1 Abstract Decision making outside the general meeting of limited companies (per rollam) The aim of the thesis is particularly using the descriptive and the analytical method and the legal argumentation to analyse the legal regulation of the decision making outside the general meeting of limited companies (per rollam) contained in Civil Code and especially in Business Corporations Act, to focus of its specifics and possible interpretational problems of selected topics, to assess the impact of the per rollam decision making on rights of members of limited companies and last but not least to suggest framework possibilities for the further development of the legal regulation de lege ferenda. Alternatively, the comparative method with the British and Slovak legal regulation is used. The thesis is divided into four chapters; each of them is further divided into subchapters and closed with a partial summary. After the initial definition of the limited company and outlining its characteristics in the first chapter, the second chapter is devoted to the general analysis of the general meeting with an emphasis on possible alternative ways of decision making on and outside the meeting and to the question of the nature of the general meeting's resolution. Psykoanalytikers upplevelser av att patienten finns med i deras inre värld : utanför terapins tid och rum / Psychoanalysts' experiences of the patient's presence in their inner world : outside the therapeutic sessions

Inledning: Relationen mellan analytiker och patient i det terapeutiska rummet är av stor betydelse för terapin, men vilken betydelse har samma relation utanför nämnda rum? Frågeställningar: Denna studie syftar till att undersöka psykoanalytikers upplevelser av patientens närvaro i deras inre, utanför terapin, hur analytikern, det terapeutiska samarbetet och processen i terapin påverkas av detta. Metod: Fem analytiker intervjuades genom semistrukturerad kvalitativ intervju. Intervjuerna analyserades med Interpretative Phenomenological Analysis. Resultat: Analytikerna beskrev erfarenheter av en lugn, kreativ, rörlig och drömsk närvaro av patienten i terapeutens inre, av en betungande närvaro präglad av oro, av en närvaro präglad av både kärleksfulla känslor och oro, av en överföring och motöverföring präglad av stark aggressivitet, där analytikern känner sig ockuperad av patienten samt av patientens närvaro kopplad till rambrott. Diskussion: Samtliga analytiker uppgav att patienterna för dem blivit inre objekt, vilka utgjorde en bestående del av deras inre värld. Detta kunde upplevas både som berikande, i form av känslor av glädje, tillfredställelse och kreativitet, och krävande, i form av känslor av oro, frustration och ilska. I båda fallen upplevdes dock närvaron av patienten i analytikerns inre värld utanför terapin som en tillgång och ett verktyg i den terapeutiska processen. / Introduction: The relationship between analyst and patient in the therapeutic setting is of great importance in therapy, but what is the importance of this relationship outside the therapeutic setting? Question: The purpose of this study is to examine psychoanalysts’ experiences of the patient’s presence in their inner world, outside the therapeutic setting, how the analyst, the therapeutic collaboration and the therapeutic process are affected by this. Method: Five analysts were interviewed using semistructured qualitative interview. The interviews were analyzed using IPA. Results: The analysts described experiences of a calm, creative, fluid, dreamlike presence of the patient, of a burdening presence characterized by concern, of a presence characterized by feelings of both affection and concern, of a transference and counter transference characterized by aggression, where the analyst feels occupied by the patient, and of the patient’s presence linked to frame break. Discussion: All analysts stated that the patients had become internal objects, and a permanent part of their inner world. This could be experienced as both enriching, with feelings of joy, satisfaction and creativity, and demanding, with feelings of concern, frustration and anger. In both cases this presence was, however, experienced as an asset and a tool in the therapeutic process.

