In this research project the overcrowding problem in South African prisons will be analysed as well as the influence it had on the rehabilitation of offenders. The problem of overcrowding in South Africa's prisons is very clear when the approved accommodation of a prison is compared with the actual number of prisoners incarcerated. Prison sentences are a favoured form of punishment throughout the world. More and more people seek alternatives to incarceration in order to reduce prison overcrowding. The time to finalize criminal cases, releases on bail, the abolishment of minimum sentences and better utilization of community based sentences are some of the issues which can reduce overcrowding. One of the concepts that was implemented to establish rehabilitation within prisons was Unit Management. The number of prisoners incarcerated makes it difficult for Unit Management to be effective. In some cases prisoners are kept under inhumane conditions which is a violation of the Constitution of South Africa. Currently the morale of members of Correctional Services is very low and this has an influence on the way in which they treat prisoners. These members are supposed to be an example to prisoners but instead their bad behaviour has a negative influence on prisoner's discipline. Correctional Services goal is to make every member a rehabilitator but overcrowding will first have to be reduced. Individual attention to prisoners is one of the building blocks of Unit Management but overcrowding of prisons creates a member/prisoner ratio which is far too high to be effective with rehabilitating prisoners. Community based sentences can also be utilized more frequently by the courts. It can better rehabilitation possibilities and through this the objectives of punishment are met. In the past the focus of South African Law was on the criminal. With the Correctional Services Act (Act 111/1998) this focus was shifted to the victim as well. Both these parties can now come together and discuss the offence as well as the influence it had on the victim. A comparative penological study on recidivism

Text in English / South Africa has a high level of Crime and thus also has a high level of recidivism. The high rate of crime contributes to overcrowding in prison. The Department of Correctional Services has programmes for the offenders such as rehabilitation, parole, probation, re-entry and reintegration. These programmes are not effective to an extent that they are not changing the offenders’ behaviour. The qualitative aim of this study was to explore recidivism through the application of concepts and theories. The significant impact that rehabilitation, parole, re-entry, probation and reintegration exerted on recidivism cause more problems for the Department Correctional Services. Ineffectiveness of these programmes has a negative impact on the escalation of recidivism. The study revealed that programmes are not effective or adequate and that recidivism is the end-product. The recommendation from the study indicates that Correctional Services should encourage offenders to participate in these programmes. The department should also review policies on these programmes and align them with international standards. The study also recommended that more research needs to be conducted on recidivism in order to understand its impact into the community and Correctional Services. The recommendations on this study indicates that recidivists should have their own specific facilities and offenders that have committed different type of crimes be treated and offered a programme designed for a particular offender and not to use a “one size fits all” approach. / Corrections Management / M.A. (Corrections Management)

It is approximately 200km to the north of Limpopo Provincial capital of Polokwane. It focuses on finding out factors that influence offenders to re-offend again, investigate recidivism among youth offenders and identify some of the problems relating to recidivism. The research consisted of juvenile offenders incarcerated in the Thohoyandou Correctional Centre within the juvenile area. Both groups of sentenced male and female juveniles participated in the study. The research used non-probability sampling. Purposive sampling was used to gather information within the Thohoyandou Correctional Centre. The research used interviews and focus group interviews as methods of collecting data. The interviews were conducted using English and Tshivenda then the responses were translated from Tshivenda to English. The researcher interviewed young offenders who have offended and re-offended. The researcher used grounded theory as a method to analyse data. This method helped the researcher to generate theory from the data collected

