[pt] O presente estudo abordará as teorias da representação política como expostas por Bernard Manin, Nadia Urbinati e Pierre Rosanvallon, sob a perspectiva de que a relação entre democracia e representação política é marcada por uma tensão inerente, como retomada por Bernard Manin. A retórica que acompanha a escalada do sufrágio universal como solução da tensão entre representação política e democracia faz com que a forma de entendimento da institucionalidade representativa esteja cercada de superstições quanto à eficácia e pujança de seus métodos. Interpelar a representação política enquanto um processo mediador destas tensões entre a esfera social e política é um movimento que aproximaria os três autores estudados. A questão é que para os dois primeiros, o processo de representação seria pré-estabelecido e, portanto, fechado e não permeável às mudanças, onde o mundo da política é claramente delimitado. Enquanto que para o terceiro, por uma postura diferenciada no que concerne à relação entre o social e o político, parece haver uma perspectiva singular de processo em aberto a ser considerada, traduzida em uma concepção de política expandida e contraditória, ou seja, do social e do político em intersecção. / [en] The research herein deals with the theories of political representation as they are exposed by Bernard Manin, Pierre Rosanvallon and Nadia Urbina ti, considering the perspective of a tense existing relationship between democracy and political representation, as it was recovered by Bernard Manin. There is a rhetoric that follows the universal suffrage adoption in which it is seen as a solution to the tense relationship among political representation and democracy, what has led general understanding of representative institutionality to be surrounded by superstitions regarding its mechanisms effectiveness and responsiveness. It is possible to approximate the three studied theorists if political representation is inquired as a process that mediates these tensions between political and social spheres. The question is that for both former authors, the political representation process is pre-established and, thus, closed and not permeable to changes, where the world of politics is clearly delimitated. While to the later, a different attitude towards the relationship between the social and the political seems to assure a singular perspective of open process to be considered, traduced in an expansive and contradictory conception of politics, in others words, of social and political intersection.

[pt] O presente trabalho consistirá em um estudo de direito comparado, em que serão analisados instrumentos de participação política, consagrados como tais, nos ordenamentos jurídicos brasileiro e libanês. Isto é, os meios de exercício da soberania popular, já que as constituições de ambos os Estados adotam o princípio democrático. Para isso, serão fornecidas indicações básicas atinentes aos contextos jurídicos e sociopolíticos dos dois Estados; após, identificar-se-ão as principais normas dos sistemas eleitorais e partidários dos ordenamentos jurídicos brasileiro e libanês, bem como as regras referentes ao exercício da soberania popular, mais especificamente o direito de sufrágio e a previsão de instrumentos de participação política direta. Por fim, será realizado o cotejo, tendo em mente aferir a efetividade da participação política nos dois países, a partir de suas previsões legais, principalmente quanto à amplitude dessa participação, aos instrumentos indiretos e diretos consagrados e aos mecanismos de controle adotados. / [en] This work consists in a study of comparative law, in which instruments of political participation, established as such in the Brazilian and Lebanese legal systems are going to be analyzed. That is, the means of exercise of popular sovereignty, since the constitutions of both states adopt the democratic principle. For this purpose, basic indications relating to the legal, social and political contexts of the two states will be provided, and then the main rules of the electoral and party systems of the Brazilian and Lebanese legal systems are going to be identified, as well as the rules concerning the exercise of popular sovereignty, more specifically the right of suffrage and instruments of direct political participation established. Finally, the comparison will be done in order to assess the effectiveness of political participation in both countries, considering their legal provisions, particularly as to the extent of such participation, as the direct and indirect instruments comprised; and the control mechanisms adopted.