O objetivo da presente pesquisa é o de configurar o lugar do pensamento na obra de Michel Foucault, de modo que se evidenciem pontos de interlocução com algumas questões educacionais contemporâneas, em particular com aquelas que questionam os pressupostos de soberania do sujeito e do conhecimento os principais eixos norteadores das teorias críticas em educação. Nesse contexto, os estudos foucaultianos acerca do poder, da resistência e da subjetivação oferecem uma oportunidade ímpar de problematização das questões da verdade e do conhecimento, apontando para a experiência do pensamento da diferença. A pesquisa busca então sustentar o princípio de que, numa perspectiva pós-crítica, a tarefa educacional poderia deslocar-se do trabalho com o conhecimento para o do pensamento. Do ponto de vista metodológico, procedeu-se à genealogia da concepção de linguagem na obra do autor e, posteriormente, à do pensamento do fora e da diferença. Tais eixos temático-conceituais são vertebradores para a condução do percurso argumentativo. Assim, foram articuladas teoricamente as relações possíveis entre os conceitos de linguagem literária, loucura, morte, ser da linguagem, limite, transgressão, dobra e subjetivação. Nas considerações finais, estabeleceu-se que a experiência do pensamento instaura-se como uma possibilidade fecunda de produção ético-política da existência, cabendo à educação os cuidados em relação à estética de si e do mundo comum. / The present research aims at outlining the role of thought in Michel Foucalts work so as to highlight aspects which dialogue with certain contemporary educacional issues, mainly the ones that refer to the principles underlying the concepts concerning the sovereignty of the subject and knowledge, namely the main axes that guide the critical theories on education. Under the scenario, the Foucaultian studies on power, resistance as well as subjectivity offer an unique opportunity of problematizing the issues of truth and knowledge, focussing on the experience of the thought of difference. Therefore, this study tries to sustain, from a post-critical perspective, the principle that the focus of the educacional task could shift from working with knowledge to working with thought. From a methodological perspective, this work departed from the genealogy of the conception of language within the work of the author to the subsequent thought of the outside as well as the difference. Such thematic and conceptual axes proved to be essential to the development of the argumentative discussion. Hence, the possible relations between the notions of literary language, madness, death, linguistic being, border, trangression, fold and subjectivity were articulated. In the final considerations, it was stablished that the experience of thought departs from a rich possibility of ethical and political production of existence, thus empowering education with the responsibility of taking care of aesthetics at both the personal and the communal world.

Consumo alimentar e estilo de vida: um estudo longitudinal com estudantes universitários / Diet and lifestyle: a longitudinal study of college students

