Indicadores de benchmarking dos serviços de saneamento voltados a populações vulneráveis / Benchmarking indicators of water supply and sanitation services aimed at vulnerable populations

Diante da realidade de segregação residencial existente no Brasil, determinada pela heterogeneidade de renda, de condições sociais entre bairros e distritos, evidencia-se uma sociedade cada vez mais penneada por iniquidades sociais e ambientais. Somado a isto, há o fato do crescimento da concentração populacional em áreas urbanas. Este e outros fatores geram transformações nas estruturas das cidades acentuando conflitos referentes ao uso e ocupação do solo. Tais conflitos requerem agilidade de suprir demandas de fornecimento de serviços essenciais, tais como de abastecimento de água e esgotamento sanitário, especialmente quando se trata destes serviços às populações vulneráveis. Para apoio a medição e visualização desse cenário, de forma a elaborar políticas públicas e empresarias, é fundamental a utilização de indicadores, os quais, no entanto, não estão prontamente disponíveis. Emerge assim a necessidade de proposição de indicadores que mensurem o fornecimento dos serviços às populações vulneráveis em áreas urbanas. Neste contexto, com estudo de caso para o Estado de São Paulo, Brasil, a pesquisa teve como enfoque atuar na interface teórica e prática para proposição de indicadores. Foram realizadas, então, revisão bibliográfica, análise documental e discussão crítica com base no aprendizado do estudo de caso. Doze indicadores foram propostos e um sistema de indicadores de benchmarking dos serviços de abastecimento e esgotamento sanitário voltados às populações vulneráveis foi estruturado. O sistema e os indicadores foram identificados por meio do alinhamento de diferentes visões dos atores, o que permitiu que fossem condizentes com a realidade dos serviços, e posteriormente, mais facilmente implementados. / The income heterogeneity and social conditions between neighborhoods and districts show a society increasingly permeated by social and environmental inequities by means the reality of residential segregation that exists in Brazil. In addition, there is population growth occurred concentrated in urban areas, this and other factors that generate transformations in the structures of cities accentuating conflicts regarding the use and occupation. Such conflicts require flexibility to supply demands for essential services such as to provi de water and sanitation services, especially aimed to vulnerable populations. For the measurement and visualization ofthis scenario, in order to produce the policies and business, it is essential to use of indicators, which, however, are not readily available. Thus emerges the need to propose indicators that measure the provision of services to vulnerable populations in urban areas. In this context, with case study in Sao Paulo State, Brazil, the research was focused on theoretical and practical interface to proposed indicators. Were performed also, literature review, document analysis and critical discussion based on the learning case study. Twelve indicators were proposed and a system of benchmarking indicators for the water supply and sanitation services to targeted vulnerable populations was structured. The framework and indicators were proposed by aligning different views of the actors, in a way to be consistent with the reality of services and more easily implemented.

An evaluative study of Municipality programs in addressing water and sanitation services in informal settlements

A dissertation submitted in partial fulfilment of the requirement for the award of a degree of Masters of Arts in Community Work in the Department of Social Work, at the University of Zululand, 2010. / South Africa has one of the most progressive legislative and policy frameworks for water and sanitation services in the world, which includes a constitutional right to water and a national free basic water policy. However, when it comes to the local government level (municipalities) who arestipulated with the duty to provide water and sanitation services not only in informal settlements, the reality is quite different.In many municipalities, water and sanitation services programs are still run according to long established routine and customs which have never been examined for their effectiveness or appropriateness to current conditions of the areas (informal settlements) where services are driven to. Nevertheless, the intention of this study was to evaluate municipality programs in addressing water and sanitation services in informal settlements. To produce data for thestudy, the questionnaires, interviews schedule and document review or analysiswas utilised.A sample of 10respondents was drawn from three Umhlathuze municipalities, namely: Richards Bay, Empangeni and Esikhawini municipalities. The findings from the study indicated that Umhlathuze municipality programs in addressing water and sanitation services in informal settlements is a failure, the municipality have a sour working relationship with the community, the criteria used to choose the strategy to the provision of the services does notencourage community participation, and finally, the municipalities are still using a bit of the past supply driven approach and the new approach; demand responsive approach simultaneously. The set objectives for the study were achieved, andmost importantly, it is recommended that fullcommunity participation at different levels and stages of water supply and sanitation service planning and implementation should be encouraged.

In particular, they focus on determining if these are legally entitled to market the treated waste water generated as a result of the provision of public services in charge. Additionally, in order to provide a complete analysis of the issue, the authors speak about the powers of the National Water Authority and his power to permit reuse of treated wastewater. / Los autores del presente artículo realizan un análisis sobre las empresas prestadoras de servicios públicos de saneamiento. En particular, se enfocan en determinar si es que estas se encuentran facultadas legalmente para comercializar el agua residual tratada que generan como consecuencia de la prestación de los servicios públicos a su cargo. Adicionalmente, a fin de brindar un análisis completo del tema, se toman en cuenta las facultades de la Autoridad Nacional del Agua para conceder autorizaciones de reúso del agua residual tratada.

