The Portland Public School Police: Formative Years - 1937 to 1953

This thesis traces the historical evolution of one of the early responses to youth crime and violence -- public school police. In addition, this thesis addresses the lack of information about the creation and implementation of a public school police force, specifically the Portland Public School Police and School District No. 1, during its formative years, 1937 to 1953. Finally, the thesis intends to address two principal questions: A) Why did the Portland Board of Education find it necessary to create their own police agency? While one opinion suggests that there was a real need for school police due to the escalating crime raking place within the school district, the other opinion suggests that the school police were created mostly for underlying political reasons rather than general public safety. B) What were the principal functions of the School Police? The initial function of the Portland Public School Police was to protect school property and reduce the monetary loss incurred by the school district. However, after 1941, when large number; of immigrants came to Portland with their school-age children, the Portland Public School Police expanded their function from property protection and reduction of monetary loss to include crime repression and protection.

The aim of this thesis is to examine how the EU directive 2004/35/EC on environmental liability impacts the Swedish administrative legal order. The thesis examines the directive through two main EU principles - the principle of good administration and the principle of procedural autonomy. The EU principle of good administration as a concept contains various procedural and substantive obligations that make up the subject for examination of the directive, both as regulated in the directive and as general principles of EU law. The directive is analyzed using a comparative method to determine to what extent the procedural and substantive principles of the directive impacts the Swedish administrative law, and weather or not the Swedish regulations comply with the EU principle of good administration. The results of the study shows that, althought there’s a general principle of national procedural autonomy, the EU principles of good administration do affect the Swedish administrative regulation in various aspects, through the implementaion of the directive on environmental liability as well as general principles of EU law. Furthermore the study shows that the Swedish regulations that are used to implement the directive don’t always act in accordance with the EU principles of good administration in certain areas, which potentially could restrain the impact of the directive in the Swedish legal order.

Before 1994 administrative law was dominated by parliamentary supremacy which dictated that Parliament is the supreme law-making authority in the state. This position was radically changed by the new democratic order. To protect the rights of citizens a Bill of Rights was introduced in South Africa. This research focuses on the uncertainty pertaining to the application of the audi alteram partem rule to the proceedings of commissions of inquiry. Section 24 of the interim Constitution, section 33 of the final Constitution and the Promotion of Administrative Justice Act 3 of 2000 were introduced to safeguard the individual against unfair administrative action. These legislative measures as well as applicable case law are analysed in order to establish whether they have brought about greater clarity concerning the application of the audi alteram partem rule to the proceedings of commissions of inquiry. / Thesis (LL.M. Žemė yra ribotas, pažeidžiamas ir niekuo nepakeičiamas gamtos išteklius, nuo kurio priklauso mūsų gyvenimas. Žemės naudojimo valstybine kontrole siekiama užtikrinti, kad valdant ir naudojant žemę būtų laikomasi Lietuvos Respublikos žemės įstatymo bei kitų įstatymų, kurie susiję su žemės naudojimo priežiūra. Siekiant užtikrinti tinkamą žemės naudojimą, susiduriama su įvairiais pažeidimais. Tyrimas atliktas siekiant nustatyti žemės naudojimo valstybinės kontrolės darbų organizavimo problemas, trukdančias pasiekti efektyvų kontrolės vykdymą. Tyrimo objektu pasirinktas žemės naudojimo valstybinės kontrolės vykdymas Alytaus ir Lazdijų rajonuose 2007–2009 m. Tyrimams panaudoti literatūros šaltinių analizės, alternatyvų paieškos, lyginamosios ir vertinamosios analizės ir loginio mąstymo metodai. Baigiamajame darbe išanalizuoti žemės naudojimą ir valstybinės kontrolės vykdymą reglamentuojantys teisės aktai, Nacionalinės žemės tarnybos prie Žemės ūkio ministerijos ir Alytaus bei Lazdijų rajonų kontrolės vykdymo veiklos ataskaitos. Išnagrinėjus teisės aktus, jų praktinį taikymą ir kontrolės vykdymo veiklos ataskaitas, nustatytos problemos, apibūdinti nustatyti pažeidimai – žemės naudojimo ne pagal nustatytą pagrindinę paskirtį (žemės ūkio paskirties žemės apleidimo), savavališko žemės užgrobimo, riboženklių sunaikinimo, derlingojo dirvožemio nesaugojimo, savavaldžiavimo atvejai. By the state control of land use one strives to ensure that while managing and using land, the land law and other laws of the Republic of Lithuania related to land use care are obeyed. While trying to ensure the appropriate use of land, a lot of different offences can be met. The research was carried out in order to find out the problems of state control of land use which might be the obstacles of effective control implementation. During the research the object selected was the research of land use control procedures Alytus and Lazdijai district in 2007-2009 year. During the research the analysis of literature sources, alternative search, comparative and evaluation analyses and methods of logical thinking were used. In Master Work the use of land and legal acts that regulate state control implementation and control implementation work reports of National Land Service under the Ministry of Agriculture and Alytus, Lazdijai district were analyzed. Analyzing legal acts, their practical application and work reports of control implementation the problems were stated and also the stated offences were described, for example the inappropriate use of the land (negligent use of farming land), willful occupation of the land, the destruction of bound marks, careless attitude towards soil, the cases of self-will. It is the aim with this paper, to research the shortcomings experienced in the appeal procedures as contained in the Engineering Profession Act ("EPA"), in order to determine whether the process should be revised or if only certain relevant sections of the EPA should be rewritten. Due to the administrative nature of certain duties of the Council as authorised by the EPA, it makes it inevitable that appeals will follow. It is therefore imperative that the procedures to appeal, must be both functional and effective. The relevant sections of the EPA as well as the appeal procedures of the Health Professions Act's will be researched, taking into account the stipulations of the Constitution and the Promotion of Administrative Justice Act ("PAJA"). Relevant legal administrative principles and doctrines, court judgments, as well as the views of authors are also taken into account. Two major areas of concern in certain sections of the EPA have been identified: • The fact that the whole council has to decide on appeals, and • the fact that such hearings have to take place within a very limited time frame. Relevant court findings have made it clear that decisions made by authorities, have to comply with the requirements set out in the Constitution in coherence with PAJA. In conclusion, based on the Constitutional and the legal administrative requirements, it is found to be necessary to rewrite the relevant sections of the EPA, as well as the rules of appeal, as these do not make the grade at present. / Thesis (LL.M. Le pouvoir de gestion est une puissance publique propriétaire en interaction avec les droits des usagers. / The power to manage state administered property is an atypical legal object. At the core of the dialectic between public authority and property, and facing new property, economic and competitive issues related to state owned public domains, its outline and its foundation must be redefined based on its genealogy. A power upon a thing, the managing public authority must also be defined from a subjectivist approach, within the framework of its interactions with citizens. Management power is a public owner power interacting with the users’ rights.
