A democracia Cabo-verdiana e os pequenos partidos políticos / Cape Verde democracy and small political parties

A presente dissertação busca entender as razões do insucesso dos pequenos partidos políticos em Cabo Verde e o seu fraco desempenho eleitoral ao longo da história política cabo verdiana. O modelo do financiamento público tem sido apontado como a causa principal deste resultado. Questionamos essa explicação, buscando mostrar que a razão que está por trás do insucesso dos pequenos partidos não se deve unicamente à dificuldade de acesso ao financiamento público, mas também a outras variáveis, nem todas elas institucionais. Através da análise dos dados do Afrobarómetro é possível inferir que os pequenos partidos não têm apoio da população. As pessoas não transferem as suas preferências numa terceira força partidária, favorecendo assim os dois grandes partidos, fomentando ainda mais o bipartidarismo. / This work seeks to understand the reasons for the failure of small political parties in Cape Verde and its weak electoral performance throughout the political history Cape Verdean . Public funding model has been suggested as the main cause of this result. We question this explanation, seeking to show that the reason behind the failure of small parties is not due solely to the difficulty of access to public funding, but also to other variables, not all of them institutional. By analyzing the Afrobarometer data we can infer that the small parties have no popular support. People do not transfer their preferences in a third party force, favoring the two major parties, encouraging even more bipartisanship.

L'office du juge civil quant au relevé des moyens de droit / The raising of pleas in law by the civil judge

L’office du juge quant au relevé des moyens de droit est régi par les dispositions des principes directeurs du procès civil et plus particulièrement par l’article 12 du code de procédure civile. Fruit de la réforme des années 1960 1970 qui visait à renforcer le rôle du juge, les ambiguïtés de sa rédaction n’ont que très difficilement permis au dessein des réformateurs de se réaliser. Après trente ans d’hésitation jurisprudentielle, l’assemblée plénière de la Cour de cassation a, en 2007, enfin fixé le principe selon lequel le juge n’a que la simple faculté de s’écarter du fondement juridique invoqué par les parties si celui-ci s’avère erroné. Cependant, les exceptions se multiplient en faveur de l’obligation sous l’influence de la jurisprudence de la Cour de justice de l’Union européenne. En outre, le contexte procédural est différent de celui dans lequel est né la réforme. Des bouleversements sont intervenus quant aux exigences attendues des parties au regard du droit (principe de concentration des moyens) et l’architecture et l’objet des voies de recours est en pleine mutation (appel ; pourvoi en cassation). Le déséquilibre est flagrant entre office du juge et rôle des parties. Fort de ce constat, c’est en tenant compte des possibilités de censure du juge défaillant que la thèse propose des pistes en vue d’un renforcement raisonnable de l’office du juge de nature à offrir une meilleure garantie de leurs droits aux justiciables. / The function of the judge, as for raising pleas in law, is governed by civil trial’s leading principles, more specifically by article 12 of the French code of civil procedure. As a result of the 1960-1970 reform, which was intended to strengthen the role of the judge, the aim of the reformers has been difficult to achieve because of its writing ambiguities. After thirty years of a hesitant legal precedent, the Court of cassation in plenary assembly, in 2007, finally laid down the principle whereby the judge only has the ability to rule out the legal basis pleaded by the parties if it turns out to be incorrect. However, under the influence of the European Court of Justice case law, exceptions in favour of the obligation are increasing. Furthermore, the procedural context is different from the one in which the reform was passed. There have been upheavals regarding the requirements expected from the parties regarding the law (concentration of pleas’ principle) and the structure and purpose of legal remedies (appeal before the Court of appeal or the Court of cassation). The disparity between the function of the judge and the role of the parties is obvious. With this observation, by considering the censorship possibilities of the failing judge, this thesis proposes leads for a reasonable strengthening of the function of the judge to offer to the litigants a best guarantee of their rights.

L'interprétation des écritures des parties par le juge administratif français / The interpretation of the parties' writings by the French administrative judge

