Projekt výstavba pečovatelského domu / Nursing Home Project

The diploma thesis aims to present the method of the project financing on an example of Nursing Home Project. The thesis is focused on examination whether it is possible to finance the private project regarding services of general economic interest just from operational revenues and allowed state aid. The thesis describes regulations of social care system in the Czech Republic and European regulation and directives regarding the state aid. The last chapter is designed as a feasibility study of the whole project. The feasibility study contains model of future project's cash flows. The horizontal and vertical analyses of financial statements of non-profit organization are also part of the thesis.

Ce travail a pour but de montrer quelles logiques de la finalité sont en jeu dans le travail du manager. Nous avons distingué deux façons d’aborder la finalité. La première, proche des notions d’objectif, d’intérêt, d’utilité, constitue le soubassement des façons d’aborder classiquement le travail du manager. Nous avons fait émerger, en nous appuyant sur la pensée d’Aristote, Thomas d’Aquin, et Spaemann, une conception alternative de la finalité, qui diffère de l’objectif et de l’intérêt en ce qu’elle n’est pas construite. Ce concept de finalité permet de voir autrement trois dimensions essentielles du travail du manager : le management par objectif, le faisceau d’exigences contradictoires dont le manager est le point focal, et le dilemme qui se pose à lui entre éthique et efficacité. Enfin, une enquête de terrain permet de montrer que cette logique alternative de la finalité, rattachée à l’éthique des vertus, trouve une certaine place dans le discours des managers de la FDJ, aux côtés du conséquentialisme, qui consacre l’acception utilitaire de la finalité, et du déontologisme qui évacue le recours à la finalité. / This thesis aim is to show which notion of purpose is at stake in the manager’s work. It differentiates two ways to address the concept of purpose. The first one, close to the notions of objective, interest, utility, forms the foundations of a classical vision of the manager’s work. However, a second one, based on Aristotle, Thomas Aquinas and Spaemann’s philosophies, arose. This alternative conception differs from objective and interest as it is not elaborated by the subject. It allows a different view on three essential dimensions of the manager’s work: the management by objectives, the body of contradictory requirements that built up on the manager and the dilemma between ethics and efficiency. Finally, a field survey showed that this alternative conception of purpose, linked to virtue-based ethics, has a certain place in the FDJ’s managers’ message, together with consequentialism, which expresses the utilitarian conception of purpose, and deontological ethics, which evacuates any purpose.

在高工時的社會下,工作對於生活的比重愈來愈高,工作意義感對個人的重要性也與日俱增,因此,如何提升員工的工作意義感便成為了企業組織需面對的課題。過往探討工作意義感的研究顯示,除了工作特徵外,人際互動亦會對工作意義感有所影響,其中又以領導行為對於部屬工作意義感的型塑具有關鍵的重要地位。然而,對於領導行為的影響歷程,目前卻較少有量化的實徵研究出現,尤其是作為普遍於華人文化中的領導風格,家長式領導如何影響部屬的工作意義感,對華人企業主管在管理上更是格外重要。有鑑於此,本研究立基於社會訊息處理理論,探究家長式領導對於部屬工作意義感的影響,並探討工作目的與正向自我的中介效果。透過兩階段問卷施測,共收集190份有效問卷。研究結果發現仁慈領導能顯著預測工作意義感,而正向自我與工作目的在其中的中介作用則獲得部分支持。最後針對研究結果進行討論,說明理論貢獻、管理意涵、研究限制及未來研究方向。 / In modern society, employees are working longer hours than ever before. Therefore, finding meaning of work is important to employee today, and how to contribute to the perceived meaningfulness of work become a critical issue for every enterprise to face. This research model based on social information processing theory offers a theoretical approach for examining the causal effects of paternalistic leadership, a prevalent leadership style in Chinese business organizations, and the mediating role of work purpose and positive self-perceptions on subordinate meaningfulness of work. Using data form Taiwanese firms including 190 employees, results from structured equation modeling techniques supported partly our hypothesized model. Overall, this study supports and adds to the range of positive self-perceptions effects associated with paternalistic leadership and are suggestive of interventions that organizations can make to improve work meaningfulness of workers. Implications for the theory and practice of leadership are discussed.

