State infringement of the responsibilities and rights of parents with regard to the reproductive health of their children / Wezi Sambo

Sambo, Wezi January 2014 (has links)
This research seeks to contribute to the debate on the state infringing upon the responsibilities and rights of parents with regards to the reproductive health of their children. The qualitative method of research is used. The researcher analysed the right of the child to participate in conjunction with best interests of the child, as well as the reproductive rights of children. Furthermore, the argument is based on the provisions of the South African legislation that deals with the reproductive rights of children. This legislation includes the Children's Act 38 of 2005 and the Choice on Termination of Pregnancy Act 92 of 1996. The crux of the discussion is on access to contraceptives provided to children without parental consent, as it is provided for in section 134 of the Children's Act 38 of 2005, as well as the lack of consent needed in the Choice on Termination of Pregnancy Act 92 of 1996 for a girl with no specification of age. The debate is on the fact that the responsibilities and rights that parents have towards their children are not considered. They are not involved in the major decisions that the children who are under their care and guidance have to make. Due to this finding, it has been recommended that it is very imperative to allow the parents to be involved in matters that pertain to their children's reproductive rights. This means that as children are informed about their reproductive rights, the parents must be involved as well, so as to make informed decisions relevant to the issues that their children encounter. / LLM (Comparative Child Law), North-West University, Potchefstroom Campus, 2015

The role of the audit committee in supporting the external auditor's independence and effectiveness

Marx, B., Lubbe, D. January 2010 (has links)
Published Article / This article discusses the developments and factors that impact on the external audit function, and analyses the role that an effectively functioning audit committee can play in supporting the external auditor's independence and effectiveness. This is done through a literature review of external audit and audit committee developments, and is supported by empirical evidence obtained from assessing the annual reports and from questionnaires sent to the audit committee chairs of the Top 40 listed companies in South Africa. The main findings of the study are that audit committees at the largest listed companies in South Africa are taking responsibility for overseeing the external audit function, but that the disclosure thereof in annual reports was found to be lacking. These findings are of significance as they provide support for the recommendations of King III (effective from 1 March 2010) that all companies should form audit committees and that external audit should be given oversight responsibilities in this regard.

: Preschool staff's conceptions of distributed tasks and responsibilities in their own team: A comparative study between a preschool in Norway and Sweden

Unge, Alexandra January 2016 (has links)
The main aim of this study is to gain a deeper understanding of how a preschool team should be organized to work in the best possible way. A comparative study between a preschool in Norway and in Sweden. The distribution of tasks and responsibilities are different between the countries, to explore improvements the preschool staff´s conceptions of their own organization will be focused. The distribution of tasks and responsibilities are different but the conceptions of improvements may be the same. The empiricial data has been obtained from seven interviews. The participants were preschool teachers, child minders and preschool heads in a Swedish preschool and in a Norwegian preschool. In my study one improvement emerged in both teams, better requirements to make use of their competencies. The conclusion of this study is that a preschool team should be organized in a way that makes it possible to make use of everyone’s competencies.

Towards binding economic, social and cultural rights obligations of non-state actors in international and domestic law: a critical survey of emerging norms.

Chirwa, Danwood Mzikenge January 2005 (has links)
This study argued that the issue of non-state actors requires a comprehensive response that includes the recognition of both non-binding and binding human rights obligations of these actors. It examined critically the emerging norms on voluntary obligations, state responsibility, and direct responsibility of these actors with regard to human rights at both international and domestic levels.

Surprenant, Hugues 08 1900 (has links)
Citizenship education as a form of legal socialization is a way to conceive a possible overtaking of the «lazy reason » that embodies western political paradigms. The basis of a new moral code proposing an individual and collective identity for each citizen is necessary. Thus, the efforts invested in the best possible development of future actors in the province of Québec, in the sharing of ideas and views in a contemporary perspective, can only benefit the promotion and the upcoming of a society where equity coexists with difference. It is through reflection and while exchanging on the subject with others that we decided to concentrate our research on citizenship education with law as its content. Naturally, a positivistic analysis of the law is absent in such work. As we will see, a study that tackles young individuals' view of the legal universe they live in, rather commands a sociological approach. The conclusions we reached will contribute to the debate on the concepts of citizenship, fundamental rights and social responsibilities in a learning environment. Taking into account the cultural dimension of citizenship, we describe the differences in the interpretation and the representation of fundamental rights and social responsibilities in the conscience of "initiated" and "non-initiated" to a legal socialization activity organized by the Centre de développement pour l'exercice de la citoyenneté (CDEC). This activity is called Débats de citoyens, which translates to Citizens' debate. Only once this work is done will we attempt to evaluate the value and worth of such a pedagogical approach.