[pt] A presente dissertação Visibilidade e Participação Política: Um estudo no Conselho Municipal da Pessoa com Deficiência em Niterói constitui-se num esforço de refletir sobre o tema participação política das pessoas com deficiência nos espaços públicos. Desse modo, a escolha deste Conselho teve a finalidade de compreender a trajetória de participação política desses sujeitos na construção desse espaço público, na busca pela sua visibilidade. Procurou-se analisar se esse Conselho tem se constituído enquanto um espaço estimulador da capacidade das pessoas com deficiência agirem em conjunto, como sujeitos políticos, encorajando-os a serem gerentes da sua própria vida e protagonistas da sua própria história. Para tanto, o entendimento de participação política que se pretende revelar nesse estudo trata-se da capacidade do agir pluralmente e em conjunto, nos espaços públicos, discutindo e deliberando sobre as coisas da vida política da sua cidade. Visando atender o trabalho proposto, a metodologia adotada para a pesquisa fundamentou-se numa abordagem de caráter qualitativo e para a coleta de dados foram utilizadas: entrevistas semi-estruturadas com conselheiros e ex-conselheiros que estiveram presentes no percurso de formação do Conselho Municipal da Pessoa com Deficiência - COMPEDE; observação participante e análise de documentos. Como resultado desse trabalho, a pesquisa revelou que a participação política das pessoas com deficiência, bem como a construção dos espaços públicos no Brasil, ainda que venham sendo constituídas dentro de um terreno adverso, mostram possibilidades de apropriação do sentido público e coletivo, dando um novo sentido à política. / [en] The present dissertation Visibility and Political Participation: A study in City Council for People with Disability is an effort to reflect on the theme political participation of people with disability in the public space. This way, the City Council for People with Disability was chosen in order to understand the trajectory of the political participation in the construction of the public space by those in search for visibility. We tried to analyze if this council has been a space of encouragement for people with disability to act as a group, as political subjects, encouraging them to be protagonists of their own history. For such, the idea of political participation that we tried to reveal in this study should be understood as the capacity to act as a group in the public spaces, discussing and deliberating on issues of the public life of the city. The methodology used is a qualitative type of research and for the data we used semi-structured interviews with counselors and former counselors that were present in the organization of the City Council for People with Disability - COMPEDE, participative observation, and analyzes of documents. As a result of this study, the research showed that, with regards to the participation of people with disability, as well as the construction of public spaces in Brazil, even though they were conceived in adverse fields, there are possibilities of appropriation of the public and collective sense, giving new meanings to politics.

[pt] Este trabalho contempla uma investigação sobre juventude e política no contexto contemporâneo brasileiro, tomando a educação popular como centro de sua ação. A expansão dos chamados cursos pré-vestibulares comunitários no Rio de Janeiro, desde a década de 90, vem representando um importante vetor de tensionamento de nosso sistema educacional (SANTOS, 2005), assim como um novo campo de investigação para as ciências humanas. Originados no interior de lutas e movimentos sociais, estes cursos vêm ampliando a possibilidade de ingresso e ação política de jovens das classes populares nas universidades. Partindo de uma compreensão da subjetividade humana como um efeito de agenciamentos coletivos de enunciação (GUATARRI E ROLNIK, 1980), mostra-se interessante pensar os modos de subjetivação construídos nestes cursos e suas consequências nas práticas cotidianas. O processo de construção da subjetividade política (CASTRO, 2008a, P. 254) nestes espaços, envolvendo experiências de engajamento dos jovens que os levam a assumir ações coletivas no campo social, afeta diretamente as maneiras como eles vivenciam o espaço acadêmico. O método da cartografia e as discussões sobre o lugar da imagem técnica no contemporâneo (JOBIM E SOUZA, 2011; GODINHO, 2011) são as principais referências para nossa construção metodológica. A cartografia nos guiou pelas diferentes experiências no campo dos pré-vestibulares comunitários, até a definição da Associação Mangueira Vestibulares como campo de pesquisa. Já as considerações sobre a importância das imagens na contemporaneidade motivaram a criação de uma narrativa audiovisual sobre a dimensão política desse movimento social, construindo um documentário coletivamente com os sujeitos da pesquisa na intenção de ampliar o debate para além dos limites da academia. / [en] This work describes an investigation into youth and politics in the contemporary context of Brazil, taking the popular education as the center of its action. The expansion of so-called pre-university community courses in Rio de Janeiro, from the 90s, has represented an important vector of tensioning of our educational system (SANTOS, 2005), as well as a new field of research for the human sciences. Originated within social struggles and movements, these courses have expanded the entry possibilities and the political action of the young working class in universities. Starting from an understanding of human subjectivity as an effect of collective assemblages of enunciation (GUATARRI & ROLNIK, 1980), proves to be interesting to consider the forms of subjectivity produced in these courses and their consequences in everyday practices. The construction process of political subjectivity (CASTRO, 2008a, P. 254) in these spaces, involve the engagement of young people that lead them to take collective actions, affecting directly the ways they experience the academic space. The method of carthografy and the discussions on the role of image in the contemporary (JOBIM E SOUZA, 2011; GODINHO, 2011) are the main references for our methodology. The carthografy guided us through the different experiences in the field of pre-university community courses, until the definition of Associação Mangueira Vestibulares as our research field. The considerations about the importance of images in contemporary life motivated the creation of an audiovisual narrative about the political dimension of this social movement, building a documentary with the people surveyed in the intention to broaden the debate beyond the boundaries of academy.

