Diese Arbeit behandelt die Frage, welche Auswirkungen eine EU-Mitgliedschaft der Türkei auf die europäischen Sicherheitsbeziehungen haben würde. Es wird die sicherheitspolitische Situation in- und außerhalb der türkischen Staatsgrenzen analysiert. Auf Basis der Rational Choice Theorie vom Akteurzentrierten Institutionalismus wird gezeigt mit welchen Herausforderungen die Europäische Union konfrontiert wäre und die Frage behandelt, ob eine so genannte Privilegierte Partnerschaft eine mögliche Alternative zu einer Vollmitgliedschaft sein kann. / This work deals with the question which impact an EU-membership of Turkey would have on European security relations. It analyzes the security situation in- and outside Turkeys frontiers. Based on the rational choice theory of Akteurzentrierter Institutionalismus it tries to give a prospect of possible challenges for the European Union and brings up the question whether a so called privileged partnership is a possible altnernative to a full membership.

Minskning av transporters negativa miljöpåverkan, eller en ökning av hållbara resor, har blivit en allt viktigare fråga för lokala aktörer. Genom samhälls- och trafikplanering ska dagens ohållbara transportsystem bli mer hållbart. Det gör hur planerare i Helsingborg planerar för hållbara resor intressant att studera. Avhandlingen undersöker hur planerare föreställer sig vad hållbart resande är, vilka resenärer det är som bör resa mer hållbart samt hur en hållbar stad kan se ut. Teoretiskt kombinerar avhandlingen ett intersektionellt ramverk med feministisk planeringsteori samt teorier från STS (teknik- och vetenskapsstudier). Det empiriska materialet består av djupintervjuer med sexton planerare, en fokusgruppsintervju samt bildanalys av de planeringsdokument som Helsingborgs stad använder sig av i planeringen för hållbara resor. Framförallt visar avhandlingen att planerare inte betraktar resors negativa miljöpåverkan som ett argument som kan få människor att resa mer hållbart. Istället är det möjligheten att framställa hållbara resor som roliga, hälsosamma, lustfyllda och praktiska som planerare tror kan få helsingborgarna att cykla eller åka mer buss. Men det är bara vissa resenärer som antas kunna ta del av de hållbara resornas positiva värden. Planerarnas föreställningar om bland annat kön, etnicitet och klass är avgörande för hur de förstår hållbara resor. Planerarna menar sammanfattningsvis att det är stort att resa rätt av miljöskäl, men större att fritt välja det mest attraktiva färdsättet. / Demands for sustainable mobility have become an increasingly important issue for local actors. Through city and traffic planning, the current unsustainable transport systems are going to become more sustainable. However, how to define sustainable mobility is disputed. Therefore, how planners in the Swedish municipality of Helsingborg define sustainable mobility makes an interesting case. This thesis examines how planners imagine sustainable mobility, who the sustainable traveler is, and what a sustainable city might look like. Theoretically the thesis combines an intersectional framework with a feminist planning theory and theories from Science and Technology Studies. The empirical material is based on in-depth interviews with sixteen planners, a focus group interview, and visual analyses of the planning documents the city of Helsingborg uses in planning for sustainable mobility. The analyses show that planners do not see the negative environmental impact of traveling as an argument which will persuade people to travel more sustainably. Instead, it is the possibility to construct sustainable mobility as fun, healthy, pleasurable, and practical that planners believe will persuade the inhabitants of Helsingborg to cycle or travel by bus more often. But not all travelers are likely to benefit from the positive values of sustainable mobility. in English Title: Murder of a Newborn Child by Its Mother under Section 142 of the Criminal Code Author: Lucie Brázdová This thesis addresses the issue of further need for a special legal regulation of the criminal offence of murder of a newborn by its mother. The first chapter is dedicated to the origin and the development of this legal provision and explains the circumstances within which this criminal offence has become part of the current Criminal Code. By describing the organization of the Criminal Code and main provisions of the Constitutional Law, the following chapter demonstrates the values on which the Criminal Law is built. These have to be taken into account when assessing the need for a change or a repeal of the discussed legal provision. The third chapter is an overview of primary information on constituent elements of this criminal offence. However, it does not neglect certain disputable aspects including the issue of pinpointing precisely when human life begins. From a theoretical point of view, the offence in question is considered to be a "privileged factum". In such cases, a certain additional factor lowers the harmful effect the offence has on society. Estudo da atividade antinoceptiva e anti-inflamatoria protótipos de fármacos / Study of antinoceptiva activity and anti-inflammatory farmacos prototypes