A universidade é um local de aprendizagem no qual conhecimento acadêmico, social e cultural permeia a relação entre os estudantes, onde estes terão a oportunidade de vivenciar diferentes situações durante o curso. A maior preocupação é como esta experiência influenciará o estado nutricional com a possível mudança dos hábitos cotidianos, como abuso de bebidas alcoólicas, uso irrestrito de suplementos vitamínicos e alimentares e a alimentação inadequada. O consumo alimentar de universitários foi o foco desta pesquisa que teve como objetivo geral identificar as principais mudanças do consumo de alimentos/ bebidas e estilos de vida por meio de estudo de coorte, envolvendo estudantes ingressantes nos cursos de graduação da Escola Superior de Agricultura \"Luiz de Queiroz\" - ESALQ/USP, e como objetivos específicos desenvolver, validar e aplicar um instrumento com a finalidade de identificar medidas comportamentais relacionadas aos hábitos de consumo alimentar, atividade física, situação socioeconômica e relacionar as informações obtidas ao estado nutricional do estudante; descrever o consumo dentro e fora do domicílio. Participaram da pesquisa estudantes com idade entre 18 e 30 anos. Um questionário foi aplicado juntamente com a avaliação antropométrica para mensuração do peso, altura e classificação do estado nutricional por meio do Índice de Massa Corporal (IMC). Este protocolo foi repetido após 8 meses de curso para que fosse identificada a situação do estado nutricional de cada indivíduo relacionada às mudanças do comportamento alimentar. Os dados coletados foram armazenados em base de dados no Microsoft Excel, sendo analisados por meio do Statistical Analysis System. Os dados quantitativos foram expressos em média e desvio-padrão (DP) com cálculos de intervalos de confiança de 95%. O teste do qui-quadrado foi utilizado para comparar a distribuição da prevalência de sobrepeso e obesidade quanto à variável sexo, associando-se ao IMC. Foi utilizado o coeficiente de correlação intraclasse de Pearson para verificação de concordância entre peso e altura aferidos e referidos. Foi realizada análise de regressão múltipla para identificação da mudança de consumo entre as fases, assim como para peso corporal. Utilizou-se o nível de significância de 5%. Observaram-se entre as duas fases quantidades preocupantes de nutrientes ingeridos aquém ou além dos limites preconizados para ambos os sexos; destaque para o elevado consumo de sódio, e insatisfatório de carotenóides. No caso dos carotenóides, houve crescimento significativo da contribuição da categoria 3 para as alunas. O consumo de cafeína na segunda fase foi maior, predominando o fornecimento pelos alimentos ultraprocessados. De forma geral houve aumento do consumo de alimentos processados e ultraprocessados. Observou-se aumento (significativo a 5%) no consumo de lipídios. Constatou-se diminuição na prática de exercícios físicos e aumento na ingestão de bebidas alcoólicas, e destas com energéticos e no tabagismo. Concluiu-se que o ingresso na universidade contribui para a mudança nos hábitos alimentares e estilos de vida de maneira negativa, sendo necessária intervenção adequada visando a promoção da saúde dos estudantes. / The college is a learning place where academic, social and cultural knowledge exists in the relationship between students, where they will have the opportunity to experience different situations during the course. The biggest concern is how this experience will influence on the nutritional status with the possible change in daily habits, such as alcohol abuse, unrestricted use of vitamin and food supplements and inadequate nutrition. Dietary intake of students was the focus of this research aimed to identify the main changes in the consumption of food, beverage and lifestyles through cohort study, involving freshman students in undergraduate courses of the Escola Superior de Agricultura \"Luiz de Queiroz \" - ESALQ/USP, and specific objectives are to develop, validate and apply an instrument in order to identify behavioral measures related to food habits, physical activity, socioeconomic status and relate the information obtained to the nutritional status of the student, describe consumption inside and outside the home. the participants were students, aged between 18 and 30 years. A questionnaire was administered along with the anthropometric for measuring weight, height and classification of nutritional status using the Body Mass Index (BMI). This protocol was repeated after 8-month course to be identified the situation of the nutritional state of each individual related to eating behavior changes. The collected data were stored in a database in Microsoft Excel (2007 version), and analyzed using the Statistical Analysis System software (version 9.3). Quantitative data were expressed as mean and standard deviation (SD) with calculation of 95% confidence intervals. The chi-square test was used to compare the distribution of the prevalence of overweight and obesity and gender, associating with BMI. We used the intraclass correlation coefficient of Pearson to check correlation between weight and height measured and reported. It was performed multiple regression analysis to identify the change in consumption between phases, as well as body weight. Used the significance level of 5%. They were observed between the two phases worrying amounts of nutrient intake below or above the recommended limits for both sexes; especially the high sodium intake, and poor carotenoids. In the case of carotenoids, a significant growth of the category 3 contribution to the students. Caffeine consumption was higher in the second phase, predominantly supply the ultra-processed food. Overall there was an increase in the consumption of processed foods and ultra-processed. There was an increase (significant at 5%) in the consumption of lipids. Found a decrease in physical exercise and increased intake of alcohol, and those with energy and tobacco. It was concluded that entry into the university contributes to the change in eating habits and lifestyles in a negative way, requiring appropriate intervention to combat harmful habits to aiming to promote the health of students.