The presence of the risen Jesus in and among his followers with special reference to the first farewell discourse in John 13:31-14:31

The author of the Fourth Gospel delivers the true divine identity and significance of Jesus throughout the entire narrative. He aims at guiding his readers through the narrative of the Gospel with the purpose that they will “see” (meet) Jesus, confess him as Christ, and receive eternal life. John actually planned that the text of the Gospel should actively change people. Furthermore, the Gospel of John has wide spectrum of the reader. This means that John opens his message to the all the generations who are no longer in a position to see Jesus physically. Nobody reading this text should or could stay the same, since he or she will be confronted with the protagonist of the text, namely Jesus. By accepting this message, that person will receive life; by rejecting the message, a person will perish. This truth is rehearsed over and again in the narrative for every reader to see. The text of the Gospel thus becomes the “presence of Jesus” among the readers. This functional purpose of the Gospel accounts for the first farewell discourse in John 13:31-14:31. In response to previous scholarship that understands the Johannine farewell discourses solely as a testament, the present study convinces that the discourses interface with classical literature, specifically the following literary styles: Greek tragedy, consolation literature, and the literary symposium tradition. The multiplicity of the generic associations of the discourses sheds new light on the nature of Jesus’ departure as well as his continuing presence in spite of that departure. No longer designed to evoke only the themes of departure and absence, the testament of Jesus in John emphasises instead Jesus’ abiding presence. While the material from Greek tragedy will only further emphasise the theme of departure, the material from classical consolation literature and the literary symposium tradition will accentuate the theme of continuing presence. John has thereby transcended the usual expectations of the testament. Thus the physically absent Jesus becomes present through his first farewell discourse: the reader is confronted with a dynamic portrait of Jesus and this confrontation results in an acceptance of Jesus as Christ, as well as the receiving of eternal life. According to the first farewell discourse, eschatological promise, knowing and seeing the Father, glory, love, pastoral ministry, deeds, prayer, Paraclete, remembering, faith, peace and joy, and the words of Jesus all serve as the replacement of the physical Jesus. Therefore, the first farewell discourse does not indicate the separation of Jesus from his disciples but rather the permanent presence of the risen Jesus in and among them. Text in German with German and English summaries / Starting point of the search for the purpose of 1 Timothy is the assumption of basic similarities between this letter and letter writing in Greco-Roman antiquity. This means that 1 Timothy is designed for an oral performance in front of an audience. The analysis concentrates on the so far neglected classical duties of the speaker: memoria and pronuntiatio. This means the memorized performance in front of an audience. 1 Timothy shows many mnemotechnical devices and puts certain terms in focus. This shows what expressions the audience has to memorize and what aspects show prominence. The result of this can be formulated as the purpose of 1 Timothy: Paul wants to confirm Timothy in his mandate to guard the gospel from being changed through a resolute dismissal of wrong teachings and an ethic that honours God and men. / Ausgangspunkt der Frage nach der Absicht des 1. Timotheus ist die Annahme, dass dieser Brief grundsätzliche Gemeinsamkeiten mit der kaiserzeitlichen Epistolographie aufweist. Demnach ist der 1. Timotheus für den mündlichen Vortrag (Performanz) vor einem Publikum konzipiert. Die Analyse konzentriert sich auf die bisher in der rhetorischen Forschung vernachlässigten klassischen Aufgaben des Redners: memoria (das Auswendiglernen) und pronuntiatio (der freie Vortrag). Dabei zeigt sich, dass im 1. Timotheus eine Vielzahl mnemotechnischer Mittel eingesetzt wird. Will Beauty Save the World? A historical context study of the Miss Venezuela pageant as a conceivable contributor to communication for development

