A Study on Legal System of Assembly and ParadeYin, Chun-shiang 12 August 2008 (has links)
As it¡¦s proclaimed in Article 14 of Constitution of the Republic of China that ¡§The people shall have freedom of assembly and association,¡¨ the government shall stipulate associated laws to protect people¡¦s freedom to exercise the said right. However, since the practice of Constitution, owing to political environment, the constitution of laws guaranteeing people¡¦s freedom to exercise the right of assembly and parade had been delayed for a long time. Assembly and Parade Law was not promulgated until Jan. 20, 1988 after the martial law declared to be ended. Hence, people can claim the right of assembly and parade and police authority can execute tasks regarding order maintenance accordingly. Nevertheless, the said Law was stipulated under the time and environment that the concept, ¡§Value Society Security above Human Right¡¨ being purposely reinforced. Therefore, controls over people¡¦s basic rights still remained therein. Though Assembly and Parade Law was amended twice and supported by Interpretation of Shih-Zih No. 445 made by Council of Grand Justices, there seemed no changes made on the entire regulation and the shadow of controlling still existed. Therefore, unceasing criticism was generated arguing that it is violation of Constitution. As a result, it¡¦s essential to make a research on how to formulate the legal system of assembly and parade that will ¡§protect people¡¦s freedom of assembly and parade¡¨ as well as ¡§maintain social orders.¡¨
The legal system of assembly and parade of Republic of China is examined herein by the basic methods of administrative law, namely, the five major frameworks, including administrative principles, administrative organization, limitation of administrative power, administrative relief, and administrative supervision from every respect and viewpoint. Meanwhile, bibliography exploration, historical narration, comparative analysis, and generalization analysis are adopted as the principal research approaches to explore whether there¡¦s any improvement required regarding ¡§Legal System of Assembly and Parade¡¨ on the basis of five major frameworks of administrative law. Additionally, practical implementation and suggestions for regulations and actions concerning future assembly and parade are hereby provided to achieve the goal of protecting people¡¦s freedom to assemble and parade and maintaining social orders as well.
With the exploration by means of five major frameworks of administrative law, the assembly and parade legal system of Republic of China has formed the prototype as that of countries ruled by law. However, problems such as inappropriate system design, incomplete decrees and laws, uncertain legal concepts and unclear meanings as well as rigid adherence to bureaucrat system still remained in the existing legal system of assembly and parade of Republic of China. As a whole, restriction exceeding protection is also the major cause generating criticism against the legal system of assembly and parade presently. Under this condition, it would result in endless ¡§Police-Civilian Conflicts¡¨ emerged upon assemblies and parades and even the freedom and right that people have for assembly and parade will be violated illegally. The governor shall examine the problems dwelling in assembly and parade legal system of Republic of China on the basis of five major frameworks of administrative law one by one as soon as possible and further to review and perform modification. This is exactly the method of radical reformation and solution.

La celebració mediàtica de la Victòria a la Rússia post-soviètica. Anàlisi transversal dels observables de l'hegemonia en la commemoració televisiva de la Victòria sobre l'Alemanya naziGuerrero Solé, Frederic 04 October 2011 (has links)
La present tesi doctoral té com a objectiu l’anàlisi de la commemoració televisiva de la Victòria sobre l’Alemanya nazi a la Rússia post-soviètica.
En particular, l’anàlisi es centra en la retransmissió de la desfilada militar del 9 de maig a la Plaça Roja de Moscou, el gran media event de la Rússia de Putin i Medvédev, i segueix el cami encetat per Dayan i Katz en l’estudi dels grans esdeveniments mediàtics.
Tal i com indica el subtítol de la tesi, aquesta anàlisi és transversal; a part de la retransmissió de l’acte central de la commemoració, també s’ocupa d’analitzar els discursos presidencials dels darrers onze anys (2000-2010), utilitzant la metodologia de la semiòtica narrativa, així com l’anàlisi de les programacions del dia 9 de maig entre 1964 i 2010 del principal canal de televisió rus, i de l’agenda temàtica dels noticiaris de les principals televisions del país del 19 d’abril al 16 de maig de 2010.
L’objectiu final de la tesi és posar de manifest les diferents estratègies que fan de la commemoració de la Victòria un esdeveniment mediàtic hegemònic a la Rússia actual i com a través d’aquest esdeveniment es constitueixen les bases de la identitat de la Rússia post-soviètica que converteix els seus ciutadans en soldats de la memòria històrica de la Victòria. / This thesis aims to analyze the TV celebration of the Victory over Nazi Germany in post-Soviet Russia.