[pt] A análise do lastro e dimensão do Judiciário enquanto instância democrática, e de como a abertura de seu acesso e a revisão de seu papel podem contribuir para o exercício da democracia, foram os pontos nodais do trabalho desenvolvido, que alicerça sua base teórica na teoria da ação comunicativa de Habermas, buscando-se demonstrar, num primeiro ensaio de experimentação de suas categorias à práxis que resulta da inter ação dos Juizados Especiais com o Código de Defesa do Consumidor (Lei 9099/95 e Lei 8078/90), como estes podem atuar enquanto instrumentos de democratização do espaço público judicial. No desenvolvimento do tema, situamos o processo como modo de reprodução das enormes diferenças e conflitos encontrados no meio social, e como condutor de necessidades e expectativas sociais, vendo nele, ainda, uma peculiar forma de participação política da sociedade através do Judiciário, palco argumentativo para obtenção de entendimentos, capaz de traduzir um resultado com natureza deliberativa e não decisória. Buscou-se também demonstrar como pode ser atuado, de modo a permitir, no âmbito daquele espaço institucionalizado, uma maior efetivação dos direitos fundamentais, de como se processa a equalização de sintonias que permitam a redução das desigualdades ínsitas à realidade social, operando a transformação da igualdade jurídica para a material, a nível procedimental, e de como, reflexamente, pode esta alcançar efeitos pan-processuais concretos. Constatou-se, ainda, pela dinâmica dos dois microssistemas e de seus resultados, a potencialidade capaz propiciar a afetação do sentimento de alteridade, ainda que tênue, naqueles subsistemas auto-referenciais referidos por Habermas, que se contrapõem à sociedade como forças hegemônicas de dominação na contemporaneidade. Buscou-se, enfim, descortinar uma nova interação entre Judiciário, democracia e participação da sociedade, principalmente enquanto individualidades coletivizáveis, que possa potencializar as resistências e criar atalhos para efetivação dos valores que permeiam a tessitura de seus anseios por igualdade e dignidade. Num mundo descrente e adensado por complexidades e problemas múltiplos, que, cada vez mais, afetam globalmente os destinos e realidades mais remotas, qualquer caminho de reflexão e crítica, mesmo que através da releitura de um Poder de Estado, já constitui, em si, uma finalidade, por colocar num palco de discussão pública as legítimas expectativas da sociedade. / [en] The analysis of the ballast and dimension of the Judiciary while democratic instance and of how the opening of its access and the revision of its role can contribute to the exercise of democracy were the nodal points of the work evolved, which consolidates its theoretical basis on the theory of communicative action of Habermas, seeking to demonstrate, in a first attempt to experiment its categories to the praxis which results from the inter action of the Special Judiciaries with the Consumer´s Defense Code (Law 9099/95 and Law 8078/90), how they can perform as instruments of democracy in judicial public sphere. In the development of the subject we pose the process in such a manner as to reproduce the enormous differences and conflicts found out in social environment, and as a conductor of necessities and social expectations, also finding a peculiar form of society´s political participation through the Judiciary, argumentative stage for the reaching of agreements, which may express a result of a deliberative but not decisive nature. Also it was sought to demonstrate how process can be put into action so as to permit, within the scope of that institutionalized sphere, a greater effectiveness of fundamental rights, the equalization of syntonies which would permit a reduction of judicial inequalities inherent in social reality, operating the transformation of legal equality to material one, at the procedural level, and how, reflexively, this can reach concrete pan- prosecutional results. It was also noticed by the dynamics of the two micro-systems and their results the potential capacity of propitiating the affectiveness of alterity sentiment, albeit tenuous, of those auto-referential subsystems referred to by Habermas, which oppose society