In recent years, old-hand development scholars, in the category of Dan Brockington, have expressed their concern over academia’s neglect of the significance of celebrities in the field. As has been the case of an outturn hereof, namely beauty pageants. In the last six decades, Venezuela has positioned itself not only as one of the world's largest exporters of oil but also as one of the leading engenderers of titleholders in international pageantry. The latter, which has resulted in Venezuelans regarding the pageant as a fundamental cultural undercurrent in their collective identity, seems to be a ceaseless manifestation in spite of the country’s worrisome current socio-economic status. Rather than adopting a condescending paradigm towards the Miss Venezuela pageant, it is precisely this vertex of ambiguity that opens the avenue for an interesting development question. After all, if celebrity beauty queens from Venezuela are deemed as part of the nation’s identity, could the pageant, in the same breath, be deemed as a contributor to communication for development? While espousing historical context as an analysing method and in pursuit of David Hulme’s Celebrity-Development nexus and Elizabeth McCall’s four strands of communication for development, this paper presents a qualitative study in which hands-on experts are given a platform. The findings show the evolution of a beauty pageant from a, nearly, nationalist device into a system that is grounded in the Millennium Development Goals and that aims to forge socially responsible beauty representatives that are competent enough to herald purposeful messages.

Corporate capacity, special purpose vehicles, and traditional securitisation in South African company Law

Doctor Legum - LLD / The ideals of shareholder and creditor protection are affected by legislation pertaining to the validity of a company’s transactions. Until legislative reforms introduced in the twentieth century, a company’s capacity and the ultra vires doctrine traditionally limited the company’s ability to contract. Therefore, the legal framework regulating corporate capacity influences a company’s interactions with outsiders. The goal of the law in this regard should be to facilitate commerce while providing adequate protection to all affected stakeholders. South Africa’s Companies Act 71 of 2008 (the Act) contains several novel provisions regarding a company’s capacity, the desirability of which is questionable. Special purpose vehicles (SPVs) are used for various purposes in commerce, from asset holding in the financial services sector to concluding complex financial functions in corporate finance. For instance, traditional securitisation is a financial engineering technique that makes use of corporate SPVs. Traditional securitisation is a valuable risk management, earnings management, and corporate financing tool. Incorporators of securitisation SPVs often include capacity restrictions in the constitutions of such entities as a means of reducing the likelihood that the SPV will be subject to liquidation proceedings.This thesis analyses the capacity provisions in the Act to determine whether they provide a commercially desirable framework to facilitate the activities of SPVs used in traditional securitisation schemes. The thesis argues that the capacity provisions in the Act in their current form are undesirable because they place third parties at too great a risk in exchange for inconsistent and unreliable shareholder protection. Executory ultra vires contracts concluded by limited capacity companies are at the same time valid and capable of being restrained by a single shareholder, director or prescribed officer of the company. It is argued that the Act’s approach to corporate capacity is detrimental to commercial certainty and creditor protection, and that capacity restrictions under the current framework do not provide any more shareholder protection than ordinary authority limitations would. Consequently, it is argued that the capacity provisions in the Act do not make a positive contribution to the “insolvency-remoteness” of SPVs used in traditional securitisation schemes. It is recommended that the capacity provisions in the Act should be substantially amended, or deleted.

This diploma thesis deals with increasing the efficiency of the assembly workplace (production line). Thesis gradually discusses with lean production, their basic methods and the EURO VI emission standard, which is closely related to the produced product. In the main part, an analysis of the current state is performed with the help of the above-mentioned methods and a proposal of solutions to ensure efficiency. On the base of these findings, the automation of the test station is proposed, including a 3D model, drawing documentation, phases of implementation and real cost calculations with a final assessment of efficiency, return of investments and risk analysis. The second elaborated complementary variant deals with the ergonomics of the production line and includes a 3D model of newly designed tables, real calculations and final economic evaluation.

Nová synagoga Teplice / New synagogue Teplice

The subject of this diploma project was to design an architectural proposal of The New Synagogue and Jewish Community Centre in Teplice, Czech Republic. The main goal was to design a complex of buildings which would be used not only for the worships but also for cultural and educational purposes. The proposal consists of the design of 3 buildings connected to each other by a cen-tral courtyard. The form is based on the traditional values set into contemporary de-sign shaped by demands of current generations. One of the main design elements - the beam structure above the courtyard implies a symbol of The Star of David as the symbol of Judaism as we know today. The building of New Synagogue represents the first, three storey building on the north part of plot. The second, east part, is building consisting of cultural centre, info centre, museum, gallery and spaces for workshops with it's technical and sanitary facilities. A Kosher Restaurant will be located into the third and last two-storey building. An undeground parking will be used by the staff and visitors of the whole complex.
