Le stress dans la salle d’interrogatoire : l’impact associé au stress apparent sur la divulgation d’informations et sur la confessionBélanger, Philippe Léopold 05 1900 (has links)
Jusqu’à présent, le stress en contexte d’interrogatoire policier demeure peu exploré par les chercheurs. Les quelques études empiriques ayant abordé le rôle du stress dans l’interrogatoire se sont principalement penchées sur les fausses confessions induites par le stress (Forrest et al., 2002 ; Geven et al., 2020 ; Guyll et al., 2013 ; Morgan III et al., 2020). Pour ce qui est des facteurs de stress liés à l’interrogatoire, ils sont abordés indirectement dans la littérature et ils sont peu approfondis. Ce mémoire a deux objectifs. Premièrement, déterminer l’impact associé au stress apparent sur la décision des suspects de divulguer des informations pertinentes à l’enquête et d’avouer leur crime. Deuxièmement, déterminer les facteurs qui influencent le stress apparent des suspects. Dans ce but, ce mémoire est basé sur 130 interrogatoires policiers impliquant des individus reconnus coupables pour des délits relatifs à l’exploitation sexuelle d’enfants en ligne. Les résultats indiquent que la décision du suspect de confesser les faits qui lui sont reprochés ou de divulguer de l’information pertinente pour l’enquête n’est pas influencée par son stress apparent. En outre, on constate que peu de facteurs semblent influencer le stress apparent du suspect. Les analyses bivariées révèlent que les stratégies d’interrogatoire l’influencent principalement. Quant à elles, les analyses multivariées mettent en évidence que l’âge du suspect, rappeler les bienfaits de la coopération et mentionner vouloir être honnête ou authentique diminuent le stress apparent du suspect. Inversement, le nombre d’opportunités d’empathie est associé à une augmentation de celui-ci. Bref, il est important de poursuivre la recherche sur le stress en contexte d’interrogatoire policier afin de mieux saisir son effet lors de l’interrogatoire. / To date, stress in the context of police interrogation remains sparsely explored by researchers. The few empirical studies that have investigated the role of stress during police interrogation have primarily focused on stress-induced false confession (Forrest et al., 2002 ; Geven et al., 2020 ; Guyll et al., 2013 ; Morgan III et al., 2020). As for the interrogation-related stressors, they are indirectly addressed in the literature and are poorly elaborated. This thesis has two objectives. First, determine the impact associated with apparent stress on the decision of the suspects to disclose information relevant to the investigation and to confess his crime. Second, determine the factors that influence the suspects’ apparent stress. To this end, this thesis is based on 130 police interrogations involving individuals convicted of offenses relating to online sexual exploitation of children. The results indicate that the suspect’s decision to confess the alleged facts or to disclose information relevant to the investigation is not influenced by his apparent stress. Furthermore, few factors seem to influence the apparent stress of the suspect. Bivariate analysis reveal that interrogation strategies mainly influence it. As for them, the multivariate analysis shows that the suspect’s age, recalling the benefits of cooperation and mentioning the desire to be honest or authentic reduce the suspect’s apparent stress. Conversely, the number of empathy opportunities is associated with an increased of it. In short, it is important to continue the research on stress in the context of police interrogation to better understand its effect during interrogation.