Este trabalho apresenta a análise das concessões dos serviços de saneamento básico, obtidas pelo grupo transnacional Suez S.A., em Limeira-SP e Manaus-AM e procura desvendar em que medida essas concessões integram as novas estratégias de negócios deste mesmo grupo. Nesta análise, procura-se discutir como a obtenção da concessão de importantes áreas com abundância de água pelo grupo Suez, aliada à crescente participação desse grupo no mercado acionário, tem contribuído para a expansão do grupo, embora, no âmbito local, os serviços de saneamento básico nesses municípios apresentem a retração de investimentos. Deste modo, a discussão sobre os serviços de saneamento básico em Manaus e em Limeira reconhece que a prioridade não é a defesa dos interesses públicos, sendo que houve atrasos e retração nos investimentos, bem como a manutenção do alijamento de parcelas mais pobres da população ao acesso à água tratada e ao esgotamento sanitário, mas sim a defesa dos interesses do grupo por parte das suas concessionárias. A defesa dos interesses do grupo por parte das suas concessionárias, que é o de obtenção de lucros e rendimentos, tem contribuído para a manutenção da condição de exclusão aos serviços de saneamento básico e concorrido para o comprometimento do meio ambiente e da saúde pública, onerando e fragilizando ainda mais o Estado, já que é este quem acaba por assumir as conseqüências destes déficits. / The concessions of water supply and sanitation services, obtained by the transnational SUEZ group in Limeira-SP and Manaus-AM are discussed, focusing them as new strategies to spread up the group´s businesses. On this analyses, the acquisition of new concessions in water abundant areas in connection with the growing participation of the Suez group in the stock market is emphasized as a business spreading strategy despite of less investments and lack of local water and sanitation services improvement. In this manner, the discussion about the water and sanitation services in Manaus and Limeira recognizes that the priority is not the public interest, particularly because of the delay on the sanitation investments and the absence of positive strategies in order to include the poor part of the population in accessing drinking water and sanitation but, contrarily, the private interests of the concessionaries and consequently of the transnational group are the main goal. The defense of the group interests and rentability by its concessionaries has contributed to the maintenance of the water and sanitation exclusion of the less favored social classes and concurred for the environment and public health impairment, so costing and weakening even more the State which is, on the last instance, the one assuming all of those deficits.

Cette thèse étudie les inégalités environnementales dans un objectif de justice sociale. La première partie propose une définition interdisciplinaire de ces inégalités afin de capter son caractère multidimensionnel et de montrer son utilité en économie de l’environnement et en économie écologique. À partir de la littérature en philosophie économique, le caractère juste ou injuste des inégalités environnementales est ensuite analysé en mobilisant différentes conceptions égalitaristes de la justice et en considérant l’existence d’autres objectifs sociétaux. À la suite de ce travail théorique, la seconde partie s’articule autour d’une application aux enjeux de l’accès à l’eau et à l’assainissement au Brésil. Après avoir présenté la situation relative à ces services dans le contexte brésilien, les déterminants socioéconomiques et institutionnels de cet accès sont identifiés par des analyses économétriques sur des données à l’échelle des ménages. Ces analyses permettent de mettre en lumière des déterminants au cœur des problématiques de justice environnementale comme le revenu, l’ethnicité, mais aussi le rôle des États en ayant recours à des modèles multi-niveaux. En utilisant un indicateur d’accès à l’eau et à l’assainissement construit à partir d’une analyse factorielle, les inégalités associées à ces services sont ensuite mesurées par différentes méthodes correspondant à chacune des conceptions de la justice développées dans la première partie / This thesis studies the environmental inequalities in an objective of social justice. The first part offers an interdisciplinary definition of these inequalities in order to catch their multidimensional nature and to show their usefulness in environmental economics and ecological economics. Based on a philosophy of economics perspective, the fairness of environmental inequalities is analysed by using different egalitarian conceptions of justice with a consideration of the existence of other societal objectives. Following this theoretical development, the second part is devoted to an analysis of the issues of access to water and sanitation services in the context of Brazil. After a discussion over the situation related to the water and sanitation sector in Brazil, the socioeconomic and institutional determinants of the access to these services are identified using econometric analyses at the household level. These analyses enable to expose key determinants in the perspective of environmental justice including income level and ethnicity. In addition, they show the role of the state level thanks to the use of multilevel models. By using an indicator of the access to water and sanitation services elaborated through a factor analysis, the inequalities associated to these services are then measured by different methods which correspond to each conception of justice developed in the first part.

