[pt] O objetivo da dissertação é analisar o conceito de
soberania e as questões
que esse tema suscita para a filosofia política. Para
isso, escolhemos investigar a
evolução do conceito em momentos específicos do pensamento
clássico para
melhor clarificar as formulações e as questões
contemporâneas levantadas acerca
desse tema no presente trabalho. A soberania exerce
extensa influência na vida na
comunidade política; para estudar as questões levantadas
pelo tema, a dissertação
divide-se, então, em duas partes. A primeira fornecerá o
embasamento teórico
para uma análise consistente na segunda parte. Tendo em
vista a complexidade do
tema, na primeira parte, limitamos o estudo a quatro
autores clássicos,
representantes de períodos históricos distintos. Dessa
forma, priorizamos a
exposição das teorias acerca da soberania, enfatizando a
compreensão conceitual
própria de cada um e o papel da soberania na organização
política do Estado. Os
autores abordados são: Jean Bodin, Thomas Hobbes, Rousseau
e Hegel. Na
segunda parte do trabalho, percorremos alguns autores do
século XX e XXI que
apresentam críticas e análises da presença da soberania na
atualidade. Nesse ponto
da dissertação, limitamos o estudo a cinco autores com
importantes contribuições
à discussão, que são: Carl Schmitt, Hannah Arendt, Michael
Hardt e Antonio
Negri, John Rawls e Giorgio Agamben. / [en] The objective of the dissertation is to analyze the
concept of sovereignty
and the questions that this theme evokes to the political
philosophy. Then we have
chosen to investigate the evolution of the concept on
specifics moments of the
classic thought to enlighten raised contemporary
formulations and questions on
that theme in the present work. Sovereignty exerts wide
influence in life in the
political community, then to study the questions raised by
the subject the
dissertation is divided in two parts. The first will
provide us with the theoretical
base for a consistent analysis on the second part. Given
the proportion of the
discussion, on the first part, we have limited the study
to four classic authors,
which are representatives of distinct historic period.
Thus we rendered priority to
the exposition of the theories on sovereignty, emphasizing
due conceptual
comprehension of each author and the role of sovereignty
in the political
organization of the state. The selected authors are: Jean
Bodin, Thomas Hobbes,
Rousseau and Hegel. In the second part of the
dissertation, we move to some
authors of the XX and XXI century that produce critics and
analysis of the
presence of sovereignty in the present. In this point of
the dissertation, we limit
the study to five authors with important contributions to
the discussion, they are:
Carl Schmitt, Hannah Arendt, Michael Hardt and Antonio
Negri, John Rawls and
Giorgio Agamben.

[pt] Num contexto histórico em que o direito, segundo concepções mais ou menos correntes, passa por uma constante crise de legitimidade, o presente trabalho se insere na tentativa de compreender quais os limites e os horizontes dessa crise, buscando chaves conceituais que permitam refletir se esta crise pode ser considerada como conjuntural ou estrutural. A presente pesquisa busca analisar a obra de Giorgio Agamben no que tange a análise do direito ou das possibilidades abertas para se pensar o direito a partir deste autor, mas também estabelecendo o diálogo com outros pensadores que permitam uma maior elucidação do objeto proposto. Busca-se apontar elementos centrais para que se possa contribuir na tentativa de expor alguns aspectos que dizem respeito ao universo conceitual do direito e de suas relações, dentre eles a exceção e a violência. [pt] Considerando que o direito tem sido mobilizado no processo de
modernização brasileiro como instrumento de soberania do Estado, a tese discute
as oportunidades emancipatórias abertas pelo constitucionalismo democrático da
Carta de 1988. A ideia é demonstrar que a disputa pelo sentido da Constituição se
transfigurou na própria pauta civilizatória, conduzida de maneira horizontal e
plural pela cidadania através do acesso à Justiça. Este seria o sentido da
judicialização da política. Todavia, nem sempre os Tribunais assumem o papel
de mediador ou representante da soberania popular na sua luta por direitos
constitucionalizados. Esse trabalho chama de ativismo judicial a postura
imperial da Justiça no que diz respeito à sua capacidade de estabelecer uma
agenda política de âmbito nacional, por se considerar o principal, senão o único,
intérprete do compromisso constitucional. Sob essas condições, é possível
perceber o retorno da ação demiúrgica da soberania monolítica do Estado, todavia,
operacionalizada no âmbito da jurisdição constitucional. Essa pesquisa discute e
critica as inflexões judicializantes e ativistas do Supremo Tribunal Federal. / [en] Considering that the Brazilian modernization process has been used the law
as State s sovereignty instrument, this work discusses the emancipatory
opportunities disclosed by the democratic constitutionalism of the 1988 Charter.
The goal is to show that the dispute for the meaning of the Constitution ends up
being its own civilizational agenda, steered horizontally and plurally by the
citizenship through right s litigation. That would be the definition of the
judicialization of politics. However, not always the Courts take over this role as
the citizenship s mediator or representative. The research will call judicial
activism the imperial attitude of the Justice regarding its own ability to establish
a national political agenda, because it considers itself as the major if not the only
interpreter of the constitutional commitment. Under these circumstances it is
plausible to realize the return of the demiurgic action of the monolithic State s
sovereignty, however, implemented by the judicial review. This work discusses
both judicial and activist inflexions of Brazil s Supreme Court.

