Förutsättningar för vägledning

Syftet med denna uppsats är att beskriva och analysera vilka förutsättningar studie- och yrkesvägledare på språkintroduktionsprogram har för det individuella vägledningssamtalet. Utifrån detta utformades följande frågeställningar: vilka är vägledarnas förutsättningar för det individuella vägledningssamtalet med elever med annan kulturell bakgrund? Hur arbetar studie- och yrkesvägledaren med det individuella samtalet för att stötta eleverna i studie- och yrkesvalsprocessen? För att besvara uppsatsens frågeställningar använde vi oss av en kvalitativ metod och genomförde sex intervjuer med studie- och yrkesvägledare på språkintroduktionsprogram. Tidigare forskning visar att vägledningssamtal utgör en central funktion för studie- och yrkesvägledning och är den plats där framtidsfrågor ges utrymme. Studie- och yrkesval för elever med annan kulturell bakgrund kan innebära utmaningar då eleverna befinner sig i en ny kontext samt kan sakna kunskap om utbildning och arbetsmarknad. För att analysera vägledarnas förutsättningar och hur de arbetar med det vägledande samtalet används begreppen habitus, fält och kapital från Bourdieus sociologiska teori. Begreppet handlingshorisont från Hodkinson och Sparkes careership theory och begreppet levnadsrum från Peavys konstruktivistiska vägledning används även vid analys av empirin. Studien visar att de intervjuade vägledarna trots varierande förutsättningar, arbetar kompensatoriskt genom att informera om utbildning och arbetsmarknad samt samarbetar med andra aktörer i det vägledande samtalet. / Due to the increased cultural differences in schools across Sweden, it has been argued that there is a clash of how different guidance counselors work with language introductory programs. Accordingly, the purpose of this paper is to describe and analyze the prerequisites of guidance counselors in such programs with a focus on individual guidance consultation. The paper adds knowledge to previous research that suggest that consultations are key in the guidance of career and study for individuals coming from abroad. This is because study and career choices for students with different cultural backgrounds can be challenging as students are included in a new context and lacks knowledge about education and the labor market in Sweden. Conducting six interviews with guidance counselors on language introduction programs in Scania region of Sweden, this paper analyzes, using the concepts of action horizon from Hodkinson and Sparkes careership theory and living space from Peavy's constructivist how they work with the guiding conversations, as well as the concepts of habitus, fields and capital drawing on Bourdieu's sociological theory. The study shows that the interviewed guidance counselors, despite different and equal conditions, work compen-satory by informing about education and the labor market and cooperating with other actors in the guiding conversation.

Examination of potential elicitors of operant and respondent behaviors in smokers

Research on operant learning principles suggests that discriminative stimuli, and negative and positive reinforcement play a role in the maintenance of smoking behavior. Smoking research from a respondent learning paradigm focuses on the role of environmental stimuli that function as elicitors of physiological responses related to smoking. Basic research suggests that compensatory responses may play a role in drug tolerance and relapse. In one preliminary study assessing the role of compensatory responses to smoking stimuli (Machado, 2011), drops in carbon monoxide (CO) were observed only when smokers viewed smoking related stimuli. However, it is possible that these patterns were influenced by CO monitor sensitivity to differing exhalation durations in which exhalation duration may have been under stimulus control of the smoking stimuli. The purpose of the current study was twofold: Study 1 controlled for exhalation duration by holding exhalation duration constant using a within subject design and Study 2 precisely measured but did not control total exhalation duration in an attempt to replicate the results from Machado (2011). Results from Study 1 did not support the presence of compensatory responses in smokers; results from Study 2 did not support the presence of operantly maintained exhalation durations. Study limitations, implications and future directions are discussed.

Spatial ecology and demography of eastern coyotes (Canis latrans) in western Virginia

Coyote (Canis latrans) range expansion in the Central Appalachian Mountains has stimulated interest in ecology of this predator and potential impacts to prey populations. This is particularly true in the Ridge and Valley Region in western Virginia where white-tailed deer (Odocoileus virginianus) populations are restricted by low nutritional carrying capacity and are subject to two other predators, bobcats (Lynx rufus) and American black bears (Ursus americanus), in addition to an active hunter community. I address two primary objectives of the Virginia Appalachian Coyote Study: to investigate 1) spatial ecology and 2) population dynamics of coyote populations in Bath and Rockingham counties. I deployed 21 GPS satellite collars on 19 coyotes over 32 months. I estimated home range size (mean = 13.46 km², range = 1.23 km² - 38.24 km²) across months using biased-random bridges and second-order habitat selection at four scales using eigenanalysis of selection ratios. I developed a metric to classify social status of individuals as either resident or transient based on stability of home range centers over time. I found evidence for class substructure for selection of territories where adult residents had a higher probability of mortality in high productivity/high risk habitats, compared to subadults and transients that were restricted to less productive habitats. I collected scat samples over five scat surveys across 2.5 years and extracted fecal DNA to identify individual coyotes in a mark-recapture framework. I estimated coyote densities in Bath (5.53 – 9.04 coyotes/100 km²) and Rockingham Counties (2.41 – 8.53 coyotes/100 km²) using a spatial capture-recapture model. Six-month apparent survival was lower in Bath County (Φ<sub>Bath</sub> = 0.442, 0.259 – 0.643; Φ<sub>Rockingham</sub> = 0.863, 0.269 – 0.991). The Bath County population demonstrated persistence despite high mortality and the Rockingham population demonstrated boundedness with recruitment inverse of changes in density. Findings at both sites suggest density-dependence, and tests of territoriality, presence of transients, and territory turnover demonstrate a capacity for immediate local immigration in response to high mortality in Bath County. I suggest that landscape-level habitat management may be a viable strategy to reduce potential conflicts with coyotes in the region. / Ph. D.

