Dealing lightly with the wounds of my people : a theological ethical critique of the South African Truth and Reconciliation Commission

This study is an attempt to critique the South African Truth and Reconciliation Commission from a theological ethical perspective. The central critique and argument of this study will be that, it is impossible to reconcile the dispossessor and the dispossessed or the oppressor and oppressed in the way the South African TRC did. As such, it will be befitting to start off this study which explores some of the noticeable lessons and challenges emerging from the South African Truth and Reconciliation Commission (hereafter, the TRC) by elucidating that this study is an attempt to contribute to the on-going discussions on reconciliation. It is also vital to mention up front that this study attempts to contribute to the discussion on reconciliation which seeks to remove injustice at the root. It contributes to a discussion of the weeds of alienation and fragmentation, and it stands in contrast to the frequent use of reconciliation merely to reach some political accommodation and not to address the critical questions of justice, equality and dignity (Boesak & DeYoung 2012). It is also befitting to point out that two central themes – political pietism and Christian quietism – form the backdrop to this study (Boesak & DeYoung 2012). The study contends that reconciliation in South Africa was used merely to reach some political accommodation and did not address the three critical questions of justice, equality and dignity. These arrangements perpetually favour the rich and powerful but deprive the powerless of justice and dignity. Hitherto, this reconciliation is presented as if it does respond to the need for genuine reconciliation and employs a language that sounds like the truth, but it is in fact deceitful – and this we call political pietism. It is also vital to mention that “reconciliation” is a Christian concept, and as such, Christians’ measure matters of reconciliation with the yardstick of the gospel and therefore should know better. However, as it will be shown in this study, when Christians in South Africa discovered that the TRC was not really promoting reconciliation, they became complicit in a deceitful reconciliation. This may have been for reasons of self-protection, fear or a desire for acceptance by the powers that govern the world. Whichever way one looks at it, they tried to seek to accommodate the situation, to justify it and to refuse to run the risk of challenge and prophetic truth telling. As a result, they denied the demands of the gospel and refused solidarity with the powerless and oppressed. This is called Christian quietism (Boesak & DeYoung 2012:1). This study in its attempt to critique the South Africa TRC from a theological ethical perspective will point out that, the TRC which was obviously the product of the negotiated settlement needs to be understood against the background of the global struggle of particularly Third-World countries which were resisting authoritarian regimes put in place by the West for the benefit of the West. As such, this study will point out how the West, in their attempt to keep a grip on the Third-World countries – particularly on their resources – had to recommend and promote their notion of democracy. Democracy became the only option for Third-World countries as a result of the fall of the Soviet Union. It must, however, be mentioned that the problem is not democracy but the manifestation thereof under capitalism. This is because the notion of democracy was recommended to Third-World countries when capitalism was becoming global. As such, this presented some contradictions because democracy emphasizes joint interests, equality and common loyalties whilst capitalism is based on self-seeking inequality and conflicting individual and group interest (Terriblanche 2002). This means that a transition to democracy (especially constitutional democracy) means that the former oppressor or dispossessor will hold on to economic power. As such, the sudden interest of both the NP and the corporate sector in South Africa to a transition to democracy needs to be understood against this background. This study will argue and demonstrate how the ANC was outsmarted during the negotiations in that, at the formal negotiations, the ANC won political power whilst the NP/corporate sector in South Africa won economic power. This is mentioned to here to point out that both the elite compromise reached at the formal and informal negotiations and the influence of the Latin-American truth commissions led to the inability or unwillingness of the TRC to uncover the truth about systemic exploitation. As such, this study will argue and demonstrate that, on the one hand, reconciliation was not added to the truth commission for the purpose of confronting the country with the demands of the gospel and, on the other hand, the TRC was set up (from its inception) for failure. / Philosophy, Practical and Systematic Theology / D. An evaluation of the use of testamentary and Inter vivos trusts as estate-planning vehicles and the development of holistic estate-planning models involving the use of these trusts

Trusts are subject to multiple fOl1lls of legislative regulation dealing with taxation and governance. Trusts were widely used by planners as taxavoidance shelters. Tax legislation was amended to subject trusts, other than special trusts as defined, to the highest income tax rate of forty percent, in tel1llS of section 5(2) of the Income Tax Act, 58 of 1962. The inter vivos trust is also subject to a wide range of anti-avoidance measures, including those contained in sub-sections (3) to (8) of section 7 of the Income Tax Act and Part X of the Eighth Schedule to the Act, as well as the general anti -avoidance measures in section 103. These measures impact negatively on the use of trusts for estate-planning purposes. The research objective was to evaluate the use of testamentary and inter vivos trusts for estate-planning purposes and to develop a holistic estate-planniD.g model incorporating these planning instruments. Both the testamentary trust and the inter vivos trust were evaluated against broad principles of effective estate planning and the taxes and duties applicable to them. The research also reviewed the writings of financial planners on various techniques and models used for estate planning, as wells as case studies documented in the literature. The research developed and evaluated holistic estate-planning models incorporating testamentary trusts and inter vivos trusts, respectively. By neutralizing the effects of various taxes and duties, it was demonstrated that it is possible to develop an estate plan that satisfies most of the requirements of effective estate planning.

