The right to adequate housing : making sense of eviction procedures in the context of rental housing after Ndlovu V Ngcobo

Since democracy in 1994, the government has promulgated a number of acts to achieve the goal of adequate housing for all. These include the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE) and the Rental Housing Act (RHA). The problem for the courts is knowing when to apply each act. To reach the goal embodied in the constitutional right of adequate housing for all, the government has invested R18 billion in housing since 1994. Despite this, the need for housing has escalated. The RHA, in which the legislature tried to create a balance between the rights of landlords and tenants, followed. This was done in order to alleviate some of the pressure to ensure access to land, which rests solely on the shoulders of the government. The legislature tried to create a sphere into which private investors would want to invest their money. A number of recent cases dealing with tenants who defaulted on their rentals and the landlord's capacity to effect eviction raised awareness about the existing inadequacies of the law in this particular field. In a Supreme Court of Appeal ruling, the court found that when a landlord wants to evict a defaulting tenant the time-consuming and costly procedure of PIE should be used. The assumption underlying this study is that PIE should not be applicable in cases of evicting a defaulting tenant. The rights and duties of the various parties involved in rental housing therefore need to be examined. The main aim is, however, to ascertain which procedure should be employed when obtaining an eviction order against a party holding over and what the effects are when the most appropriate eviction procedure is not used. A well-regulated relationship would ensure the best balance of interest for the landlord, tenant and the government by creating a market in which a landlord could make money out of letting and more tenants could obtain adequate housing through renting. A further assumption is that the rei vindicatio should be used when having a defaulting tenant evicted. It offers an alternative procedure that does not undermine the objectives of the housing legislation. / AFRIKAANSE OPSOMMING: Suid-Afrika ervaar tans 'n probleem met die verskaffing van behuising vir almal. Sedert die land se verwerwing van demokrasie in 1994 het die wetgewer 'n hele reeks wette aangeneem om die probleem op te los, ondermeer die Wet op Huurbehuising en die Wet op die Voorkoming van Onwettige Uitsetting en Onregmatige Okkupasie van Grond (hierna verwys as PIE). Die howe ondervind soms probleme wanneer daar bepaal moet word wanneer 'n spesifieke wet van toepassing behoort te wees en wanneer. Ten spyte van die R18 miljard wat die regering reeds bestee het aan armes sonder huise, het die getal mense wat sonder geskikte behuising woon gegroei. Die wetgewer het deur die promulgasie van die Wet op Huurbehuising gepoog om 'n mark te skep waarin daar behuising verskaf sal word in die vorm van huurbehuising. Terselfdertyd sal die privaatsektor baie nodige geld in die huurmark kan investeer. Onlangse regsspraak in die verband dui daarop dat daar nog baie leemtes bestaan veral met verwysing na uitsetting. Na 'n resente Appelhof beslissing sal die verhuurder van die meer tydrowende en duurder prosedures in PIE gebruik moet maak om 'n persoon uitgesit te kry. Die onderliggende aanname is dat PIE nie van toepassing behoort te wees wanneer 'n verhuurder 'n huurder wat agterstallig is met die huur wil uitsit nie. Die regte van beide huurder en verhuurder word gevolglik bestudeer. Die hoof-oogmerk van die studie is egter om vas te stel watter uitsettingsprosedure die beste sal wees en wat die gevolge sal wees indien die prosedure nie gebruik word nie. 'n Goed gereguleerde huurmark sal sorg dat huurders genoegsame beskerming geniet, dat die verhuurder geld sal kan maak uit die huurmark en dat die regering se druk tot 'n mate verlig word. 'n Verdere aanname is dat die prosedure vir die rei vindicatio die korrekte prosedure is om te gebruik om 'n huurder wat versuim om sy/haar huur te betaal uit te sit. Die rei vindicatio word gevolglik bestudeer en daar word getoon dat die prosedure aansienlik van die van PIE verskil. Dit bied 'n alternatief en is nie van so aard dat dit die behuisings wetgewing se oogmerke belemmer nie.

[pt] A computação na nuvem vem modificando a maneira pela qual os usuários acessam e usufruem de serviços computacionais. Um sistema gerenciador de banco de dados é um dos principais recursos deste novo ambiente de trabalho. Entretanto, os grandes volumes de dados devem ser adequadamente gerenciados e disponibilizados, de acordo com as oscilações das cargas de trabalho e em função de novos parâmetros existentes. Pelas dimensões do problema neste novo ambiente da nuvem, não há como dispor de um DBA que consiga, manualmente, administrar, manter disponibilidade e desempenho de maneira aceitável. Em particular, há necessidade de sintonia fina (tuning) automática pois o sistema na nuvem deve cumprir requisitos contratuais de operação e, para o usuário, deve-se oferecer recursos como se fossem ilimitados ao mesmo tempo que com excelente desempenho. Nesta dissertação são explicitadas e comparadas as atividades de (auto) sintonia fina em SGBDs que operam em ambientes convencionais e em ambientes de nuvem. Enfatizam-se as diferenças observadas na visão do provedor do serviço de nuvem e dos usuários em um contexto de DBaaS. Nesta pesquisa será proposta uma nova extensão da ontologia de domínio desenvolvida e aprimorada por [Almeida, 2013] e [Oliveira, 2015], a fim de abranger a sintonia fina em banco de dados na nuvem. / [en] Cloud computing is changing the way users access and benefit from computer services. A database manager is one of the main features of this new working environment. However, large volumes of data must be properly managed and made available, according to the fluctuations in workloads and function of new and existing parameters. Because of dimensions problems in this new cloud environment, it is very difficult to have a DBA who can manually manage, maintain availability and performance acceptably. In particular, the necessity of a tuning process automatic in the cloud system to meet contractual operation requirements and the necessity of offering to the user resources as if they were unlimited while with excellent performance. This thesis explains and compares the activities of (self)-tuning database systems operating in conventional and cloud environments, emphasizing the differences observed in the cloud service provider s view and users in a context of DBaaS. In particular, it is proposed to extend of tuning ontology in order to automate actions to tuning the Database as a Service.

