Význam výpočetní techniky v procesu edukace žáků a studentů se zrakovým postižením / The Importance of Information Communications Technology for Pupils and Students with a Visual Disability in the Educational Process

My dissertation thesis deals with information and communication technologies in the context of education and their impact on the subsequent quality of life of individuals with sight impairment. The work shows that it appears essential to provide pupils and students with impaired sight not only with the standard volume of knowledge, but also with specific and social skills and competences which will become a tool compensating their impaired sight handicap. The objective of the practical section of my thesis consists in determining the specifics of the process of instruction of pupils and students with sight impairment focussed on information technologies and in comparing the acquired data with research results aimed at the majority population of pupils and students. The said issues were analysed using the quantitative procedure of questionnaire research and evaluated under the application of frequency statistics. The testing of hypotheses was based on the Chi-square independence test. The research also incorporated the target group of parents of pupils with sight impairment and their teachers. Significant factors affecting the optimisation of the education and instruction process as a whole in the above mentioned target groups were determined and compared. Based on the acquired data and their statistic evaluation I succeeded to prove a significant correlation between the level of acquired competences in the field of information and communication technologies and the level of sight impairment. The results of the empiric section also suggest that the education of students with impaired sight within the mainstream educational process shows considerable reserves as compared with the educational process applied in special schools for pupils with a health handicap. The theoretical section of my thesis is divided into three chapters focussed on the conceptual and material specification and definition of the problem. The introductory chapter deals with the theoretical issues of sight impairment and the individuals with this type of handicap. The second chapter presents the system of the education of pupils and students with impaired sight and the concluding chapter deals with information and communication technologies as the tools compensating the information deficit in individuals with sight impairment. In co-operation with the Special Educational Centre based in České Budějovice, the results of my dissertation thesis will present the basis of recommendations targeted at an optimised formation of specific skills and competences in pupils with impaired sight educated within the mainstream educational process. The theoretical output of my thesis will result in study materials for the branch of specific educational studies in the Faculty of Health Care and Social Studies of the University of South Bohemia.

Contribuição ao estudo das medidas compensatórias em direito ambiental / Contribution to the study of compensatory measures in environmental law

Este trabalho estuda o instituto das medidas compensatórias como uma nova obrigação imposta pelo direito aos empreendimentos com potencial de causar impactos negativos ao meio ambiente. A pesquisa do tema se deu de forma crítica, enfrentando as contradições do sistema econômico vigente. Verificou-se que as medidas compensatórias emergiram da mais evidente crise ambiental ou à crescente escassez dos recursos naturais, buscando, ao mesmo tempo, a proteção ambiental e a manutenção do sistema de mercado. Procurando a melhor funcionalidade das medidas, pretendeu-se demonstrar que elas não se equiparam a uma forma de reparação por dano futuro, tampouco se enquadram necessariamente em uma espécie tributária; podem, como quis o Supremo Tribunal Federal, ser chamadas de compartilhamento de despesas entre o Poder Público e os empreendedores pelos custos da utilização dos recursos naturais no processo produtivo. Na verdade, em razão de serem dotadas das características da transversalidade e da interdisciplinaridade, as medidas compensatórias apresentam-se com diversas facetas, podendo mostrar características predominantes de mecanismos de comando e controle, como também de instrumentos econômicos. Assim, concluiu-se nesta tese ser um instituto híbrido, não enquadrável em uma categoria jurídica estanque. Verificou-se, ainda, ser necessária uma análise estrutural a fim de serem eficazes. Nesse sentido, propôs-se a sua instituição por normas primárias, nas quais se fixem padrões mínimos e com critérios objetivos de aplicação. Para tanto concluir, o estudo partiu dos debates já travados, tanto pela jurisprudência quanto pela doutrina, acerca da constitucionalidade, metodologia de cálculo e natureza jurídica de uma das medidas compensatórias, chamada compensação ambiental, instituída pela Lei nº 9.985/2000 (Lei do Sistema Nacional de Unidades de Conservação-SNUC). A partir daí, buscou-se demonstrar o processo subjacente à edição de normas ambientais, recaindo nos princípios do Direito Ambiental, dentre eles o importante princípio do poluidor-pagador, cuja premissa é internalizar os custos pela utilização dos recursos naturais no processo produtivo, para não serem assumidos pelo Poder Público e por toda a coletividade. Ainda, buscou-se diferenciar os conceitos de dano ambiental e de impacto negativo ao meio ambiente, porquanto as medidas compensatórias visam a compensar o meio ambiente pelos impactos negativos, significando uma perda aceita, prevista e gerenciada; o dano ambiental, por sua vez, é algo intolerável, indesejado e, por isso, objeto de reparação civil objetiva, de responsabilidade administrativa e, ainda, da penalização criminal / This paper studies the institution of compensatory measures, considered as a new obligation imposed by law for projects with the potential to cause adverse environmental impacts. The theme was investigated critically, facing the contradictions of the current economic system. In this regard, we verified compensatory measures instituted to cope with an increasingly apparent environmental crisis and the growing shortage of natural resources, while seeking environmental protection and maintenance of the market. In the search for a better functionality of the measures, we sought to demonstrate that they do not represent a form of compensation for future damages, nor do they necessarily fall within the range of any legitimate taxation. In fact, these measures were adopted by the Supreme Court more as a sharing of costs between government and entrepreneurs for the use of natural resources in the production process. Fundamentally, the compensatory measures of this instrument, equipped with characteristics of transversality and interdisciplinarity, present different aspects, which can deploy features to carry out command and control mechanisms, as well as economic instruments. Our thesis has therefore led us to the conclusion that this instrument is not readily classifiable under any isolated legal category, and should be looked upon as a hybrid mechanism. Nevertheless, we considered that a structural analysis was necessary to ensure the effectiveness of the measures. In this respect, we proposed it be instituted on primary norms, with the establishment of minimum standards and objective application criteria. This required starting with debates conducted in jurisprudence and doctrine over the constitutionality, method of calculation, and legal nature of a compensatory measure called environmental compensation, established by Law No. 9.985/2000 (Law of the National System of Conservation Units, SNUC). From there, we sought to demonstrate the process behind the issuing of environmental standards falling within the principles of environmental law; among which the important polluter pays principle, which is premised on the environmental externalities of economic activities that use natural resources, and prevents that pollution costs be borne by Government and, ultimately, by the whole community. We went on by delimiting the concepts of environmental damage and negative environmental impact, considering that compensatory measures aim at providing compensation for adverse impacts, which signify accepted, provided and managed losses. Environmental damage, in turn, is something unacceptable and undesirable, and must therefore be subject to civil liability, as well as criminal penalties.