This work was conducted to evaluate the activity anti-inflammatory and antinocieptive two series of derivatives of N-acilidrazonas (NAH) rationally designed and synthesized by LASSBio® UFRJ. The first series consists of four compounds, being two metal complexes generated from the coordination of prototypes LASSBio-1064 and LASSBio-466 and second prototype LASSBio-1064 and LASSBio-466. The second series comprised eight derivatives, designed as structural analogues of piroxicam. Were performed nociception models of functional chemical (writhing induced by acetic acid 0.1 N, formalin test), thermal nociception (hot plate test), cell migration assay (peritonitis induced by zymosan A and / or induced by carrageenin) assay evaluation of inhibition of COX-1/COX-2. All compounds and standards were administered 40 min before starting the test (p.o) at a dose of 100 mmol / kg. In the first series, Animal constriction induced by acetic acid was inhibited by all the compounds studied, highlighting the [Zn(LASSBio-466)H2O]2 and H2LASSBio-1064 that inhibited (p˂0.01) at 82.7 % (p˂0.01) and 81.3% (p˂0.01) the number of writhes, as the standard drug (dipyrone) inhibited 77.7% (p˂0.01). In the first phase of the formalin test H2LASSBio-466 and H2LASSBio-1064 reduced the latency time to lick 53.1% (p ˂ 0.05) and 46.5% (p˂0.01), respectively. In the second phase of the test compounds H2LASSBio-1064 and [Zn(LASSBio-466)H2O]2 reduced the latency time to lick at 48.5% (p˂0.05) and 37.3% (p˂0.05), respectively. All compounds showed levels of inhibition of peritonitis induced by zymosan comparable or superior to indomethacin (drug standard). In the second series, the compounds were active in the assay of writhing induced by acetic acid highlighting the LASSBio-1638, LASSBio-1604 and LASSBio-1639 inhibited the contortions that abdmoniais in 84.0% (p˂0.01), 82.7% (p˂ 0.01) and 90.4% (p˂ 0.01), respectively, whereas piroxicam (drug standard), inhibited by 95.4% (p˂0.01) . In the formalin test, only LASSBio-1617 significantly inhibited the nociceptive activity in the first stage by 58.2% (p<0.01). In the second phase the LASSBio-1637, LASSBio-1638 inhibited the nociceptive activity in 60.0% (p<0.05) and 54.2% (p<0.05), respectively, and piroxicam inhibited 53.9 % (p<0.01). In models of acute inflammation, the compounds showed inhibitory activity against cell migration similar to or greater than the piroxicam. In the trial of carrageenan-induced acute peritonitis compounds LASSBio-1604LASSBio-1637, LASSBio-1638 and LASSBio-1639 inhibited cell migration by 74.2% (p˂ 0.01), 73.2% (p˂0.01), 77.6% (p˂ 0.01) and 81.8% (p ˂ 0.01), respectively, where as piroxicam inhibited by 25.5% (p˂0.01). The compounds LASSBio-1637, LASSBio-1638-1639 and LASSBio highlighted in the testing of acute peritonitis induced by zymosan A, inhibiting cell migration in 78.6% (p˂0.01), 81.2% (p ˂ 0.01) and 82.7% (p ˂ 0.01), showing that, in this essay, more active than piroxicam (57.3%). LASSBio-1604 and LASSBio-1617 inhibited the enzyme COX in vitro, presenting, respectively, IC50 values of 0.22 M and 0.28 M for inhibition of COX-1 and 0.24 M and 0.26 M for inhibition of COX-2. Pharmacological Evaluation results suggest that in the first series, the coordination of zinc (II) is a good strategy to improve the antinociceptive activity of the compound H2LASSBio-466 associated with inflammatory pain, and in the second series, all compounds exhibit antinociceptive and anti-inflammatory similar or superior to piroxicam. / Neste trabalho foi realizado a avaliação da atividade antinocieptiva e anti-inflamatória de duas séries de derivados N-acilidrazonas (NAH) racionalmente planejadas e sintetizados pelo LASSBio® da UFRJ. A primeira serie é formada de 4 compostos, sendo 2 complexos metálicos gerados a partir da coordenação dos protótipos LASSBio-466 e LASSBio-1064 e 2 protótipos LASSBio-466 e LASSBio-1064. A segunda série formada por 8 derivados, desenhados como análogos estruturais do piroxicam. Foram realizados modelos funcionais de nocicepção química (contorção abdominal induzida por ácido acético 0,1N, ensaio de formalina), nocicepção térmica (ensaio da placa quente), ensaio de migração celular (peritonite induzido por zymosan A e/ou induzido por carragenina) ensaio de avaliação de inibição da COX-1/COX-2. Todos os compostos e padrões foram administrados 40 min antes do início ensaio (vo) na dose de 100 μmol/kg. Na primeira série, a constrição animal induzida por ácido