma de colocaÃÃes e de enunciados completos, bem como de fÃrmulas discursivas de abertura e de fechamento. / This work aims at analyzing the phraseology of the judicial discourse. The corpus has been built upon decisions pronounced by judges of the Federal Court in the State of Cearà in lawsuits filed in 1999, 2001, 2003 and 2005. Communicative Theory of Terminology has been chosen as the framework for this research, thus meaning that lexical, syntactic and discursive criteria were taken into account in the process of identifying and categorizing the phraseological units. For data analysis, two instruments have been employed: the software WordSmith Tools v. 4.0 and phraseological unit files, which were used for classifying the phrases according to their function in the texts. The results suggest that phraseology in judicial discourse is manifested by means of collocations, clauses and discursive formulas.

Una articulación de arte y política: dislocaciones y rupturas en la poética de Edgardo Antonio Vigo (1968-1975)

Esta tesis, que integra los estudios de la Sociología del Arte, se centra en la vinculación de la poética del artista Edgardo Antonio Vigo (1928 - 1997) con la política y lo político, así como con los procesos sociales más generales entre 1968 y 1975. Vigo ocupó una posición emergente en el desarrollo del arte platense y desplegó producciones que emprendieron una poética rupturista con lo establecido por algunos de los cánones tradicionales del arte y sus instituciones, y elaboró propuestas estéticas innovadoras que abarcaban las artes visuales en sus diversas formas. Se analizan en esta tesis los modos por los que Vigo al mismo tiempo que apunta a cuestionar las estructuras y manifestaciones de las Bellas Artes, lo hace con las formas dominantes de la cultura a través de obras y textos que tendían a desestabilizar los roles de autor, espectador y obra, así como a involucrarse de distintos modos en los acontecimientos políticos de la época. Se estudian, además, las producción de acciones artísticas en el espacio público, que Vigo llamó señalamientos, la utilización y apropiación del discurso y aspectos materiales de lo judicial-administrativo y la edición de la revista ensamblada Hexágono ’71 (1971 -1975). En estas zonas de la poética de Vigo se consideran las diversas relaciones entre arte y política, las cuales no han sido lineales ni unidireccionales, sino modos de distorsionar y disentir con las jerarquías, lugares y funciones de los sujetos y objetos del entramado social. Para la realización de la tesis se produjo un diseño metodológico cualitativo, se utilizaron fuentes documentales y entrevistas. Se desarrolla un análisis de las obras del artista, más que remitiéndolas a una corriente artística particular, haciendo foco en su relación con la situación social y política, especialmente en sus vinculaciones con el particular proceso de subjetivación política de la época. Se procuró para ello realizar una investigación que se detenga de manera pormenorizada en el trabajo artístico y sus particularidades (materiales, técnicas, formas, estrategias de intervención), así como en sus discursos escritos, plasmados en ensayos, artículos y otros textos, para avanzar desde allí hacia un análisis interpretativo y comprensivo de las conexiones y de los efectos que perseguía tal trabajo con los procesos políticos. Se presentan en los Anexos matrices de datos de los señalamientos y de Hexágono ’71, así como un índice razonado de la misma. / This dissertation is part of the field of Sociology of Arts and focuses on the relationship between the poetics of the artist Edgardo Antonio Vigo (1928-1997) and politics and the political, as well as the general social processes between 1968 and 1975. Vigo occupied an emerging position in the development of local art and carried out productions that undertook a poetics which broke with some traditional canons of art and their institutions, and he also made innovative aesthetic proposals in visual arts. We analyze the ways in which Vigo, while questioning structures and manifestations of Beaux Arts, did it with the dominant culture forms through works and texts that tended to destabilize the roles of author, spectator and work, as well as to be involved in political events. We also study the production of artistic actions in the public space, which Vigo called señalamientos [signalings], the use and appropriation of the judicial-administrative discourse and materials, and the publication of the assembling magazine Hexágono ’71 (1971-1975). In these zones of Vigo’s poetics we consider diverse relationships between art and politics, which were not linear or one-way, but means of distorting and dissenting from hierarchies, places and roles of subjects and objects in society. To prepare this dissertation we produced a qualitative research design and used documental sources and interviews. We developed an analysis of Vigo’s works, focusing on the relationship with the social and political situation and the process of political subjectivation of that time, rather than following a specific artistic movement. The research discusses in detail the artistic work and its distinctive features (materials, techniques, forms, strategies of intervention), as well as Vigo’s written discourses expressed in essays, articles and other texts, to progress from there to an interpretative and comprehensive analysis of the connections and effects pursued by those works with regard to the political process. In the Appendix we include data matrices of señalamientos and Hexágono ’71, and an index of this magazine.