The Effects of Suggestibility, Compliance, and Situational Stress on Miranda Abilities, Waiver Decisions, and False ConfessionsOtal, Tanveer K. 08 1900 (has links)
Miranda abilities, individual characteristics, and contextual factors are critical elements to evaluate in determining the validity of Miranda rights waivers and confessions. Research indicates that many individuals waive their Miranda rights without adequate comprehension or reasoning. In addition, personality characteristics of suggestibility and compliance are key factors influencing waiver decisions. Furthermore, scholars found that situational anxiety likewise impairs Miranda abilities and waiver decisions. Previous research has investigated the effects of Miranda abilities, individual characteristics, and contextual factors on Miranda waivers and confessions by utilizing confession paradigms. A methodological limitation of these paradigms is the lack of volition and autonomy in committing the accused acts of wrongdoings. The current study of undergraduate students advances previous research through examining the detrimental impact of false accusations of wrongdoings committed independently and intentionally using a novel paradigm. This thesis sought to further the understanding of the effects of Miranda abilities (i.e., comprehension and reasoning), personality characteristics (i.e., suggestibility and compliance), and situational factors (i.e., false accusation) in relation to Miranda waivers and confession decisions. The final sample included 87 undergraduate students, of whom approximately 97% waived their rights and 40% falsely confessed to the wrongdoing. The results indicate that Miranda reasoning, suggestibility, and compliance significantly predict the likelihood of false confession. These findings can be used to inform policy changes as well as the evaluations of the validity of Miranda waivers and confessions.

Masvingo Diocese in Zimbabwe towards the Sacrament of Confession prompted this study.
The claim of Zvaiwa (2009) that confession is disappearing while psychology is being used
more, as reflected in the title of his article ―Confession out, psychology in‖, motivated this
research. The objective of the study was therefore, to explore the practical therapeutic value
of the Sacrament of Confession among members of the Catholic Church in Masvingo
Diocese in Zimbabwe. A theoretical and qualitative life narrative study was done from within
a practical pastoral therapeutic perspective of practical theology. The sample of the empirical
study consisted of 30 priests and laypeople in the five deaneries. A lifeline and semistructured
interview instrument was used. A key finding of the study was that the Sacrament
of Confession was not threatened by psychological counselling or psychotherapy. Another
significant finding was that the Catholic Diocese of Masvingo was experiencing a
devaluation of the church‘s pastoral confessional practice among its priests and laypeople.
The study confirmed that the Sacrament of Confession has therapeutic value and spiritual
meaning in the Church. The Sacrament of Confession and psychological counselling or
psychotherapy were found to collaborate as therapeutic disciplines in pastoral therapy. A new
model of therapeutic counselling that embraces spiritual direction through psychological
counselling and reconciliation is proposed. It is rooted in cultural value; spirituality; private
confession followed by prayer and absolution; and change in existential life, to enhance the
pastoral role of the Sacrament of Confession in the Diocese of Masvingo, Zimbabwe. This
model has interdisciplinary elements borrowed from medical, pastoral, psychological and
social research fields. If adopted in the Diocese it would decrease the spiritual indifference

This research aims to investigate the understanding, attitudes and application of Article 4 of the Belhar Confession by Melodi ya Tshwane (MyT). The aim specifically outlines the current mission praxis of MyT and its missionary activities, the church’s missionary calling in line with Article 4 of Belhar , evaluate the extent to which Article 4 of Belhar is applied, and to propose missionary praxis for MyT . The research findings include: participants have a narrow understanding of missions; conducting outreach activities in the form of charity. Some gaps identified include: lack of understanding of God as the missionary God, and a narrow interpretation of justice. Guiding principles on being missional include: missions should be Christ-centred, relational, collaborative, transformational, and lived out in word and deed. Text in German / The impulse for this research comes from the present crisis of the penitential practice within the Roman Catholic communities of Germany, where notwithstanding all pastoral efforts the practice of sacramental confession has dropped to almost nothing. The procedure adopted is based on the method of R. Zerfass.

2nd step: The present research, in the first chapter deals with the New Testament origins of penance and the historical development up to the present time. An essential result attained is the insight that conversion (Mk 1,14 f.) does not consist of a message of doom but urges the audience to pursue the salvation of the reign of God. As a consequence the believer experiences an ethic motivation whereby he takes as orientation the rules of the kingdom of God.
