5 Public participation on the decision-making procedure regarding the environment protection is a very important aspect within the building-permitting process. In this thesis, I focus particularly on the public participation in the form of associations through the entire permitting procedure of the structures. The desired goal of this thesis is to analyse the current Czech legislation including with a preview to the international legislation regarding the two fundamental rights: right to information and right to participation. I analyse the actual state of the association participation within the procedure using the relevant case-law. Above all, I aim to the comparison of the current need of such extensive rights to participation against the preservation of the interest of the environment protection and public monitoring function which is definitely important within any procedure. Finally, I am reaching the opinion that the structure-permitting procedure is unnecessarily complicated which can't be a benefit for the public nor the investors. In my opinion, the entire procedure should greatly simplify and the cooperation between the public and the investors should be carried out in a different manner.

The thesis contains the issue analysis and process of regional planning according to legal standards of the Czech Republic. It examines the influences which affect municipal councils while regional planning and how the municipal councils can use it in connection with the municipality development possibilities. Comparison of theory with practical application and demonstration of the influences is shown on the municipality Knínice u Boskovic.

1 Abstract This thesis analyzes and describes legal possibilities, which are given to the public for participation in land-use planning. The aim of this thesis is to reach to conclusion, if the public can, as one of the subjects of land-use planning, play a crucial role in this matter or if her role is rather marginal. The author firstly defines the basic terms as "public" and "land-use planning". Besides, he outlines the issue of the status of environmental associations, which is one of the main topics of this thesis. Subsequently, he categorizes land-use planning tools into conceptional and implementation tools. Further, he continues with basic characteristic of individual tools and their mutual relations. For each tool, he describes its function, content and typical features. In following chapters, author detailly describes and analyzes concrete public possibilities, means and tools for participation in land-use planning. He always doing so in the relation to specific land-use planning tools. The analysis is not limited only to the current state of legislation, but also examines its development since the adoption of the Building Act in 2007. When new buildings are constructed, the municipality create a zoning plan that regulate the land and water use. While creating the zoning plan, the municipality also needs to complete different investigations so that the land can be built on. The effectivity of the municipal planning process is often criticized and some of the criticism is pointed towards the investigations. Investigations take long time and is often contributing to high costs. The aim of this study is therefore to examine what type of investigations that are made before and during the planning process. The result shows that the investigations occurs during three different periods of the planning process; before the process, during the process and after the consultation of the plan. Many of the investigations are common through every plan, however some of them differs depending on the conditions of the building area. / Vid ny bebyggelse upprättar kommunen en detaljplan som reglerar mark- och vattenanvändningen. Vid framtagandet av en detaljplan krävs även att olika utredningar görs för att marken ska kunna bebyggas. Effektiviteten av den kommunala planeringsprocessen kritiseras och en del av kritiken är riktad mot utredningar. Utredningarna drar ut på tiden och bidrar ofta med höga kostnader vid upprättande av detaljplaner. I denna studie undersöks därför vilka utredningar som görs, både före och under detaljplaneprocessen. Undersökningen är en fallstudie som behandlar sex detaljplaner i tre olika kommuner. De utvalda detaljplanerna är bostadsområden som har vunnit laga kraft och är upprättade enligt Plan- och bygglagen (2010:900). Resultatet visade att utredningar sker vid tre olika skeden i planprocessen; innan planbesked, under planarbetet och kompletterande utredningar efter samrådet. Många utredningar var liknande i samtliga detaljplaner, men en del skiljde sig beroende på förutsättningarna av planområdet.