In particular, the analysis focuses on the broadcast of the military parade of 9 May in Moscow’s Red Square, the great media event in Putin’s and Medvedev’s Russia, and follows the path begun by Dayan and Katz in the study of media events.
As indicated in the subtitle of the thesis, this analysis is cross-sectional; in addition to the broadcast of the main event of the commemoration, it also analyzes the presidential speeches from 2000 to 2010 —using narrative semiotics methods—, the programming on 9 May of Russia’s main television channel from 1964 to 2010 and the agenda of the main television news programmes in the country from April 19 to May 16 in 2010.
The goal of this thesis is to highlight the different strategies that turn the commemoration of Victory into a hegemonic media event in present Russia, and how through this event the basis of post-Soviet Russian identity is constructed, turning the Russian citizen into a soldier of the historical memory of Victory.

Previous issue date: 2016-08-29 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / In the thesis proposed, is concerned to argue about the micro-territorialities the LGBT Parade (Lesbian, Gay, Bisexual and Transsexual) in Goiânia, Goiás, from groups of individuals - or not, as there are those who prefer to remain isolated in space-time the event - which mediated by corporeality, performing and festive actions claim the to LGBT citizenship, and celebrate the Gay Pride movement in a party. A guiding question was revealed as thread for the development of research: how the public space of Goiânia is territorialized by participants of LGBT and how emerge micro-territorialities, guided in ephemeral relationships at the time of the event? Based on literature review on authors of Cultural Geography Critical, in Anthropology of Performance, in Social Psychology, and Philosophy; as well as field work in three editions of LGBT Parade (2013, 2014 and 2015) with semi structured interviews, questionnaires, photographs, cultural cartography and urban ethnography in the city's daily life; we analyze the discourses of hetero-normativity that imposes itself as mechanisms and power relations; break and daily transgression - based on speeches hostile to homosexuality - through the festive effervescence and the performances developed in the public space; and the construction of festive landscapes that come with own subversion of partying and celebrating diversity, sexuality and the possibility to show what is hidden in the city everyday. / Na tese proposta, preocupa-se em argumentar sobre as microterritorialidades na Parada LGBT (Lésbicas, Gays, Bissexuais e Travestis) em Goiânia, a partir dos ajuntamentos de indivíduos - ou não, pois há aqueles que preferem manter-se isolados no espaço-tempo do evento -, que mediados pela corporeidade, ações performáticas e festivas reivindicam os direitos à cidadania LGBT, e celebram o Orgulho Gay em um movimento-festa. Uma questão norteadora revelou-se como fio condutor para o desenvolvimento da pesquisa: como o espaço público de Goiânia é territorializado
pelos indivíduos partícipes da Parada LGBT e de que forma emergem as microterritorialidades, pautadas em relações efêmeras no instante do evento? Baseado em revisão bibliográfica em autores da Geografia Cultural Crítica, na Antropologia da Performance, na Psicologia Social e na Filosofia; além de trabalho de campo em três edições da Parada LGBT (2013, 2014 e 2015) com entrevistas semi estruturadas, aplicação de questionários, fotografias, cartografia cultural e etnografia urbana no cotidiano da cidade; analisamos os discursos acerca da heteronormatividade que impõe-se como mecanismos e relações de poder; a ruptura e transgressão do cotidiano - baseado em discursos que hostiliza a homossexualidade -, por meio da efervescência festiva e nas performances desenvolvidas no espaço público; e a construção de paisagens festivas que surgem com a subversão próprias do festar e do celebrar a diversidade, a sexualidade e a possibilidade de mostrar o que é ocultado no cotidiano da cidade.

In connection with their development this study also deals with the history of these formats prior to 1989 and with the period context. The complexity of the topic also forms the theoretical basis in which work is about notions of popular culture, mass and consumer culture and globalization. The concept of globalization is closely related to the developement of television programs. Globalization is going through all the basic components of the production of these programs, both music and the television environment itself, and is just a possible consequence of the decline in the popularity of television hit-parades today. should be conducted, for evidence derived from it to be admissible in court. To conduct effective investigation, it is important for investigators to be familiar with the concept “identification parade”, its purpose, the procedures to conduct it and its values.