L'objectif de cette thèse est d'étudier l'interdépendance des ressources scolaires et des ressources individuelles dans la production du capital humain. À travers trois cas d'études sur données françaises, différentes méthodes sont proposées pour analyser l'effet des politiques éducatives tout en tenant compte des comportements des individus. Le premier chapitre montre que les politiques d'éducation prioritaire sont susceptibles de conduire les familles, notamment les plus avantagées socialement, à contourner les établissements traités. Ces stratégies d'évitement sont de nature à contrebalancer les effets des moyens supplémentaires sur les résultats des élèves. Le deuxième chapitre cherche à savoir si les choix d'orientation des élèves sont contraints par J'offre scolaire locale. Nous montrons que l'ouverture d'un nouveau lycée augmente la proportion d'élèves qui poursuivent leurs études dans le second cycle, notamment en voie professionnelle. Enfin, le troisième chapitre montre que les étudiants tiennent compte de l'information contemporaine dont ils disposent sur leurs notes lorsqu'ils évaluent les qualités pédagogiques de leurs enseignants. / The main objective of this thesis is to study the interdependence of school resources and individual resources in human capital production. In three empirical analyses using French data, various methods arc proposed to evaluate the impact of educational policies, taking individual behaviors into account. The first chapter shows that compensatory education policies may result in individual sorting. The fact that socially more advantaged families tend to avoid treated schools cancels out additional resources positive effects on academic achievement. The second chapter examines whether pupils are constrained by local school supply. We find that opening a new high school increases the proportion of pupils who continue in upper secondary education, particularly in a vocational track. Studying how students evaluate teaching, the third chapter shows that they take contemporaneous information about their grades into account when they evaluate teachers' pedagogical qualities.

The premise of this thesis is that "learning", particularly in terms of students and universities, is capable of being seen as a specific and developed culture. This study is a contribution to the ethnography of that learning, the ultimate aim being to produce a descriptive theory of learning as a cultural system. This research was conducted within the context of the recent proposals made by the South African Commission on Higher Education. The proposals relevant to this study were, broadly, increased access to higher education and national funding for academic staff development programmes. There are, however, serious obstacles in the way of realising the aims of the higher education system outlined by the NCHE. Given the limited time and resources available for higher education development, it is imperative that the major flaws and obstacles in the system be identified and addressed as soon as possible. In view of this need, it was the concern of this study to conduct research which would assist in the designing of staff development programmes for academics teaching in English-medium tertiary institutions, like Rhodes University, where more than half the intake of first-year students already speaks English as a second, or other, language. Founded on the social constructionist view of knowledge, the aim of the study was to identify the needs of academic staff as well as the possible obstacles to the implementation of a "Language Across the Curriculum" policy. A genre-centred, ethnographic approach was used to access a disciplinary discourse community (the Psychology Department) in order to describe the practices of the community as well as to analyse the community's orders of discourse, particularly those which occurred at points of contact between lecturers and first-year students. It is argued that staff development programmes should promote the use of collaborative learning, which implies a reframing of the roles of both academic staff and students.

