引發專利訴訟的影響因素-以動態競爭AMC觀點分析ITC案件為例 / The Factors Initiating Patent Litigation- Analysis from AMC perspective of Competitive Dynamics by ITC cases

專利訴訟一直以來是台灣廠商邁向國際市場的一大挑戰,除了建構完整的智財管理能力外,若能事先預測訴訟發動的時間點與條件,不僅能避免對手的干擾風險,更能取得打下市場的先機。面對可能的侵權風險,競爭對手會在何時、何種條件下採取訴訟手段,是本文探討的焦點。本文以美國國際貿易委員會(International Trade Commission, ITC)有關智慧財產權之337條款調查案作為研究對象,配合台灣上市公司的名單找出交集廠商,分析、歸納台灣廠商在ITC案件中的訴訟趨勢,並進一步挑選出五家個案公司,觀察其與主要競爭對手間彼此的角力過程。藉由動態競爭觀點中的察覺(Awareness)-動機(Motivation)-能力(Capability)之AMC三環透視法解析訴訟發生的條件。本文的研究結果指出,個案公司與競爭對手發生訴訟戰的時間點,多半出現在彼此市佔率的成長即將出現交叉或已出現交叉之時;另一方面,搶食代工客戶或穩固訂單等需求,也會構成廠商採取訴訟打擊的條件之一。本文進一步在這樣的基礎上提出「專利侵權」指標的概念,希望能為預測專利訴訟的發生提供一個觀察基礎。 / Patent litigation is one of the difficulties facing by Taiwanese companies expanding their international market share. As a result, to tell when or under what kind of circumstances will litigations happen become an essential mission for intellectual property management. Therefore, this thesis uses case records of 337 investigations from US International Trade Commission as sample, combined with listed company of Taiwan Stock Exchange in order to select the intersection of the two. Choosing from the intersection, this thesis picks up five different companies and further analyzes the conditions under which they faced their ITC litigations. Research result indicates that most ITC cases are initiated while these companies have surpassed main competitors’ market share or nearly so. Moreover, to initiate litigations in ITC as means of stabilizing their connections with OEM/ ODM customers or merely as interference to other companies’ connections with their OEM/ ODM customers are all common reasons why patent litigations are adopted.

In this thesis, we deal with the issue of invasive methods of prenatal care from a nursing perspective using standardized classification schemes NANDA, NIC and NOC, which offer many opportunities to streamline, simplify and improve the care of women who undergo invasive procedures. The theoretical part is focused on screening in prenatal care, individual invasive methods and the most common congenital malformations of the child. Furthermore, standardized classification systems NANDA, NIC and NOC, which represent a common nursing language. The empirical part of the dissertation is processed using qualitative strategy. To collect data, we selected the following research methods: content analysis of documents, evaluation using Fehring's model. The first goal was to detect and identify the problems that women face after amniocentesis (AMC), chorionic villus sampling (CVS) and cordocentesis and second goal was to assess the applicability of selected issues of classification systems NANDA, NIC and NOC with Fehring's model of validation of nursing diagnoses. Using content analysis, we have selected three nursing diagnosis from the NANDA International Taxonomy II, from publication of Nursing Interventions clasification (NIC) 3 nursing interventions and from Nursing Outcomes Clasification (NOC) 4 expected results, which are focused on the respondents after invasive methods. From selected nursing diagnoses of NANDA, NIC interventions and NOC expected results, we have developed a research form, specific questionnaire we submitted to the validation by respondents. The survey was carried out from January to March 2015 in the polyclinic GENNET Ltd. - Centrum of Medical genetics and reproductive medicine and in a private clinic OG Medical Center Ltd. The sample consisted of 34 intentionally selected respondents who underwent amniocentesis, chorionic villus sampling, or cordocentesis. The outcome of this thesis is the basic concept of the nursing diagnosis, according to NANDA-I, NIC and NOC aimed at women after invasive methods for prenatal care. Research has shown that with the the vast majority of respondents significantly exhibited symptoms of fear and anxiety. In contrast, in terms of the respondents reported that the knowledge of the issue is sufficient. This result is influenced by the fact that respondents find a lot of information on the Internet, but that may not always be true. Unfortunately, the results showed that it is more a problem of communication and interest of the medical staff.

