Legal Regulation of Waste Management: Current Issues / Teisinis atliekų tvarkymo reguliavimas: probleminiai aspektai

The author poses a question whether the current legal regulation of waste is proper. The question is answered by analyzing five issues: variety of the concepts of waste (waste can be perceived in distinct manners and the current concept aggravates the solution of two principal waste problems – danger to the environment and danger to human health); non-systematic use of terms (improper terms are used in Lithuanian legal acts); the jurisprudence of Lithuanian courts in explaining the concept of waste (the courts do not perceive waste properly); the twofold term of the municipal/household waste in Lithuanian legal acts (municipal/household waste is regulated by using the same term, thus it is not clear for which waste persons are taxed); the application of the municipal levy for waste management (the current model does not encourage to preserve the environment). The author concludes that the variety of the concepts of waste, the disagreements among the scholars on the question, the difficulties encoutered by the courts and non-ameliorating status of the environment show that it should be reasonable to discard the current legal regulation of waste. The two principal problems posed by waste and unsuccessfully solved by the current legal regulation are determined principally by the objects which are not in any possesion. Then waste should be perceived as an object which is not in a possesion and the legal regulation should be orientated in making all the objects to have a possesor. / Disertacijoje keliamas klausimas, ar esamas atliekų tvarkymo teisinis reguliavimas yra tinkamas. Į šį klausimą atsakoma analizuojant penkis atliekų tvarkymo teisinio reguliavimo probleminius aspektus: (1) atliekų sampratų įvairovę (atliekas galima suvokti labai įvairiai, o dabartinė atliekų samprata apsunkina dviejų pagrindinių atliekų keliamų problemų – pavojingumo aplinkai ir žmogui - sprendimą); (2) nesusistemintą terminiją (teisės aktuose vartojami netinkami terminai); (3) Lietuvos teismų praktiką aiškinant atliekų sąvoką (teismai atliekas suvokia netinkamai); (4) dvilypę komunalinių atliekų sąvoką (komunalinės atliekos teisės aktuose suvokiamos dvejopai, todėl neaišku, už kokių konkrečiai atliekų tvarkymą asmenys yra apmokestinami); (5) vietinės rinkliavos už komunalinių atliekų surinkimą ir atliekų tvarkymą taikymą (rinkliava neskatina asmenų tausoti aplinkos). Daroma išvada, kad atliekų sampratų įvairovė, teisės mokslininkų nesutarimai, ką laikyti atliekomis, teismų patiriami sunkumai nagrinėjant atliekų bylas ir negerėjanti aplinkos padėtis rodo, kad būtų tikslinga atsisakyti esamo atliekų teisinio reguliavimo. Dvi pagrindines atliekų problemas, kurias siekiama išspręsti esamu atliekų teisiniu reguliavimu, iš esmės kelia tik nevaldomi objektai. Tuomet atliekomis reikėtų laikyti tik tuos objektus, kurie nėra valdomi, o teisiniu reguliavimu siekti, kad visi objektai būtų valdomi.

The optimality of a dividend barrier strategy for Levy insurance risk processes, with a focus on the univariate Erlang mixture

In insurance risk theory, the surplus of an insurance company is modelled to monitor and quantify its risks. With the outgo of claims and inflow of premiums, the insurer needs to determine what financial portfolio ensures the soundness of the company’s future while satisfying the shareholders’ interests. It is usually assumed that the net profit condition (i.e. the expectation of the process is positive) is satisfied, which then implies that this process would drift towards infinity. To correct this unrealistic behaviour, the surplus process was modified to include the payout of dividends until the time of ruin. Under this more realistic surplus process, a topic of growing interest is determining which dividend strategy is optimal, where optimality is in the sense of maximizing the expected present value of dividend payments. This problem dates back to the work of Bruno De Finetti (1957) where it was shown that if the surplus process is modelled as a random walk with ± 1 step sizes, the optimal dividend payment strategy is a barrier strategy. Such a strategy pays as dividends any excess of the surplus above some threshold. Since then, other examples where a barrier strategy is optimal include the Brownian motion model (Gerber and Shiu (2004)) and the compound Poisson process model with exponential claims (Gerber and Shiu (2006)). In this thesis, we focus on the optimality of a barrier strategy in the more general Lévy risk models. The risk process will be formulated as a spectrally negative Lévy process, a continuous-time stochastic process with stationary increments which provides an extension of the classical Cramér-Lundberg model. This includes the Brownian and the compound Poisson risk processes as special cases. In this setting, results are expressed in terms of “scale functions”, a family of functions known only through their Laplace transform. In Loeffen (2008), we can find a sufficient condition on the jump distribution of the process for a barrier strategy to be optimal. This condition was then improved upon by Loeffen and Renaud (2010) while considering a more general control problem. The first chapter provides a brief review of theory of spectrally negative Lévy processes and scale functions. In chapter 2, we define the optimal dividends problem and provide existing results in the literature. When the surplus process is given by the Cramér-Lundberg process with a Brownian motion component, we provide a sufficient condition on the parameters of this process for the optimality of a dividend barrier strategy. Chapter 3 focuses on the case when the claims distribution is given by a univariate mixture of Erlang distributions with a common scale parameter. Analytical results for the Value-at-Risk and Tail-Value-at-Risk, and the Euler risk contribution to the Conditional Tail Expectation are provided. Additionally, we give some results for the scale function and the optimal dividends problem. In the final chapter, we propose an expectation maximization (EM) algorithm similar to that in Lee and Lin (2009) for fitting the univariate distribution to data. This algorithm is implemented and numerical results on the goodness of fit to sample data and on the optimal dividends problem are presented.