acético foi inibida por todos os compostos estudados, destacando-se o [Zn(LASSBio-466)H2O]2 e H2LASSBio-1064 que inibiram (p˂0,01) em 82,7% (p˂0,01) e 81,3% (p˂0,01) o numero de contorções, enquanto o fármaco-padrão (dipirona) inibiu em 77,7% (p˂0,01). Na primeira fase do ensaio de formalina o H2LASSBio-1064 e H2LASSBio-466 reduziram o tempo de latência de lambida em 53,1% (p˂0,05) e 46,5% p˂0,01), respectivamente. Já na segunda fase do ensaio os compostos H2LASSBio-1064 e [Zn(LASSBio-466) H2O]2 reduziram o tempo de latência de lambida em em 48,5% (p˂0,05) e 37,3% (p˂0,05), respectivamente. Todos os compostos mostraram níveis de inibição da peritonite induzida por zymosan comparáveis ou superiores à indometacina (fármaco padrão). Na segunda série, os compostos mostraram-se ativas no ensaio de contorções abdominais induzida por acido acético destacando-se o LASSBio-1638, LASSBio-1639 e LASSBio-1604 que inibiram as contorções abdmoniais em 84,0% (p˂0,01), 82,7% (p˂0,01) e 90,4% (p˂0,01), respectivamente, ao passo que o piroxicam (fármaco padrão) inibiu em 95,4% (p˂0,01). No teste de formalina, apenas LASSBio-1617 inibiu significativamente a atividade nociceptiva na primeira fase em 58,2% (p <0,01). Na segunda fase o LASSBio-1637, LASSBio-1638 inibiram a atividade nociceptiva em 60,0% (p <0,05), e 54,2% (p <0,05), respectivamente, e o piroxicam inibiu em 53,9% (p <0,01). Em modelos de inflamação aguda, os compostos apresentaram atividade inibitória sobre a migração celular semelhante ou maior que o piroxicam. L'atteinte à la transparence des marchés financiers : l'exemple du délit d'initié : étude comparée du droit français et du droit libanais / Affecting transparency of financial markets : example of insider trading

Le délit d’initié peut être légal ou illégal selon le moment où l’initié fait le commerce : il est illégal lorsque l’information est non publique. Effectuer une négociation tout en ayant une connaissance particulière est injuste pour les autres investisseurs qui ne disposent pas de l’accès à ces connaissances. Les dirigeants ne sont pas les seuls à être reconnus coupables du délit d’initié. Des gens comme les courtiers, et même les membres de familles peuvent en être coupables. Par contre, le délit d’initié est légal une fois l’information a été rendue publique, au moment où l’initié n’a aucun avantage direct sur d’autres investisseurs. La tendance est à la pénalisation du délit d’initié ainsi qu’à la création d’une autorité de régulation spécifique aux marchés financiers. Ce travail s’appuie donc sur une étude des différents systèmes juridiques répressifs qui tendent à assurer la transparence des marchés et veiller au respect de l’égalité entre les opérateurs par le phénomène de la régulation. On s’attachera dans une première approche à l’originalité de l’infraction, à savoir la double définition qui engendre une double poursuite : pénale et administrative. Et dans une deuxième approche, on analyse la question de l’effectivité du dispositif répressif instauré, dans lequel nous concluons que cette dualité de système répressif face à la règle non bis in idem ne peut être comprise que comme une cohérence et une complémentarité entre les deux ordres de juridictions qui forment une avancée en particulier / Insider trading can be illegal or legal depending on when the insider makes the trade: it is illegal when the material information is still non public, trading while having special knowledge is infer to other investors who don’t have access to such knowledge. The tendency is to the criminalization of insider trading and the foundation of a specific regulatory authority for financial markets. The work is therefore based on a study of different law enforcement jurisdictions which trend to ensure markets transparency and ensure the respect of equity between the operators by the phenomenon of regulation. In a first approach, we study the originality of the crime including the double definition that generates a double prosecution: criminal and administrative. And in a second approach, we analyze the effectiveness of the repressive system in which we realize that this duality of the repressive system facing the non bis in idem can only be seen as coherence and complementarily between the two orders of jurisdictions

Utopian Hope vs. Merely-Political Combat: Directionality for the Kingdom of God

