L’actuelle reconfiguration de l’activité maritime et portuaire s’accompagne de mutations majeures qui appellent à un renouvellement de la gouvernance des villes portuaires. Trois des principales villes portuaires de la Rangée Nord-Ouest Européenne – à savoir Anvers, Le Havre et Rotterdam – expérimentent la diffusion du paradigme stratégique et la diversité de projets induits.Pour répondre aux enjeux théoriques et opérationnels issus d’un tel contexte, cette thèse est structurée autour de quatre volets – dont l’analyse de l’impact des instruments de planification stratégique sur les processus d’aménagement dans les villes portuaires. L’élaboration d’une méthodologie pertinente pour appréhender la complexité des enjeux d’aménagement des villes portuaires et le nouveau contexte de production des politiques d’aménagement constitue le deuxième volet. L’étude du lien entre planification stratégique et cohérence territoriale en est le troisième. Par ailleurs, il s’agit d’étudier la possibilité de modéliser les différents types de planification stratégique. Cette recherche est conduite selon une méthodologie pluridisciplinaire et une analyse systémique.Outre la méthode d’analyse des démarches stratégiques et de la complexité des villes portuaires, les travaux menés permettent, d’une part, de mieux appréhender la redéfinition actuelle des processus d’aménagement et, d’autre part, d’évaluer l’intégration de la cohérence territoriale dans les politiques d’aménagement des villes portuaires.Enfin, la formalisation théorique des projets stratégiques débouche sur une typologie originale des 3 modèles de planification stratégique mis en évidence à Anvers, au Havre et à Rotterdam. / Port and maritime activity are currently undergoing an important reorganisation. This phenomenon goes hand in hand with prominent evolutions triggering a renewal of port cities governance. Among the Northern Range, three major cities – namely Antwerp, Le Havre and Rotterdam – have been experiencing the spreading of the strategic paradigm followed by a diversity of strategic projects. In order to answer the theoretical and operational issues induced by this renewed context, the research is structured around four axes among which the analysis of strategic planning instruments and its impact on spatial planning processes in port cities. Conceiving a methodology that allows explaining the complexity of port cities constitutes an important challenge. As such, it is the second axis explored. The link between strategic planning and territorial coherence forms the third axis. Finally, the opportunity of modelling strategic planning of port cities is the fourth axis. The research follows a cross-disciplinary approach coupled with a systemic analysis. On top of providing a specific methodology to analyse strategic planning and port cities complexity, the doctoral study contributes to a better understanding of spatial planning processes and their current redefinition. It also produces an evaluation of the way territorial coherence is integrated to spatial planning policies in port cities. Last but not least, the research presents a theoretical formalisation of strategic processes leading to an original typology of the three strategic planning models identified in Antwerp, Le Havre and Rotterdam.

La réforme du droit chinois du transport maritime de marchandises / The reform of the chinese law of carriage of goods by sea

Le transport de marchandises par mer constitue de nos jours un pilier du commerce international et l’un des principaux moteurs de la mondialisation. De ce fait, le droit du transport maritime de marchandises, en tant qu’élément déclencheur du droit maritime, reste toujours la discipline essentielle dans ce domaine. En raison du développement de la technologie de construction des navires et des modifications des modalités de l’exploitation maritime, les normes en vigueur, relatives au transport maritime, se trouvent confrontées aux changements évolutifs dans la pratique. Tout spécifiquement, en raison de l’absence d’une tradition à ce propos, le droit chinois s’est inspiré inévitablement des normes internationales, quant à son développement. À l’heure actuelle, la question qui se pose ici est de savoir s’il convient d’introduire de nouveaux instruments, et en particulier les Règles de Rotterdam, dans le processus de modernisation du droit positif chinois ? L’étude menée vise à présenter quelques avis de recommandation, proposés pour la réforme du droit chinois du transport maritime de marchandises, vis-à-vis les Règles de Rotterdam. Dans le cadre d’une économie mondialisée, la modernisation du droit positif chinois, et surtout en matière maritime, devrait se développer dans les directions suivantes : d’une part la participation et l’intégration au système international, et de l’autre la reconnaissance de sa particularité au sein de la législation / The carriage of goods by sea constitutes at present time a pillar of international trade and one of the principal engines for the globalization. For this reason, the law of the carriage of goods by sea, being as the primary trigger for the maritime law, remains always its essential position in this domain. Due to the technological progress in the construction of the vessels and to the changes of the operational mode of maritime exploitation, the relevant laws in force are confronted with progressive transformation in practice. Particularly in relation to the Chinese maritime law, because of absence of the tradition in this regard, it has been inspired inevitably by the international norms, with respect to its development. At the current time, the question here is whether to introduce some new instruments, and in particular the Rotterdam Rules, in the process of modernization of Chinese positive law ? The present research is intended to provide some recommendation notices, proposed for the reform of the Chinese law of carriage of goods by sea, vis-à-vis the Rotterdam Rules. In the context of a worldwide economy, the modernization of the Chinese positive law, and especially in terms of maritime law, should be deployed with the following sprits: the participation and the integration to the international system on the one hand, and the recognition of its particularities in the course of the legislation on the other hand

Heritage planning in Malmö and Rotterdam during the 2000’s : A cross-contextual analysis of arguments, metaphors and figures of thought