Nação, estou pronto: - diga ao Povo que fico, que consagrou o Dia do Fico, este
trabalho tem como objetivos: pôr em destaque o protagonismo do príncipe regente
D. Pedro de Alcântara nesse acontecimento em meio às forças políticas presentes
em ambos os reinos; identificar as mudanças nos conceitos Povo, Nação, Cidadão,
Soberania e Felicidade em decorrência dos embates entre as concepções
absolutistas do Estado e aquelas do Constitucionalismo; e dialogar criticamente
com a historiografia que interpreta o Dia do Fico como o ponto de partida para
revolução de Independência do Brasil concretizada no 7 de setembro de 1822,

the Fico Day, this work aims to: highlight the role of the prince regent D. Pedro de
Alcântara as protagonist in this event among the political forces in both kingdoms;
identify changes in the concepts of People, Nation, Citizen, Sovereignty and
Happiness as a result of the clashes between the absolutist conceptions of the State
and those of the Constitutionalism, and critically dialogue with the historiography
that portrays the Fico Day as a starting point for independence revolution of
Brazil achieved in the September 7, 1822., once D. Pedro intended to avoid the
risk of independence and to preserve the union of the Portuguese Empire, ensuring
the authority of the Braganças. To that end, this dissertation traces a short
biography of D. Pedro, analyzes two of the main newspapers of the period
Revérbero Constitucional Fluminense and A Malagueta; and highlights the
correspondence between the prince and his father, D. João, since the end of

na política global e, dentre estes, a Rede Transnacional
de Movimentos Sociais
Via Campesina seria um exemplo dos mais emblemáticos. Esta

representativos de
atores marginalizados em suas respectivas sociedades,
unidos no propósito
comum de lutar pela implantação de um novo modelo de
desenvolvimento que,
baseado na Soberania Alimentar, substitua o padrão
neoliberal vigente. Esta
dissertação visa investigar a capacidade de a Via
Campesina influenciar as
negociações de agricultura e desenvolvimento em nível
internacional. Para tal,
elegemos as suas relações com duas das principais
instituições internacionais a
negociarem o tema da agricultura em nível internacional: a
FAO e a OMC. Além

player in global
politics. We find between these players, the Transnational
Network of Social
Movements, Via Campesina, which is one of the most
emblematic examples. This
is an heterogeneous network formed by social movements
composed by actors,
which are kept apart by their own societies, united by a
common purpose of
fighting for the implementation of a new model of
development based on the idea
of food sovereignty which could replace the actual
neoliberal model. This essay
seeks to investigate the capacity of Via Campesina to
influence the agricultural
and development negotiations at the international level.
For that purpose, we
investigate its relationships with two of the main
international institutions, which
negotiate the agricultural matter at the international
level: the FAO and the WTO.
Further on, we want to demonstrate that the Via
Campesina´s relevance goes
beyond its relationship with state players. With this
intention, we tackle the
relation of mutual influence with the local organizations
from witch they are built;
its interaction with NGOs and research institutes and its
participation in social
forums. One way to get to this question is to evaluate the
backgrounds,
motivations and the network evolutions; we mention,
moreover, its main
campaigns, among which, we favor the Seeds Campaign
against the transgenic
agriculture.