Med den nya plan- och bygglagen (PBL) som trädde i kraft den 2 maj 2011, blev det möjligtatt redovisa fastighetsindelningsbestämmelser i en detaljplan på motsvarande sätt somgjordes genom fastighetsplan i 1987 års PBL. Den särskilda planformen fastighetsplan togsdärmed bort. Syftet med de nya bestämmelserna var att förenkla tillämpningen.Bestämmelserna möjliggör en mer detaljerad reglering i detaljplan, men medför också enskyldighet att göra en prövning redan i planarbetet enligt lagvillkor som finns utanför PBL.Syftet med detta arbete var att bidra med ny empiri avseende hur och i vilken utsträckningsvenska kommuner har tillämpat bestämmelser om fastighetsindelning i plan- ochbygglagstiftningen, samt vilken betydelse tillämparna haft för implementeringen avfastighetsindelningsbestämmelser i plan- och bygglagstiftningen. Genom att tillämpa ettimplementeringsperspektiv är avsikten att bidra med ett nytt perspektiv på tillämpningen avplan- och bygglagstiftningen.Målsättningen var att genom att undersöka och besvara min frågeställning vidareutveckladenna nyvunna kunskap i form av ett förslag till en metodbeskrivning för tillämpningen avlagstiftningen. Då examensarbetet utförts på Halmstads kommunsSamhällsbyggnadskontor var tanken att slutprodukten ska vara ett användarvänligt redskapför dem vid tillämpande av bestämmelser om fastighetsindelning. Metodbeskrivningenresulterade i ett flödesschema och en checklista.En fallstudiemetod tillämpades där implementering av fastighetsindelningsbestämmelservar det ”fall” som studerades och analysenheten bestod av Sveriges 290 kommuner.Datainsamling har skett genom en webbaserad enkät till landets alla kommuner.Det är endast drygt ett år sedan nya PBL trädde i kraft och det är fortfarande tidigt att dranågra slutsatser kring lagstiftningens genomslag. Mina slutsatser är att kommunerna inteanvänder sig av bestämmelserna i så stor utsträckning. Majoriteten av de bestämmelser sominförs avser fastighetsindelning och gemensamhetsanläggningar. Lantmäteriet spelar ennyckelroll vid tillämpandet av bestämmelserna, det är oftast lantmäteriet som prövar attbestämmelsen är förenlig med villkor i förrättningslagstiftningen. Och i de fåtal fall man tagit fram rutiner har man låtit lantmäteriet utarbeta dem. Tillämparna inverkar på implementeringen av lagstiftningen främst på två vis. För det första genom att tillämparna inte till fullo förstår lagparagraferna som reglerarfastighetsindelningsbestämmelser. Konsekvensen av det är att nödvändig villkorsprövninginte görs eller att kommunerna inte använder sig av fastighetsindelningsbestämmelser överhuvudtaget. För det andra genom att det är oklart vilka tillämparna av lagparagrafenfaktiskt är. Det innebär att implementeringsprocessen på lokal nivå kommer att tolkas iljuset av olika professionella perspektiv, exempelvis arkitekter, fysiska planerare, ingenjöreroch samhällsplanerare med en mängd olika utfall. I viss mån påverkas tillämparna av kulturoch tradition hur man tidigare arbetat med fastighetsplan i kommunen. / With the new Planning and Building Act (PBA), which came into force on 2 May 2011, it became possible to account for provisions on property division in a detailed developmentplan in the same way as was done in a property regulation plan in the former legislation.The property regulation plan then ceased as a separate plan. The purpose of the provisionswas to simplify the process and only have one planning process instead of two. Theprovisions on property division allow for a more detailed regulation of the detaileddevelopment plan, but also means a duty to conduct an investigation already in planningwork according law terms that is outside the PBA.The purpose of this work was to contribute new empirical evidence regarding how and towhat extent the Swedish municipalities have applied the provisions on property division,and the importance the implementing officers at the local authorities had for theimplementation. By applying an implementation perspective, the intention is to provide anew perspective on the application of planning and building act. The aim was to investigate and answer my questions and by that further develop this newfoundknowledge in the form of a proposal for a methodology for implementing thelegislation. Since this thesis work was performed at Halmstad Municipality Planning Office,the idea was that the end product will be a user-friendly tool for them in the application ofthe provisions on property division. Method disclosure resulted in a flow chart and achecklist.A case study method was used where the implementation of the provisions on propertydivision was the “case” that was studied and the analysis consisted of 290 municipalities inSweden. Data was obtained from a web based survey among the country's municipalities.It is only just over a year ago, new PBA entered into force and it is still early to draw anyconclusions about the regulatory impact. My conclusions are that the municipalities do notuse the provisions as much. The majority of the provisions introduced concerns propertydivision and joint facilities. The cadastral authority plays a key role in the application of theprovisions, it is usually the cadastral authority which examines that the provision isconsistent with law terms outside the PBA. And in those few cases they have developedroutines it is prepared by the cadastral authority. The implementing officers at the local authorities affect the implementation mainly in twoways. Firstly, by the users not fully understanding the provisions. The consequence of thisis that necessary testing of conditions is not done or that the municipalities do not applythe provisons at all. Second, in that it is unclear which the users of the legislation actually is. This means that the implementation process at the local level will be interpreted in light ofdifferent professional perspectives, such as architects, physical planners, engineers andplanners with a variety of outcomes. To some extent the users are affected by culture andtradition how the municipality previously worked with real estate plan.