La sécurité des produits : droit positif ivoirien : étude à l'aune du droit communautaire UEMOA / Product Safety : Ivorian positive law : study in the light of WAEMU Community Law

Coulibaly, Sognon Céline 25 June 2012 (has links)
The proliferation of serial and personal injury by products implies product safety as a major societal concern. Beyond the expansion of product risks, it's States incapacity, evidenced by the lack or the inadequacy of legal means of prevention that matters. It is also the economic activity that is in question. And if the need for product safety must be filled, whether to preserve life and health against the dangers of products, common sense is required: Prevention is better than effective cure, reparation or sanction. Therefore, it is little more than prevention at the request, but imposing a process, particularly through the requirements of the UN, WHO, of the SPS and TBT WTO and especially to UEMOA whose subtlety reflects the extent of the responsibilities of the Ivorian government and economic forces. The formers are responsible for internal public order and should reform the incomplete legal and institutional framework of an integrated risk control of products. The laters are responsible for the safety of their products, and are prompted to the internalisation of risk management that will certainly allow them to limiting the costs of liability.

Právní úprava rodiny a vztahů mezi rodiči a dětmi (s pohledy do minulosti i budoucnosti) / Legislation of Family and Relationships between Parents and Children (with Insights into Past and Future)

Valentová, Hana January 2011 (has links)
The presented thesis provides a comprehensive view of the current legislation on family and parents-children relationships, including insights into past and future. Being a still hot topic is the reason why I chose it for my thesis. Two introductory chapters discuss historical context of family and development of legal relationships between parents and children to date. The family has evolved over time, developed and changed and so has the status of its individual members, which was all reflected in legislation (paternal power, parental power, parental rights and duties, parental responsibilities). The current concept of family is described in Chapter 3, followed by Chapter 4 which gives general characteristics of family law and legal relations within the family, including the definitions of basic concepts used in the rest of the work. Key Chapter 5 discusses the concept of parental responsibilities brought into our law by the so-called "big amendment" to the Family Code (Act No. 91/1998 Coll.). In exercising these rights and duties, parents are obliged to protect the best interests of the minor child, to control his or her actions and to exercise supervision over him or her. The parent-child relationship is equal and both its parties are holders of complementary rights and duties. In all actions, child's...

Le capitaine

Sahed, Wahiba 18 November 2011 (has links)
Long "only master after God," the captain's authority is no longer present in the same way, which does not, moreover, that the latter is questionable. The specificity of its function is a very specific character on board. This last character is placed in a certain extent, on the same plane as the sailor who is under eighteen years of age, character essential for both its traditional role for its activity on the ship. Its position on board is a marine different from other crew members. He has authority over all of the crew. Although this authority, as is also true for business leaders on the ground no longer exercised with the same rigor as in the past, it nonetheless. Marin, head of maritime shipping, commercial agent of the owner, attendant water, the captain has seen its role evolve over time. From a regulatory point of view, his duties on board, and its position makes it retains a unique situation, the entire maritime labor regulations can not, therefore, be applied to him

Transnational caregiving

Horvath, Rozalia January 1900 (has links)
Master of Science / Department of Family Studies and Human Services / Rick J. Scheidt / In 2011, about 13 percent of the U.S. population, approximately 40 million people, were foreign born in the United States. Many of them participate in transnational caregiving, either as children supporting their parents in their country of origin or parents moving to the U.S. to help their children. This report examines research on transnational caregiving between immigrant adult children and their parents. Following the caregiving definitions of Finch (1989), the articles were reviewed and categorized as economic support, accommodation, personal care, practical support and childcare, and emotional and moral support. Changes in family norms and roles, and the caregiving responsibilities after immigration, are also presented. Keywords: transnational, caregiving, immigrant, elderly, economic support, accommodation, personal care, practical support and childcare, and emotional and moral support, living arrangement.
