[pt] O presente trabalho busca fazer uma retomada do abolicionismo penal a partir das bases teóricas da criminologia crítica. Em meio aos diversos discursos e propostas de abolição penal contemporâneos, o que se pretende é argumentar que uma prática que vise a realização da abolição do sistema punitivo precisa se calcar em bases teórico-metodológicas rigorosas, a fim de compreender os processos que determinam o sistema punitivo e sua relação com estrutura econômica. Defende-se que a prática abolicionista precisa se socorrer dos conhecimentos acumulados pela criminologia crítica, de base marxista, a fim de que se possa organizar a ação política necessária para uma mudança nas condições sociais que determinam a violência e a pena. Ao se examinar a síntese das diversas determinações que criam o Estado, o direito e a pena na sociedade burguesa por meio da categoria do sujeito de direito e do princípio da troca equivalente de mercadorias é possível verificar o desenvolvimento histórico e as alterações das formas de punição na sociedade capitalista de acordo com a organização e necessidades de produção e reprodução dos modos de produção. Somente a partir dessa análise e compreensão das relações que a punição estabelece com o Estado e com a sociedade dentro da estrutura econômica é se torna possível propor um modelo de prática abolicionista que não seja idealista. / [en] This work intends to review the penal abolicionism from the theoretical basis of the critical criminology. Amongst the different contemporary penal abolition discourses and propositions, the intent is to argue that a praxis that aims at the accomplishment of abolishing the punitive system needs to hold onto a strong theoretical and methodological foundation, in order to comprehend the processes that determines the punitive system and its relation to the economic structure. The abolitionist action has to resort to the cumulated knowledge of the critical criminology, of marxist source, in order to be able to organize the political action needed to provoke a change in the social conditions that determine violence and punishment. When looking closely at the synthesis of the different determinations that build up the state, law and punishment in burgoise society, throughout the categories of subject of Law and the equivalent exchange of merchandise principle it is possible to verify the historical development and changes in the means of punishment in the capitalist society according to the organization and needs of production and reproduction of the means of production. Only through this analysis and comprehension of the relation that punishment establishes to the State and to the society within the economic structure it is possible to propose a model of abolitionist action that is not idealist.

[pt] A presente tese propõe como chave de leitura de Origens do totalitarismo, de Hannah Arendt, a análise de seus personagens, que não poderiam ser mais variados: judeus, antissemitas, artistas, intelectuais, comerciantes, políticos, aventureiros, charlatões, pais de família, assassinos e líderes populares como Hitler e Stálin. Numa obra de tamanho fôlego e que trata de assuntos tão complexos como antissemitismo, imperialismo e o próprio totalitarismo, parece improvável que tantos tipos humanos envolvidos possam ser tratados sob termos comuns. O argumento da tese mostra que para Arendt as diferenças são menos determinantes do que um traço comum a todos aqueles homens: a incapacidade cada vez maior de discernir realidade de ficção. Assim, a tese procura tratar do que parece ser um poderoso argumento antropológico com óbvias implicações para a teoria da história. / [en] The current thesis works on Hannah Arendt s The Origins of totalitarianism by analyzing its characters, who could not be more varied: Jews, anti-Semites, artists, intellectuals, businessmen, politicians, adventurers, charlatans, heads of families, assassins and leaders like Hitler and Stalin. In work of such weight where complex issues like anti-Semitism, imperialism, and totalitarianism take place, it seems unlikely that the many human types involved could be considered under common terms. The thesis arguments that Arendt manages to do so by considering such differences less determinant than a common trace shared by all those men: the ever-growing incapacity to discern fiction from reality. Thus, the thesis works on what seems to be a powerful anthropological argument with inevitable implications to theory of history.

A correspondência entre os autores revela a discrepância de análises, que julgamos ser benéfica para a compreensão dos eventos. Arendt observava no totalitarismo uma originalidade terrível ao passo que Voegelin ressalta que o fenômeno era apenas o clímax de uma crise espiritual que assola a modernidade. Para levar à cabo a análise, foi estudada a teoria de cada um dos autores sobre o totalitarismo, de modo a aprofundar o entendimento sobre as questões levantadas / [en] The present dissertation intends to explore the debate between the GermanHannah Arendt and Eric Voegelin thinkers about the phenomena of totalitarian regimes, especially National Socialism, whose rise to power was witnessed by both. Correspondence between the authors reveals the discrepancy of teams, which we judged. Arendt observed a terrible originality in totalitarianism, while Voegelin emphasizes that the phenomenon was just the climax of a spiritual crisis that plagues modernity. To carry out the analysis, it was studied on the theory of each of the authors the way to deepen totalitarianism, the understanding as raised.

[pt] Partindo das rupturas políticas - simbolizadas pelo ano de 1989 - nos planos teórico e prático, esta pesquisa busca estudar a imaginação política crítica contemporânea. Tomando tal fio condutor, o presente estudo intenta criticar o estado-centrismo de alguns teóricos (Rosenberg, Colás e Panitch) de hoje. Ainda, propõe um diálogo entre outros dois críticos (Walker e Holloway), visando apreender tais limites imaginativos e sugerir - com auxílio da prática de certos movimentos sociais - outros modos de pensar os dilemas da soberania estatal e sua inclusão e exclusão do espaço político. / [en] Beginning from the point of political ruptures - symbolized by 1989 - on the theoretical and practical levels, this research critically explores the contemporary critical political imagination. Following this line of thought, this investigation aims at criticizing the state-centrism of some current theorists (Rosenberg, Colás and Panitch). Moreover, it proposes a dialogue between two other critics (Walker and Holloway), in order to explore and appreciate such imaginative boundaries and to suggest - with the help of certain social movements` practices - other ways of thinking through the dilemmas of state sovereignty and its inclusion and exclusion of the political space.

On rights a defense and analysis of rights through natural law

One of the central questions in political theory deals with the nature of rights. What sorts of rights do people possess? How are these rights justified? How ought these rights be reflected and related when seen in political, economic, and social institutions? Following the publication of John Rawls' A Theory of Justice (1971) and Robert Nozick's Anarchy, State, and Utopia (1974), rights have once again returned to dominate much of contemporary political theory. However, natural law, which was the historical basis of the early Enlightenment theories of rights, is no longer the primary system appealed to when discussing rights. In fact, classical natural law has been all but discarded in most of political theory today. There has also been renewed debate over the nature of public neutrality, and what the relationship ought to be between the public and private sphere. The mainstream view of how our liberties relate to our rights, as well as what kinds of rights we have over our private affairs, has come under fire from a newly emerging political philosophy known as communitarianism. This thesis will present a robust theory of rights that provides a new understanding of the relationship between positive and negative rights through a defense of classical natural law as an ethical foundation for political theory. It will side with the communitarian critics of public neutrality, and offer a practical method of determining when the state is justified in limiting private liberties due to public interest.