En vertu de la règle du principe dispositif qui s’applique au procès administratif, le litige est la chose des parties : la matière de l’instance est fixée par les écritures que les parties rédigent et qu’elles soumettent au juge administratif. L’essence de l’office de ce juge consiste à trancher le litige en répondant juridiquement aux prétentions et à l’argumentation développées par les parties dans leurs écritures. L’étendue de son intervention est donc tributaire de la formulation des écritures qu’il devrait se borner à interpréter littéralement, et ce même lorsqu’elles sont maladroitement rédigées. Pourtant, le juge s’autorise à les interpréter extensivement ou restrictivement. Les raisons qui président à ce choix sont incertaines. L’un des enjeux de cette recherche est de les clarifier. Elle doit aussi déterminer l’étendue de ce pouvoir, et notamment son caractère – est-ce une faculté ou une obligation ? –, les éléments des écritures susceptibles d’être interprétés, les parties dont les écrits peuvent être appréciés, les méthodes mobilisées, ou encore ses limites et les contrôles auxquels il est soumis. Mais, à cause du rôle central des écritures dans le procès administratif, leur interprétation peut avoir d’importantes conséquences sur cette instance. Certaines interprétations peuvent même la déstabiliser. La recherche doit donc envisager les mécanismes permettant de corriger ces déséquilibres. En interprétant les écritures des parties, le juge participe à la fixation de la matière de l’instance. Dès lors, cette étude doit, plus fondamentalement, contribuer à déterminer l’auteur de cette substance : les parties ou le juge ? / According to the principle of party autonomy that rules the administrative trial, the litigation is the thing of the parties: the disputed matter is set out in the contentious writings the parties submit to the administrative judge. The essence of the office of this judge is to settle the disputed by legally answering the claims and arguments developed by the parties in their written pleadings. The scope of his intervention is therefore dependent on the wording of the contentious writings, which the judge should confine himself to literally interpreting, even when they are badly written. However, he allows himself to interpret them extensively or restrictively. The reasons for this choice are uncertain. One of the stakes of this research is to clarify them. It must also determine the scope of that power, and in particular its character - is it a possibility or an obligation? -, the elements of the written submissions likely to be interpreted, the parties whose writings can be assessed, the methods used, or its limits and the controls to which it is subject. But, because of the central role of the written pleadings in the administrative process, their interpretation can have important consequences on this instance. Some interpretations can even destabilize it. This research should therefore consider ways to correct such imbalances. In interpreting the parties’ written submissions, the judge participates in the determination of the disputed matter. Consequently, this study must, more fundamentally, contribute to determining the author of this matter: the parties or the judge?

Champ d'application de la Convention des Nations Unies sur les contrats de vente internationale de marchandises

Le champ d’application de la Convention de Vienne de 1980 sur la vente internationale de marchandises constitue une question très délicate. En effet, le caractère abstrait et supplétif de ladite Convention a donné naissance à une jurisprudence fort divergente et à une doctrine rarement en accord. Les difficultés d’application de la Convention démontrent clairement les limites de cette dernière à s’adapter aux nouveaux contrats de vente internationale. Ces difficultés sont-elles dues à une mauvaise interprétation des termes de la convention ? Serait-il juste de compléter les lacunes de la Convention de Vienne par d’autres Conventions telles que les règles d’UNIDROIT ou les principes de droit européen des contrats ? Faut-il aller «au-delà» de la Convention de Vienne ? Toutes ces questions doivent être gardées en tête pour bien analyser le champ d’application de ladite Convention. / The scope of application of the 1980 Vienna Convention on Contracts for the International Sale of Goods is a very delicate issue. Indeed, its abstract and supplementary nature has given rise to markedly divergent judgements and rarely agreeing doctrine. The difficulties arising from the application of the CISG clearly exemplfy its limited ability to adap to novel international sale of goods contracts. Are these difficulties attributable to faulty interpretations of the provisions of the CISG? Would it be opportune to compensate for the CISG's shortcomings by resorting to other instruments, such as the UNIDROIT rules or the principles of European contract law? Is it necessary to look beyond the Vienna Convention? All these questions must be considered in order to properly analyse the scope of application of the CISG.

