Aspects of banker liability : disclosure and other duties of bankers towards customers and sureties

Suretyships given in favour of banks are being challenged in the courts on the basis of equitable doctrines of unconscionable conduct, undue influence, or statutory provisions dealing with unfair conduct or unfair contract terms. This thesis is an enquiry into a bank's duties of disclosure or advice to an intending surety. Such an investigation also necessitates a study of the relationship between banker and customer, as the surety is quite often a customer of the bank as well, and, as a surety's obligation to the bank is an accessory obligation, the obligation is dependent on a valid principal obligation between the bank and the principal debtor - the customer. The face of modern banking has, however, changed dramatically and most major banks have become multi-functional. As a result, the banker-customer relationship may often be seen as a fiduciary relationship. A major problem brought about my multi-functioning banks is that of conflicts of interest between the bank and its customer. Furthermore, the banker-customer relationship is providing much more scope for lender liability than in the past. Various factors are currently having an impact on the law of contract, and this is expected to affect the legal policy makers in their assessments of whether a duty of disclosure of material facts exits or not. A surety has long been a favoured debtor in the eyes of the law, and the courts have developed a plethora of technical principles on which a surety can be relieved of his obligation. The escape routes of the surety, especially if he is a consumer as well, on the new grounds of public policy, unconscionability, good faith or unreasonableness, are growing. The results of these trends is the expected demise of suretyship as an acceptable, cheap form of debt security in the banking sector. / Jurisprudence / LL.D.

Life cycle assessment in the development of forest products : Contributions to improved methods and practices

The prospect of reducing environmental impacts is a key driver for the research and development (R&D) of new forest products. Life cycle assessment (LCA) is often used for assessing the environmental impact of such products, e.g. for the purpose of guiding R&D. The aim of this thesis is to improve the methods and practices of LCA work carried out in the R&D of forest products. Six research questions were formulated from research needs identified in LCA work in five technical inter-organisational R&D projects. These projects also provided contexts for the case studies that were used to address the research questions. The main contributions of the research are as follows: Regarding the planning of LCA work in inter-organisational R&D projects, the research identified four characteristics that appear to be important to consider when selecting the roles of LCAs in such projects: (i) the project’s potential influence on environmental impacts, (ii) the degrees of freedom available for the technical direction of the project, (iii) the project’s potential to provide required input to the LCA, and (iv) access to relevant audiences for the LCA results. Regarding the modelling of future forest product systems, it was found that (i) it is important to capture uncertainties related to the technologies of end-of-life processes, the location of processes and the occurrence of land use change; and (ii) the choice of method for handling multi-functionality can strongly influence results in LCAs of forest products, particularly in consequential studies and in studies of relatively small co-product flows. Regarding the assessment of environmental impacts of particular relevance for forest products, it was found that using established climate impact assessment practices can cause LCA practitioners to miss environmental hot-spots and make erroneous conclusions about the performance of forest products vis-à-vis non-forest alternatives, particularly in studies aimed at short-term impact mitigation. Also, a new approach for inventorying water cycle alterations was developed, which made it possible to capture catchment-scale effects of forestry never captured before. To connect the LCA results to global challenges, a procedure was proposed for translating the planetary boundaries into absolute product-scale targets for impact reduction, e.g. to be used for evaluating interventions for product improvements or for managing trade-offs between impact categories.

The content of this diploma thesis is the solution of the summary of the technical report, a study of the implementation of major technological stages, the time schedule of the main construction of the object, schedule object, the technological regulations for the monolithic ceiling structure and installation of steel structures, inspection and test plans, risk with subsequent security measures, itemized budget with bills of quantities, solving the major transport routes, design of mechanical assemblies and equipment to the construction site. The substrate was drawing documentation for the implementation of this construction.

Many legal institutions require a burden of proof regarding web content. This thesis deals with a problem connected to web reconstruction and archiving. The primary goal is to provide an open source solution, which will satisfy legal institutions with their requirements. This work presents two main products. The first is a framework, which is a fundamental building block for developing web scraping and web archiving applications. The second product is a web application prototype. This prototype shows the framework utilization. The application output is MAFF archive file which comprises a reconstructed web page, web page screenshot, and meta information table. This table shows information about collected data, server information such as IP addresses and ports of a device where is the original web page located, and time stamp.

The aim of my thesis was the design of a new urban structure, located in the existing buildings by the river Svitava inZvonařkaStreet, near the center of the city. My proposaladded to the existing urban character of the area and added it to the missing block development. This location has become an attractive area for the whole region, which offers a wide range of new jobs in services, administration, education, healthcare and a number of residential units for different social groups. The proposed multi-purpose building uses plot in the urban area and is designed as a selfcontained. It reduces transportation and cumulates more diverse functions in one place. It follows the surrounding urban areas. West facade respects the existing street line the MasnáStreet and its height fits the surrounding buildings. When forming materials, some spatial structuring principleswere used, namely: multiplicity, porosity and connectivity.

