Contesting Uganda's legislative homophobia in the African court on human and peoples' rights: Substantive and procedural challenges

Magister Legum - LLM / In many societies, a division between genders exist. This differentiation is attributed to a patriarchal culture which creates gender norms in sexualities.1 A set of cultural practices and expectations exist; these cultural practices and expectations assume that heterosexuality is the cornerstone of social unions - this phenomenon is known as heteronormativity.2 Heteronormativity affords that there are only two sexes with predetermined gender roles,3 creating the homophobia in societies. Human rights infringements on the basis of gender identity and sexual orientation has become noticeable across Africa.4 Homophobia in Africa is linked to the codification of laws that infringed on human rights under colonialism, which still forms part of the current norms around sexuality.5 Homosexuality is prohibited and is unlawful in most of the countries in Africa, South Africa being the only country that allows for the legal union of same-sex couples.6 There have been a number of academic texts debating the importance of culture against the right to equality in the South African context; 7 however, there is an inadequate amount of academic text available about this topic on an African level. Therefore, an ongoing debate about the protection of "sexual minorities" contrasted with the protection of cultural rights exists on an international scale. 8 The rights of sexual minorities are disregarded too often and they are often denied equal and fair access to the law. A large number of African countries believe that homosexuality is un African,9 thus choosing to exclude lesbians and gays from citizen rights. 10 Due to this belief, the practice of homosexuality in Africa is seen one that goes against the morals and values of the majority of society. This creates a stand-off between cultural rights and equality rights of sexual minorities.

Fordringsägare vid konkurs : Revisionens betydelse i värderingen av ett litet bolags betalningsförmåga / Creditors at time of bankruptcy : The value of audits in credit ratings of small enterprises

Stora företagsbedrägerier och skandaler såsom Kreuger, Enron och Worldcom där fordringsägare led omfattande förluster, följs ofta av en debatt om revisionens syfte och omfattning. Efter påtryckningar från EU om att minska den administrativa bördan, öka konkurrenskraften och stimulera Europas ekonomi, avskaffades revisionsplikten för mindre aktiebolag i Sverige 2010. Fordringsägare i form av bland annat kreditgivare och investerare är parter som kan drabbas vid en konkurs och har därför behov av att ha en fungerande relation med företaget. Tillsammans med kompletterande information från revisorer bidrar kreditbetyg till en bättre bild av kreditrisker som fordringsägare utsätter sig för. Syftet med studien är att öka förståelsen för revisionens betydelse i värderingen av ett litet företags betalningsförmåga när det sedan 2010 inte längre är ett lagstadgat krav att ha revisor. Studien ger även möjlighet till att bättre bedöma revisionens påverkan på kreditrisken för fordringsägare i händelse av konkurs. Detta är en triangulerande studie, där insamling av data har skett genom både kvalitativa intervjuer och kvantitativ information från 57 konkursbon av små bolag från 2009 och 61 från 2012. Intervjuerna har gjorts med 10 respondenter inom revision, kreditgivning och konkursförvaltning. Resultaten har analyserats utifrån framförallt agent- och intressentteorin. Studien har kommit fram till att användandet av revisor är en funktion som värderas högt. De har en viktig roll när det gäller att hjälpa företagare att leva upp till de ekonomiska kunskapskrav som omvärlden ställer. Även när det gäller bedömningen av företagets fortsatta drift kan revisorns kunskaper bidra till att minska risken för en obeståndssituation. Studien har dock inte kunnat fastställa att underskottens storlek i konkurserna har påverkats av om bolaget har haft revisor eller inte. Varken respondenterna eller sambandsanalysen styrker någon skillnad i påverkan på prioriterade borgenärer efter avskaffandet av revisionsplikten. För både 2009 och 2012 har många konkurser små underskott medan få har stora, vilket indikerar att kreditgivare i det flesta fall har kunnat göra rimliga kreditbedömningar. / Major fraud and scandals in corporations such as Kreuger, Enron and Worldcom where creditors suffered significant losses, are often followed with debate around the purpose and scope of corporate audits. After pressure from the EU in order to reduce the administrative burden, increase competitive capacity, and stimulate the European economy the mandatory auditing was abolished for small enterprises in Sweden in 2010. Creditors of which some are banks and investors are parties that who can be affected by a bankruptcy and are therefore dependent on a working relationship with the enterprise. Together with additional information from an auditor credit ratings will aid a creditor in the assessment of exposed risk. This study aims to increase the understanding of audit significance in the aspect of credit rating of small companies and their ability to fulfil payments to prioritised creditors in case of bankruptcy as the legislated audit no longer is a requirement. It will also provide a possibility to assess the influence of auditing on the credit risk creditor is subject to in the event of bankruptcy. The study is using a triangulating method where data is collected using both qualitative interviews and quantitative data from 57 bankruptcies of small enterprises from 2009 and 61 bankruptcies from 2012. The interviews were conducted with 10 respondents representing auditing, loans, and Insolvency practise. The results have been analysed from the perspective of Agent- and Stakeholder theories. The study has derived to the conclusion that the use of auditors does carry a significant value. They have an important role to play when it comes to assisting entrepreneurs to live up to the expectation and skills their counterparts have on them. Even the assessment made by auditors on the company’s ability to continue operation, going concern, is knowledge which can contribute to the prevention of a future situation of insolvency. The study has not been able to prove any relationship between the company's level of debt in bankruptcy and if the company has chosen to have an auditor. Neither respondents in the qualitative data collection nor the search for correlation in the quantitative data has been able to support findings of difference on the impact on the prioritised creditors between the companies using auditors and the ones not using auditors from the time after the abolishment of mandatory audits. From both 2009 and 2012 most bankruptcies have low deficits and a small number have high, which indicate creditors have been able to make reasonable credit assessments.