To achieve the goals and objectives of the practice of an identification parade, investigators must know how to conduct it, what the value of its evidence is, and how to use it as a technique to identify suspects.
The direction, by implication, and clarification of the crime situation, is hardly possible without the determination of the identity of the perpetrator or suspect of a criminal act. This dissertation analyzes the choice and the development of this topic by the school, discussing the representations of slum presented in the parade and the ideas and negotiations held between members of the school during its preparation. More specifically, this work has the challenge of thinking slum presented by GRES St. Clement from the ' dogmas ' consolidated around the slum, as argued Licia Valladares (2005 ), and contrasting the expected luxury of a parade of Samba Schools with the simplicity composed of all alleged absence that the slum has. / Para o Desfile das Escolas de Samba do Grupo Especial do Rio de Janeiro em 2014, o Grêmio Recreativo e Escola de Samba (G.R.E.S) São Clemente escolheu o enredo 'favela'. A presente dissertação analisa a escolha e o desenvolvimento desse tema pela escola, problematizando as representações da favela apresentadas no desfile e as ideias e negociações mantidas entre os membros da escola na preparação do mesmo. Mais especificamente, o trabalho procura enfrentar o desafio de pensar a favela apresentada pela G.R.E.S. [pt] A dissertação dedica-se a investigar e compreender as opiniões e interpretações elaboradas por diversos segmentos sociais a respeito dos temas suscitados pela Parada do Orgulho LGBT, considerando que o evento propõe um agendamento de questões caras às minorias sexuais na sociedade. O ambiente de investigação foi a Internet e o foco recaiu sobre os discursos a respeito da Parada do Orgulho LGBT da cidade de São Paulo de 2011, presentes em blogs pessoais e sites de notícias. À luz de teorias oriundas da Análise do Discurso, identificaram-se padrões, referentes aos temas mais recorrentes suscitados pela manifestação e às estratégias discursivas relativas a cada tema. Neste processo, o estudo estipulou três categorias de análise, relativas às discussões sobre a pertinência do evento, aos direitos civis de minorias sexuais e ao juízo moral – biológico e religioso – sobre sexualidades não heteronormativas. / [en] The study aims to investigate the opinions and interpretations of readers s comments about the Parada do Orgulho LGBT (LGBT Pride Parade), considering that the event proposes an agenda for sexual minorities demands. The data were collected on the Internet and focused on São Paulo LGBT Pride Parade in 2011, in personal blogs and news websites. From a Discourse Analysis perspective, the study identified patterns, regarding the most recurring discursive strategies adopted in these statements. Three analytic categories have been found, regarding the pertinence of the event, civil rights for sexual minorities and the moral evaluation - both ideological and religious - about non-heteronormative sexualities.

POSTCOLONIAL DISSENT SCENOGRAPHY: setting civic scene, building urban voice, new societies prototyping facilitation for Tensta.Otkalenko-Povalinska, Mariia January 2022 (has links)
Urban space is a product of power relations and negotiations in society. Who gets represented and monumentalised in it, you? One is being formed and deformed by the environment they are placed into through the way it functions and suggests certain actions in a particular sequence, through the power distribution in its spatial equivalent. Cities, consciously or not, dictate and proclaim “norms” encoded into their visible and invisible fences by those in majority, those in power, systematically failing the misfits. Yet rebellious minorities coming out of oppressive systems refuse to be silenced and “normalised”, their dissent practices carry critical potential, highlighting systematic obstacles, testing response measures and prototyping alternative futures. For my research I define:Social sustainability as constant renewal of the system and social contract, adapting to the newly occurring challenges of the time.Dissent as expressing opinions, demanding conditions and carrying lifestyles, at variance with those hegemonic or officially held. Working in Stockholm’s suburban area of Tensta I concentrate on local postcolonial dissident practices. I want to take a look at how they can inform urban planning, making the system more flexible and adaptable to constant changes. I decode the disciplining choreography of the city and examine roles of such dissent actors as planner, civic educator, warrior and builder. In my design proposal I try toset a new civic urban stage with shifting borders, multilayered visibility, entrance and escape points, with mobilisation, education, commoning and retreat backstage able a) of making global, national and communal politics a local and tangible affair, b) of enhancing and empowering individuals and minorities in their role as civic actors, building peaceful urban voice; and create flexible local ecosystems c) facilitating new grassroots societies prototyping.