The main questions which guided this study consider reflections about the assistance directed to children and teenagers in a vulnerable situation in Maringá, the analysis of the configurations of the Non-Formal Education scenario in the Brazilian Education and the factors which define the educational practices in institutions in the Third Sector. It was analyzed two philanthropic and social institutions in Maringa. The study is characterized by being a qualitative and multi-referential. The theoretical reference is composed by authors of the Popular Education, Non-Formal Education and critics of the Third Sector. The methodological procedures applied were: semi-structured interviews and focal groups. In order to understand the policy considering the assistance to children and teenagers interviews were performed with the members of the Municipal Committee of Children and Teenagers Rights – MCCTR and with employees of the Secretariat of Social Assistance and Citizenship – SSAC. To understand the effectiveness of these policy and the educational practices of the institutions, it was performed interviews with the social tutors, coordinators of the supplementary activities outside class time and also the assembling of focal groups with teenagers from the institutions. The main considerations about this study are: the SSAC establishes, most of the times, a relation with the institutions of supplementary activities outside class time of the bureaucratic and distant city. The MCCTR is characterized as a structure that seeks the democratic acting, but ends up being limited to projects, reports, few visits and verifies the denunciations. In relation to the social educators it is understood that they need to build up the educative action as a group, to reflect about the performed studies and reflect in order to discuss the aims and projects of the institutions of supplementary activities outside class time in which they work, to mediate the institutional proposals of the popular classes and the social policy. In relation to the teenagers, it is verified that they are from popular classes with a very low scholar output and who consider the institutions of supplementary activities outside class time that they participate a cozy space and an opportunity of being inserted into the work market and the ludic and sport activities represent a leisure and compensating time due to the routine that they have. In this way it was possible to highlight the urgent necessity of reflections about the public policy and educative actions formed in the partnerships established with the Third Sector and the State in order to the social inclusion of the children and teenagers in a vulnerable situation. / Este estudo tem por objetivo investigar conceitos subjacentes às falas dos sujeitos envolvidos no processo da Educação Não-Formal na cidade de Maringá, tendo como foco principal as atividades lúdicas e esportivas. As questões que nortearam o trabalho estão voltadas para as reflexões sobre a política de atendimento às crianças e adolescentes em situação de vulnerabilidade social em Maringá, a análise das configurações do cenário da Educação Não-Formal na educação brasileira e dos determinantes que definem as práticas educativas em instituições do Terceiro Setor. Foram analisadas duas instituições de cunho filantrópico e social da cidade de Maringá. O estudo caracteriza-se por ser uma pesquisa qualitativa de cunho multirreferencial. O referencial teórico é composto por autores da Educação Popular, da Educação Não- Formal e críticos do Terceiro Setor. Os procedimentos metodológicos utilizados foram: entrevistas semi-estruturadas e grupos focais. Para compreender a política de atendimento às crianças e adolescentes, foram realizadas entrevistas com os membros do Conselho Municipal de Direitos da Criança e do Adolescente – CMDCA e com funcionárias da Secretaria de Assistência Social e Cidadania – SASC. Para entender a efetivação dessas políticas e as práticas educativas das instituições, foram realizadas entrevistas com os educadores sociais, coordenadores das instituições de contra turno social e realizados grupos focais com adolescentes institucionalizados. As principais considerações sobre este estudo são que: a SASC estabelece na maioria das vezes uma relação com as instituições de contra turno social da cidade burocrática e distante. O CMDCA se configura como uma estrutura que busca adentrar na atuação democrática, mas que acaba se limitando a projetos, relatórios, visitas esporádicas e apuração de denúncias. Em relação aos educadores sociais compreendemos que estes precisam construir coletivamente a ação educativa, refletir sobre os trabalhos realizados e discutir os objetivos e projetos das instituições de contra turno social em que atuam, fazer as mediações entre as propostas institucionais, a realidade das classes populares e as políticas sociais. Quanto aos adolescentes, o que se verifica é que são provenientes de classes populares, têm um rendimento escolar muito baixo, consideram a instituição de contra turno social que freqüentam um espaço acolhedor e uma oportunidade de serem inseridos no mercado de trabalho e que as atividades lúdicas e esportivas representam um momento de descanso e de compensação diante da rotina imposta a eles. Sendo assim, foi possível evidenciar a urgente necessidade de reflexões sobre as políticas públicas e as ações educativas formadas nas parcerias estabelecidas entre o Terceiro Setor e o Estado no sentido de inclusão social das crianças e adolescentes em situação de vulnerabilidade social.

