Este trabalho discute a teoria do direito de Ronald Dworkin, desde sua gênese até seus desenvolvimentos mais recentes, com o objetivo específico de aferir a influência que esta sofreu da filosofia política de John Rawls e de sua concepção de justiça. Essa influência foi especialmente sentida na metodologia inicialmente concebida por Dworkin para responder às tradicionais questões de teoria geral do direito, já que estas teriam sido mal resolvidas pelos positivistas. O que se verifica é que tal método se baseia na idéia de equilíbrio reflexivo de Rawls. Essa intensa convergência que inicialmente se verifica é progressivamente afastada na medida em que Dworkin caminha rumo a um liberalismo abrangente, defendendo uma continuidade entre a moralidade política e a ética, e Rawls reinterpreta sua teoria para defender uma limitação desta ao domínio do político. / This paper will discuss Ronald Dworkins legal theory since its genesis till its most recent studies, aiming specifically assess how this theory was influenced by John Rawls political philosophy and his conception of justice. This influence was specially noticed in the methodology first conceived by Dworkin to respond to the traditional issues of jurisprudence, since these ones had been unresolved by the legal positivism. What can be verified is that such method is based on Rawls idea of reflective equilibrium. This strong convergence, that is initially observed, is gradually deviated insofar as Dworkin moves towards to a comprehensive liberalism, defending continuity between morality and ethics, and Rawls reinterprets his theory to defend a limitation of it to the domain of the political.

A literatura jurídica brasileira sobre o controle de políticas públicas não trata, de um modo geral, sobre a discricionariedade dos juízes. Mas é possível utilizar as teorias de Ronald Dworkin e de Neil MacCormick para a obtenção de critérios de sindicabilidade do poder discricionário dos magistrados, principalmente quando em discussão casos difíceis, como podem ser caracterizadas, em geral, as controvérsias sobre políticas públicas. Esses critérios são a coerência/integridade do Direito, a consistência da interpretação jurídica e o prognóstico das consequências da deliberação jurisdicional. As decisões de tribunais brasileiros sobre política pública penitenciária podem e devem ser analisadas à luz desses critérios decisórios.

The diploma work is focused on situation and function of Czech mobile providers market. The theoretical background is based on Ronald Coase's findings. The functionality of theoretical hypothesis is verified and further discussed on the basis of foreign telecommunication markets. Different real economics provide valuable experience concerning identification of possible assets and problems. The acquired information is consequently used for analysis of Czech mobile market. Next to the evaluation of the current situation the focus is given to the planned auction of frequencies. Conditions of this auction are described and the potential influence to future Czech mobile providers market is monitored.

A abordagem, no que se refere à decisão, procura esclarecer o conceito de Direito para Dworkin, a teoria da decisão judicial que ele propõe, e, por fim, como se opera a decisão nos casos difíceis, de modo a abordar as etapas da interpretação e o método de Hércules; o poder discricionário do juiz; os direitos institucionais e jurídicos e a tese da única resposta certa nos casos controversos. No que se refere à legitimidade, são discutidas as questões atinentes ao modelo de Estado de Direito em referência ao papel a ser desempenhado pelos juízes; o problema da coerção nos casos controversos e a eventual violação da Democracia pela teoria proposta por Dworkin / This work focuses on analyzing the Ronald Dworkin´s theory on hard cases from the perspective of adjudication and legitimacy. Defusing a Rhetorical Situation through Apologia: Ronald Reagan and the Iran-Contra Affair

This thesis examines the manner in which Ronald Reagan responded to the Tower Commission Report concerning his involvement in the Iran-Contra Affair. It explores the following questions: 1) What were the factors leading to a rhetorical situation as defined by the media and which required Ronald Reagan to provide a public response of self-defense; 2) what strategies of apologia did Reagan employ; and 3) how did the media and the White House characterize the outcome of Reagan's speech? Data for analysis were drawn from nationally recognized newspapers that shaped public perception of the Iran-Contra Affair: The Washington Post, The New York Times, Los Angeles Times, and The Christian Science Monitor. In addition, The Tower Commission Report and Ronald Reagan's March 4, 1987 speech were used as primary texts. It was found that the events of the Iran-Contra Affair qualified as a crisis, and exemplified an exigence needing a response. The thesis demonstrated that the Iran-contra Affair was an appropriate case for study as a rhetorical situation. Analysis demonstrates how Ronald Reagan made full use of the conventional apologetic strategies of denial, bolstering, differentiation, and transcendence to regain lost credibility; moreover, analysis provides further evidence of the utility of genre criticism.