En la presente investigación se aborda la problemática existente en la composición del Directorio y en el procedimiento de elección de sus miembros en una Empresa Prestadora de Servicios de Saneamiento ubicada en el centro oeste del Perú, en adelante EPS S.A. como factor que incide en la Sostenibilidad en la gestión empresarial de dicha empresa y en las demás Empresas Prestadoras de Servicios de Saneamiento de accionariado municipal a nivel nacional, en adelante “EPS”. Aspectos jurídicos da gestão compartilhada dos serviços públicos de saneamento básico / Legal aspects of the integrated management of the sanitation services

Os serviços de saneamento básico, considerando-se o histórico de sua concretização no Brasil, configuram o campo ideal para a aplicação mecanismos de gestão de serviços públicos que possibilitem a atuação coordenada de diversos entes da federação. De fato, se de um lado é possível reconhecer o interesse local que as atividades de saneamento apresentam, de outro deve-se levar em consideração que, muitas vezes, a prestação dos serviços terá caráter regional e ocorrerá em um contexto em que parcela significativa dos Municípios brasileiros não possuirá, isoladamente, condições econômicas de proporcionar a sustentabilidade dos serviços. O renovado arranjo institucional proporcionado pelo art. 241 da Constituição da República, pela Lei Federal n. 11.445/2007, pela Lei Federal n. 11.107/05 e o tradicional arranjo das regiões metropolitanas demonstram, em muitos pontos, a importância da união de esforços entre entes federados para a implantação dos serviços de saneamento. Tal prestação integrada exige peculiar conformação institucional, dotada de normatividade própria, além de requisitos específicos, temas esses aqui examinados desde seus fundamentos até sua organização prática. / The sanitation services, on what concerns the history of its concretization in Brazil, configure an ideal field for the appliance of the public services management mechanisms that enable a coordinate action between different federation entities. Indeed, if on one hand it is possible to recognize the local interest that such sanitation activities represents, on the other hand, it must be considered that, many times, the provision of those services will have regional characteristics and will occur in a context in which significant part of the Brazilian municipalities will not have, on its own, economical conditions to sustain the services. The new institutional framework brought by article 241 of the Federal Constitution, by the Federal Laws 11.445/2007 and 11.107/05 and by the well-known arrangement set forth by the metropolitan regions, demonstrate all together the importance of federal entities to unify efforts to implement the sanitation services. Such integrated provision of sanitation services demands a peculiar institutional framework, ruled by specific laws and regulations and specific requirements, matters which are here examined from its foundations to its practical organization.

Agências reguladoras intermunicipais : uma proposta para a regulação do saneamento básico na região metropolitana de Ribeirão Preto /

Orientador: José Carlos de Oliveira / Resumo: A Região Metropolitana de Ribeirão Preto está constituída por 34 municípios, marcada pela diversidade entre eles, especialmente sob a ótica demográfica, geográfica, cultural e social. O espaço metropolitano requer um planejamento coordenado a fim de dar viabilidade às funções públicas que ora se apresentam com o status de interesse comum. Dentre essas funções, não há dúvida sobre o protagonismo dos serviços públicos de saneamento básico. Contudo, a ausência de regulação desses serviços fez nascer a inquietação sobre o modelo mais adequado para esta recente região metropolitana. Este trabalho buscou compreender as políticas públicas que circulam os serviços públicos de saneamento básico. A partir de algumas respostas, buscou-se evidenciar os principais modelos de regulação setorial, apontando-se como foco principal o modelo intermunicipal. Com base no paradigma da ARES-PCJ, demonstrou-se que a criação de uma agência reguladora intermunicipal, especificamente para os serviços públicos de saneamento básico, se mostra como o modelo ideal para a Região Metropolitana de Ribeirão Preto. Portanto, qualquer alternativa individual para a necessária adequação a Lei n. 11.445/2007 se mostra em descompasso com os princípios e diretrizes previstos no Estatuto da Metrópole, em especial quanto à prevalência do interesse comum sobre o local e da necessidade de gestão compartilhada das funções públicas – federalismo de cooperação. / Abstract: The metropolitan region of Ribeirão Preto is consisted of 34 municipalities marked by the diversity among them, especially from the perspective of population, geographical, cultural and social. The metropolitan area requires a coordinated planning in order to give the public functions viability that appear with the status of common interest. Among functions, there is no doubt about the importance the role of public sanitation services. However, the absence of regulation of these services gave birth to the concern about the most appropriate model for this recent Metropolitan region. This study sought to understand public policy, driven to public sanitations services. From some answers, sought to highlight the main models of sectoral regulation, pointing as its main focus the intermunicipal model. Based on the paradigm of ARES-JCP, it was demonstrated that the creation of a regulatory agency, specifically for public sanitation services, shown as the ideal model for the metropolitan region of Ribeirao Preto. Therefore, any individual alternative to the requires fitness for law No. 11.445/2007 shown mismatch with the principles and guidelines laid down by the Statute of the metropolis in particular with regard to the prevalence of common interest on the location and the need for shared management of public functions – cooperative federalism. / Mestre