La configuración narrativa en el proceso penal. Un análisis discursivo basado en corpus

Esta tesis se ocupa de describir el modo como se configura lingüísticamente la narrativa de los hechos enjuiciados en el proceso penal español. La finalidad última de esta investigación es doble: de un lado, contribuye con el conocimiento propio de la Lingüística a la mejor comprensión de la administración de justicia; de otro lado, proporciona una descripción precisa de los recursos lingüísticos implicados en el proceso judicial que permite diseñar materiales y métodos para la capacitación comunicativa de juristas. Ese objetivo general se desglosa en los siguientes objetivos específicos: 1. Revisar las principales propuestas que, desde disciplinas diversas, han abordado la dimensión narrativa de la administración de justicia. 2. Confeccionar un corpus judicial ajustado a las características particulares del sistema judicial en España. 3. Proponer un modelo analítico capaz de explicar adecuadamente cómo se configuran discursivamente las narrativas judiciales. 4. Analizar la configuración narrativa desde una perspectiva dinámica y global, que permita dar cuenta de los recursos lingüísticos implicados en la elaboración de las historias de los hechos a lo largo de todo el proceso (en concreto, en los géneros discursivos del escrito de acusación, el escrito de defensa, los interrogatorios, los informes finales y la sentencia) y de cómo producen conocimiento de tipo factual. 5. Contribuir al debate general sobre la faceta narrativa de la justicia, apuntando nuevas líneas de investigación en las que la Lingüística puede aportar conocimientos relevantes al estudio de la administración de justicia. / This thesis deals with the way the narrative is linguistically constructed in Spanish criminal prosecution. The goal of this research is twofold: first, linguistics knowledge is used to the deeper understanding of the administration of justice; on the other hand, this thesis provides an accurate description of the linguistic resources involved in the judicial process, that allows designing materials and communication methods for training lawyers. This general objective is divided into the following specific objectives: 1. Review the main proposals that, from various disciplines, have addressed the narrative dimension of the administration of justice. 2. Develop a judicial corpus fit for study of the specific characteristics of the judicial system in Spain. 3. Propose an analytical model to explain adequately how to set up legal narratives. 4. Analyze the narrative configuration from a global dynamic, that allows to account for the linguistic resources involved in developing the stories of the facts throughout the process (in particular, discursive genres of prosecution statements of the case, the statement of defense, interrogation, final reports and judicial sentence) and how to produce factual knowledge. 5. Contribute to the general discussion on the narrative side of justice, pointing out new lines of research where linguistics can provide relevant knowledge to the study of the administration of justice.

