Locus delicti nos crimes informáticos / Locus Delicti in cybercrimes

Aborda a introdução do computador e da internet na sociedade e sua relação com o direito. Discorre sobre o uso da informática para a prática de crime, observando que o delito penal deixou de ser local e ganhou dimensões internacionais, porquanto seu resultado não se dê necessariamente no mesmo local onde foi praticada a conduta. Chama a atenção ao fato de que os princípios delimitadores da validade da lei penal no espaço podem não ser suficientes para dirimir eventuais conflitos de jurisdição, se interpretados como tradicionalmente se tem feito. Analisa e classifica as espécies de crimes informáticos de forma exemplificativa, bem como os agentes criminais da era digital. Reúne e comenta as leis e projetos de leis nacionais, bem como as leis estrangeiras e convenções sobre crimes informáticos. Ao final, aponta, em sede de conclusão, critério de solução para a resolução do conflito de jurisdição para os crimes praticados no ciberespaço, sugerindo, de lege ferenda, a persecução de uma lei dirimente de eventual conflito. / Discusses the advent of the computer and the internet in society and their relation with the law. Considers the use of information technology in committing crime, observing that a penal offence is no longer local, since it has acquired international dimensions. Therefore, its resolution does not necessarily happen in the same locality where it was practiced. Draws attention to the fact that the principles that delimit the validity of the penal law might not be sufficient to dispel possible conflicts of jurisdiction, if interpreted in the usual traditional way. By giving examples, it analyses and classifies types of electronic crimes as well as the criminal agents of the digital age. Gathers and comments laws and projects of law, both national and international, as well as conventions on electronic crimes. Finally, it presents criteria of solution for resolving the conflict of jurisdiction for crimes practiced in cyberspace, suggesting, of lege ferenda, the pursuit of a law which would eliminate such conflicts.

La législation irakienne définit le contrat comme étant l’union d'une offre faite par la partie contractante avec l'acceptation d'une autre partie et ce de manière à établir les effets dans l'objet du contrat. Ainsi, la place occupée par le contrat de vente en droit irakien est importante. Lorsque les parties relèvent d’ordres juridiques différents, leurs rapports sont régis par le droit international privé, qui détermine le tribunal apte à trancher le litige. Cette thèse de doctorat vise alors à vérifier la capacité à appliquer les règles de conflit de compétence internationale en droit irakien sur des contrats « virtuels » ou dématérialisés. Comme nous le verrons, dans ce domaine, « virtuel » ne veut pas pour autant dire que ce contrat n’est pas réel, comme le spécifie très clairement la loi irakienne. Il reste rattaché au territoire. Le problème est que le droit irakien, en ignorant les notions de frontière et de territorialité, ne reconnaît pas sa propre « immatérialité ». Cette réalité dans les textes et la pratique implique que les opérations qui se produisent sur Internet ne sont pas prises en compte par les règles de conflits de compétence internationale. C’est la raison pour laquelle nous avons souhaité vérifier et comprendre la capacité et l’effectivité des règles de conflit de compétence internationale dans le cadre de litiges sur Internet. Ce faisant, nous espérons mettre en lumière les règles les plus appropriées, qui correspondent le mieux à la nature du contrat virtuel, à savoir son immatérialité. Pour ce faire, nous entreverrons quelques développements sur les litiges de l’Internet. Ainsi nous disposons de deux domaines de recherche : un premier au niveau de la législation nationale, comme le droit français et le droit américain ; un deuxième au niveau des conventions internationales, comme les conventions des Nations-Unies en 2005, la convention de la Haye en 2005, la convention de Bruxelles en 1968 ou encore les règlements de Bruxelles 2000 et 2012. / Iraqi law defines the contract as the union of an offer made by the contracting party with the acceptance of another party and that in order to establish the effects in the contract. The place of the sales contract under Iraqi law is important. When the parties come from different legal orders, their relations are governed by the private international law which determines the court will decide. This thesis research aims to test the ability to apply the international rules of conflict of jurisdiction under Iraqi law on the virtual contract, which is paperless. We shall see, this is not to mean however that the contract is not real, as clearly specifies Iraqi law. It remains attached to the territory. In contrast, the Iraqi law does not recognize its immaterial that meanwhile ignores borders and notions of territoriality. This reality in the texts and practices therefore makes transactions that occur on the Internet are not taken into account by the rules of international jurisdiction conflicts. That is why, we wanted to check and understand the capacity and effectiveness of international jurisdiction conflict rules in the context of Internet disputes. So we will try to find the most appropriate rules, consistent with the nature of the virtual contract, namely its immateriality. This search will reveal developments in litigation of the Internet. Thus, it takes two directions: first at the national legislation, such as French and US law. Second, at the stage of international conventions such as the United Nations Conventions 2005, Hague Convention, the Brussels Convention 1968 and the 2000 and 2012 regulations.