Thus, this study aimed to understand the sense of the concept of God to J. L. Moreno, discussing four of his writings, and we review the concept of God in the face of the concepts of spontaneity, creativity and moment. To this end, we in the study of the Moreno's written in 1920, 1923 and 1934, respectively, "The Words of Father," "The Theatre of Spontaneity" and "Who Shall Survive? ". We discussed, then, the fixed idea of God and the this meaning for Moreno, with his last written as a parameter autobiographical work originally published in 1989. And we conclude with questions of the epistemological's place of the notion of God to the understanding of the Moreno's theory.

Entomofauna associada à fase de implantação de sistemas agroflorestais utilizando modelo Nelder

Insects are one of the important elements for the Agroforestry action and handling, once they can act as material decomposers, cultivations powerful pollinator and herbivorous. This work aimed to evaluate the Entomological Fauna which is associated to implementation period of Agroforestry Systems, using Nelder s pattern. The research was realized on Experimental Fields of Agroecological Studies belonging to Instituto Federal de Educação, Ciência e Tecnologia de Sergipe, at Tabuleiros Costeiros region, in São Cristóvão SE city. The insects related to eight Agroforestry Systems: eucalyptus + corn (SEM), eucalyptus + beans (SEF), teak + beans (STF), teak + corn (STM), gliricidia + beans (SGF), gliricidia + corn (SGM), leucaena + corn (SLM ) and leucaena + beans (SLF). The monthly collects of insects were realized from February to September/2012, with pitfalls traps aids. In all evaluated systems, the insects that are from Hymenoptera line contrasted in the previous period to the implementation of Agroforestry Systems, while the partners of Diptera line were more expressive in the post period. Coleoptera was the order of the richest families in both periods. The family Formicidae was the most representative, independently of the collect period. The biggest number of insects was noted after the implementation of Agroforestry Systems. The SLF presented the hugest number of individuals, the SLM and SLF the hugest wealthy of families and the SEF, the hugest variety of insect families. The composition of insect families was highly similar among the evaluated Agroforestry Systems. The obtained results indicate that the rainy period, the available food offer, the variety of vegetal species, the distance among the systems and the collect method which were used, influenced in the Entomofauna levy associated to Agroforestry Systems. / Os insetos são um dos componentes importantes para o funcionamento e manejo dos Sistemas Agroflorestais, uma vez que podem atuar como decompositores de materiais, polinizadores e herbívoros potenciais das culturas. O presente trabalho teve como objetivo avaliar a fauna entomológica associada à fase de implantação de Sistemas Agroflorestais utilizando modelo Nelder. A pesquisa foi realizada no Campo Experimental de Estudos Agroecológicos, pertencente ao Instituto Federal de Educação, Ciência e Tecnologia de Sergipe, na região dos Tabuleiros Costeiros, no município de São Cristóvão-SE. Foram analisados os insetos associados a oito Sistemas Agroflorestais: eucalipto + milho (SEM), eucalipto + feijão (SEF), teca + feijão (STF), teca + milho (STM), glirícidia + feijão (SGF), gliricídia + milho (SGM), leucena + milho (SLM) e leucena + feijão (SLF). As coletas mensais de insetos foram realizadas de fevereiro a setembro/2012, com auxílio de armadilhas pitfalls. Em todos os sistemas avaliados, os insetos da ordem Hymenoptera destacaram-se no período anterior à implantação dos Sistemas Agroflorestais, enquanto que os representantes da ordem Diptera foram mais expressivos no período posterior. Coleoptera foi a ordem com maior riqueza de famílias em ambos os períodos. A família Formicidae foi a mais representativa independentemente do período de coleta. Maior abundância de insetos foi observada após implantação dos Sistemas Agroflorestais. O SLF apresentou maior abundância de indivíduos, o SLM e SLF maior riqueza de famílias e o SEF maior diversidade de famílias de insetos. A composição de famílias de insetos foi altamente similar entre os Sistemas Agroflorestais avaliados. Os resultados obtidos indicam que o período chuvoso, a oferta de alimento disponível, a diversidade de espécies vegetais, a distância entre os sistemas e o método de coleta utilizado, influenciaram no levantamento da entomofauna associada à fase de implantação dos Sistemas Agroflorestais.