A mixed method research study on parole violations in South Africa

The researcher conducted a mixed method research study on parole violations from a South African perspective. In South Africa, there is limited research regarding the causes of parole violations. Thus, the study is mainly descriptive, but also exploratory in nature and considered a first of its kind. The study aimed to explore parole violation as a phenomenon through the perceptions, opinions, attitudes and incident recall of re-incarcerated parolees. Furthermore, the study aimed to describe the causes for parolees to fail on parole. A two-phase sequential mixed methods research design was used that involved the collection and analysis of primarily quantitative data from self-administered questionnaires. These questionnaires were complemented by a qualitative data collection phase consisting of focus group interviews. A representative sample (n=111) chosen according to the various ethnic groups was drawn from a population of 1 111 adult male parole violators in the Gauteng region (aligned to the regional divisions used by the Department of Correctional Services and not to the provincial borders) for the quantitative phase. Non-probability sampling was used to select 22 participants who volunteered for the second, qualitative phase of the study (focus group interviews). Descriptive statistical analysis was used to analyse the data collected from the questionnaires. The data was analysed by means of frequencies (frequency tables and graphs) to describe one variable and cross tabulations (contingency tables) to show bivariate quantitative data. All the focus group interviews were recorded and transcribed verbatim for analysis. The transcripts provided a complete record of the discussions and helped to facilitate the analysis of the data according to identified, recurring themes. On release, many stigmatised and rejected parolees face widespread post-release challenges that prevent successful reintegration. The study revealed that poor pre-release planning and post-release support, a lack of education, unemployment, substance abuse, and a loss of family support are described as the main causes of parole violations. The recommendations from the research findings showed the importance of pre-release planning, risk assessment, employment, education, treatment for drug and alcohol abuse, community partnerships, family involvement, and graduated responses to parole violations that are fair, consistent, and legal. / Penology / D.Lit. et Phil. Learning in bars : the experiences of undergraduate students in a South African prison

Never before has the learning experience of incarcerated persons been captured by one of their fellow inmates. Public perception is that prisoners should be denied access to educational opportunities and be punished for the crimes committed. In this groundbreaking study, situated in the qualitative paradigm, I recorded the learning experiences of a group of inmates who are studying at undergraduate level, via distance learning. This phenomenological study originated from my experience of studying while incarcerated, and is aimed at increasing our knowledge of, and enhancing our understanding of incarcerated persons. The study focuses on the learning experiences and challenges encountered by these students. Data was collected from the participants using qualitative methods and analysed using content analysis. Interpretation of the data revealed a number of factors which impede the studies of these students. The investigation is of importance to all persons involved in the Corrections environment but also the general public as inmates return to their communities upon release. / Curriculum and Instructional Studies / M. L’évaluation du risque en fonction de l’âge : l’efficacité de l’évaluation structurée dans la prédiction de la récidive

Huit instruments d’évaluation du risque ont été appliqués sur 580 délinquants sexuels. Il s’agit du VRAG, du SORAG, du RRASOR, de la Statique-99, de la Statique-2002, du RM-2000, du MnSORT-R et du SVR-20. De plus, les sujets ont été cotés sur la PCL-R, qui vise la mesure de la psychopathie, mais qui a fait ses preuves en matière de prédiction de la récidive (Gendreau, Little, et Goggin, 1996). En vue de mesurer l’efficacité de ces instruments et de la PCL-R, une période de suivi de 25 ans a été observée. Aussi, une division de l’échantillon a été faite par rapport à l’âge au moment de la libération, afin de mesurer les différences entre les délinquants âgés de 34 ans et moins et ceux de 35 ans et plus. Le présent travail vise à répondre à trois objectifs de recherche, soit 1) Décrire l’évolution du risque en fonction de l’âge, 2) Étudier le lien entre l’âge, le type de délinquant et la récidive et 3) Comparer l’efficacité de neuf instruments structurés à prédire quatre types de récidive en fonction de l’âge. Les résultats de l’étude suggèrent que l’âge influence le niveau de risque représenté par les délinquants. Par ailleurs, les analyses des différents types de récidive indiquent que le type de victime privilégié par les délinquants influence également ce niveau de risque. Les implications théoriques et pratiques seront discutées. / Eight evaluation techniques demonstrating high risk sexual offenders has been taken upon 580 individual sexual offenders. They are among the VRAG, the SORAG, the RRASOR, the Static-99, the Static-2002, the RM-2000, the MnSORT-R ans the SVR-20. Also, the subjects have been quoted according to the PCL-R, which focuses on their mental health, however supporting the quotes by prediction and relaps (Gendreau, Little, et Goggin, 1996). With the ongoing measuring of the suitability of these instruments as well as the PCL-R, it will take a period of 25 years for the observance. As well, a group of subjects have been studied from the age they were let out of prison, to come up with conclusions differentiating the offenders aging 34 and less with the offenders aging 35 and older. The present work on this subject matter hopes to focus on three research objectives: 1) Describe the evolution of risk according to the age, 2) To study the common point between age, they type of offender, and their relaps, and 3) To compare the suitability of 9 instruments the predict 4 types of relaps according to their age. The study results suggest that age affects the level of risk posed by offenders. Furthermore, analyses of different types of recidivism indicate that the preferred type of victim offender also influences the level of risk. The theoretical and practical implications are discussed.

