Law and psychoanalysis are disciplines that address different questions and have different purposes. However efforts have been made to find some spaces for interdisciplinarity. One of these efforts has been to use judicial proceedings as places in which individual traumas can be transformed into cultural and social traumas. This article aims to show the risks and pitfalls of this enterprise by using a real life example. The purpose is to show how law can fail on this purpose and turn itself instead into a place for revictimization. In this latter scenario the role of lawyers and their professional duties play a key role. / El derecho y el psicoanálisis son disciplinas que tienen propósitos diferentes y se formulan preguntas distintas. No obstante, son varios los esfuerzos que se han hecho y las posibilidades que existen para que ambas disciplinas puedan interactuar. Una de las formas a través de la que se ha propuesto una aproximación interdisciplinar es la idea según la cual los procedimientos judiciales pueden convertirse en escenarios para la socialización de un trauma de naturaleza individual y su consecuente tránsito hacía un trauma cultural de tipo colectivo. El presente artículo tiene como propósito advertir los riesgos de esta estrategia y demostrar, a través de un ejemplo puntual, cómo los procesos judiciales pueden fallar en este propósito y constituirse más bien en un escenario de revictimización. En este proceso de revictimización juegan un papel determinante los abogados, la concepción estándar de la ética profesional del abogado y la forma en la que esta enmarca sus deberes profesionales.

The dissertation thesis To Be a Lawyer - Theory and Practice of Professional Ethics of Chosen Legal Professions in the Czech Republic aims to strengthen (currently rather weak) discussion about professional ethics in the Czech Republic. The first part introduces elemental terminology of the topic which enables easier understanding of second and third part. The second part is devoted to the presentation of results of researches regarding the analysis of judgements issued by Czech disciplinary authorities on judges', state attorneys' and lawyers' discipline. The last part demonstrates how professional ethics scrutiny operates in a real-life situation. A judicial usage of social media serves as an example of such situation (or more precisely of such scrutiny). Arguments for and against the judicial usage of social media are articulated and based in a weighting of the arguments final decision is taken.

INTRODUÇÃO: O aborto em consequência do abuso sexual é permitido na legislação brasileira, porém não significa que exista um consenso sobre esse tema na nossa sociedade. O nosso questionamento foi, sobretudo, o livre arbítrio da mulher em decidir sobre a interrupção da gestação frente a esse direito que lhe é concedido e o impacto do abuso sexual na vida dessa mulher. Utilizamos dos conceitos basilares da bioética para fundamentar a problemática referente ao inicio da vida, bem como do principio da autonomia do ser humano diante da escolha. O sujeito que iremos nos deter é a mulher que um dia foi vitima de um delito e em outro momento se tornou uma criminosa. MÉTODOS: A pesquisa foi realizada na Penitenciaria de Piraquara no Estado do Paraná, Brasil. A seleção foi feita na escola da penitenciaria, no programa de educação de jovens e adultos. Após a seleção dos sujeitos, realizamos uma entrevista a partir de um roteiro semiestruturado. A analise qualitativa foi realizada a partir de uma analise temática. RESULTADOS: Tivemos em nossa amostra 65 sujeitos sendo que 50 responderam não terem sofrido abuso sexual e 15 responderam afirmativamente a essa questão. Isso representa que 23 % da população estudada foram abusadas sexualmente. E desses 15 sujeitos que sofreram abuso sexual 4 afirmaram procuraram o serviço de saúde e forma orientadas sobre os procedimentos para prevenir a gestação e doenças sexualmente transmissíveis. Realizamos a entrevista e na analise temática abordamos os seguintes tópicos: (1) o episodio da violência sexual, (2) momento da vida em que ocorreu, (3) se procurou ajuda , (4) se conhece o agressor , (5) se ficou gravida e se interrompeu a gestação decorrente do abuso sexual. CONCLUSÃO: A amostra estudada não representa todos os seguimentos sociais, uma vez que a pesquisa foi realizada com a população carcerária feminina. A interrupção da gestação em consequência do abuso sexual passa a ser um assunto secundário frente ao abuso sexual. Ocorreu um consenso entre todas as entrevistadas que o abuso sexual deixa marcas para sempre e que caso ocorresse uma gravidez fruto desse abuso iriam interromper / INTRODUCTION: Abortion as a consequence of sexual abuse is accepted by the Brazilian legislation. However, that does not mean that there is a consensus on the issue in our society. Our question was, above all, women\'s free will to decide upon interrupting her pregnancy, as this right is granted to her, as well as the impact of sexual abuse in their lives. We used bioethics concepts to as the base for the problem related to the beginning of their life, as well as the principle of human autonomy when facing a choice. The subject who we will analyze is the woman who, one day, was the victim of abuse and, in another moment, became a criminal, and started dealing drugs. METHODS: The study was carried out in the Piraquara Penitentiary in the state of Paraná, Brazil. Selection was carried out in the penitentiary school, in the education program for adults and young adults. After subjects were selected, they were interviewed using a semi-structured questionnaire. The qualitative study was performed by thematic analysis. RESULTS: There were 65 subjects in our sample, and 50 of them said they had not suffered sexual abuse; 15 stated they had, represented 23% of the population studied. From these 15 subjects who suffered sexual abuse, four stated they had sought the health services and were informed about the procedures to prevent pregnancy and sexually transmitted diseases. We carried out the interview and the thematic analysis on the following topics: (1) episode of sexual abuse; (2) moment of life when this occurred; (3) if they looked for help; (4) if they knew the abuser; (5) if she got pregnant and if they interrupted the pregnancy caused by sexual abuse. CONCLUSION: The sample analyzed does not represent all social segments, once the study was carried out among female prisoners in a women\'s penitentiary. Interruption of pregnancy as a consequence of abuse becomes a secondary issue when sexual abuse is considered. There was a consensus among the interviewees that sexual abuse marks the person for life, and that they would interrupt pregnancy if it was a result of the abuse.