In my diploma thesis i deal with the construction of the mixed-use building in Boskovice, street lipova´ on plot 4363/2, 4415/111, 4415/116, 4415/107, 4370, 4415/109, 4415/110, 4415/1, 4415/94. The total area of the plot is 6460 m2. The mixed-use building has 4 floors and a part basement. Vertical constructions in the basement are designed from the concrete blocks and for the overgound floors porotherm clay grinded bricks p+d. The vertical peripheral structures are provided with an etics thermal insulation system. Horizontal bearing structures are designed as monolithic reinforced concrete slabs. The roof is a warm flat roof. In the mixed-use building are situated 4 offices, 2 shops, 2 small service offices and 8 dwelling units. Storage rooms and garage are designed in the basement. The drawing part of my thesis was processed in a computer program AutoCAD.

The subject of this master’s thesis is elaboration of project documentation for a multi-functional building according to the actual standards and norms given by law. The object has four floor above the ground and one floor partly below ground level with nine flats and two commercial premises. Residential part and commercial premises are separated from each other operationally independent and accessible main entrances. The basisc are made from contrete strips. The house is made by a brick technology of a ceramic blocks. The external walls are insulated with certified contact thermal insulation system. The building is roofed with warm flat roof.

The subject of this diploma thesis is a design documentation of multi-functional building. The building has a basement and four above-ground floors. The basement is served as an APS garage. The ground floor contains commercial premises as a bistro, copy centre and hairdresser's. The first floor is used for offices. The third and the fourth floors contain two maisonette with roof decks. Structural system is masonry systém of lightweight concrete block Ytong and RC’s elements. A roof is design as warm flat roof with waterproof membrane of m-PVC foil. Dominant elements are a ventilated cladding Cembrit and glass facade oriented on south-east.

Urban church, re-developing space within Pretoria's Schubart Park complex

The study investigates the development of church infrastructure within the urban environment. A symbiotic interaction between church form and urban conditions is proposed and contextualised through analysis of existing church models and current spatial concerns within Pretoria’s inner-city. The potential of church as agent for urban renewal and community development is identified and the study generates a spatial and programmatic model aligned with the inner-city’s need for meaningful and integrated interventions. A systemic definition of church proposes a multi-layered programme based on partnership and interaction while alternative church positioning suggests the concept of re-claiming inner-city spaces, applied through the re-development of the Schubart Park housing complex. This report presents the master thesis project carried out by Pierre Lindgren & Jacob Thagaard Hansen at KTH Royal Institute of technology for IKEA of Sweden. The project aimed to explore the capabilities of so-called smart textiles, as well as to establish clear user needs which these can meet. Based on this, a design proposal for a furniture concept was developed, with the main purpose of offering the client IKEA clearer paths for further research and development on the chosen materials. The final design proposal, which was named ODENSE, was developed based on the needs of users who want to be more active in their homes. The design proposal meets their need to have easy access to their training equipment, by way of a multi-functional storage. The storage solution offers additional functionality in the form of light, thus occupying the same space and providing the same functions as a floor lamp and a small storage shelf. The design proposal potentially offers additional environmental benefits with regard to energy consumption and CO2 emission as it merges two products and functions. As the furniture concept combines the functions light and storage, it also has the opportunity to meet more needs than what it was initially developed for. Thus, Odense has great potential to be further developed to meet the needs of even more users. The project group found great benefit in the concurrent background research on smart textiles, as it enriched the user study significantly and opened up the minds of both the interviewees and the project group members to the future development opportunities. / I denna rapport presenteras examensarbetet som utförts av Pierre Lindgren & Jacob Thagaard Hansen på Kungliga Tekniska Högskolan för Ikea of Sweden. Projektet gick ut på att utforska de möjligheter som så kallade smarta textilier erbjuder, samt att etablera tydliga användarbehov som dessa kan uppfylla. Utifrån detta kunde ett designförslag för ett möbelkoncept tas fram, med huvudändamålet att erbjuda uppdragsgivaren Ikea tydligare spår för vidare utveckling och efterforskning om materialen som valts. Det slutgiltiga designförslaget, som döptes Odense, togs fram utifrån behoven hos användare som önskar vara mer aktiva i sina hem. Designförslaget möter deras behov av att ha enkel tillgång till deras träningsutrustning, detta via multifunktionell förvaring. Förvaringslösningen erbjuder ytterligare funktionalitet i form av ljus. Designförslaget erbjuder potentiellt även ytterligare miljörelaterade förbättringar med avseende på energiförbrukning och CO2-utsläpp, eftersom det slår samman två produkter och funktioner. Då möbelkonceptet kombinerar funktionerna ljus och förvaring har det även möjlighet att möta fler behov än vad konceptet initialt togs fram för. Således har Odense stor potential att vidareutvecklas för att möta ännu fler användares behov. Projektgruppen fann stor nytta i den breda efterforskningen om smarta textilier, då den berikade användarstudien betydligt och öppnade upp både de intervjuades och projektgrupp-medlemmarnas sinnen till de framtida utvecklingsmöjligheterna.