Morphosyntactic competence of adult learners of English in Sweden : The impact of L2 exposure outside school and highest completed education on morphosyntactic development

The aim of this study was to investigate the morphosyntactic development of Grundvux learners (adult learners who study school subjects at elementary school levels in Sweden) of English with the aid of Processability theory, or PT, and to investigate the potential influence of exposure to English outside school and the participants' highest completed formal education on the participants' morphosyntactic levels. The participants of this study were Grundvux learners who studied English either on National Course 2, 3, or 4. This study also investigated how similar or different Course 2, 3 and 4 participants were when it comes to their highest attained PT-levels. The participants described a picture series and answered questions about their highest completed education from their home countries and how much they tend to be exposed to English on a weekly basis outside school. The results show that Course 2, 3 and 4 participants have both similarities and differences regarding their highest attained PT-levels. The results also show that there could be a possible connection between educational background and morphosyntactic development, i.e. that educational background can have a solid influence on morphosyntactic development. Furthermore, this study shows that a connection between exposure to English outisde school and morphosyntactic development is not likely. Yet, more research with more participants and tasks with different instructions are needed to draw definitie conclusions about the effects of exposure to English outside school and highest completed education on learners' morphosyntactic development. Lastly, this study provides some information to in-service teachers about what morphosyntactic structures to teach and when based on the learners' highest attained PT-levels.

在銀行進行放款的過程中,經由審核、監督、流動性轉換等流程,銀行對借款人資訊會有進一步的認識及瞭解,而這些資訊並無法完全被其他金融機構或市場所知悉,故資訊上的好處可讓銀行與借款人間建立「借貸關係」。 許多實證文獻探討「借貸關係」,這些文獻均支持「借貸關係」對銀行和借款人具有價值。而本文則以理論模型推導的方式,研究「借貸關係」對放款契約的影響。本文發現,在「借貸關係」建立的過程中,「內部銀行」可瞭解借款人的品質及資訊,並透過這些內部的資訊,獲取「資訊獨佔力」帶來的好處。而透過銀行與借款人間「借貸關係」的維持,及銀行間的潛在競爭性,則可以舒緩銀行和借款人間「資訊獨佔」的扭曲效果。另外,內部資訊也能讓借款人得到利益,好的借款人可利用較低的利率融資,並獲得較高的放款額度;而壞的借款人則會漸被排除在市場之外。