Delegering av flaggstatsskyldigheter : Hur påverkas sjösäkerheten av flaggstatens delegering av skyldigheter till klassificeringssällskap?

Arbetet har syftat till att undersöka och problematisera flaggstatens och klassificeringssällskapens roller såsom kontrollfunktion avseende sjösäkerhet. Frågor har ställts angående vilka skyldigheter flaggstater å ena sidan, och klassificeringssällskap å andra sidan, har vad gäller fartygskonstruktion och fartygssäkerhet. Vidare har arbetet även behandlat frågan vilka sjösäkerhetsrelaterade effekter som kan uppkomma av att flaggstaten delegerar skyldigheter avseende konstruktion till klassificeringssällskap. För att besvara frågorna har en kvalitativ dokumentstudie gjorts, med vissa inslag av rättsdogmatik i de delar som avsett finna gällande rätt på området. Materialet för dokumentstudiens del har till stor del valts ut genom en bred sökning i litteratur och avhandlingar på området. På så vis har det använda materialet redan genomgått en urvalsprocess och därmed ansetts vara relevant för arbetet. Resultatet visar att det finns en viss överlappning i kontrollfunktionsrollen för både flaggstaten och klassificeringssällskapen. Att delegering av skyldigheter sker från flaggstaten till klassificeringssällskapen är inte nödvändigtvis problematiskt. Dock kan en delegering få negativa effekter på sjösäkerheten i de fall klassificeringssällskapen inte är i paritet med flaggstaten eller båda parter saknar en effektiv kontrollfunktion med högt ställda krav. Skulle delegering ske till ett klassificeringssällskap som har en god kontrollfunktion med höga krav kan brister som finns inom flaggstaten, såsom bristande resurser och kompetens, avhjälpas. Trots att systemet till stor del verkar fungera tillfredsställande finns anledning att fortsätta forska inom området för att undersöka hur de problem som belysts i detta arbete kan åtgärdas eller förhindras i framtiden. / The aim of this paper has been to investigate and problematize the roles of the flag state and the classification societies in regard to their maritime safety control function. Questions have been raised regarding what obligations flag states on one hand, and classification societies on the other hand, have regarding ship construction and ship safety. Furthermore, the paper has also addressed the question of what maritime safety-related effects may arise from the flag state delegating their duties to classification societies. To answer the questions, a qualitative document study has been conducted, with some elements of legal dogmatics in certain parts in order to find the current legal situation. The material for the document study has been selected by thorough research into literature and dissertations in the area. Therefore, the chosen material has been previously reviewed and gone through a selection process and was thus considered relevant for this paper. The result has shown that there is some overlap in the control function for both the flag state and the classification societies. Delegating obligations from the flag state to the classification societies is not necessarily problematic. However, delegation of the said duties can have negative effects on maritime safety in cases where the classification societies are not on par with the flag state or both parties lack an effective control apparatus to enforce high standards. Should delegation occur to a classification society that has a good control apparatus with high requirements, possible shortcomings that exist within the flag state, such as lack of resources and skills, can be remedied by the high standard performance of the classification society. Even though the system might seem satisfactorily at first glance, there is room for further research in the area in order to investigate how the existing problems can be managed and prevented in the future.

Communicative strategies used by witnesses of the Leon and Phumaphi Commissions of Enquiry in Lesotho

Text in English with summaries in English, South Sotho and Xhosa / Bibliography: leaves 196-215 / This study explored the communicative strategies which were used by participants who were called in as witnesses before the Leon Commission and the Phumaphi Commission of Enquiry in Lesotho in 1998 and 2015 respectively. The study specifically looked into the types of communicative strategies employed, their linguistic realisations and their conversational effectiveness in providing required information to the commissions. It further compared the use of strategies by participants in both commissions. Data for this study was obtained from twenty-six audio recordings of twenty-six witnesses. The study established that participants used twelve types of communicative strategies which are classified under the following groups based on their functional characteristics: conversational category which includes strategies such as code-switching, fillers, vague language and circumlocution; a grammatical category that comprises personal pronouns, direct speech, passive voice and questioning; a sociocultural category that covers strategies such as figurative language, indirect communication, direct refusal and indirect criticism. The study established that communicative strategies such as code-switching, fillers, personal pronouns, and direct quoting were conversationally effective as participants strategically employed them to succinctly express themselves. However, strategies with concealing attributes such as those found under a sociocultural category and those under the grammatical category (passive voice and questioning) were considered conversationally ineffective as they withheld required information from the commissioners.