This dissertation, entitled "Invalid Termination of Employment, and Related Consequences", aims to provide a comprehensive look into the issue of invalid employment termination by giving notice, immediately terminating an employment, or the employer cancelling employment during a trial period, and of the related consequences. The dissertation is divided into three main chapters. The first chapter briefly characterizes employment as a special private relationship, and industrial conduct as a legal fact which results in establishing, altering, and terminating employment. Special attention is paid to the individual aspects of industrial conduct whose fulfilment is a prerequisite for perfect industrial conduct. The second chapter focuses on the consequences of faults in industrial conduct, intending mainly to alert the reader to the necessity of differentiating between seemingly legal conduct and invalid legal conduct. Le droit des règlements pécuniaires entre époux consécutifs au divorce a pendant longtemps été fondé sur l’idée de sanctionner le conjoint responsable de la rupture que ce soit en France, au Canada ou dans la province canadienne de Québec. Bien que de traditions juridiques différentes, les droits français et canadien reconnaissaient ainsi un rôle central à la faute dans leur droit du divorce. Face à l’évolution concomitante des sociétés française et canadienne vers un individualisme plus marqué et une volonté croissante de pacifier les conflits, ces droits ont dû tendre vers une plus grande objectivation du divorce et de ces conséquences. Parallèlement à un mouvement de quasi-disparition de la faute, de nouvelles institutions sont apparues dans les droits étudiés, institutions fondées sur des idées de compensation, d’équité mais aussi de solidarité avec la survie ou l’apparition d’obligations alimentaires. Aujourd’hui, les droits étudiés sont marqués par une diversité d’institutions avec pour certaines des fondements multiples et des intitulés qui, malgré la différence de tradition juridique, peuvent se répondre comme, par exemple, la pension alimentaire non compensatoire canadienne qui n’est pas sans rappeler la prestation compensatoire que nous qualifions d’alimentaire française. Cette diversité amène alors à s’interroger sur la nécessité de repenser et de rationaliser les institutions existantes pour les rendre tout à la fois plus compréhensibles mais aussi plus accessibles par les futurs ex-époux. Cette simplification doit en effet s’accompagner d’une plus grande liberté contractuelle permettant aux conjoints divorcés de se réapproprier leur séparation avec l’aide d’un avocat, d’un médiateur ou encore du juge. Le divorce pacifié, se pose alors la question de la pacification de la rupture des autres couples que sont les unions libres ou encore les PACS et union civile. Ces unions hors mariage se développant, il est nécessaire aujourd’hui de prendre en considération les conséquences de leur dissolution voire d’envisager un droit commun des règlements pécuniaires consécutifs à toute séparation. / Historically post-divorce laws between spouses was based in France, Canada and Quebec on penalizing the responsible party of the separation. Although from different law traditions, Canadian and French law recognized an important place to the fault in their divorce laws. However, the tendency of the French and Canadian societies to be more individual and to pacify conflicts, divorce law had to change to become more objectivized. The movement of removing the fault in divorce permitted the creation of new institutions based on compensation, equity and solidarity which is symbolized by spousal support and alimony. The studied laws are characterized by diverse institutions, are founded on different grounds. These institutions inspired by different law traditions are thus very similar such as the Canadian on compensatory spousal support and the French compensatory obligation that we call "alimony compensatory obligation". This diversity impose us to think about the possibility of a renewal and rationalization of the existent institutions in order to be simplified and comprehensible for the future divorce spouses. A greater freedom of contract should also ensure the appropriation of the divorce's consequences by the divorced spouse with help of lawyers, mediators and judges. Once the divorce humanized, the question of the pacification of the dissolution/ ruptures of other types of union such as common law marriage or civil partnership. The increasing number of those new couples, it is becoming a necessity to take in consideration the consequences of their dissolution and draw a new common law for their dissolution.