Environmental and green politics came into prominance during the last two decades. These two concepts, as well as environmentalism and ecologism are defined in this study and placed within the context of the political system. The emphasis is on green politics and ecologism. The global green movement is analysed according to policy, organisational structures and pattern of development. The South African environmental and green movements are described in the latter part of the study. It is shown that South Africa has a long history of environmentalism. The South African green movement is compared with the global green movement after which it is placed within the context of the South African political system. Green politics in South Africa seems to resemble the early stages of the development of the European movement and the concept of social justice is emphasised. Comment le droit international peut-il règlementer des phénomènes complexes ? Cette question se pose avec une acuité particulière en ce qui concerne la déforestation tropicale. En effet, les difficultés techniques et les intérêts divergents des États, découlant de l’interaction des multiples services assurés par les forêts, ont empêché l’adoption d’une convention internationale en ce domaine. Néanmoins, les négociations menées au sein du régime international du climat ont créé un mécanisme dit de « réduction des émissions résultant du déboisement et de la dégradation des forêts et le rôle de la conservation et de la gestion durable des forêts et du renforcement des stocks de carbone forestiers dans les pays en développement » (REDD+). Défini par un ensemble de décisions de la Conférence des parties à la convention-cadre des Nations-Unies sur les changements climatiques, il a déjà permis d’initier, sur le territoire des pays en développement, une amélioration substantielle du contrôle des ressources forestières et des réformes règlementaires et institutionnelles de grande ampleur. Notre étude se propose d’évaluer les spécificités du système normatif mis en place sur la REDD+. Elle a pour objet, en dépassant l’apparente faiblesse formelle des instruments juridiques sur lesquels il repose, de mettre en évidence sa portée normative. Elle révèle l’aptitude du droit international à règlementer des phénomènes complexes en donnant naissance à des systèmes juridiques adaptatifs. Elle démontre que la spécificité de tels systèmes normatifs réside dans la satisfaction de deux exigences opposées : la flexibilité et la sécurité juridique / How International law can regulate complex phenomenon? This question appears particularly relevant if we consider tropical deforestation. Technical issues and the opposite interests of States, stemming from interlinked services provided by forest, had prevented International community to adopt a convention on forests. Nevertheless, climate regime has recently created a so-called mechanism on « reducing emissions from deforestation and forest degradation in developing countries and the role of conservation and sustainable management of forests and enhancement of forest carbon stocks in developing countries » (REDD+). The normative framework laid down in decisions of the Conference of the parties has stimulated control improvement on forest resources and wide-ranging reform in developing countries. The study will evaluate the specificities of this normative system by going further its apparent normative weakness. It will expose how International law manage to regulate complex phenomenon by producing adaptive legal system. The study will demonstrate that the specific feature of this system lies in its ability to conciliate two opposite needs: flexibility and legal security

La thèse, s’appuyant sur le fonds de motets à grand chœur conservés à la bibliothèque municipale de Lyon, tente de répondre à la problématique de la pratique musicale lyonnaise au XVIIIe siècle. Les quatre-vingt dix-neuf manuscrits et imprimés conservés se présentent sous forme de partitions ou de parties séparées et viennent pour la plupart de l’ancienne académie des beaux arts ou Concert. La première partie présente les cadres d’exécution du Grand motet à Lyon, dont le Concert, actif entre 1713 et 1773, mais aussi l’éphémère académie des Jacobins, la cérémonie annuelle du vœu pour le salut du roi Louis XV, les fêtes et réjouissances publiques et les concerts spirituels. Le corpus des motets conservés à Lyon est l’objet d’une analyse rigoureuse : la deuxième partie s’attache au catalogue de l’académie, au support musical (papiers à musique, filigranes et graphies musicales), ainsi qu’aux éléments musicaux dont témoignent les sources. La troisième partie présente le répertoire lyonnais du genre. Lalande représente la moitié du corpus conservé et la majorité des compositeurs sont des maîtres de musique de la Cour ou de la capitale, mais l’on trouve également des compositeurs d’autres provinces (Pétouille, Valette de Montigny, …) et des Lyonnais (Estienne, Bergiron du Fort-Michon, Belouard, …). La réception des œuvres à Lyon est mise en évidence par des comparaisons de sources, tandis que quelques particularités locales apparaissent, telles que la composition en « fragments ». Cette étude permet d’affirmer que, si la musique à Lyon est inscrite dans son époque, elle développe néanmoins des caractéristiques qui lui sont propres. / This thesis is founded on the corpus of french “grands motets” which are part of the collection of the Lyon public library, and tries to explain the question of musical practice in Lyon in the 18th century. The ninety-nine manuscripts and engraved sources conserved in the collection are scores and material which come mostly from the ancient “académie des beaux-arts”, also known as Concert. The first part of the thesis presents the context of Grand motet performances in Lyon, namely the Concert, which was active from 1713 to 1773, the short-lived “académie des Jacobins”, the yearly ceremony of the vow for salvation of the king Louis XV, and also public festivities and spiritual concerts. The corpus of motets conserved in Lyon is the subject of a rigorous analysis: the second part is dedicated to the catalogue of the Concert, the musical support (music papers, watermarks and musical handwritings) and to musical elements which appeared in the sources. The third part presents Lyon’s repertory of the motet genre. Half of the corpus is made up of Lalande’s works; most of the composers are from the Court or the capital, but there are musicians from other French provinces (Pétouille, Valette de Montigny, …) and also from Lyon (Estienne, Bergiron du Fort-Michon, Belouard…). The specific nature of the treatment of the motet in Lyon is brought to the fore by a comparison of the sources, while local particularities appear, like the composition by “fragments”. This study shows that if Lyonnais music belonged to its time, it nevertheless developed its own characteristics.