Há muito se discute a relação entre exceção e regra; estado de natureza e estado
civil; civilização e barbárie. O que impulsionou a presente tese foi a análise da
real existência destes binômios e como ocorrem (se é que podemos assim dizer),
os momentos de ruptura. O surgimento do Estado é tido para muitos como uma
etapa de evolução, sobretudo o surgimento do Estado Democrático de Direito.
Assim, práticas consideradas excepcionais representam um retrocesso ao Estado
de Direito e geram espanto pelo fato de que ainda possam ser aplicadas. A
investigação buscou demonstrar que, ao contrário da concepção de evolução e
linearidade da história da humanidade, a vida acontece no plano real e o passar
dos tempos nem sempre trará o almejado progresso, tendo em vista que a
mencionada realidade fática ocorre através de cisões, saltos, sobressaltos e
retrocessos. Para tanto, utilizou-se o conceito de história benjaminiano que será
abordado, assim como os conceitos de Estado Democrático, Estado de Direito,

et l état civile, la civilisation et la barbarie. Ce qui a poussé cette thèse est
d analyser l existence réelle de ces binômes et comment ils se produisent (si on
peut dire), les moments de rupture. L aboutissement de l Etat est considéré par
une partie considerable des etudiants sur le thème, comme une étape dans
l évolution, en particulier l aboutissement d un Etat démocratique. Ainsi, les
pratiques considérés comme exceptionnels représentent un revers pour l Etat de
droit et de générer la crainte, car ils peuvent toujours être appliquées. Cette thèse a
cherché à démontrer que, contrairement à la notion de linéarité et de l évolution de
l histoire humaine, la vie se passe dans le réel et le passage du temps ne donne pas
toujours les progrès souhaités, compte tenu de ce que la réalité des faits ci-dessus
se produit à travers scissions, des sauts , des surprises et des revers. Pour ce faire,

[pt] Desde sua criação em 1944, o Fundo Monetário Internacional já sofreu
grandes crises de legitimidade; no entanto, após períodos de rejeição e limbo, a
instituição sempre logrou renascer das cinzas; argumentar-se-á que esta aparente
imortalidade do FMI é devida à capacidade da instituição de adequar-se aos novos
ciclos normativos que emergem de crises financeiras. Esta capacidade se
vincularia, por sua vez, à legitimidade da instituição relacionar-se à justificação
de sua atuação em coerência com o propósito para o qual teria sido criada.
Assim, se o discurso que emerge como consenso da análise das crises acusa a
instituição de ter tido parte nas causas da instabilidade, o realinhamento do FMI
à nova norma em ascensão pode resultar em mudanças em sua orientação
prática, como quando após a crise asiática teve sua relevância significativamente
reduzida com a adoção da política de supervisão e liberalização financeira ditada
pelo mercado, e não mais ordenada por si, ao longo dos anos 2000. Já a crise que
se desenvolve, ao final da primeira década do século XXI, com origem nos
maiores produtores de consenso sobre política macroeconômica — Estados
Unidos e União Européia — mostra-se como oportunidade para reajuste do papel
do Fundo em uma posição novamente central, propiciando uma análise dos
interesses diversos que esta instituição, com 187 Estados-membros e potencial de
levantamento de centenas de bilhões de dólares em poucos dias, é capaz de
atender ou suscitar em um cenário de maior equilíbrio financeiro nos países
emergentes e desequilíbrio nos grandes centros. / [en] Since its inception in 1944, the International Monetary Fund has suffered
major crises of legitimacy; however, after periods of rejection and limb, the
institution was always able to rise from the ashes. It will be argued that this
apparent immortality of the Fund is due to its ability to adapt to the new
normative cycles that emerge from financial crises. This ability could be traced to
the relation between the legitimacy of the institution and the justification of its
acts in coherence with the purpose for which it was created. In this sense, if the
discourse that emerges — as a consensus from the analyses of the crises —
accuses the institution of having had a part in the causes of the instability, the
realignment of the IMF to the new ascending norm may result in changes in its
practical orientations, as it happened, for instance, after the Asian crisis, when the
Fund had its relevance significantly reduced with the adoption of a policy of
market-led financial liberalization throughout the decade of 2000, replacing the
former model of IMF-led orderly liberalization. Finally, the crisis developed by
the end of the first decade of the XXI century and that originated in the largest
producers of macroeconomic policy consensus — the United States of America
and the European Union — presents itself as an opportunity for readjustment of
the Fund s role once again in a central position, allowing for the analysis of the
diverse interests that this institution — with its 187 member-States and potential
for raising hundreds of billions of dollars in a few days — is able to meet in a
scenario of greater financial balance among emerging markets, along with the
instability of the great centers.