as supreme forces of domination in present days. It was also sought to unveil a new interaction among the Judiciary, democracy and social participation, mainly as collectivized individualities, which might potentialize the resistances and create short cuts to the accomplishment of the values which permeate the contexture of their longing for equality and dignity. In a disbelieving world crowded with complexities and multiple problems, which, more and more, globally affect the destinies and the remotest realities, any path leading to reflection and criticism, even through the re-reading of a Power of State, creates, itself, a finality, by putting on the stage a public discussion of the legitimate expectations of society.

[pt] O debate argumentativo na sociedade antecede e renova o espírito vinculante das cartas constitucionais. A busca por uma fundamentação da normatividade dos princípios constitucionais requer, mais do que o peso que se pretende atribuir ao papel da jurisdição constitucional, que se identifique a relevância da deliberação democrática no processo de formação do sentimento constitucional pelos cidadãos da polis, que são, ao mesmo tempo, destinatários e agentes criadores das diretrizes políticas fundamentais. A maior contribuição dos estudos elaborados em torno da democracia deliberativa reside, pois, na percepção da inestimável relevância das relações intersubjetivas entre os membros da comunidade durante o processo político, o conhecimento de suas dificuldades e limites, assim como a verificação de seus méritos. Neste rumo, é oferecido um vasto campo favorável à aproximação entre as teses contrapostas dos liberais e republicanos, tornando possível a coexistência teórica e prática entre a realização efetiva da soberania popular e a proteção dos direitos fundamentais, tendo sempre em vista a supremacia da dignidade humana, como elemento informador e balizador de todas as atividades ínsitas à vida em sociedade. / [en] The argumentative debate inside society antecedes and renews the bonding force of the constitutional charts. The search for a justification of fundamental rights and principles requires, more than the weight that one might wish to attribute to the role of constitutional jurisdiction, that the relevance of democratic deliberation be taken into account in the process of the formation of a constitutional feeling by the people of the polis, which are at the same time addressees and creators of the fundamental political directives. The most important contribution of recent studies concerning deliberative democracy reside, in fact, in the perception of the utmost relevance of the intersubjective relations between all members of the affected community during the political process, the knowledge of its difficulties and limits, as well as the verification of its merits. In this direction, a vast field is offered for the convergence between opposed theories such as those of liberals and republicans, paving the way for the effective application of popular sovereignty and human rights protection, while considering the supremacy of the value of human dignity as the informative and orientative standard of all activities inherent to life in society.

[pt] Este trabalho analisa a produção da Coleção Primeiros Passos, publicada pela editora Brasiliense no período da abertura democrática, no Brasil, entre os anos 1979 e 1985. Com a produção dessa Coleção a Brasiliense não só conquistou uma nova posição no campo editorial como criou um espaço de participação política relevante no processo democrático em construção. Destaca-se para a análise histórica o projeto político editorial de esquerda construído pela Brasiliense nesse momento. / [en] This work analyzes the production of Primeiros Passos, the book collection, edited by Brasiliense during the period of the Brazilian democratic opening process, from 1979 to 1985. With it, Brasiliense reached a new and important position on the publishing field and furthered an extremely relevant space for political discussion and participation alongside with the democratic process under construction by civil society. The leftist political publishing project built by Brasiliense is focused on here from a historical perspective.
