El presente informe aborda sobre dos controversias judiciales tanto en el ámbito privado como en el público, sobre la materia de otorgamiento de escritura pública y reposición por despido laboral, respectivamente. El Expediente N° 1969-2016-0-0401-JR-CI-09, expediente privado, abarca sobre una demanda de otorgamiento de escritura pública de un contrato de promesa de compraventa de un local comercial ubicado en la ciudad de Arequipa. La controversia principal corresponde a si el contrato celebrado entre la compradora primigenia y los demandados se trataría de un contrato de promesa de compraventa o un contrato definitivo, y como consecuencia, si la transferencia realizada por dicha compradora primigenia a la demandante se trataría de una cesión de posición contractual o de una cesión de derechos. El Noveno Juzgado Especializado en lo Civil y la Segunda Sala Civil, emitieron sentencias contradictorias, estando de acuerdo respecto a que el contrato de promesa de compraventa se trataría de un contrato definitivo; sin embargo, discrepan respecto al segundo punto, toda vez que la primera de las mencionadas señala que la transferencia del inmueble materia de litis se habría realizado a través de una cesión de posición contractual y no a través de una cesión de derechos como señala la Segunda Sala Civil. Por otro lado, el Expediente N° 03489-2014-0-1801-JR-LA-08 abarca sobre una demanda de reposición laboral, toda vez que la demandante alude que la despidieron fraudulentamente por “haber participado en una pelea de agresión mutua verbal y física”, considerado falta grave establecida en el inciso f) del artículo 25 del D.S. N° 093-97-TR, en contra de una trabajadora de otra empresa, mientras se encontraba de vacaciones y en un lugar distinto al de su lugar de trabajo. En ese sentido, la controversia principal del mencionado expediente es determinar si el despido se encontraba realmente justificado o no. Al respecto, el Octavo Juzgado Especializado Permanente de Trabajo y la Cuarta Sala Laboral Permanente de Lima emitieron sentencias contradictorias, donde la primera de las mencionadas señala que no se ha acreditado objetivamente la falta grave imputada a la demandante por lo que corresponde la reposición laboral; a diferencia de lo señalado por la Cuarta Sala Laboral Permanente de Lima quien establece que si se produjo la mencionada falta grave. Finalmente, la demandante interpone recurso de casación, la misma que es declarada improcedente toda vez que pretende una nueva valoración de hechos ya analizados en la Sentencia de Vista. / This report deals with two legal disputes, both in the private and public scope, about granting of a Public Deed and replenishing for labor dismissal, respectively. File No. 1969-2016-0-0401-JR-CI-09, private file, is about a demand for the granting of a Public Deed of a sale promise contract of a commercial property located in the city of Arequipa. The main controversy corresponds to whether the contract between the original purchaser and the defendants was a sale promise contract or a definitive contract, and therefore, whether the transfer made by the original purchaser to the plaintiff was an assignment of contractual position or an assignment of rights. The Ninth Specialized Civil Court and the Second Civil Chamber issued contradictory judgments, both agreeing that the sale promise contract is a definitive contract; however, they differ about the second point, in which the first one indicates that the transfer of the property subject to litis would have been carried out through a transfer of contractual position and not through the assignment of rights, as indicated by the Second Civil Chamber. On the other hand, File N° 03489-2014-0-1801-JR-LA-08 is about a demand for replenishing for labor dismissal, in which the plaintiff argues that she was fraudulently fired for “having participated in a fight of mutual verbal and physical aggression”, considered a serious misconduct according with paragraph f) of article 25 of the Supreme Decree N° 093-97-TR, against a worker from another company while she was on vacation in place different than her workplace. In that sense, the main controversy of the mentioned file is to clarify whether the dismissal was really justified or not. In this regard, the Eighth Permanent Specialized Labor Court and the Fourth Permanent Labor Chamber of Lima issued contradictory judgments as well, in which the first indicated that the serious misconduct charged to the plaintiff has not been objectively proved and therefore it corresponds the replenishing; unlike what was indicated by the Fourth Permanent Labor Chamber of Lima which established that the serious misconduct aforementioned occurred. Finally, the plaintiff filed a cassation appeal which was declared inadmissible since it pretended a new analysis of facts which was already done in the judgment issued by the second instance court. / Trabajo de suficiencia profesional

Hash functions belong to elements of modern cryptography. Their task is to transfer the data expected on the entry into a unique bite sequence. Hash functions are used in many application areas, such as message integrity verification, information authentication, and are used in cryptographic protocols, to compare data and other applications. The goal of the master’s thesis is to characterize hash functions to describe their basic characteristics and use. Next task was to focus on one hash function, in particular MD5, and describe it properly. That means, to describe its construction, safety and possible attacks on this function. The last task was to implement this function and collisions. The introductory chapters describe the basic definition of hash function, the properties of the function. The chapters mention the methods preventing collisions and the areas were the hash functions are used. Further chapters are focused on the characteristics of various types of hash functions. These types include basic hash functions built on basic bit operations, perfect hash functions and cryptographic hash functions. After concluding the characteristics of hash functions, I devoted to practical matters. The thesis describes the basic appearance and control of the program and its individual functions which are explained theoretically. The following text describes the function MD5, its construction, safety risks and implementation. The last chapter refers to attacks on hash functions and describes the hash function tunneling method, brute force attack and dictionary attack.