3rd step: The sociological situation of the target group is the topic of chapter two. The study is based on the work of G. Schulze. The central point made by his analysis is the affirmation that people in contemporary society are basically experience orientated and that all opportunities and offers are assessed according to their experiential value. Because of the confusing oversupply of experiences and the avoidance of disappointments caused by unfulfilled expectations homogeneous groups (milieus) emerge. People, in search of experience orient themselves according to these experiences and
shape them in their turn. In the realm (market) of experiences which cannot be controlled supply and demand come together. The supplier who do not follow the laws of the market is ousted because of failing to supply what is demanded.
4th step: In chapter 3 a practical theological theory is developed that present penitential crises is routed in a crises of faith. For this reason an updated pastoral approach to conversion needs to take as its starting point the liberation message of Jesus and at the same time to take into consideration the rules that govern the market, the contemporary segmentation of the milieu included. Thesis (PhD)--Stellenbosch University, 2014. / ENGLISH ABSTRACT: In this study, the researcher studied the Belhar Confession of the Uniting Reformed Church in Southern Africa (URCSA), which gained shape following the social injustices that resulted from the policy of apartheid. The researcher argues that the Belhar Confession, especially Article 4 of the said confession, forces URCSA to establish a Theology of Development within their structures.
While URCSA‟s role (Dutch Reformed Mission Church and the Dutch Reformed Church in Africa pre-1994) during the apartheid era was that of resistance, the church‟s role in a post-apartheid South African context was supposed to change to reconstruction and assistance. But was this the case?
The researcher compared the South African socio-economic context before and after apartheid, and judged whether or not the ANC‟s “better life for all” campaign of 1994 made a significant difference in the post-apartheid South Africa. Did the new constitution make a difference in terms of the socio-economic situation of the country? Did the ANC campaign honour their word and did it result in a better life for all? Although the researcher argued that certain areas did change and differences were achieved, the researcher is convinced that poverty in South Africa is still a real problem – in the country and the rest of the world.
Based upon this judgment, the researcher is of the opinion that given the current socio-economic situation of the country, the Belhar Confession is now more than ever relevant and exactly therefore should be the basis and motivation for the church to serve and be involved in the fight against poverty in South Africa.
This motivation for the church to be involved is also justified according to the Bible. Through this justification and Biblical cry the church is challenged to not only rely on welfare projects in their role as poverty combaters. Here the researcher uses the generation theories of David Korten as support to make it clear that although welfare projects (generation one/two modes of engagement) address the immediate needs of the poor, they do not however address the root of the real poverty problem. The researcher also proposed a third/fourth generation mode of involvement from the church to combat poverty through systemic and asset-based systems and influence policies at various levels of government to address the poverty problem. Yet, even a third/fourth generation approach would not be sufficient on its own. The researcher suggests that the church should simultaneously implement generations 1 to 4 modes of engagement in order to be able to play an active role. Nonetheless, the intriguing questions are, is the church not already doing all of this? What role does Badisa play in all of this? Don‟t local churches, presumably, hide behind Badisa as an answer in their own involvement in the fight against poverty? Even if the church is involved in various modes of engagement, is it Belhar Confession driven?
The researcher is convinced that the church is forced to stay involved in the fight against poverty at all levels. The Belhar Confession is an ecclesial theological response to the poverty and injustice context of South Africa because of the theological content of the confession as well as the context in which it originated. The confession originated in a context of racial segregation, religious apartheid and the theological justification of apartheid as well as large scale socio-political and socio-economical wrongdoing.
Currently, there is still widespread poverty and socio-economic injustice in South Africa that make the Confession of Belhar relevant. Therefore, URCSA cannot help but to be involved because a church that belongs to God and confesses a confession like Belhar is called to stand where God stands, amongst the poor. This means that the church must witness and act against injustice and against all the powerful who selfishly seek only their own interests. / AFRIKAANSE OPSOMMING: In hierdie studie bestudeer die navorser die Verenigende Gereformeerde Kerk in Suider-Afrika (VGKSA) se Belydenis van Belhar, wat beslag gekry het na aanleiding van die sosiale ongeregtighede wat die gevolg van die beleid van apartheid was. Die navorser argumenteer dat die Belydenis van Belhar, maar veral Artikel 4 van die genoemde belydenis, die VGKSA noop om ‟n Teologie van Ontwikkeling in die betrokke kerk te vestig.