L’illusion des signaux pénaux : l’effet tendancieux de l’impunité différentielle

Réalisé sous la co-direction de Pierre Tremblay / En utilisant une approche économique du crime, cette thèse s’intéresse à la capacité des délinquants à minimiser leurs risques d’arrestation ou de condamnation et à l’impact de cette adaptation différentielle sur la manière dont on devrait interpréter le profil du délinquant qu’offrent les statistiques policières ou correctionnelles. Les études qui ont utilisé cette approche ont surtout insisté sur les coûts pénaux, mais omettent de prendre en considération les bénéfices que procurent les crimes aux délinquants et leur vulnérabilité différentielle aux risques, pourtant essentiels à la validation de cette approche. En considérant les expériences pénales comme un signal d’information entre les délinquants et les acteurs du système de justice criminelle, ceux-ci devront interpréter ce signal avec du bruit : l’évitement pénal. Cette distorsion du signal induit chez les policiers, les juges ou les agents correctionnels l’image trompeuse du délinquant inefficace. Notre première analyse, basée sur une méthode d’estimation des populations, évalue l’intensité de cette distorsion à travers les différentes étapes du système pénal (arrestation, condamnation, incarcération). Ce bruit ne se distribue pas de façon aléatoire, mais est influencé par les caractéristiques des délinquants. Les délinquants les moins vulnérables à la détection se révèlent plus expérimentés dans la réalisation de leurs délits : plus âgés, plus mobiles, plus spécialisés. Notre deuxième analyse s’est intéressée à l’effet de l’évitement pénal sur notre interprétation de la récidive. Les données de délinquance autorévélée d’un échantillon de détenus, mises en parallèle avec les données pénales, ont permis d’estimer la capacité individuelle d’évitement pénal. Lorsqu’on prend en considération cette disposition, les antécédents pénaux deviennent un indicateur des échecs auxquels les délinquants font face durant leur trajectoire délinquante plutôt que de la poursuite même de cette trajectoire, créant l’illusion de l’efficacité de sa prédiction par les antécédents pénaux. L’intensité des coûts pénaux antérieurs réduit la probabilité de la poursuite de la carrière. Les bénéfices soutirés des activités criminelles augmentent cette probabilité, alors que les opportunités d’emplois conventionnels la réduisent. Notre troisième analyse reprend une stratégie d’estimation des populations qui combine une variante adaptée aux déplacements urbains des délinquants et procure une perspective plus macrosociologique à nos observations des chapitres précédents parce qu’elle étudie l’évolution des populations délinquantes de différents groupes ethniques en fonction de la surveillance policière à laquelle ils font face. Nos résultats indiquent que, pour les délits dont le signalement est principalement proactif, un surplus de surveillance d’un groupe induit une baisse de surveillance auprès des autres groupes. Il en résulte que l’effet préventif obtenu dans le premier cas est annulé par un effet incitatif dans le second cas, celui-ci étant suffisant pour observer une augmentation générale de la population délinquante. Cet effet Harcourt vient corriger l’illusion de l’efficacité du profilage criminel ou des interventions