Le contrôle des vibrations à basse fréquence adapté aux structures légères est un défi scientifique ettechnologique en raison de contraintes économiques et écologiques de plus en plus strictes. De récentes études enacoustique ont portées sur l’absorption totale d’ondes basses fréquences à l’aide d’absorbeurs parfaits sublongueursd’onde. Ces métamatériaux sont obtenus en exploitant la condition de couplage critique. Unegénéralisation de cette méthode pour le domaine élastodynamique serait d’un grand intérêt pour répondre auxexigences du contrôle des vibrations de structures légères à basse fréquence.Cette thèse vise à adapter le problème d’absorption parfaite des ondes de flexion dans des systèmes 1D et 2D avecdes résonateurs locaux en utilisant la condition de couplage critique. Une étude préliminaire sur des systèmes 1D àgéométries simples sont d’abord proposée. Celle-ci propose une méthode de conception de résonateurs simplespour une absorption efficace des ondes de flexion. Une complexification du système 1D est ensuite considérée avecl’étude du couplage critique de Trou Noir Acoustique (TNA) 1D. Ceci a motivé l’interprétation de l’effet TNA à l’aidedu concept de couplage critique afin de présenter des outils clés à de futures procédures d’optimisation pour ce typede terminaisons. La condition de couplage critique est ensuite étendue aux systèmes 2D. L’absorption parfaite parle premier mode axisymétrique d’un résonateur circulaire inséré dans une plaque mince infinie est analysée. Ladiffusion multiple par une ligne de résonateurs circulaires insérés dans une plaque mince 2D infinie ou semi-infinie,appelée métaplaque, est aussi considérée dans l’optique de se rapprocher d’une application industrielle. A traverscette thèse, des modèles analytiques, des simulations numériques et des expériences sont présentés pour valider lecomportement physique des systèmes présentés. / The vibration control adapted to light structures is a scientific and technological challenge due toincreasingly stringent economic and ecological standards. Meanwhile, recent studies in audible acoustics havefocused on broadband wave absorption at low frequencies by means of subwavelength perfect absorbers. Suchmetamaterials can totally absorb the energy of an incident wave. The generalisation of this method for applicationsin elastodynamics could be of great interest for the vibration control of light structures.This thesis aims at adapting the perfect absorption problem for flexural waves in 1D and 2D systems with localresonators using the critical coupling condition. A study of 1D systems with simple geometries is first proposed. Thisprovides methods to design simple resonators for an effective absorption of flexural waves. The 1D systems thenbecome more complex by studying the critical coupling of 1D Acoustic Black Holes (ABH). The ABH effect is theninterpreted using the concept of critical coupling, and key features for future optimisation procedures of ABHs arepresented. The critical coupling condition is then extended to 2D systems. The perfect absorption by the firstaxisymmetric mode of a circular resonator inserted in a thin plate is analysed. Multiple scattering by an array ofcircular resonators inserted in an infinite or semi-infinite 2D thin plate, called metaplate, is also considered to getclose to practical applications. Through this thesis, analytical models, numerical simulations and experiments areshown to validate the physical behaviour of the systems presented.

The thesis Catcher in the Rye and A Perfect Day for Bananafish - Motif analysis deals with motif analysis of these two literary works by J. D. Salinger. Analysis of the basic motifs of these works reveals the symbolism of Salinger's literary world, where the main themes are childhood, growing up and alienation. Essential role when presenting motifs goes to the main characters, who in these works are very distinctive, therefore they also need to be analyzed. In question of theory, the thesis is based on Boris Tomashevskyˈs concept of motif and narratological perspective of Tomáš Kubíček or Lubomír Doležel. Apart of the analysis itself the theses deals with questions of the relevance in the genre classification of the novel Catcher in the Rye as a Bildungsroman and whether Salinger idealizes childhood in his works or not.

This thesis deals with study of mappings preserving Borel classes or absolute Borel classes. We prove a theorem which shows that under some assumptions there exists a (selection) function with certain properties. Using this theorem we obtain several results on preservation of Borel classes. Moreover, thanks to that theorem we prove a theorem on preservation of absolute Borel classes under a perfect mapping. Next, we show an assertion which implies that a piecewise closed mapping has a restriction that is "piecewise perfect" and its image is equal to the image of the original mapping. Under certain additional assumptions we prove a similar assertion for an Fσ-mapping instead of a piecewise closed mapping. Using these assertions and the theorem on preservation of absolute Borel classes under a perfect mapping we obtain further results on preservation of absolute Borel classes, in particular, for piecewise closed mappings and Fσ- -mappings. In the last chapter we study mappings such that the inverse image of an open set under these mappings is of a particular additive class. 1

This research of distance learning in singing study provides some historical framework of long-distance singing study, including research on three former distance singing courses, which exemplify the "best practices" of their time: Siegel-Myers Correspondence School of Music, the Perfect Voice Institute, and the Hermann Klein Phono-Vocal Method: Based Upon the Famous School of Manuel Garcia. I also discuss current trends in long-distance singing study, including interviews and insights from current long-distance singing teachers using cutting edge technology in their virtual studios. Lastly, I make predictions and projections, based on analyses of past "best practices," where this information may have impact upon future methods of distance singing lessons, including conceivable distance singing course components of online degree programs offered at universities.