我國不良資產處理方式之研究

近年來銀行逾期放款總額劇增,連帶使銀行產生處理龐大不動產擔保品之難題。本文目的希望能幫助銀行事先對擔保品進行分類並選擇適當處理方式,以減輕銀行處理不良資產擔保品之損失。文中以法拍屋個案財務分析模擬方式之結果將擔保品分成三類:一為二拍前拍定者,此類擔保品仍可採法拍處理;另一為第三拍拍定者,此類擔保品銀行可改採銀行自行委託拍賣處理;最後為四拍後拍定者,則可考慮讓售給資產管理公司處理。 實證結果發現,二拍前拍定擔保品之特徵屬性傾向較顯著者為有增建使用,建物持分面積為中坪數者,或建物類型為普通公寓,或位於市區,或有可點交之屬性者。第三拍拍定擔保品之特徵屬性傾向為位於五樓以上,或位於郊區,或有較多競標者參與。四拍後拍定之擔保品特徵屬性傾向為位於一樓,或有多層或多號使用情形,或建物持分面積為小坪數者,或建物類型為一般大廈,或位於舊市區,或有不可點交之屬性者。因此未來銀行可對不良資產依特徵屬性分類後,再採適當方式處理,較能減少損失並達成促進資金流通與健全金融機構之目標。 關鍵字:不良資產、資產管理、法拍屋、銀行拍賣 / Recently, the non-performing loans have become serious problems due to the trouble of the real estate collaterals faced by the financial institutions. This research aims on helping the banks to deal with the collaterals and reduce the loss of banks. According to the financial simulation, the collaterals are divided into three groups: 1.for the collaterals sold before the second bid, the financial institutions could take the way of legal auctions.2.for the collateral sold on the third bid , the financial institutions could take auction by themselves.S.for the collateral sold after the special bid, the financial institutions may consider to sell the AMC. From the empirical result, we found that the obvious characters of the collaterals sold before the second bid include EXFL, MBUSPACE, INCITY, and GIVE. The characters of the collaterals sold on the third bid include UPFL, rural areas, and more bids. The characters of the collaterals sold after the special bid include SBUSPACE, API 2, OLDCITY, and without GIVE. Thus, in the future, the collaterals could be separated by the above three categories and the financial institutions can make the better decision to reduce the loss so that the internal economics structure is well established. A abordagem metodológica proposta está estruturada numa pesquisa quali-quantitativa com a aplicação da metodologia TOPSIS (Technique for Order Preference by Similarity to Ideal Solution). Os dados foram levantados a partir de setores operacionais de uma empresa caracterizada como sendo uma organização de alta confiabilidade e atuante do setor elétrico. Como resultado esperado a consolidação da metodologia proposta que permitiu a avaliação da performance da gestão global da manutenção / The Brazilian electricity sector, after the period of privatization and the creation of the National Electric Energy Agency (ANEEL), has been subjected to stricter rules and ever more demanding quality indices. The prospects of companies acting in this sector to stakeholders, as the customer requires better service levels, shareholders in turn trying to increase the efficiency of their power utilities to achieve their financial goals. Thus in this challenging environment are the electricity distributors, which in turn are measured and evaluated by ANEEL for indicators that reflect the rates charged to consumers. In this way the energy company remains seek maximum operational efficiency in order to meet in a balanced way, customer, shareholder and regulator agency. The work has developed a proposal for a maintenance index of excellence, which combines results of people, resources and technology in order to evaluate performance of operating units. The proposed methodological approach is structured in a qualitative and quantitative research with the application of the methodology TOPSIS (Technique for Order Preference by Similarity to Ideal Solution). The data were collected from operational sectors of a company characterized as a high reliability organization and active in the electricity sector. As a result expected to consolidate the proposed methodology allowed the evaluation of the performance of the overall management of maintenance.

Squeeze Casting as Alternative Fabrication Process for Carbon Fiber Reinforced Aluminium Matrix Composites

Aluminium matrix composites are among the most promising candidate materials for light weight and high strength applications such as transportation and armour. In a previous study 6061 aluminum matrix composites reinforced with plain weave carbon fiber preform (AS4 Hexcel) were successfully fabricated by squeeze casting using the laminate fabrication technique. This research aims at optimizing the fabrication process in order to achieve improved strength and mechanical properties. It focuses on the liquid infiltration squeeze casting method. Good mechanical bonding between fiber and aluminium is achieved thanks to improved infiltration and impregnation of the fabric by liquid aluminium. Oxidation products at fiber/aluminium interface and porosity are reduced. As a result, composites are produced with overall improved mechanical properties. The flexural strength is increased by up to 19.9% and 15.4% compared to the laminate approach and the reference 6061 aluminium alloy squeeze cast under identical conditions, respectively. Similarly, overall hardness is improved. However, the impact strength is reduced by 7.76% and 25.78% when compared to casts fabricated by the laminate method and the reference aluminium alloy, respectively. The thesis constitutes a good basis for further research on fiber and particle reinforced aluminium matrix composites with the goal of further improving fracture toughness, particularly for gradient materials used in armour applications.