Crises de gouvernementalité et généalogie de l’État aux XXe et XXIe siècles : recherche historico-philosophique sur les usages de la raison politique / Crises of governmentality and genealogy of the State in the twentieth and twenty-first centuries : historical and philosophical research on the uses of political reason

La thèse, composée de deux grands ensembles, explicite d’abord la trajectoire de la notion de « gouvernementalité » dans les cours de Michel Foucault au Collège de France de 1976 et 1984 afin d’établir un nouveau cadre théorique d’analyse du conflit politique à partir de l’étude des rapports de réciprocité entre les pratiques étatiques et les contre-conduites. Dans un deuxième temps, elle met ce cadre théorique à l’épreuve d’ensembles empiriques afin de tracer une généalogie de l’État au XXème et XXIème siècles à partir d’une ethnologie du dire-vrai dans la pratique sociale. Sur des aires, des temps et des populations variables, elle identifie quatre régimes différents de véridiction/juridiction des pratiques gouvernementales logiquement articulés les uns aux autres par des rapports de réciprocité successifs :1 / le régime libéral social de la res socialis en France des années 1890 aux années 1960 ; 2/ le régime de la res nullius dans les comités d’action en France dans les années 68 ; 3/ le régime néolibéral de la res economica à l’échelle mondiale depuis les années 1970 ; 4/ le régime de la res communis dans la Coordinadora del agua et les comités de l’eau boliviens dans les années 2000. Chacun de ces régimes implique une expérience différente de l’État en termes de degré et d’espaces de gouvernementalité, d’effets des politiques étatiques sur le niveau des inégalités et la structuration des rapports entre classes sociales ou sur le degré de démocratisation de la vie publique. C’est donc à une évaluation historiquement différenciée de l’État qu’invite la méthode foucaldienne d’analyse des formes de véridiction sur lesquelles sont indexées les pratiques gouvernementales. / The thesis is made of two parts and analyzes at first the trajectory of the notion of “governmentality” in Michel Foucault’s courses at the Collège de France between 1976 and 1984 to develop a new analytical framework of political conflict through the reciprocal relationships between state practices and counter-conducts. Secondly, it puts this theoretical framework to the test of a series of empirical data to draw a genealogy of the State in the twentieth and twenty-first centuries from the viewpoint of an ethnology of truth telling within social practices. On variable areas, times and populations, it identifies four different regimes of veridiction/jurisdiction for governmental practices logically articulated some in the others by successive and reciprocal relationships: 1/ the social liberal regime of the res socialis in France from the 1890 to 1960s; 2/ the regime of the res nullius for the action committees in France in the 1968s ; 3/ the neoliberal regime of the res economica at the global scale since the 1970s; 4/ the regime of the res communis for the Coordinadora del agua and bolivian water committees in the 2000s. Each of these regimes involves a different experiment of the State in terms of degree and spaces of governmentality, of effects of state policies on the level of social inequalities between classes or on the degree of democratization of public life. It is thus to a historically differentiated evaluation of the State that invites the foucaultian method of analyzing the veridictions to which are indexed the governmental practices.