Historie und Moderne liegen in Lotzdorf nah beieinander. Das Kriegerdenkmal mit dem Turnerkreuz an der Ludwig-Richter-Schule Oberschule Lotzdorf erinnert an diejenigen Gefallenen des Ersten Weltkrieges, die dem Turnerbund Lotzdorf angehörten. Gleichzeitig zeigt sich die Ludwig-Richter-Schule mit ihren Schülern hochmodern und aktuell mit der Darbietung des Kult-Songs: „Cupsong Lotzdorf“, dargeboten in der modernen Sporthalle der Schule und als Film online ins Internet gestellt.

Im ersten Halbjahr 2016 wurde in Kooperation mit dem Martinsclub Bremen e.V. eine empirische Untersuchung zur funktionalen Varietät ' Leichte Sprache ' durchgeführt. Diese Ziele wurden verfolgt: 1) Für die ' Leichte Sprache ' wird u.a. vom ' Netzwerk Leichte Sprache ' reklamiert, für eine äußerst heterogene Zielgruppe von Nutzen zu sein. In der Untersuchung wird an Testitems, die z.T. erheblich gegen die ' Regeln ' für ' Leichte Sprache ' verstoßen, ermittelt werden, wie Gewährspersonen unterschiedlicher Zielgruppen (Menschen mit kognitiver Beeinträchtigung, Funktionale Analphabeten und Migranten) die ‚Schwierigkeit' und die ‚Akzeptabilität' der Items bewerten. 2) Die Regeln für ' Leichte Sprache ' sind (linguistisch) zu explizieren und auf die Bedürfnisse unterschiedlicher Zielgruppen zuzuschneiden. Beide Ziele wurden durch die Untersuchung für einzelne morphosyntaktische Phänomene erreicht. In diesem Artikel werden die Ergebnisse der Studie knapp vorgestellt und am Beispiel passivischer Strukturen des Deutschen im Detail diskutiert. Angrenzende Phänomenbereiche (sein-Perfekt, Kopulakonstruktionen mit sein und werden sowie werden mit futurischer und/oder epistemischer Lesart) werden nur angeschnitten.

In this paper, a periodic maintenance model is formulated assumingcontinuous monitoring, imperfect preventive maintenance (PM) and perfect correctivemaintenance (CM) using three decision variables, (I, N, Z). The model is derived in aninfinite horizon context where the mean cost per unit time is modelled. PM actionsare performed N − 1 times at time instants iT for i = 1, ..., N − 1, where T = ∆T · Iand ∆T is a fixed positive number representing the minimum time allowed betweenPM actions and I is a time interval multiple representing the decision of how oftenPM actions should be performed. The N:th maintenance activity is either a plannedreplacement (if Z = 0) or a corrective replacement from letting the component runto failure (if Z = 1). Imperfect PM is modelled using age reductions, either using aconstant r or a factor γ. Previous research on assumptions of these types has beenlimited as the assumptions yield models of high complexity which are not analyticallytractable. However, assumptions of this type are considered more realistic than othermore thoroughly researched assumptions, using e.g. minimal CM. Therefore, twocomplimentary optimisation methods are proposed and evaluated, namely, completeenumeration and a specially derived genetic algorithm which can be used for differentproblem sizes respectively. Carefully determined solution bounds enabled completeenumeration to be applicable for many input parameter values which is a great strengthof the proposed model. / I denna rapport modelleras en periodisk underhållsmodell baserat på antagandenakontinuerlig tillsyn,. ofullständigt förebyggande underhåll (FU) och perfektavhjälpande underhåll (AU) genom tre beslutsvariabler (I, N, Z). FU åtgärder utförs vid N − 1 stycken tillfällen vid tidpunkternaiT för i = 1, ..., N − 1, där T = ∆T · I och ∆T är ett givet positivt tal som representerarden minsta tillåtna tiden mellan FU åtgärder och I är en tidsintervallmultipelsom representerar beslutet kring hur ofta FU åtgärder ska utföras. Det har visat sig finnas få tidigare studier som baseras påliknande antaganden då antaganden av denna typ resulterar i modeller av högkomplexitet som inte går att optimera analytiskt. Dock anses antaganden av dennatyp vara mer realistiska än andra mer välstuderade antaganden som exempelvisminimalt AU. Därför föreslås och utvärderas två kompletterande optimeringsmetodertill modellen, nämligen, total genomsökning och en specifikt anpassad genetiskalgoritm som kan användas för olika problemstorlekar. Genom att härleda effektivalösningsavgränsningar kunde optimering med hjälp av total genomsökning bli möjligtför många olika värden på modell parametrarna vilket är en stor fördel med denslutgiltiga modellen.