For this purpose, we have chosen sections, facts as found and relevant law , sections of the petition, with the understanding that, in this way, respectively, the narration of events, which gives margin to the propositioning to the judicial action, and the exposition of the law that upholds the author s intention. We base our discussion on the field of Linguistics, more precisely, Textual Discourse Analysis (TDA), whose theoretical basis is derived from Textual Linguistics (TL) and Enunciative Linguistics. We foreground, particularly, the way in which the author of texts, objects of analysis, use discursive strategies that evidence ER. The relevance of this study, then, is in the formation of a critique of the judicial text, as it conceives of a dialogical approach to the point of view, raising not only questions about the way in which a linguistic instance conceives an object of discourse, but also considering questions of language inherent to technical writing and, in this aspect, contributing to the work of those operating in Law about the many ways ER is formed in the body of a petition. We selected two categories to analyze that, according to Adam (2011), characterize the degree of ER in the textual material of the propositional enunciations: the different types of representation of speech and the indications of profile of mediators. In this sense, with this task as an objective, we base our study regarding point of view on Rabatel (2003, 2009a, 2010) with relation to the enunciative approach, including the study of PDV in polyphonic and dialogical theoretical framework to study the ER from different types of speech representations that conceive forms of transmission of discourse and the role of the enunciating subject, mainly the responsibility and the prerogative by the propositional contents. In the same way, intending to study the indications of the mediator profiles, we observed the postulations of Guentch?va (1994, 1996), which develop the notion of mediative grammatical categories, of which permit the linguistic marking of distance and engagement of the enunciator with regard to the information expressed. The methodology we adopted was based on qualitative research, of an interpretive and introspective nature, in light of the fact that his study focuses on processes and strategies underlying language use. The corpus of the research is comprised of Initial Petitions, which gave rise to actions originating in the Civil Court of Currais Novos County RN. The data analysis shows that an object of discourse is always perspective oriented and presents the point of view of one or more enunciators. Consequently, the producer of a text, using the PDV of other enunciators, influences and establishes the argumentative orientation of the text. In the same way, it evidences the relevance of the use of mediated constructions in the judicial text, as they function as strategies attenuated to the responsibility of the producer of the text with what is said, and at the same time points to a discourse of authority through the entrance of the sources of law. Moreover, it reveals the documental and international importance of this practice, at the same time that it exposes the compositional and normative difficulties with regard to legal and linguistic aspects / Esta investiga??o objetiva descrever, analisar e interpretar a Responsabilidade Enunciativa (RE) em Peti??es Iniciais, g?nero discursivo circunscrito ao dom?nio jur?dico. Para tanto, elegemos como objeto o estudo das se??es Dos fatos e Da fundamenta??o jur?dica , da peti??o, compreendendo, assim, respectivamente, a narra??o dos eventos, que deu margem ? propositura da a??o judicial, e ? exposi??o do direito que ampara a pretens?o da parte autora. Ancoramos a discuss?o no campo da Lingu?stica, mais precisamente, na An?lise Textual dos Discursos (ATD), cujas bases te?ricas decorrem da Lingu?stica Textual (LT) e da Lingu?stica Enunciativa. Colocamos em relevo, particularmente, o modo como o autor dos textos, objetos de an?lise, faz uso das estrat?gias discursivas que indicam a RE. Dessa forma, a relev?ncia deste estudo reside na constru??o da cr?tica ao texto jur?dico, pois empreende uma abordagem dial?gica do ponto de vista, suscitando n?o apenas questionamentos sobre a maneira como uma inst?ncia lingu?stica concebe um objeto de discurso, mas tamb?m discutindo as quest?es de linguagem inerentes ? escrita especializada e, nesse aspecto, contribuindo com o trabalho dos operadores do Direito acerca das v?rias maneiras de constru??o da RE no corpo do texto peticional. Nesse sentido, objetivando tal tarefa, baseamo-nos nos estudos acerca do ponto de vista realizados por Rabatel (2003, 2009a, 2010) no que concerne ? abordagem enunciativa, inserindo o estudo do PDV no arcabou?o das teorias polif?nicas e dial?gicas para estudar a RE a partir dos diferentes tipos de representa??o da fala que compreendem as formas de transmiss?o do discurso e o papel do sujeito enunciador no tocante ? responsabilidade e ? imputa??o pelos conte?dos proposicionais. Da mesma forma, tencionando estudar as indica??es de quadros mediadores, observamos os postulados de Guentch?va (1994, 1996), que desenvolve a no??o de categoria gramatical do mediativo (MED), a qual permite marcar linguisticamente o distanciamento ou engajamento do enunciador diante das informa??es expressas. No que concerne ? metodologia, adotamos a pesquisa de base qualitativa, de natureza interpretativista e introspectiva, haja vista que este estudo focaliza processos e estrat?gias subjacentes ao uso da linguagem. O corpus da pesquisa ? constitu?do por Peti??es Iniciais, que ensejaram a??es oriundas na Vara C?vel da Comarca de Currais Novos-RN. A an?lise dos dados mostra que um objeto de discurso ? sempre perspectivado e manifesta o ponto de vista de um ou mais enunciadores. Como consequ?ncia, o produtor do texto, ao utilizar-se dos PDV de outros enunciadores, influencia e estabelece a orienta??o argumentativa do texto. Crime, Community and the Negotiated Truth : Court Narratives of Capital Crime in the District Courts of Jämtland-Härjedalen 1649—1700

The purpose of this thesis is to study the court narratives of serious crimes in the district courts of Jämtland-Härjedalen in the latter half of 17th century. This is done by studying the negotiated aspects of criminal court proceedings; how did stories of crime, guilt and character come together in the records to form narratives that became accepted truths by the local community and the authorities? Investigations of serious crime have been sampled from the collected records of five district courts in the period 1649–1700. These records have been analysed by identifying the different actors and voices of the narratives, the social stratification of the participants, their speech acts and how they were depicted by the court and by other participants. The analysis of the social stratification of accusers, defendants and witnesses shows evidence of a deeply hierarchical and patriarchal society: men and women of lower social status were not only grossly overrepresented as defendants in criminal investigations, they were also mostly excluded from participating as a witness. The inverse could be said about local elites and landed peasantry. Women were more often accused of crime, and while they were allowed to testify as witnesses, they were less so than men. The negotiation of the truth took place in three parallel and intersecting spheres of discourse, differing in what kind of questions were asked and what problems were being discussed between different categories of participants. The nature of crime was negotiated when accusers, defendants and witnesses debated the presented narratives; the accepted narrative of the crime was found by the assessment of the honesty of the individual participants, by considering their reputation and standing in the local community. While the word of the law was unrelenting and impossible to legally negotiate at the district court level, a kind of negotiation was done by the local community and sometimes also the district court taking the side of the defendant, pleading and petitioning the Royal High Court to find mercy for the convicted criminal.