policières ciblées. En conclusion, on constate qu’en se basant seulement sur des données pénales, on entretient l’illusion de l’efficacité pénale. Le bruit causé par l’évitement pénal ou l’impunité différentielle des délinquants a des répercussions importantes sur notre compréhension du comportement adaptatif des délinquants. / Using an economic approach to crime, this thesis focuses on offenders’ ability to minimize their risks of arrest or conviction and on the effect of this differential adaptation on the way we should interpret offenders’ profile based on police and correctional statistics. Studies using the approach mostly insisted on penal costs, but overlooked the benefits that offenders gain from crime and their differential vulnerability to risks, essential to its interpretation. Considering penal experiences as an information signal between offenders and criminal justice system officials, both parties would need to interpret this signal with a serious amount of noise: penal avoidance. This signal distortion induced to police officers, judge or correctional officers a misleading depiction of inefficient offenders. Our first analysis, based on a population estimates method, assess the intensity of this distortion through the different steps of the penal system (arrest, conviction, incarceration). This noise is not randomly distributed, but influenced by offenders’ characteristics. Offenders who are less prone to detection are be more experienced in the achievement of their offences: older, more geographically mobile, more specialized. Our second analysis looked at the effect of penal avoidance on our interpretation of recidivism. Self-reported offending data from an inmate sample, in conjunction with penal data, allowed us to assess individual penal avoidance ability. When taking into consideration penal avoidance, past penal experiences appear to be an indicator of failure faced by offenders during their criminal career rather than its true continuation, creating the illusion of the efficient prediction of recidivism using past penal experiences. The intensity of past penal costs reduces the probability of the continuation of the criminal career. The benefits of crime increase this probability while legitimate opportunities reduce it. Our third analysis, also using a population estimates methods combined to a variation adapted for offenders’ urban mobility, gives a macro perspective to our past observations and allowed us to examine the evolution of offenders populations from different ethnic groups in function of the intensity of police surveillance they each are subject to. Our results suggest that, for offenses with more proactive reporting, an increased surveillance of one group results in the decreased surveillance of other groups. The preventive effect on the first group is then cancelled by an incentive effect on the second. This effect alone suffices to increase the total criminal population. This Harcourt effect corrects the illusion of criminal profiling or targeted strategies efficiency. In conclusion, we observe that relying solely on penal data to assess offenders behaviours maintain an illusion of penal efficiency. The noise caused by offenders’ penal avoidance or differential impunity influences our understanding of offenders’ adaptive behaviors.