A presente pesquisa buscou levantar os aspectos que envolvem o ativismo judicial no Brasil, desde os elementos estimuladores de sua prática pelos magistrados, até os efeitos de sua realização. O trabalho foi dividido em duas partes principais. Se inicia com uma breve digressão história, explicativa da importância da formação do Estado de Direito e da democracia, e do diploma legal que assegura esse sistema jurídico, a Constituição. Em seguida, demonstra a atuação da jurisdição constitucional, e seus limites impostos pela própria Magna Carta. E então, nesse cenário, avalia como o ativismo judicial se desenvolveu no Brasil, após a promulgação da Constituição Federal de 1988. Foram abordados os temas mais relevantes para o estímulo do ativismo judicial, quais sejam, as normas constitucionais com conceitos indeterminados, a vasta quantidade de direitos sociais previstos na Constituição Federal, pendentes de implementação legislativa e administrativa, o período histórico que vivemos denominado \"neoconstitucionalismo\" conferindo alto prestígio aos princípios para regularem os casos concretos, a análise da omissão inconstitucional por meio do mandado de injunção e da ação direta de inconstitucionalidade por omissão, e por fim, o controle concentrado de constitucionalidade, em especial, no que se toca aos efeitos da decisão nos processos objetivos. Na segunda parte do trabalho é realizada uma explicação sobre o Direito e desenvolvimento, e como seus estudos foram abordados por diversos autores, considerando a falta de uma sistematização teórica. Por fim, é feita uma análise do ativismo judicial, como praticado no Brasil, e seus impactos no processo de desenvolvimento econômico. / The present research investigated the aspects that involve the judicial activism in Brazil, from the stimulating elements of its practice by the magistrates, until the effects of its accomplishment. The work was divided into two main parts. It begins with a brief history, explaining the importance of the formation of the rule of law and democracy, and the legal diploma that ensures this legal system, the Constitution. Then demonstrates the performance of the constitutional jurisdiction, and its limits imposed by the Constitution itself. And then, in this frame, evaluated how judicial activism developed in Brazil after the promulgation of the Federal Constitution of 1988. The most relevant themes for the stimulus of judicial activism were discussed, which are, constitutional norms with indeterminate concepts, the vast number of social rights in the Federal Constitution, pending of legislative and administrative implementation, the historical period we call \"neoconstitutionalism\" conferring high prestige on the principles to regulate concrete cases, the analysis of the unconstitutional omission by mandatory injunction and direct action of unconstitutionality by omission(judicial review for the omission), and, finally, the control of constitutionality, especially, as regards the effects of the decision in the objective processes. In the second part of the work an explanation is made about law and development, and how its studies were approached by several authors, considering the lack of a theoretical systematization. Finally, an analysis of judicial activism, as practiced in Brazil, and its impacts on the process of economic development are made.

Le réseau Internet favorise les transactions transfrontalières, même entre des personnes vivant à des distances éloignées les unes des autres. La perméabilité des frontières lors de l'utilisation d'Internet rend difficile l'application des règles traditionnelles du droit international privé, fondées sur le paradigme territorial. Le présent mémoire a pour but d'analyser cette problématique. En premier lieu, nous explorons dans ce contexte les caractéristiques d'Internet et les sources pertinentes du droit international privé. À travers le prisme du cyberespace, nous procédons ensuite à un examen des critères juridictionnels retenus par la doctrine et la jurisprudence. Dans cette optique, nous accordons une attention particulière au domaine de la cyberconsommation, lequel est particulièrement vulnérable à l'absence de référence territoriale. En effet, le paternalisme étatique destiné à protéger les consommateurs peut difficilement s'y exercer. Dès lors, il devient évident que la communauté internationale, confrontée à cette nouvelle réalité, sera appelée à se tourner vers des modes alternatifs de résolution de conflits et que les États participeront à cette fin à une corégulation avec le secteur privé. / The Internet facilitates transborder transactions, even among people living far away from one another. The permeability of borders arising from the use of the Internet makes it very difficult to apply traditional rules under private internationallaw, which are based on a territorial paradigm. The purpose of this thesis is to analyse this problem. First, we explore the characteristics of the Internet in this particular context and the relevant sources of private international law. Through the prism of cyberspace, we then review jurisdictional criteria arising from the doctrine and jurisprudence. Special attention is paid to the field of cyberconsumers, which is particularly vulnerable to the absence of territorial references. Indeed, state paternalism designed to protect consumers is difficult to apply in this field. Moving out to sea : international legal implications of building an offshore airport outside territorial waters

This thesis deals with the plan of the Dutch government to build an offshore airport outside its territorial waters. Because the airport will be outside territorial waters several problems may arise. Under the Law of the Sea the question is whether such an airport can lawfully be built and what the different conditions are under which it is possible. The Convention on International Civil Aviation is older then the new Law of the Sea Convention and therefore not up to date with the new zones in the sea that have emerged. Air law therefore needs to be interpreted in the light of those new developments. / The first chapter deals with the reasons behind the plan to build such an airport. Thereafter, subsequent chapters discuss the law of the sea, air law, European law and the law of other organizations, which will have an influence on an offshore airport outside the territorial sea. The final chapter deals with plans and examples of other uses of artificial islands, including offshore airports.