A wide variety of scholars acknowledge heritage planning as a widespread phenomenon. However, to what extent it is widespread is debatable. Also, if heritage planning is an acknowledged widespread phenomenon, what can be learned about it when looking at the rhetoric and the key concepts used in different contexts? This study aims at a cross-contextual investigation. The main aim is to interpret and to discuss rhetoric and underlying ideas used in heritage planning debates across contextual boundaries. The main aim is made workable through a number of methodological choices that curtail the scope of the study. The following main question is the result of these choices; what kinds of arguments, metaphors and figures of thought are similar (context-independent) versus different (context-dependent) in a selection of recent and on-going debates about heritage planning from Malmö and Rotterdam? As part of the methodology, figures of thought – that are expected to be relevant for understanding debates about heritage planning – are treated. This includes figures of thought such as the idea of an “original” and the idea of “progress”. Cases from the cities of Malmö and Rotterdam are chosen to study what similarities and differences come to the fore in heritage planning debates running parallel in time but being situated in different contexts (respectively a Swedish and a Dutch). The debates chosen are about the Kockums Crane and the area of Varvsstaden in Malmö and about the Porters Lodge and the area of RDM in Rotterdam. The analysis shows that the arguments and premises raised, the metaphors used and the underlying figures of thought are to a great extent similar between the cases from Malmö and the cases from Rotterdam. However, the use of arguments, metaphors and figures of thought differs professional groups in-between (“monument curators” versus “planners”) and between debates about single objects (the Kockums Crane and the Porters Lodge) and debates about the development of areas (Varvsstaden and the area of RDM). This study shows that arguments, metaphors and figures of thought effectively are exchanged across national boundaries through professions. More notable however, is that different “language-games” played or kinds of arguments used by monument curators and planners do not seem to conflict with each other at a discursive level. For example, the monument curator’s story-telling metaphors are smoothly turned into the planner’s commodification metaphors. However, at the level of figures of thought a potential conflict may arise between the preservationist idea of the moral duty of stewardship and the idea of commodification of built heritage propagated by an alliance between bureaucracy and economy.

Este trabalho propõe a primeira tradução feita diretamente do latim para o português brasileiro de uma das obras mais importantes do humanista Erasmo de Rotterdam: a Querela Pacis undique gentium eiectae profligataeque, publicada em 1517. Tal obra constitui-se, ao lado de outros escritos, como uma das mais importantes declamações realizadas durante o Renascimento. Nossa transposição para o português considerará os recursos retóricos escritos em latim, além de conter notas explicativas e referências históricas, mitológicas e bibliográficas, sempre que estas se fizerem necessárias para melhor compreensão do texto, além de referências a autores da Antiguidade assim como a outras obras do próprio autor. No estudo introdutório dessa obra de gênero declamatio renascentista, procurar-se-á analisar o texto erasmiano segundo a conceituação da retórica tradicional antiga, sobretudo dos autores do período imperial, quando a prática das declamações escritas em grego e latim se sobrepôs à oratória, sem espaço em razão do declínio senatorial. Com base nas fontes antigas e nos estudos recentes, pretendemos identificar as semelhanças e diferenças entre a retórica dos autores romanos e a erasmiana nela concretizada. Também serão investigadas as estratégias da argumentação persuasiva, sejam epidíticas, sejam deliberativam, em favor da paz e em sua polêmica diatribe contra a guerra. / This paper proposes the first translation directly from Latin into Brazilian Portuguese of one of the most important works by the humanist Desiderius Erasmus: Querela Pacis undique gentium eiectae profligataeque, published in 1517. This work constitutes one of the most important declamations written during the Renaissance. Our transposition to Portuguese will consider rhetorical resources, as well as containing explanatory notes about historical, mythological and bibliographical references, whenever these are necessary for a better understanding of the text, such as references to direct or indirect allusions to writings of Antiquity or other works by the author himself. In the introductory study of this work of the Renaissance declamatio genre, we will analyze the Erasmian text according to the ancient traditional Greco-Roman concept of Rethoric, especially in the authors of the imperial period, when the practice of declamations written in Greek and Latin overlapped the oratory without the ancient status because of the senatorial decline. Based on ancient sources and recent studies, we intend to identify the similarities and differences between the rhetoric of classic Latin authors and the erasmian rhetoric embodied in the Complaint of Peace. We will also investigate the strategies of persuasive argumentation, whether epididical or deliberative, in favor of peace and in its controversial diatribe against war.

Demand Systems For Agricultural Products In The Oecd Countries

The estimation of demand equations provides the earliest example of the use of statistical and econometric techniques on economic data. It is possible to identify two distinct approaches to the estimation of demand equations. The first and original approach concentrated on the demand for particular goods by paying attention to any special characteristics of the single market involved. The second approach involved simultaneous estimation of complete systems containing the demand equations for every commodity group purchased by consumers. The estimation of a complete system of demand equations in principle enables us to obtain better estimates of each equation in the system than the first approach because of interaction in the demand behavior of different commodities. This study is directed towards the estimation of demand systems for agricultural products in the OECD countries. Three representatives demand systems with their extensions, namely the Rotterdam Model, An Almost Ideal Demand System (AIDS), and CBS model are used. These models are estimated by Seemingly Unrelated Regression (SUR) method. The procedures to estimate demand systems suggest significant empirical regularities for agricultural products in the OECD countries. The main contribution of this study is its procedure for model selection. This procedure implies the superiority of AIDS and CBS models over the Rotterdam model.