Waar die VGKSA in die apartheidsera (toe die Nederduitse Gereformeerde Sendingkerk en Nederduitse Gereformeerde Kerk in Afrika, onderskeidelik) se rol tydens die apartheidsera dié van weerstand was, moes die kerk se rol in ‟n post-apartheid Suid-Afrikaanse konteks na een van rekonstruksie en bystand verander. Is dit egter die geval?
Die navorser vergelyk die Suid-Afrikaanse sosio-ekonomiese konteks voor en na die apartheidsbestel en oordeel of daar na aanleiding van die ANC se “better life for all” veldtog van 1994 ʼn wesenlike verskil in post-apartheid Suid-Afrika is. Het die nuwe grondwet ʼn verskil gemaak in terme van die sosio-ekonomiese situasie van die land? Het die ANC-veldtog hulle woord gestand gedoen en ʼn beter lewe vir almal tot gevolg gehad? Alhoewel daar op sekere gebiede veranderinge en verskille bewerkstellig is, is die navorser oortuig dat armoede in Suid-Afrika steeds ʼn wesenlike probleem in die land, maar selfs ook in die wêreld is.
Op grond hiervan oordeel die navorser dat, gegewe die huidige sosio-ekonomiese situasie van die land, die Belydenis van Belhar stééds relevant is en dit juis as grondslag en as beweegrede vir die kerk moet dien vir daadwerklike betrokkenheid in die stryd teen armoede in Suid-Afrika.
Hierdie motivering word ook Bybels geregverdig en die kerk word uitgedaag om nie net op welsynsprojekte staat te maak in hulle rol as armoedebestryders nie. Hier gebruik die navorser die generasieteorieë van David Korten ter ondersteuning en maak dit duidelik dat alhoewel welsynsprojekte (generasie een/twee modusse van betrokkenheid) die onmiddellike nood van armes aanspreek, dit nie die wortel van die kwaad aanspreek nie. Die navorser hou wel voor dat die kerk na die derde/vierde generasie modusse van betrokkenheid moet beweeg wat sistemiese en bategerigte stelsels vir die verligting van armoede tot gevolg het en beleide op verskeie regeringsvlakke moet aanspreek. Tog kan dit ook nie alleen gebeur nie. Die navorser stel voor dat die kerk tegelykertyd op generasie 1 tot 4 modusse van betrokkenheid moet fokus om sodoende ʼn daadwerklike rol te kan speel. Die vrae is egter: Doen die kerk dit nie reeds nie? Watter rol speel Badisa hierin? Skuil plaaslike gemeentes nie dalk agter Badisa as antwoord in hulle eie betrokkenheid tot die stryd teen armoede nie?
Die navorser is oortuig dat die kerk, in alle gestaltes waarin sy haar bevind, genoodsaak word om betrokke te bly in die stryd teen armoede op alle vlakke. Die Belydenis van Belhar is ‟n kerklik-teologiese respons op die armoede en ongeregtigheidsituasie in Suid-Afrika vanweë die teologiese inhoud van die belydenis sowel as die konteks waarin dit ontstaan het. Die belydenis het sy ontstaan gehad in ‟n konteks van rassesegregasie, kerklike apartheid en die teologiese regverdiging van die apartheidsbeleid asook grootskaalse sosio-politieke/ekonomiese ongeregtigheid.