Neurodégénérescence et processus compensatoires dans le cerveau des rongeurs après lésion du système dopaminergique nigro-striée et effets de la stimulation à haute fréquence du noyau sous-thalamique

Les processus compensatoires qui accompagnent les atteintes du système dopaminergique (DA-ergic) nigrostrié illustrent les capacités adaptatives du cerveau adulte. Cette neuroplasticité permet le maintien de la transmission dopaminergique pendant un certain temps de sorte que les symptômes moteurs cardinaux de la Maladie de Parkinson (MP), qui se caractérise par une dégénérescence progressive des neurones DA-ergiques de la substantia nigra (SN), ne se manifestent qu'après une perte neuronale très importante. De ce fait, le diagnostic présymptomatique est une question cruciale pour le développement de traitements neuroprotecteurs. Un autre exemple de neuroplasticité est illustré par la production de nouveaux neurones dans le cerveau adulte (neurogenèse adulte). Cette neurogenèse s’observe principalement dans deux zones: le continuum zone sous-ventriculaire (SVZ)-bulbe olfactif (OB) et le gyrus denté (DG) de l'hippocampe, et se trouve altérée chez les patients parkinsoniens. Ces dernières années, le traitement chirurgical par la stimulation à haute fréquence (SHF) du noyau sous-thalamique (NST) s'est avéré être une option thérapeutique très efficace pour ces patients. Dans ce contexte, mon travail de thèse a été axé sur l’étude de la neuroplasticité dans différents modèles de la maladie de Parkinson et de son traitement avec les objectifs principaux: 1) Développer un modèle de MP présymptomatique; 2) étudier les mécanismes compensatoires impliquant le système nigrostrié; 3) Déterminer les effets de la SHF-NST sur la neurogenèse adulte dans la SVZ-OB et le DG.Dans la première étude, nous avons développé des modèles expérimentaux de la MP à différents stades, basés sur l’administration de MPTP chez la souris. Nous avons montré que le passage du stade avancé présymptomatique au stade symptomatique précoce correspondant au seuil d’atteinte des systèmes DA-ergiques associé à l’apparition des déficits moteurs, se caractérise par : (a) une diminution de DA dans les terminaisons striatales épargnées par la lésion; (b) une augmentation de DA et d’expression de la tyrosine hydroxylase dans les cellules de la SN; (c) une augmentation du renouvellement de la DA dans le striatum et une augmentation moindre dans la SN.La deuxième étude est basée sur un modèle de lésion DA-ergique extensive par injection intranigrale de 6-hydroxydopamine chez le rat, imitant les stades tardifs de la MP. Nous avons étudié séparément les étapes de prolifération et de survie des nouvelles cellules sur des animaux non lésés et des animaux lésés avec ou sans SHF subchronique (8 jours) du NST. Nous avons pu montrer une régulation spécifique des étapes de prolifération et de survie suite à la lésion dopaminergique, et des effets stimulateurs de la SHF du NST sur la survie des cellules néoformées, suggérant un effet neuroprotecteur de ce traitement. / The compensatory processes that accompany a lesion of the nigrostriatal dopaminergic (DA-ergic) system serve to maintain its function and illustrate adult brain neuroplasticity. The typical motor symptoms of Parkinson’s diseases (PD), characterized by progressive degeneration of DA-ergic neurons of substantia nigra (SN), appear only after substantial neuronal loss. Therefore presymptomatic diagnosis is a crucial issue for future neuroprotective therapies. Another good manifestation of neuroplasticity is adult neurogenesis, known to persist in two areas: the subventricular zone (SVZ) – the olfactory bulb (OB) continuum, and the dentate gyrus (DG) of the hippocampus, and to be altered in PD. In recent years, the surgical treatment by high frequency stimulation (HFS) of the subthalamic nucleus (STN) has proven to be an efficient therapeutic option for PD patients. In this context, my PhD work was focused on neuroplasticity under the functional deficiency of the nigrostriatal DA-ergic system (parkinsonism) and its treatment with the following main objectives: 1 - Develop a model of presymptomatic parkinsonism; 2 - study compensatory mechanisms in nigrostriatal system; 3 - Characterize the effects of subchronic STN HFS on adult neurogenesis. In the first part, we have developed models of presymptomatic parkinsonism based on MPTP administration in mice, as defined by sub-threshold DA depletion and degeneration of DA-ergic axons in the striatum followed by a loss of DA-ergic cell bodies in the SN (advanced presymptomatic stage). In the early symptomatic stage, these parameters reach a threshold that is associated with the appearance of motor deficiency. We have shown that the transition from the advanced presymptomatic stage to the early symptomatic stage is characterized by: (a) a decrease of DA content in surviving DA-ergic axons in the striatum; (b) an increase of DA content and TH-expression in surviving neuronal cell bodies in the SN; (c) an increase of DA turnover in the striatum and much less increase in the SN. The last part of my work is based on extensive DA lesion in rats, using intranigral 6-hydroxydopamine injection mimicking late PD stages, to determine a possible effect of STN-HFS on adult neurogenesis. We have completed series of animals with DA lesion either sham implanted or subsequently treated for 8 days by STN-HFS to be compared with unlesioned rats, and studied selective phases of neurogenesis: proliferation and survival. This study demonstrates selective regulation of cell proliferation and survival following DA depletion and provides the first evidence that prolonged STN-HFS might have a neuroprotective action as shown by the selective increase in survival of newly formed cells following this treatment.