Utopia, as a concept, has experienced a resurgence within literature of various genres, ranging from scholarly work inside the 'academy' to diverse accounts of utopian and/or dystopian imaginaries within diverse fictional stories. Identifying what utopia picks out conceptually, however, is challenging, not least due to the limitations inherent in the ways we perceive the world could be. In this dissertation, I first defend a 'processual' account of utopia, contrasting this way of thinking about the idea against any fixed or granular description of some candidate, concrete state of affairs. I then look at the primary methodology leveraged by most processual utopian theorists, namely: utopian hope. After considering this affective, performative stance against what I call 'merely-political' combat, I demonstrate how utopian hope, within processual accounts, turns out to be equivalent to religious faith. As such, processual utopian projects require a return to a mystical, transcendent field of play for both their theoretical and methodological constituents. The second half of my project attempts to outline a fledgling, practical methodology for processual utopia, first identifying a very counter-intuitive directional focus on the part of the privileged when pursuing utopian ends. This focus requires the privileged to consider alternate imaginaries for possible futures while additionally requesting assistance from the marginalized to appropriately parse them. I conclude by examining several instances of liminal 'utopias' that have occurred in the wake of tragic events. These are placed in conversation with fictional accounts of utopian effort in order to highlight why utopian performativity must begin from a space of mutual vulnerability. / Doctor of Philosophy / In this dissertation I aim to do two things. In the first half, I defend the concept of "processual utopia" as a more fruitful way to think about striving for societies that feature less stratification in the way they distribute opportunity and privilege. I contrast this idea with those theories that try to describe, using present-day imaginaries, concretely-imaginable utopias in the here and now. I argue that the latter effort is a fool's errand, a process that incurs insurmountable difficulties in that opposing visions are immediately juxtaposed against any solidified description of what utopia might look like. I then examine the primary constituent of processual utopia's process, namely: utopian hope. I contrast this with the kind of affective performativity normally found within politics and political struggle, concluding that these efforts do not result in utopian ends. This is because what I call the 'merely-political' is bent on a kind of binary striving for power, focused on proving the 'other' side to be subhuman and irrational. Utopian hope counters political maneuvering for a particular vision of 'better' societies on a more transcendental foundation. It looks for a reality that humankind cannot yet understand or describe – something that remains on the horizon as a target for our dreams and efforts. This affective viewpoint should motivate our actions to make currently unimaginable realities possible in a distant, not-seen-by-us, future. I also suggest that utopian hope, although talked about a great deal over the past century by writers such as Ernst Bloch and Ruth Levitas, has its conceptual genesis in religious faith. I argue that the two are equivalent in the case of utopian affect and desire. My foils in this effort are Kierkegaard and St. Augustine and examining their accounts of faith reveals the parallel nature this mystical logic shares with contemporary ideas about utopian hope. In the second half of the dissertation, I connect processual utopian theory to potential practice. The investigative point-of-view throughout is that of the currently privileged. I argue that those who possess the highest levels of opportunity within realms of social and political power tend to defend the status quo, even when suggesting or devising initiatives to supposedly level the playing field more fairly. Privileged actors, it seems, are culturally programmed to reinforce the same logics that prevent substantive change. This also means that our targets for 'better societies' tend to simply reinforce the same stratifications of opportunity that exist currently. Privileged actors not only need help understanding the ideas of the marginalized concerning more just societies, they also need to engage in what might seem like 'dystopian' effort (from our perspective) in order to actually strive for something more 'utopian' in the future. To help orient those wishing to be allies to the marginalized, I examine various accounts of alternate futures, explaining how those challenge our default ways of understanding the world. These, in turn, should motivate the privilege to ask for help (from the marginalized) in order to understand them, a request the latter must answer if processual utopia is the goal of all concerned. This highlights what I call an 'ethical minefield' that highlights divisive issues we can observe in our current socio-cultural moment. I end with an analysis of both tragedy and dystopian fiction, arguing that a sense of mutual vulnerability is needed for an actor to pursue processual utopia.