Vandag heers daar steeds grootskaalse armoede en sosio-ekonomiese ongeregtigheid in Suid-Afrika wat die belydenis steeds relevant maak. Daarom kan die VGKSA nie anders nie, want ‟n kerk wat hierdie belydenis bely en ‟n kerk wat aan God behoort, is geroep om te staan waar God staan, saam met die armes. Dit hou in dat die kerk sal getuig teen onreg en teen alle magtiges wat uit selfsug slegs hulle eie belange sou soek al word ander daardeur benadeel.

Confession, embodiment and ethics in the poetry of Antjie Krog and Joan MetelerkampWeyer, Christine Louise 03 1900 (has links)
Thesis (PhD)--Stellenbosch University, 2013. / ENGLISH ABSTRACT: This thesis examines the work of two contemporary South African poets, Antjie Krog
and Joan Metelerkamp. Through an analytical-discursive engagement with their work,
it explores the relationship between confession and embodiment, drawing attention to
the ethical potential located at the confluence of these theories and modes. The theory
informing this thesis is drawn from three broad fields: that of feminism, embodiment
studies and ethical philosophy. More specifically, foundational insights will come
from the work of Simone de Beauvoir, Maurice Merleau-Ponty and Emmanuel
Levinas. While much of the theory used originates from Western Europe and North
America, this will be mediated by sensitivity towards Krog and Metelerkamp’s South
African location, as is fitting for a study focused on embodied confession and the
ethical treatment of the other.
The first chapter will establish Krog and Metelerkamp as confessional poets and
explore the ethical implications of this designation. It will also explore the contextual
grounds for the establishment for a confessional culture in both the United States of
America of the 1950s that gave rise to the school of confessional poets, and in South
Africa of the 1990s. The second chapter will use embodiment theory to discuss the
relationship between poetry and the body in their work, and the ethics of this
relationship. The remaining chapters concentrate on three forms of embodiment that
frequently inhabit their poetry: the maternal body, the erotic body and the ageing
body. Throughout the analyses of their poetic depictions of, and engagements with,
these bodies, the ethical potential of these confessional engagements will be
investigated.
Through the argument presented in this thesis, Metelerkamp’s status as a minor South
African poet will be re-evaluated, as will that of Krog’s undervalued English
translations of her acclaimed Afrikaans poetry. The importance of confessional poetry
and poetry of the body, often pejorative classifications, will also be asserted.
Ultimately, through drawing the connections between confession, embodiment and
ethics in poetry, this thesis will re-evaluate the way poetry is read, when it is read, and
propose alternative reading strategies. / AFRIKAANSE OPSOMMING: Hierdie tesis ondersoek die werk van twee kontemporêre Suid-Afrikaanse digters,
Antjie Krog en Joan Metelerkamp. Analities-beredeneerde benadering tot hulle
werk verken die verband tussen belydenis en beliggaming. Klem word gelê op die
etiese implikasies waar hierdie teorieë en vorme bymekaarkom. Die teorie waarop
hierdie tesis berus, word vanuit drie breë velde geput: feminisme, beliggamingsteorie
en etiese filosofie. Daar word meer spesifiek op die fundamentele beskouings van
Simone de Beauvoir, Maurice Merleau-Ponty en Emmanuel Levinas gesteun.
Alhoewel die teorie grotendeels ontstaan het in Wes-Europa en Noord-Amerika, sal
dit met begrip benader word ten opsigte van Krog en Metelerkamp se Suid-Afrikaanse
agtergrond, wat meer gepas is vir studie wat fokus op beliggaamde belydenis en die
etiese hantering van die ander.
Die eerste hoofstuk vestig Krog en Metelerkamp as belydenisdigters en verken die
etiese implikasies van hierdie benaming. Die kontekstuele beweegredes vir die
vestiging van belydeniskultuur word ook ondersoek, in beide die Verenigde State
van Amerika van die 1950s (wat geboorte geskenk het aan die era van
belydenisdigters) en in Suid-Afrika van die 1990s. Die tweede hoofstuk rus op
beliggamingsteorie om die verband tussen poësie en liggaam in hul werk te bespreek,