Consonant gemination in West Greenlandic

Ce mémoire analyse, à l’aide du Sérialisme Harmonique, un processus de gémination consonantique s’opérant à travers des frontières de morphème en groenlandais de l’ouest. Une partie intégrante de cette analyse se base sur les restrictions sur les formes de surface des consonnes géminées et le comportement général des consonnes chez les frontières de morphème. Le processus de gémination discuté implique l’assimilation consonantique régressive quand un affixe qui commence par une consonne se rattache à un stem qui se termine par une consonne. Un processus d’effacement consonantique en fin de stem s’opère dans le même contexte. Ces deux processus empêchent des groupes consonantiques d’apparaître dans des représentations de surface. Bien que la distribution de ces processus ne soit pas évidente, cette analyse propose une explication basée sur des mores flottantes qui déclenchent l’assimilation. En outre, l’analyse implémente une série d’opérations qui imposent des restrictions sur les représentations de surface des consonne géminées et établit une relation formelle entre ces représentations et leur position dans un morphème. L’objectif de ce mémoire est de proposer un exemple de comment une analyse plus moderne et unifiée de la grammaire du groenlandais pourrait être accomplie par le Sérialisme Harmonique. Alors que la majorité des travaux antérieurs sur la phonologie groenlandaise sont entièrement descriptifs ou impliquent des règles de réécriture ne pouvant pas être formellement reliées, ce mémoire suggère une approche à l’aide d’un cadre théorique sérial et basé sur des contraintes comme une option viable. / This thesis proposes an analysis in Harmonic Serialism of a cross-morpheme consonant gemination process in West Greenlandic. Central considerations to the analysis are surface restrictions on geminate consonants as well as general consonant behavior at morpheme boundaries. The gemination process at hand involves regressive consonant assimilation when a consonant-initial affix is introduced to consonant-final stem. This operates alongside a process of stem-final consonant deletion, with both processes serving as mutually exclusive strategies to prevent heterorganic consonant clusters from surfacing in West Greenlandic. While the distribution of these processes is not surface-apparent, it is explained through the proposal of unattached moras that function as triggers for assimilation. Additionally, the analysis implements a set of operations that impose restrictions on the output forms of geminate consonants and establishes a formal relationship between these output forms and their position within a morpheme. The objective of this thesis is to propose an example of how a more modern, unified analysis of West Greenlandic grammar could be modeled in Harmonic Serialism. While the majority of earlier works on West Greenlandic phonology are either purely descriptive in nature or involve rewrite rules that cannot share a formal relation or output goal, this thesis proposes an approach within a serial, constraint-based framework as a viable alternative.

The presented study is designed as a comparative theoretical work, comparing two concepts of the approach to the education of children from socio-culturally deprivational background, with a focus on pupils with different mother tongues. The countries, whose educational systems are compared, are selected on the basis of my longterm pedagogical experience - France and the Czech Republic. The work detects the development of pro-inclusive measures in the school systems of both countries, the development and comparison of existing legislative measures, and together with a research probe within this education and examples of practice from the French allophone education has the potential to give a comprehensive picture of this educational domain. The presented material aims to support the discussion in the field of education of children - pupils and students with different mother tongues - in the Czech Republic.

Title: Influence of guide dog ownership on physical activity and quality of life of people with visual impairments Objectives: The main objective of the thesis was to examine differences in quality of life and volume of physical activity in persons with visual impairments who own/do not own a guide dog. Methods: It is theoretically empirical work. A quantitative form of questioning was used for the research part of this thesis. The method chosen for data collection was the standardised IPAQ questionnaire and the revised SF-36 questionnaire. The research group consisted of people with visual impairments who own/do not own guide dogs. The survey involved 15 people with visual impairments (7 women, 8 men), out of this number 8 respondents own a guide dog (5 women, 3 men) and 7 respondents do not own a guide dog (3 women, 4 men). The average age of respondents with a guide dog was - women 32 years, men 31 years. In respondents without a dog - women 32 years, males 38 years. Results: The results showed up to twice the time devoted to regular physical activity in a group of visually impaired individuals who own a guide dog, compared to individuals without a dog.