Cette recherche constitue une analyse de la présidence de Ronald Reagan sous un nouvel angle. Au sein de cet ouvrage, nous analysons l'influence que l'idéologie du messianisme américain a eue sur Ronald Reagan lors de son passage à la Maison-Blanche. L'originalité de notre étude tient au fait que nous analysons le contenu des discours prononcés par le Président suite à certains événements marquants de sa présidence en matière de politique étrangère, dans le but de constater si ce dernier fait usage d'une rhétorique messianique. En procédant de la sorte nous combinons deux facettes de sa personnalité: l'homme religieux avec le messianisme et le communicateur avec sa rhétorique. À l'aide de cette méthodologie, nous souhaitions corroborer notre hypothèse de départ stipulant que Ronald Reagan était réellement influencé par l'idéologie du messianisme et qu'il s'en servait au sein de ses discours pour justifier ses décisions en matière de politique extérieure. Pour ce faire, nous avons sélectionné les allocutions du Président qui étaient liées aux principaux événements qui ont marqué la politique étrangère américaine entre 1980 et 1988. Une fois nos analyses complétées, nous avons été frappé de voir à quel point notre hypothèse se voyait confirmée par nos résultats. Effectivement, Ronald Reagan fait usage d'une rhétorique messianique pour justifier à la nation ses décisions en matière de politiques étrangères. Il va même plus loin en se laissant influencer par des idéologies découlant du messianisme, telles que le missionnarisme, l'exceptionnalisme et le millénarisme. Enfin, nous croyons que notre approche novatrice et nos conclusions auront comme principale conséquence d'élargir le champ d'étude existant sur la présidence de Ronald Reagan tout en ouvrant une possibilité d'analyse sur les similitudes existantes entre la rhétorique messianique de Ronald Reagan et celle de George W. The Hart-Dworkin debate and the separation thesis of legal positivism

In the postscript to The Concept of Law, H.L. A. Hart describes the on-going debate inspired by his book, focusing on the criticisms of Ronald Dworkin. In this essay, I will discuss Dworkin’s criticisms of Hart, as well as Hart’s responses, showing that while Hart responds adequately to some criticisms, he fails to respond adequately to others. I will also reconstruct and evaluate the arguments given for and against the separation thesis by Dworkin and Hart. Finally, I will argue that the debate about the separation thesis – the thesis that morality and law are separable – is misguided, conflating as it does two distinct questions. These are the questions of what the positive law is, that is, the law that is posited in a specific time and place, and of what the natural law is, that is, the law that (if it exists) is universal and timeless. Once we distinguish these questions, we will see that the answer to the question of whether law is separable from morality depends on which sense of ‘law’ is relevant, and that there are two different answers corresponding to the two senses of positive law and natural law. Positive law is separable from morality while natural law is not. / text

Tolkien's aesthetic enjoyment of distance and antiquity in literature, his interest in the power of imagination, and his use of medieval romances and ancient fairy-tales as a means of rediscovering an enchanted vision of the world are analogous to the literary endeavours of the Romantics. Like them, he perceives that the real world is inherently different from how he imagines an ideal world. This thesis discovers that Tolkien's writings correspond in numerous ways to the modern form of elegiac romance, most notably because of their positive portrayals of mortality, and their depictions of intense yearning. The moral imperative to accept death, exemplified by the heroic ethos of Old English literature, clarifies why the effect of historicity is often noted in Tolkien's fictions: time is mimetic rather than mythological. Tolkien demonstrates that Fantasy is capable of reflecting the most sombre issues of the real world, particularly the inevitability of death.