O objeto da dissertação é a regulamentação do uso indevido de informação privilegiada no mercado de capitais. Discute-se no texto qual seria a melhor maneira de reprimir a conduta praticada pelo insider trading, concluindo-se que o sistema ideal seria não mais a dupla repressão como ocorre atualmente, mas sim a separação entre as esferas administrativa e penal. A primeira julgaria as infrações de menor gravidade, deixando apenas as que efetivamente causassem potencialidade lesão grave ao bem jurídico sob a tutela do direito penal. Ante a necessidade de compreensão do contexto em que o delito de uso indevido de informação privilegiada ocorre, o trabalho inicia-se com um breve panorama do mercado de capitais, no qual se trata da formação do mercado de valores mobiliários, das bolsas de valores e das sociedades anônimas. Assim, no primeiro capítulo trata-se da regulamentação do mercado de capitais no Brasil, em especial, das Leis 6.385/1976, a qual regula o mercado de valores mobiliários brasileiro e traz a descrição do tipo penal do crime do insider trading no artigo 27-D, e da Lei 6.404/1976, que regula as sociedades anônimas no Brasil, e trata dos deveres de informar, de lealdade e de guardar sigilo impostos aos administradores das sociedades anônimas de capital aberto. No segundo capítulo, é feita inicialmente uma abordagem do que vem a ser o crime de insider trading e informação privilegiada, mencionando-se quais são argumentos contrários e a favor da repressão da conduta de utilização indevida de informação privilegiada. Na seqüência, faz-se uma breve análise da legislação estrangeira, com destaque para os países Estados Unidos da América, Espanha, Portugal e Itália. O terceiro capítulo trata da regulamentação do crime de insider trading no Brasil, iniciando-se com uma breve análise comparativa entre o tipo penal da legislação pátria e os das legislações estrangeiras estudadas no capítulo anterior. Em seguida, é analisada a tipicidade objetiva e subjetiva do tipo penal, concluindo-se que se trata de crime formal, que não admite tentativa e que se consuma no momento da utilização da 173 informação relevante ainda não divulgada ao mercado, independentemente da obtenção da vantagem indevida. Ainda no terceiro capítulo, trata-se do sujeito ativo e passivo do delito, concluindo-se que, de acordo com a redação do tipo penal, apenas quem tem o dever de manter sigilo pode ser responsabilizado criminalmente no Brasil pelo crime de insider trading, e que o sujeito passivo é a coletividade, a sociedade como um todo. Esse capítulo traz também o debate existente, sobretudo na doutrina estrangeira, de qual seria o bem jurídico tutelado pelo crime em comento. Dentre todas os possíveis bem jurídicos aventados, conclui-se que apenas a igualdade entre os investidores e a confiança no mercado de capitais são dignos de tutela penal e justificam a intervenção dessa esfera do direito. O quarto capítulo trata da relação existente entre o direito penal econômico e o crime de insider trading. Além de tratar das características do direito penal econômico, o capítulo traz críticas à expansão do direito penal moderno e trata da ineficiência da utilização da esfera penal para proteger de forma eficaz os delitos da moderna criminalidade econômica. O quinto e último capítulo trata justamente do título do trabalho: Direito Administrativo Sancionador e o Crime de Insider Trading. Nesse capítulo, explica-se o modelo proposto para sancionar a utilização indevida de informação privilegiada, iniciando-se por tratar da definição de direito administrativo sancionador e sua distinção entre o direito penal. Na seqüência trata-se da possível configuração de bis in idem existente atualmente com a aplicação de sanção administrativa e penal para o mesmo fato, para o mesmo