Analysis and design of novel electromagnetic metamaterials

This thesis introduces efficient numerical techniques for the analysis of novel electromagnetic metamaterials. The modelling is based on a Method of Moments modal analysis in conjunction with an interpolation scheme, which significantly accelerates the computations. Triangular basis functions are used that allow for modelling of arbitrary shaped metallic elements. Unlike the conventional methods, impedance interpolation is applied to derive the dispersion characteristics of planar periodic structures. With these techniques, the plane wave and the surface wave responses of fractal structures have been studied by means of transmission coefficients and dispersion diagrams. The multiband properties and the compactness of the proposed structures are presented. Based on this method, novel planar left-handed metamaterials are also proposed. Verifications of the left-handedness are presented by means of full wave simulation of finite planar arrays using commercial software and lab measurement. The structures are simple, readily scalable to higher frequencies and compatible with low-cost fabrication techniques.

不良資產投資組合之分析

我國金融機構合併法第十五條,允許資產管理公司以整包、群組化的方式處理不良資產。本文即以現代投資組合理論(MPT)為基礎,探討不良資產中有關不動產組合的類型、區位與價格規模對不動產組合效率的影響。相較傳統應用於金融資產的投資組合概念,本文主要特色是:根據「風險分散」的原理,不動產投資組合以國內地理區分散、類型分散的投資組合方式為主。在不動產的投資組合運用上,由於不動產市場的資訊不透明、缺乏流動性、高昂的交易成本,特別是不動產間的產品高度異質性,影響投資者運用「縱斷面」時間序列的不動產價格資料,分析不動產組合報酬與風險之結果,因此本篇研究改從「橫斷面」的角度,將不良資產價格資料進行個體不動產的組合模擬。實證的結果發現:(1)不動產組合價格與報酬風險呈現非線性的關係;當不動產組合金額愈大或愈小時,越有可能形成效率的投資組合;若組合中的不動產具有強烈的異質性,則小規模的不動產組合,即可達到效率組合的要求。(2)個體不動產組合內容異質程度愈高,亦可達到與傳統財務投資組合理論相同的分散風險效果。(3)個體不動產異質程度方面,不動產在「區位」多角化後之組合效率,其效果高過於不動產在「類型」多角化後之組合效率。

Antennes souples à base de métamatériaux de type conducteurs magnétiques artificiels pour les standards de systèmes de géolocalisation / Flexible antenna based artificial magnetic conductors for geolocation systems

Grâce aux progrès réalisés ces dernières années dans la conception de réseaux intelligents, tels que les réseaux centrés sur la personne (WBAN) ou les réseaux sans fils de proximité (WPAN), de nouveaux types d’applications émergent et utilisent des capteurs d’informations capables de relever les paramètres physiologiques, environnementaux et plus particulièrement le positionnement des personnes. Dans ce cadre, nous nous sommes attachés dans ce travail de recherche à la conception et la réalisation d’antennes en polarisation circulaire pouvant être intégrées dans des vêtements, pour les standards de géolocalisation européen Galiléo et Américain GPS. Nous avons utilisé pour ces antennes des structures métamatériaux de type conducteurs magnétiques artificiels, afin d’augmenter les performances en rayonnement et pour diminuer le couplage avec et le corps humain. Une autre voie explorée est l’utilisation d’antennes patchs qui sont de nature faible encombrement. La bande de fréquence du standard de communications par satellite Iridium étant très proche du standard de géolocalisation GPS, nous avons trouvé intéressant de développer une solution de type patch couvrant les deux bandes GPS (1,575 GHz) et Iridium (1,621 GHz). L’antenne devant être intégrée sur une boite crânienne, les niveaux de débit d’absorption spécifique et les modifications du rayonnement sous conformation de l’antenne ont également été étudiés. L’évolution de ce travail a été ensuite d’étudier le comportement de cette antenne posée sur le dessus d’un casque militaire français. Les performances en rayonnement ont été satisfaisantes et ont montré la possibilité d’une telle application. / Thanks to the progress made in the recent years in the design of smart networks, such as wireless Body Area Network (WBAN), or Wireless Personal Area Network (WPAN), a novel type of emerging applications using smarts sensor measuring physiologic parameters, environmental et more particularly positioning of the persons are nowadays available. In the research presented in this manuscript, we are committed to design and realize antennas that can be possibly integrated into clothes, dedicated to the American GPS (1.227 GHz - 1.575 GHz) and European Galileo (1.180 GHz - 1.575 GHz) global navigation satellite systems. We used for these antennas a type of metamaterial structure named artificial magnetic conductor, to increase and enhance the radiation performance and reduce the coupling between the antenna and the human body. Another way has been explored using patch antenna solutions that are inherently low profile antennas. As the frequency band of the satellite communication system Iridium is close to the GPS one, we developed a dual band antenna solution covering both GPS (1.575 GHz) and Iridium (1.612 GHz) standards. The antenna being dedicated to be integrated over a human skull, the specific absorption rate and the radiation modification was also studied.