In this study, the promotion of self-actualisation of milieu disadvantaged children within a multi-cultural education system is discussed from a psychological-educational perspective. Attention is given to the problems and issues that play a defining role in the implementation of such an educational system. The influence of the environment en the development and functioning of milieu disadvantaged learners is investigated further. Qualitative research is done to identify the developmental areas where most problems occur. Finally, recommendations are made to the government, teachers and parents that ~an serve as guidelines to promote the selfactualisation of these learners. / Die bevordering van multikulturele onderwys en die opheffing van die milieu-geremde leerder hou nou verband met mekaar, en is tans 'n belangrike vraagstuk in die Suid-Afrikaanse onderwyssisteem. Fossilization : a case study of an adult learner

Linguistic fossilization is a prevalent phenomenon in adult ESLA and presents a perpetual pedagogical challenge to teachers. Despite controversy about the theoretical concept, research is increasingly showing that persistent erroneousness cannot be attributed to single causal factors. This single case study examines controversial aspects surrounding the concept and formulates criteria for identifying fossilization. The study investigates the conversational output of an independent adult learner over a period of nine months and presents a holistic exploration of causal influences. The findings substantiate that fossilization arises from changing combinations of factors, and that such combinations are unique to the situation of each adult learner. The key to the successful treatment of fossilized errors may lie in identifying their roots, which can be achieved by analyzing output and through discussion with learners in order to gain insight into their experience of the learning process. 本文旨在探討專利侵權損害賠償請求之範圍及賠償數額之計算方法,以我國法律規定及實務運作情形為主,並比較美國、中國大陸的規定及實務運作情形,尤其智慧財產法院自97年7月1日成立後,其在損害賠償方面之實務見解是否比過去數十年的實務運作有更創新之看法,茲為我國將來專利法修法之參考,並與實務運作相互印證。第一章緒論,說明研究背景與動機,研究目的、研究方法及流程。第二章說明專利權之定義、種類,專利侵害之類型,專利鑑定、步驟、原則及我國的專利損害賠償制度。第三章則專以損害賠償額計算之規定及實務判決研究為主,並兼論及非財產上損害,如信譽損害、律師及其他費用等。第四章比較TRIPS、中國大陸及美國之規定,尤其以美國法及判決為重點,討論我國是否應如美國一樣,增訂合理權利金之條款,又合理權利金之達成是否應在兩造自由意願下簽訂,而不能受到訴訟之威脅。第五章以過去一年來最新成立智慧財產法院判決分析比較,分析是否與之前的實務判決有不同之作法及是否已大幅改善之前實務的缺點,提出個人看法。最後一章則提出本文建議的解決方案或可供臺灣專利法修正草案之參考。 透過本文將可瞭解過去各地方法院關於專利侵權之判決、美國實務判決之立論基礎,並與智慧財產法院成立後之最新出爐判決相互比較,以資作為將來修正專利法之參考建議,並期許智慧財產法院將來在專利侵權訴訟更能保障專利權人之權利,使專利權人獲得應有之賠償,願意投入更多的資金及研發人員,創造有價值的專利,以促進科技發展,造福人類。 關鍵字:專利侵權、智慧財產、損害賠償、所失利益、合理權利金、智慧財產法院 / This study aims to explore the ambit of the patent infringement compensation and the method to calculate the damages award for the patent infringement. This thesis focuses on Taiwan’s patent law and judicial practice, compared to the regulations and practices of TRIPS , the United States, and the mainland China. Besides, with the establishment of the Intellectual Property Court since July 1, 2008 in Taiwan, did this new Taiwan Intellectual Property Court have made more innovative decisions than the past few decades ? Chapter I is the introduction of this study’s background and motivation, research purpose, research methodology and process. Chapter II refers to the definition of the patent right, types of the patent infringement, steps & principles of the patent infringement identification, and our country's patent infringement relief system. Chapter III is dedicated to the calculation of the damages award in the amount based on the provisions and court’s decision, and to deal with non-property damages, such as the reputation damages, legal fees and other costs. Chapter IV compares the regulations and practices of the TRIPS, the United States and the mainland China, in particular the United States court’s decisions.Whether our patent law should adopt the theory of reasonable royalty, as the law or judicial enforcement in the United States? Should a reasonable royalty be based on two parties under the free wills but not by the threat of litigations.Chapter V analyzes the outcomes of the Intellectual Property Court’s rulings in the past one year. Are their rulings different from the past practices? Whether they can greatly avoid the criticisms of the prior practice;Also, I will advance my personal view in this chapter. The final chapter of this thesis will put forward the proposals for the amendment to the Patent Law in Taiwan in the future.This thesis hopes to make you have a basic understanding of the past practices of the district court rulings in Taiwan, the comparisons of the practical theories in the United States, and the latest court rulings released by the Intellectual Property Court, for future reference of the amendment to the patent law.And hope that the Intellectual Property Court could even more protect the rights of patent holders in the future, so that the inventors may obtain adequate compensation, therefore they will be willing to invest more capital in R & D to create more valuable patents for the benefit of the people.