<p>The focus of the dissertation is on the performance of the yoiks, what the yoikers tell the audience and what the yoikers mean with their narratives. The results demonstrate that the verbal art of yoik includes both song and spoken messages. The analysis of the yoik tradition is couched within performance theory. The discussions of the performance give keys to understanding storytelling, oral history, verbal art and a means to recognize when a yoiksong, vuolle, begins or when it stops and why the performer yoiks its vuolle the way he or she does. I argue that an inside perspective in conjunction with performance theory, provides a highly fruitful method to research in yoik tradition. In order to understand the tacit knowledge in the performance, it has been highly relevant to discuss the seminal work by the Sami author Johan Turi and to compare his theories with Sami scholars like Israel Ruong, Nils Jernsletten and Harald Gaski.</p><p>In the 1900s there were three broader documentation projects of yoik tradition in Sweden. The first one was conducted in the 1910s by Karl Tirén, who used the phonograph and wax cylinders. In the 1940s the Institute of Language and Folklore (ULMA/SOFI) undertook a documentation project and in the 1950s the Swedish Radio did so too. Now, it was now possible, with the modern technology, to analyse the yoik tradition in new ways. It enables re-listening to the stories that was told and to see them in a context where the performers’ artistic skill, together with their social background and their relation to their audience is made visible.</p><p>It has been discussed if there was an epic yoik tradition in South Sami areas. One hypothesis says that epic yoik was found only in northern areas in close connection to Finnish culture. However, this study shows that there was an epic yoik tradition in southern Lapland and probably the last of these epic singers passed away in the 1960s. The yoikers presented here are all good representatives of an epic yoik tradition. Sara Maria Norsa, Nils Petter Svensson, Jonas Eriksson Steggo and Knut Sjaunja are my main informants in the archive material, where their performances are described with accuracy. This makes it possible to analyse the events they are participating in. They are all in fact telling their lives’ stories by describing reindeer herding.</p><p>This dissertation demonstrates the yoik tradition in its context, and I show that the vuolle has a structure where one can recognize when it begins and when it ends. The yoik tradition is not only music or song, the story that is told is equally important. The way of presenting a vuolle is also a part of the yoik tradition and one has to consider both the spoken and the sung messages in order to understand what the performer means. In short, yoik must be recognized as verbal art or storytelling.</p>

Medium Effectiveness:Placement Strategies for Digital Signage : Inside and Outside Store Locations

<p>In this age of ubiquitous advertisement, people are getting more and more burdened withadvertising clutter. Digital Signage (DS) has evolved to be a new medium that can cut throughthis clutter and reach a large number of consumers. Though Digital Signage was introduced asan in-store advertising medium, soon it started to replace traditional static billboards with thebenefit of technological advancement.</p><p>While advertising effectiveness is a much discussed subject, effectiveness of an advertisingmedia is still a less explored area. Our research explored the effectiveness of Digital Signageas an advertising media in terms of its placement inside of a store and outside of a store. Atthe beginning we developed a model to measure the effectiveness of Digital Signage on thebasis of an existing model, termed as Advertising Response Model (ARM). Based onprofound study and analysis of previous literature on advertising and media effectiveness,consumer psychology, outdoor advertising and intermediate measurement variables weconstructed the modified version of ARM that deemed to be the best fit with our purpose. Wefurther developed four hypotheses on the basis of the four major variables of our model.</p><p>The result of our study indicated that placement of Digital Signage inside and outside of thestore environment impacts the variables of Attention, Recall and Media Liking of theaudience differently. However, no significant difference in consumers’ Buying Interest issupported. Placing Digital Signage inside of the store as well outside of the store both hasdifferent degrees of impact on consumers in terms of Attention, Recall and Media Liking. Thecorrelations among the variables were also explored and thus we presented some strategicinsights about the placement of Digital Signage and practical implications for managers in thescope of our study.</p><p>Our research area has received comparatively less academic attention than other advertisingmedia. However, considering the growing importance of Digital Signage as a groundbreakingadvertising medium and scope of future research work, we believe Digital Signage will be asubject of interest for the academics, the advertisers as well as for the companies.</p>

Coetzee, in his works Waiting for the Barbarians, Life & Times of Michael K and Disgrace, does not simply critique the mentality of Empire, an “Enlightenment” or colonialist mode of knowing that knows no bounds to reason, but offers an alternative through the Magistrate, Michael K and David Lurie, all of whom are brutally shamed and “abjected”. Each character, I propose, experiences a Lacanian “therapy of humiliation” resulting in a subversion of their egos, which they come to understand as antagonistic, a site of misrecognition. In doing so, these characters confront limitation, whether by means of a Lacanian “death drive” or the abjection of the self. I argue, this subversion of their egos necessitates a return to the humility of the body resulting in a new ethical openness to others and an engagement with the world through “care” or “love” or “beauty” which manifests as careful negotiation and attentiveness. Confrontation with death, thus, allows the Magistrate, Michael K and David Lurie to slough off “Enlightenment” values in favor of an anti-humanist way of living.