Cette thèse étudie des modèles de populations branchantes appelés arbres de ramification, dans lesquels les individus évoluent indépendamment les uns des autres, ont des durées de vie indépendantes, identiquement distribuées (non nécessairement exponentielles), et donnent naissance à taux constant au cours de leur vie. On enrichit ces modèles en supposant que chaque individu porte un type et peut subir à la naissance une mutation, qui lui confère un nouveau type. On démontre dans le premier chapitre des résultats théoriques de convergence en loi pour des processus de Lévy bivariés sans sauts négatifs. Ces résultats sont ensuite exploités dans le deuxième chapitre pour établir un principe d'invariance pour l'arbre généalogique des populations décrites ci-dessus, enrichi de leur historique mutationnel, dans une asymptotique de grande taille de population. Enfin, on étudie dans le troisième chapitre la structure généalogique et le spectre de fréquence par site (nombre de mutations portées par un nombre donné d'individus) d'échantillons uniformes dans des populations branchantes critiques dont la limite d'échelle est un arbre brownien (par exemple, des arbres de naissance et mort critiques). Des perspectives d'applications de ces résultats à la génétique des populations sont présentées dans le quatrième chapitre. / This thesis studies branching population models called splitting trees, where individuals evolve independently from one another, have independent and identically distributed lifetimes (that are not necessarily exponential), and give birth at constant rate during their lives. We further assume that each individual carries a type, and possibly undergoes a mutation at her birth, that changes her type into a new one. In the first chapter, we prove convegence results for bivariate Lévy processes with non negative jumps. These theoretical results are used in the second chapter to establish an invariance principle for the genealogical tree of the populations described above, enriched with their mutational history, in a large population size asymptotic. Finally we study in the third chapter the genealogical structure and the site frequency spectrum (number of mutations carried by a given number of individuals) for uniform samples in critical branching populations whose scaling limit is a Brownian tree (e.g., critical birth-death trees). Possible future applications of these results to population genetics are presented in the fourth chapter.

Bank Bailouts, Bank Levy, and Bank Risk-Taking

This thesis is concerned with the relation between bank regulation and the risk-taking behaviour of banks. Two major instruments of regulatory intervention are considered: bank levy and bank bailouts. The major objective of this thesis is to provide an answer to the following questions: Do bank levies increase the risk-taking of banks in a competitive environment? When do bank bailouts decrease banks` risk-taking? Does the international coordination of bank bailouts affect the relation between bailouts and the risk-taking behaviour of banks? Who should rescue subsidiaries of multinational banks? How could an efficient bailout policy be designed and implemented? The bank levy and cooperation between national regulators play an important role in the recently adopted Bank Recovery and Resolution Directive (BRRD). This directive is a cornerstone of bank regulation in Europe. Although the conversion of debt into equity (bail-in) in emergencies is the key component of the current regulation, bailouts, or at least the assistance to struggling banks, should not be excluded. As the ordinary resolution tools, for instance, bail-in, have not yet been tested in a real crisis, and due to the fact that it will take time to prepare global institutions for such a tool, it may be useful to have an adequately designed tool of last resort available, such as an adequate bailout policy, in order to avoid the disruption of critical economic functions. We show that a bank levy may decrease banks`risk-taking behaviour. Bank bailouts can also decrease the risk-taking of banks. This depends on the regulator`s ability to condition his bailout policy in accordance with the macroeconomic environment, which has an impact on the banks` probability of success, or on his ability to condition the bailout policy on the banks` systemic relevance. Coordination of bailouts through a multinational regulator can improve welfare. The desirability of internationally coordinated bailouts depends on the dimension of the crisis. If the crisis is severe, it may be more efficient to delegate bank bailouts to a multinational regulator. However, such a delegation is not always feasible. Therefore, a predefined burden sharing of bank bailouts is necessary in order to achieve an efficient resolution of banks in distress.
