O uso intensivo da tecnologia nuclear contribuiu para o aumento das preocupações com as questões ambientais e sua segurança, acabando por despertar o interesse em toda sociedade. No Brasil, as atividades nucleares são regulamentadas pelo Conselho Nacional do Meio Ambiente (CONAMA). A primeira resolução CONAMA, no 001/1986, estabeleceu que as atividades nucleares deveriam ser licenciadas pela agência ambiental brasileira, ou seja, pelo Instituto Brasileiro do Meio Ambiente e dos Recursos Renováveis (IBAMA), independentemente da obrigatoriedade do licenciamento pela Comissão Nacional de Energia Nuclear (CNEN). No licenciamento é preciso elaborar o Estudo de Impacto Ambiental (EIA), um conjunto de estudos realizados por especialistas de diversas áreas, com dados técnicos detalhados, e o Relatório de Impacto Ambiental (RIMA), que deve apresentar as conclusões do EIA de forma objetiva e adequado à sua compreensão. O principal mecanismo de participação direta da população na proteção da qualidade ambiental é a audiência pública. Ela tem como finalidade expor ao público as características do projeto e o conteúdo do EIA/RIMA. Durante a audiência pública os participantes podem fazer perguntas sobre o empreendimento e tirar dúvidas sobre como se dará o licenciamento. As audiências públicas são organizadas pelos empreendedores, consoante diretrizes emitidas pelo IBAMA. Sendo a audiência pública a etapa do licenciamento mais propícia a subjetividades, este trabalho é uma contribuição para a área a partir da avaliação crítica do modelo de audiência pública, atualmente adotado, para o licenciamento ambiental de instalações nucleares. / The intense use of nuclear technology has contributed an increase in concerns about environmental issues and safety, promoting the interest of society in the issue. In Brazil, nuclear activities are regulated by the Brazilian Environmental Council CONAMA. Beyond Consensus: A Rhetorical Genre Analysis of the Mountain Valley Pipeline's 401 Public HearingsScarff, Kelly 10 June 2021 (has links)
This study seeks to understand public and institutional uptake of the public hearing genre. More specifically, this study examines how public hearing genre conventions are established and how those conventions inform and often govern tensions that arise in public discourse about a contested environmental project. In my research, I analyzed a corpus of public comments from two Mountain Valley Pipeline (MVP) 401 Water Quality Certification public hearings that were held in August 2017 and hosted by Virginia Department of Environmental Quality (VA DEQ). Additionally, I conducted interviews with 13 community members and two state representatives who spoke at one of the two hearings. This approach led me to several important findings. Most significantly, I found that while many community members understood VA DEQ's stated purpose of the public hearings, they prepared comments that spoke to an entirely different purpose because they were responding to a different kind of problem than that of VA DEQ. This finding is crucial to understanding the other tensions and ideas of consensus that occur among citizens and VA DEQ representatives since the kind of problem informs the uptake of the public hearing and the overall interpretation of the public hearing genre. My dissertation thus argues that there are ways we might reimagine ideas of effectiveness, consensus, and the public hearing genre, specifically in the case of the 401 Public Hearings and more generally in other public hearings where public discourses center on a contested environmental project like the MVP. / Doctor of Philosophy / This study examines the role and effect of public hearings and the tensions that sometimes arise within them. More specifically, I analyze transcripts from the two 401 Water Quality public hearings about the Mountain Valley Pipeline (MVP). These hearings occurred in August 2017 and were hosted by Virginia Department of Environmental Quality (VA DEQ). Given the broad scope of this theme, we restricted our investigation to the institute of public hearing, set forth by Laws n. 9868 and 9882, and so far used in three lawsuits: ADin 3510, ADPF 101 and ADPF 54. The issue here, therefore, is determining whether a public hearing is capable of synchronizing the law and the current jurisdiction in today's communities by embracing and acknowledging their differences. The master's thesis deals with landscape planning study which is a new instrument of spatial planning in Czechia. Main goal of the thesis to analyse the document's creation process and to evaluate a potential of utilization of the study by public sector. The evaluation includes intelligibility of the study, motivation on the side of the public sector as a contracting authority and a form of cooperation of authors and contracting authorities, municipalities, the public or other entities. Another partial goal of the thesis is to assess an accordance with European Landscape Convention, which is declared in a methodological instruction of the landscape planning study. Which is a document that should serve as a basis for decision making in the public sector. Four landscape planning studies made for districts of municipalities with extended powers which are in Prague's hinterland were chosen as model cases. After semantic analysis of the text of the chosen planning studies of landscape semi-structured interviews with representatives of author teams and contracting municipal offices followed. Previous issue date: 2014-10-10 / This study has as object the process of improvement of the health right by the Judiciary, whose understanding has derived from the discussions brought in the public hearing of health held by the Federal Supreme Court in 2009. In this sense, your overall goal is to analyze the arguments brought in the audience, comparing them to synthesize the thought of the orators regarding the effectuation process of health policies through the judicial assistance process. It is an interdisciplinary exploratory research that promotes a qualitative analysis of the orators speeches at the event held by the Federal Supreme Court through the content analysis method. The methodological procedures involved were the bibliographic and documentary research. The study was organized in four chapters. The first chapter seeks to elucidate the methodological trajectory adopted in the research construction, including the exposure of the ideals that inspired their subject and their justifications and objectives. The second chapter, entitled "Relevant aspects of