The Jatahy Farm was a property that along the 20th century had been through several manners of seizure; from 1925 to 1959 the farm was bought by the Companhia Mogiana de Estradas de Ferro, that extinguished the coffee plantation and in its place had started the pines and eucalyptus cultivation. In 1959 the Jatahy Farm had became a São Paulo State property and most of its area was turned into an experimental station focused on its local forest studies, resulting nowadays on an ecological station in which scientific researches and assisted environmental education are the only activities allowed. Although, thanks the seizure changes coffee farm to railway company property and then to a conservation area the working offers decreased and the Jatahy Farm s residents established out there since the time of coffee cultivation, soon by soon started leaving the place they used to live in. However, the multiplicity of meanings applied to the Jatahy Farm at the present, resulting from the effort on its conservation, are centered most on the sociability experienced in the past, when Jatahy Farm was a coffee farm. From that point on, this study is due to rebuild the collective memory of female and male Jatahy Farm s coffee workers, understanding Work in its multiple dimensions the work experienced in public and private circles as an analytical category, as way as Memory, Gender and, specifically, the Patriarchy concept. Consequently, this dissertation aims to discuss the gender differences existing on female and male memories, also considering the tenant farmers experiences as Italian immigrants. Reconstructing their life experiences throughout the Work as an analytical category is faced here as the ground zero for understanding sociabilities, representations and the multiplicity of meanings conferred to individual and collective life. Furthermore, the Gender category allows taking work, history and female opposed-power out off the invisibility, exploring the Patriarchy constructing and reconstructing process throughout time and, for that reason, its a-historical character. The time cut selected (1925-1959) is intended to include the periods in which Jatahy Farm was both a coffee farm and a Companhia Mogiana Railway property. The adopted research method was Oral History, by the possibilities it offers on registering and understanding remembrances, combined to other kinds of documents. The dialogue established amongst the variety of sources, oral and written, enhanced the relations on memory and history, which was focused on the local and regional historiography. The reconstruction of tenant farmers collective memory was also possible thanks to photographic sources, understood as a support for memories and the elaboration of affective maps by the deponents. / Este estudo analisa as lembranças de trabalhadoras e trabalhadores de uma antiga fazenda cafeeira do Nordeste Paulista, a Fazenda Jatahy, município de Luiz Antônio/SP. Esta fazenda passou por diferentes formas de apropriação da terra ao longo do século XX. Primeiramente, de 1925 a 1945, foi uma importante fazenda cafeeira do nordeste paulista. Posteriormente, de 1945 a 1959, foi comprada pela Companhia Mogiana de Estradas de Ferro, que substituiu o cultivo do café pelos de pinos e eucaliptos. Em 1959, esta área passou a ser gerida pelo Governo do Estado de São Paulo, que a transformou em uma estação experimental, intensificando a silvicultura. Atualmente, grande parte da área da antiga fazenda é uma estação ecológica estadual, onde apenas são permitidas as pesquisas científicas e atividades de educação ambiental monitoradas. Após essas diferentes formas de apropriação da terra fazenda cafeeira, estrada de ferro e, atualmente, área de preservação estadual os moradores e moradoras, que ali viviam à época do café, aos poucos abandonaram a área em virtude da diminuição da oferta de trabalho. Entretanto, as (re)significações da atual área de preservação centram-se, sobretudo, na sociabilidade de outrora, quando a área era uma fazenda cafeeira. A partir desta constatação, objetivou-se reconstruir a memória coletiva desses trabalhadores e trabalhadoras. Utilizam-se como categorias de análise o trabalho, compreendido em suas múltiplas dimensões o trabalho nas esferas pública e privada , a memória e o gênero, especificamente o patriarcado. Por conseguinte, visa-se a elencar as diferenças de gênero existentes na memória feminina e na masculina. A reconstrução das experiências dessas colonas e colonos por meio do trabalho é o ponto central para a compreensão da sociabilidade, das representações e das múltiplas (re)significações da vida individual e coletiva. Ademais, o crivo de gênero permite retirar da invisibilidade o trabalho, a história e o contra-poder femininos, analisando as construções e (re)construções do patriarcado, desmistificando, assim, seu caráter a-histórico. O recorte temporal abrange o período da fazenda cafeeira e da Companhia Mogiana (1925 a 1959). A metodologia utilizada é a história oral, que permitiu registrar tais lembranças. Somada a ela, fontes documentais foram utilizadas. O diálogo entre as fontes oral e escrita possibilitou realizar a relação entre memória e história, centrando-se, entretanto, na historiografia local e regional. A reconstrução da memória coletiva desses colonos e colonas edificou-se ainda por meio de fontes iconográficas, concebidas como detonadoras de lembranças, e de mapas afetivos.