Armed Drones: An Age Old Problem Exacerbated by New Technology

The purpose of this thesis is to examine the history behind and the use of militarized drones in modern day conflicts, and to conclude whether the use of these machines, with special attention to the United States, is legal, ethical, and morally defensible. In achieving the aforementioned goals, shortcomings of current policy surrounding drone warfare will be highlighted, acting as the catalyst for a proposal for changes to be made to better suit legal, ethical, and moral considerations. The proposal of a policy to help us work with armed drones is due to the fact that this thesis acknowledges that armed drones, like guns, nuclear weapons, or any type of military technology, is here to stay and that once we acknowledge that fact, the most important step is to make sure we have the right tools to judge the conduct of conflict carried out using armed drones or other weapons that raise similar issues and questions.

Dating Violence on Small Rural College Campuses: Are Administrator and Student Perceptions Similar?

In recent years dating violence has become more and more prevalent on college campuses. Reports of the range of dating violence vary widely, with studies reporting from 20% to 85% of college women experiencing dating violence. However, almost all research has been conducted among urban and/or large colleges and universities, with virtually no attention to what is happening on small and/or rural college and university campuses. When a possible 20% of college women have experienced dating violence on college campuses, there becomes a crucial need for administration at a college to have an accurate assessment of the college’s liability, and of the adequacy of the college’s programs and policies relative to dating violence. This study sought to determine whether administrators and female students on small rural college campuses have the same perceptions of the type and incidence of dating violence on their campus, and of the programs and policies the college has put into place to prevent and respond to dating violence. Two domains of perceptions were addressed, dating violence beliefs and experience, and dating violence policy knowledge. The same question was examined to determine if perceptions of resident and commuter students were the same, and if perceptions of under and upper class students were the same. The investigator surveyed 52 college administrators and 306 female students at a total of four small rural college campuses to determine whether administrator and female student perceptions of dating violence incidence/type and dating violence program/policy knowledge at the college were similar. Results were that administrators tended to have similar perceptions to students as regards dating violence beliefs and experience, although not specific types of dating violence. Students did not exhibit a strong knowledge of dating violence policy. Resident and commuter students displayed similar perceptions to each other, as did under class and upper class students.