Brazilian constitutional order: social fundamental rights, the Federal Supreme Court and public hearing in the Judiciary" is composed of reflections on the Brazilian legal system, fundamental rights and the Federal Supreme Court, whose acting permeates problems of work. "The fight for health, the Brazilian sanitary movement and the denial of a fundamental right: the judicialization of public health policies in Brazil" brings in the third chapter the trajectory of health in Brazil, as well as the composition and directives of the SUS, whose content turned out to unleash the phenomenon of judicialization. Finally, in the fourth chapter, "Voices of the public hearing: the realization of the right to health by Judiciary", are presented and discussed the arguments brought by 49 orators, categorized by content analysis, getting up the problem of ensuring the right to health via the judiciary. What is more evident in the survey is the difficulty in establishing truly answers to ethical dilemmas that go beyond the mere hermeneutics of legal rules, however, the work seeks to identify the parameters constructed from the analysis of the discussion of the public hearing, to subsidize debate and the judgment of lawsuits involving the health service. / O presente estudo tem como objeto o processo de efetivação do direito à saúde via Poder Judiciário, cuja compreensão se deu a partir das falas trazidas na audiência pública da saúde, realizada pelo Supremo Tribunal Federal no ano de 2009. Nesse sentido, seu objetivo geral é analisar os argumentos trazidos na audiência, confrontando-os de modo a sintetizar o pensamento dos oradores quanto ao processo de efetivação das políticas de saúde por meio da prestação jurisdicional. Trata-se de uma pesquisa interdisciplinar de cunho exploratório, que promove a análise qualitativa dos discursos proferidos pelos oradores no evento promovido pelo STF, por meio do método da análise de conteúdo. Como procedimentos metodológicos, destacam-se a pesquisa bibliográfica e a documental. O estudo foi organizado em quatro capítulos. Previous issue date: 2015-04-29 / CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / No presente trabalho, analisou-se como os argumentos dos participantes nas audiências públicas realizadas pelo STF foram abordados pelos ministros, buscando-se identificar a práxis institucional do Tribunal na aplicação desse instituto jurídico. Em caráter ainda exploratório, a pesquisa indicou que as audiências não promovem efetiva integração da sociedade civil no controle de constitucionalidade exercido pelo STF. Investigou-se a hipótese de que essas audiências não influenciam as decisões do Tribunal, em razão de seu uso apenas para colher informações técnicas e científicas e legitimar democraticamente suas decisões, independentemente do aspecto argumentativo. A pesquisa partiu das teorizações de Jürgen Habermas quanto à superação do paradigma da filosofia da consciência pelo paradigma comunicativo, com a ampliação do conceito de racionalidade para além da instrumental. Metodologicamente, empreendeu-se a análise de conteúdo das manifestações dos expositores nas audiências e dos acórdãos. Das falas dos expositores, foram catalogados e categorizados todos os argumentos levantados a fim de confrontá-los com os votos dos ministros do STF. Após o estudo do regime jurídico sobre o instituto e da análise de todas as audiências públicas que já subsidiaram julgamentos e dos respectivos acórdãos, a pesquisa evidenciou que a atual prática institucional do STF na utilização das audiências tem sido marcada, basicamente, pela ênfase na oitiva de experts, pela ausência e passividade dos ministros, pela omissão aos argumentos dos expositores, pela ausência de diálogo e pela busca formal de legitimação democrática para suas decisões a despeito do desempenho discursivo nas audiências. Concluiu-se que essa práxis não somente tem impedido o pleno alcance das finalidades do instituto, como tem simulado um incremento na legitimação democrática das decisões do Tribunal. Assim, foram propostas alterações positivas para a superação das deficiências da atual práxis do STF na condução das audiências públicas, ressaltando-se que as sugestões serão ineficazes se não houver uma internalização do paradigma comunicativo que se traduza em posturas dialógicas com a sociedade civil. / In the present study, it analyzed how the arguments of the participants in the public hearings by the Brazilian Supreme Court were discussed by ministers, seeking to identify the institutional practice of the Court in the application of this legal institute. In still exploratory stage, research has indicated that audiences do not promote effective integration of civil society in judicial review exercised by the Brazilian Supreme Court. It investigated the hypothesis that these hearings do not influence the decisions of the Court, due to its use only to gather technical and scientific information and democratically legitimate their decisions, regardless of argumentative aspect. The research started the theories of Jürgen Habermas as to overcome the paradigm of the philosophy of consciousness by the communicative paradigm, with the expansion of the concept of rationality beyond the instrumental. Methodologically, it undertook to content analysis of the manifestations of the participants at the hearings and of the judgments. From the speeches of the exhibitors were cataloged and categorized all the arguments raised in order to confront them with the votes of the Brazilian Supreme Court ministers. After the study of the legal system about the institute and analysis of all public hearings already subsidized judgments and their judgments, the research showed that the current institutional practice of the Supreme Court on the use of the audience has been marked primarily by emphasis on hearsay of experts, by the absence of ministers and passivity, by omitting the arguments of the exhibitors, the lack of dialogue and formal search democratic legitimacy for its decisions in spite of the discursive performance in the audience. It was concluded that this practice has not only prevented the full scope of the institute's purposes, as has simulated an increase in democratic legitimacy of the Court's decisions. Thus, positive changes have been proposed to overcome the shortcomings of the current Supreme Court practice in the conduct of public hearings, emphasizing that the suggestions will be ineffective if there is no internalization of the communicative paradigm that translates into dialogical postures with civil society.