Exploring a group of African male students' talk on gender equality.

This research investigated the manner in which a group of African male students perceive and construct gender equality in the work place. A sample of 19 African male students within the University of Witwatersrand student population was used. The participants were aged between 19 and 30 years. This specific age range was chosen on the grounds that most students in this age range would have already formed specific views regarding gender equality. Individual and focus group interviews were the main methods of data collection; both types of interviews were conducted with this varied sample of African male students. The study was qualitative in nature and it employed thematic content analysis as a method of data analysis. Key themes were identified and discussed.The results indicated the contradictory nature of how men understand and accept equality. This was evident in how men tried to curb and undermine the empowerment of women in a manner that helped to advance the agenda of men. The participants used a varied number of strategies to try and argue for male power and control. These strategies were utilised as deemed contextually relevant by the men. This was especially relevant in how men were seen to negotiate their roles within the workplace in a manner that would align or help them be seen to be in favour of equal opportunities in the workplace yet in private and within their homes they were seemingly against the whole notion altogether.

Would the flexibilization of these rights necessarily require deregulation of those same rights? If there are compensatory clauses, is it possible and valid the negotiation that chooses not to apply rights enshrined in labor legislation, without compromising the principle of worker protection? O papel da jurisprudência no Processo Civil contemporâneo / The role of case law in the contemporary Civil Procedure

A utilização correta da jurisprudência conduzirá a sociedade brasileira a uma maior estabilidade jurisprudencial, com respeito ao princípio da isonomia, não somente diante da norma legislada como também perante a norma judicada. Deve-se afastar a discrepância de decisões judiciais relativas ao mesmo tema, que tratam desigualmente os iguais, evitando assim o longo percurso das vias recursais para se obter um julgamento isonômico em situações idênticas. O princípio da isonomia visa garantir que todos recebam tratamento igualitário da lei e, de outro lado, oferece a certeza de que todos os juízes devem decidir de modo análogo quando se depararem diante de situações semelhantes. A jurisprudência, uma vez que traduz a interpretação da norma, deve ser estável e previsível, com o fito de pautar as condutas dos jurisdicionados em virtude de se conhecer o entendimento da Corte máxima a respeito de uma determinada matéria. Um direito instável e imprevisível não gera a segurança jurídica, nem a pacificação social que razoavelmente se espera. A aplicação da jurisprudência no tempo, através da modulação, ganha novos contornos em virtude de sua previsão legal no projeto do Código de Processo Civil. A mudança de entendimento sedimentado observará a necessidade de fundamentação adequada e específica, considerando o imperativo de estabilidade das relações jurídicas (art. 847, 1 do projeto concluído no Senado Federal). Privilegia-se, além do princípio da segurança jurídica, o princípio da confiança que deve ter como uma das suas consequências que a expectativa legítima do jurisdicionado seja respeitada mediante a aplicação da jurisprudência dominante antiga e mais benéfica para o jurisdicionado. Neste contexto, em se pensando em uma reforma processual efetiva, deve-se ter como objetivo a ser seguido, além da celeridade processual e eficiência dos atos jurisdicionais, a uniformização da jurisprudência, eis que a necessidade de formação de uma só pauta de conduta para o jurisdicionado deve ser o objetivo almejado. E este objetivo só será alcançado quando houver uma uniformização e aplicação da jurisprudência dominante. Os instrumentos processuais inseridos no Código de Processo Civil devem ser reavaliados e novos elaborados, já que até agora serviram para dirimir conflitos intersubjetivos e não mais respondem satisfatoriamente às novas situações, que são as necessidades e valores de uma sociedade globalizada, massificada. / The correct use of case law will lead Brazilian society to a greater judicial stability that complies with the principle of equality, not only before legal rules as well as before judicial norms.It should be avoided the discrepancy of judgments related to the same matter, which unequally treat the ones in the same circumstances, thus avoiding the long judicial journey in order to obtain a uniform judgment for similar situations. The principle of equality aims to ensure that everyone receives equal law treatment and on the other hand, assures that all judges should decide in the same way when they come across similar situations. The jurisprudence as it reflects the interpretation of the rule, should be stable and predictable, in order to guide the conduct of citizens as it states the highest Court understanding on a particular matter. An unstable and unpredictable rule does not create lawl certainty nor the social peace that one can reasonably expect. The application of case law in time, by means of its modulation, earns new contours due its legal provision in the Civil Procedure Code Project. The change of a settled understanding claims for an adequate and specific reasoning, considering the need for stability of legal relations (art. 847, 1 of the completed project in the Senate). This increases the value of the legal certainty principle and of legitimate expectations principle that should have as one of their consequences that the legitimate expectation of the claimer is respected by applying him the old and more beneficial ruling jurisprudence. In this context, the aim for an effective procedural reform should be pursued, besides the procedural celerity and the efficiency of judicial acts, and also the standardization of jurisprudence. An unique agenda of conduct for the claimants should be desired as a goal. And this can only be achieved when there is a standardization and application of prevailing jurisprudence.