sujeito e com o mesmo fundamento. Trata-se ainda do fortalecimento da CVM como agência reguladora para regulamentar, fiscalizar e punir com eficiência as utilização indevida de informação privilegiada, deixando para o direito penal apenas as infrações capazes de colocar em risco o mercado de capitais. Por fim, são expostas as conclusões do trabalho. / The object of this dissertation is the regulation of the misuse of privileged information in the capital market. It is discussed in the text which would be the best way to repress the conduct practiced by insider trading, concluding that the ideal system would be no more the double repression as currently occurs, but a single repression in administrative or criminal sphere according to the seriousness of the offense. The first would judge the lesser gravity infractions, leaving only those that actually caused any serious injury to the good under the legal protection of criminal law. Before the need to understand the context in which the offense of misuse of privileged information occurs, the dissertation begins with a brief overview of capital markets, in which it comes to the formation of the securities market, stock exchange, as well as corporations. Thus, the first chapter deals with (i) the regulation of the capital market in Brazil, in particular regarding Law 6.385/1976, which regulates the securities market of Brazil and contains a description of the type of criminal offense of insider trading, and (ii) the Federal Act 6.404/1976, which regulates corporations in Brazil and provides the duties to inform, loyalty and confidentiality imposed on directors of stock companies. In the second chapter, it is initially provided an approach of the concept of the insider trading crime, mentioning what are the arguments against and in favor of its repression. Subsequently, there is a brief analysis of foreign law, particularly the legislation of the United States of America, Spain, Portugal and Italy. The third chapter deals with the regulation of the insider trading crime in Brazil, beginning with a brief comparative analysis of criminal hyphotesis provided by Brazilian law and the foreign legislation analyzed in the previous chapter. Then, it is analysed the objective and subjective elements of the criminal hypothesis, concluding that it is a formal crime, which admits no attempt and that occurs at the time of use of relevant information not yet disclosed to the market, independently of obtaining improper benefit. The fourth chapter deals with the relationship between economic crime and insider trading crime. Besides approaching characteristics of the economic criminal law, the chapter provides critics to the expansion of modern criminal law and deals with the inefficiency of using the criminal sphere to protect society against the crimes of modern economic criminality. The fifth and final chapter deals with the relationship between punitive administrative law and insider trading crime. In this chapter it is explained the model proposed to penalize the misuse of inside information, starting with the definition of punitive administrative law and its distinction from criminal law. Following reference is to the possible configuration of bis in idem currently existing in the application of the criminal and administrative sanction for the same offense, same individual and on the same basis. In addition, it is also discussed the strengthening of the Comissão de Valores Mobiliários (the Brazilian Securities and Exchange Commission) as the regulatory agency authorized to regulate, inspect and punish effectively the misuse of inside information, leaving to the penal sphere only the criminal law offenses that are entitled to put the capital market in risk. Finally, the dissertation conclusions are exposed.