Environmental Impact Assessments in Detailed Development Plan Processes: An Adequacy Analysis

A detailed development plan (DDP) is a legally binding plan that regulates the municipalities land use on a detailed level. The purpose with the DDP is to evaluate the suitability for development on land access, in order for municipalities to manage spatial planning and minimize environmental harm. If a DDP would likely cause a significant impact on the environment, an Environmental Impact Assessment (EIA) has to be produced. The aim of this thesis was to investigate how DDP and EIA processes are working on a local level in Sweden, and how the quality is reflected in the processes. More specifically, I investigated the role of EIA actors involved in the DDP process, as well as whether these processes are inadequate from an environmental conservation perspective. To investigate these issues, a document study was conducted as well as an interview study. The results from the study presents several shortcomings in both processes; examples of shortcomings were the lacking knowledge among the DDP and EIA actors in how to conduct the process, as well as interpreting and understanding the law.  Other observed shortcomings were the different levels of engagement among the plan administrators, the EIA performers and the County Administrative Board reviewers. Three important factors were recognized for achieving good processes. Firstly, the people involved need to have broad knowledge and good qualifications. Secondly, the actors must be able to communicate in a good and clear manner. Lastly, the third factor is a good process leader who brings together the DDP and EIA process.

This thesis explains basic problems related to construction of the building. A primary goal of this work was set to work out a project of small detached house in given locality. This project has to reflect requirements of modern young family living. The appearance of house also has to respect circumstances of rural surrounding. The Local plan sets out a land use strategy for the district. During this work were all the regulations of planning policy followed. Designing building layouts to maximize the space use and improve accessibility inside buildings are important consideration for building designers. There were two possible building layouts designed. After due consideration was one of these variants chosen for further elaboration. The considerable work has been done by taking a general overview of the building process preparation. The main conclusion of this work is not only the spatial layout of one single house. Building law in the Czech Republic was completely modified year 2007. In connection with this modification, this work also provides a useful outline of new building act.

The diploma thesis aims to elaboration of project documentation for a one-family house reconstruction. The project is based on the local plan of the village Boršov nad Vltavou. Proposal is made in two variations - A and B. Project is worked-out according to the variation A and elaborated in a range for issuing notification of simple building. The house is designed in compliance with the area plan of the municipality and it follows the surrounding building development with its character. Work on the project documentation respected all legal regulations concerning of building design. The drawing part has been processed by visualization cad application.

1 Abstract This diploma thesis deals with source administrative acts, which serve as a means of protection of the relevant area of the environment. The term "source administrative act" as used herein denotes various types of acts issued by administrative bodies which are then used as the ground for the final decision in administrative proceedings. The thesis does not focus only on binding source administrative acts, but also on other source acts of lower legal force. The thesis includes a section on the special legal regulation of source acts used in administrative sanctions proceedings. The main source materials for the thesis are the following: legal regulation of this issue currently in force, literature, methodologies of administrative authorities, decisions of administrative courts and the author's own professional experience. The beginning of the work includes the contents and a list of abbreviations. The third chapter contains an introduction where the author presents the reason for choosing the topic of the work, i.e. the frequent use of source administrative acts in the environmental field of public administration and their influence on administrative proceedings.