Les instruments actuariels d'évaluation du risque de récidive : applicables aux auteurs d'infractions sexuelles ayant une déficience intellectuelle?

L’intérêt porté à l’évaluation du risque de récidive chez les délinquants ayant une déficience intellectuelle (DI) a notablement augmenté depuis les 10 dernières années. D’ailleurs, certains croient que les instruments utilisés pour mesurer le risque chez les auteurs d’infractions sexuelles neurotypiques peuvent s’appliquer aux auteurs d’infractions sexuelles ayant une DI tandis que d’autres appuient l’idée d’utiliser et de développer des mesures actuarielles propres à ces individus. Trois objectifs ont été posés pour tenter d’éclaircir ces deux visions, soit 1) Comparer les taux de récidive entre les deux groupes d’auteurs d’infractions sexuelles (ayant une DI et neurotypiques), en plus de déterminer lequel récidive plus rapidement sur une courte période de temps, 2) Analyser la validité prédictive de huit instruments actuariels (et de la PCL-R) auprès d’un échantillon d’auteurs d’infractions sexuelles ayant une DI et 3) Analyser la composition des instruments par domaines (Knight et Thornton, 2007). L’échantillon est composé de 550 auteurs d’infractions sexuelles dont 54 ont une DI. Les résultats suggèrent que les deux groupes d’auteurs d’infractions sexuelles (neurotypiques et ayant une DI) présentent des taux de récidive similaires. Un nombre restreint d’instruments semblent par contre efficaces chez les auteurs d’infractions sexuelles ayant une DI. De ce fait, le SVR-20 s’est révélé avoir une validité prédictive pour la récidive sexuelle, le RMC, le RMV et le MnSOST-R pour la récidive violente et le VRAG pour la récidive non violente. Il est toutefois justifié de se questionner sur la manière d’évaluer le risque chez cette clientèle particulière. L’analyse de la composition des instruments semble importante puisque certains domaines pourraient prédire différemment la récidive chez les auteurs d’infractions sexuelles ayant une DI. Une grande partie des facteurs pouvant être utiles dans la prédiction de la récidive ne semblent toujours pas avoir été identifiés, repoussant ainsi la création d’instruments propres aux délinquants ayant une DI. / Interest in the risk assessment for offenders with intellectual disabilities (ID) has particularly grown during the last 10 years. Two opinions are shared on this subject: some believe that the instruments used to measure risk in sexual offenders can apply to sexual offenders with ID while others support the idea of using and developing actuarial measures for these people. Three objectives were set in an attempt to clarify these two visions: 1) Compare recidivism rates between the two groups of sexual offenders (with and without ID), 2) Analyze the predictive validity of the eight most commonly used actuarial instruments (and the PCL-R) based on a sample of sex offenders with ID and 3) Analyze the composition of the instruments according to their domains (Knight and Thornton, 2007). The sample consisted of 550 sex offenders of which 54 have an ID. The results suggest that the two groups of sexual offenders have similar rates of recidivism. A limited number of instruments also seems to be effective for sex offenders with ID. The SVR-20 was found to have predictive validity regarding sexual recidivism, the RMC, the RMV and the MnSOST-R for violent recidivism and the VRAG for non-violent recidivism. However, it is justified to question how the risk of recidivism is assessed for this particular clientele. The composition analysis of the actuarial instruments seems important among sex offenders with ID since some domains could predict differently the risk of recidivism. Finally, many of the risk factors that may be more useful in predicting recidivism has not been identified yet, thus delaying the creation of instruments tailored to offenders with ID.

With this purpose the recidivism has been collated rationally from a general to private matter. It looks into the recidivism, its classification and related subjects, and evaluate its evolution in the Brazilian Penal Law it also analyses theories that justifies its application, furthermore it lists its penal and procedural effects coming from the recognition of recidivism. The main goal of this paper is to question the recidivism in the current Brazilian Law (Mainly through the Brazilian Federal Constitution/ 1988) due to the failure of the prison penalty to reintegrate the criminal in the society. After verifying how other countries use the recidivism, we suggest changes for it in Brazil according to compared law and the evolution in penal law, making sure the penal law will truly be applied .The crisis of the prison system is highlighted, giving emphasis to the overpopulation of our prisons, no existence of reintegration programs and lack of support to the ex convicts, all these factors leads to high rates of recidivism / Este trabalho analisa a reincidência criminal e seu emprego como circunstância agravante da pena, visando apurar se a atual legislação pátria a trata de forma adequada conforme a evolução do Direito Penal. Para a realização desta dissertação, a reincidência é cotejada por meio de um procedimento racional que transita do geral para o particular. Verifica a origem da recidiva, suas classificações e os institutos afins; examina a evolução da reincidência no direito penal brasileiro e as teorias que justificam sua aplicação, bem como arrola os demais efeitos penais e processuais decorrentes do reconhecimento da reincidência. O objetivo central deste trabalho é questionar a atual disciplina da reincidência na legislação brasileira, principalmente com base na Constituição Federal de 1988 e em razão do fracasso ressocializador da pena privativa de liberdade. Após verificar a utilização da reincidência em outros países, são sugeridas alterações desse instituto, no Brasil, consoante o direito comparado e a evolução do direito penal de garantias, para que seja aplicado o direito penal do fato. É destacada, ainda, a crise do sistema carcerário, com ênfase à superpopulação prisional, à ausência da função ressocializadora da pena de prisão e ao diminuto apoio aos egressos, fatores que contribuem para os elevados índices de reincidência criminal