Jämställdhet, maskulinitet och (o)privilegierade subjektspositioner : En intervjustudie om diskurser kring jämställdhet, "den nye mannen" och "andra män"

Föreliggande uppsats utgår från tidigare forskning som hävdar att jämställdhetsdiskursen i Sverige bygger på ett vitt, heterosexuellt, medelklassideal som underordnar andra maskuliniteter. Uppsatsen syftar till att undersöka huruvida jämställdhetsdiskursens ovan nämnda exkluderingar samt maskulinitetsdiskurser som till exempel ”den nye mannen” kan spåras i mäns artikuleringar av diskurser kring maskulinitet och jämställdhet och hur olika subjektspositioner samt hierarkier begripliggörs och (re)produceras i denna process. Det teoretiska ramverket utgörs av poststrukturalistisk teori kring diskurser, subjektspositioner och ”görandet” av genus och andra sociala kategorier. Dessa kategorier ses ur ett intersektionellt perspektiv som sammanvävda. Uppsatsen försöker vidare förena denna poststrukturalistiska ansats med Connells teori om hegemonisk maskulinitet. Det empiriska materialet består av enskilda intervjuer samt fokusgruppintervjuer utförda i tre olika empiriska kontexter där individer i olika sexuella, etniska och klassmässiga subjektspositioner med olika grader av privilegiering i relation till jämställdhetsdiskursen befinner sig. Resultatet visar att den maskulinitetsdiskurs som artikulerades i samtliga kontexter låg nära diskursen kring ”den nye mannen”; ett mer jämställt, eller i alla fall barnorienterat, maskulinitetsideal. Jämställdhet artikulerades även någorlunda lika över kontexterna som en konsensusbaserad särartsdiskurs.  Det som däremot skilde kontexterna och intervjupersonerna åt var deras etniska, klassmässiga och sexuella subjektspositioner som relaterade till de hegemoniska diskurserna kring jämställdhet och maskulinitet på o(jäm)lika sätt. Personerna i de muslimska och homosexuella subjektspositionerna gjorde på olika sätt motstånd mot den underordning som de placerades i genom dessa subjektspositioners underordade relation till ”den nye mannen”. De förhöll sig därmed något mer distanserat till denna diskurs samt jämställdhetsdiskursen. I kontexten där intervjupersonernas subjektspositioner i större utsträckning sammanföll med ”den nye mannen” artikulerades denna diskurs tydligare. Exempelvis artikulerade man barnorientering, snarare än ett intresse för jämställdhet i sig. I samtliga kontexter uppmärksammade eller problematiserade man sällan sina egna privilegier, men det skedde på olika sätt ett skillnadsskapande gentemot ”andra män” och kvinnor. / This master thesis takes its departure in previous research which argues that the Swedish discourse of gender equality and its gender equal masculine subject “the new man” is built upon a white, heterosexual, middle class norm that excludes and subordinates other masculinities. The thesis aims at investigating whether the above mentioned exclusions in the Swedish discourse of gender equality and masculinity discourses such as “the new man” are traceable in men´s articulations of discourses regarding gender equality and masculinity, and how different subject positions and hierarchies are negotiated and reproduced in this process. The theoretical framework is a post-structural theory inspired by Ernesto Laclau and Chantal Mouffes theory of discourses, subject positions and the “doing” of gender and other social categories such as class and ethnicity, categories that from an intersectional perspective are viewed as analytically inseparable. The thesis also seeks to combine the post-structural perspective with R.W. Connells theory of hegemonic masculinity. The empirical material consists of single and focus groups interviews generated in three different contexts in which individuals located in different sexual and ethnic subject positions with different degrees of privilege in relation to the discourse of gender equality. The results show that the masculinity discourse that was articulated in all three contexts was the discourse of “the new man”; a more gender equal, or at least children-oriented, masculine ideal. The articulations of gender equality were also similar in the different contexts; a consensus based discourse of gender equality in which men and women were viewed as different but complementary. What distinguished the contexts was the interview person’s sexual and ethnic subject positions which related to the hegemonic discourses of gender equality and masculinity in different, unequal ways. The interview person´s in the Muslim and homosexual subject positions resisted the subordination these positions meant in relation to the discourse of “the new (gender equal) man”. This also meant that these persons had a more distanced relationship to this discourse and the discourse of gender equality. In the context where the interview person’s subject positions to a greater extent coincided with “the new man”, this discourse was also articulated in a less problematic way. An orientation towards taking care of children was for example more common than an interest in gender equality for its own sake. In all three context one´s own privileges were seldom acknowledged, and there were different processes of creating difference and hierarchies towards both women and “other men”.