[pt] Esse trabalho trata da luta das mães e familiares de vítimas da violência do
Estado brasileiro, mais especificamente sobre o engajamento político das mães,
moradoras de favelas no Rio de Janeiro, que perderam seus filhos assassinados
por policiais militares e agentes do Estado. As reflexões trazidas aqui são fruto de
trabalho etnográfico no qual acompanhei e testemunhei o luto público das mães
nos espaços públicos da cidade. É a partir do testemunho da luta e do luto das
mães que pude tecer a problemática dessa tese que se centra na relação entre
gênero, violência, soberania e sacrifício. Argumento, partindo das minhas
experiências e vivências etnográficas, que o movimento de mães questiona a
legitimidade do poder de matar do Estado ou, em outras palavras, questiona a
própria soberania de Estado como o poder sobre a vida e a morte. Ao defenderem
que o Estado brasileiro não tinha o direito de tirar a vida dos filhos que elas
geraram, as mães trazem à tona a relação entre gênero e soberania e o modo como
ambos estão intimamente conectados. Além disso, argumento que o movimento
de mães toca nas estruturas fundacionais do Estado-nação ao revelar que a
soberania de Estado repousa sobre uma economia sacrificial na qual a vida de
alguns depende da morte de outros. O movimento das mães reúne tanto as
condições para expor a lógica sacrificial sobre a qual se sustenta a soberania
estatal quanto revelam que elas, as próprias mães, se inserem também em uma
lógica sacrificial ao lutar em nome de seus filhos assassinados pelo Estado. Nesse
sentido, percorro um caminho de investigação filosófica a fim de compreender as
fundações mitológicas da soberania de Estado e a lógica sacrificial intrínseca a
ela. / [en] This dissertation deals with the struggles faced by mothers of victims of
Brazilian state violence. More specifically, about the political engagement of
mothers, slum dwellers in Rio de Janeiro, who have lost their sons murdered by
military police and state agents. The reflections I brought to the fore are the
results of an ethnographic project in which I followed and witnessed the public
mourning of some mothers in the public space of the city. Through witnessing
their mourning I was able to develop the problematic tackled in this thesis: the
relationship between gender, violence, sovereignty and sacrifice. Based on my
ethnographic experiences, I argue that the movement organized by these mothers
put into question the legitimacy of state sovereignty, in other words its power over
life and death. When they claim that the Brazilian state did not have the right to
take their sons lives, lives which they give birth to, they bring to the fore the
intimate relation between gender and sovereignty. In addition, I argue that the
mothers movement touch upon the foundational structures of the nation-state
when they reveal the state sovereignty reliance on an economy of sacrifice,
specifically one in which the lives of some depend on the death of others. The
mothers movement provides the conditions both to expose the sacrificial logic
upon which state sovereignty relies and to reveal that the mothers themselves are
also embedded in a sacrificial economy when they struggle in the name of their
sons killed by the state. In this sense, my thesis is a philosophical investigation in
order to grasp the mythological foundations of state sovereignty and its intrinsic
reliance of an economy of sacrifice.