Internet  has  given  possibilities  to  a  whole  new world within communication. Nowadays  the communication  inside organisations and companies  takes place  through  the Internet. The  idea  of  this paper  arose when one of  the  authors discussed  the  general  involvement of  the  tenant-owner’s association  in  the committee. Providing a new channel  for  communication  through a homepage  could  affect  the  attitude  of  the  tenants.  We  were  curious  of  what  effect  on communication  introducing a homepage would give. Also how you would  reach  the proposed effect, which is to increase the communication in the association. Through feasibility study we examined  the way of how the members communicated. After  the production of  the homepage we could see the effect of communication by having personal interviews.   Our  conclusion  is  that  the  communication  has  been  simplified  for members  and  for  the committee. Unfortunately not all members have used  the new  service,  this has been analysed. We  think  that  a  more  intensive  marketing  would  lead  to  more  interest.  The  user  must  be motivated and see the benefit of the product.

This thesis discusses the new way of delivering IT services over the Internet widely known as cloud computing. In its opening part, cloud computing is put into a historical context of the evolution of enterprise computing, and the dominant issues the IT department faces today are mentioned. Further, the paper deals with several components that make up the architecture of cloud computing and reviews the benefits and drawbacks an enterprise can have while it adopts this new model. One of the primary aims of this thesis is to identify the impact of the technology trends on cloud computing. The thesis brings together four major computing trends, namely virtualization, multi-tenant architecture, service-oriented architecture and grid computing. Another aim is to focus on two trends related to IT infrastructure that will lead to fundamental changes in IT industry. The first of them is the emergence of extremely large-scale data centers at low cost locations, which can serve tremendous amount of customers and achieve considerable economies of scale. The second trend this paper points out is the shift from multi-purpose all-in-one computers into a wide range of mobile devices dedicated to a specific user's needs. The last aim of this thesis is to clarify the economic impact of cloud computing in terms of costs and changes in business models. The thesis concludes by evaluating the current adoption and predicting the future trend of cloud computing.

The Priceless treasure at the bottom of the well : rereading Anne Brontë

Anne Brontë died in 1848, having written two novels, Agnes Grey (1847) and The Tenant of Wildfell Hall (1848). Although these novels, especially The Tenant of Wildfell Hall, initially received a favourable critical response, the unsympathetic remarks of Charlotte Brontë and Elizabeth Gaskell initiated a dismissive attitude towards Anne Brontë’s work. For over a hundred years, she was marginalized and silenced by a critical world that admired and respected the work of her two sisters, Charlotte and Emily, but that refused to acknowledge the substantial merits of her own fiction. However, in 1959 revisionist scholars such as Derek Stanford, Ada Harrison and Winifred Gérin, offered important, more enlightened readings that helped to liberate Brontë scholarship from the old conservatisms and to direct it into new directions. Since then, her fiction has been the focus of a robust, but still incomplete, revisionist critical scholarship. My work too is revisionist in orientation, and seeks to position itself within this revisionist approach. It has a double focus that appraises both Brontë’s social commentary and her narratology. It thus integrates two principal areas of enquiry: firstly, an investigation into how Brontë interrogates the position of middle class women in their society, and secondly, an examination of how that interrogation is conveyed by her creative deployment of narrative techniques, especially by her awareness of the rich potential of the first person narrative voice. Chapter 1 looks at the critical response to Brontë’s fiction from 1847 to the present, and shows how the revisionist readings of 1959 were pivotal in re-invigorating the critical approach to her work. Chapter 2 contextualizes the key legal, social, and economic consequences of Victorian patriarchy that so angered and frustrated feminist thinkers and writers such as Brontë. The chapter also demonstrates the extent to which a number of her core concerns relating to Victorian society and the status of women are reflected in her work. In Chapter 3 I discuss three important biographical influences on Brontë: her family, her painful experiences as a governess, and her reading history. Chapter 4 contains a detailed analysis of Agnes Grey, which includes an exploration of the narrative devices that help to reinforce its core concerns. Chapter 5 focuses on The Tenant of Wildfell Hall, showing how the novel offers a richer and more sophisticated analysis of feminist concerns than those that are explored in Agnes Grey. These are broadened to include an investigation of the lives of married women, particularly those trapped in abusive marriages. The chapter also stresses Brontë’s skilful deployment of an intricate and layered narrative technique.
