Criança e publicidade : hipervulnerabilidade?

O presente trabalho tem como problema de pesquisa a hipervulnerabilidade da criança à publicidade. Através de uma análise histórica da sociedade de consumo atual, pretende-se demonstrar como a publicidade atingiu seu patamar de importância atual e como o Direito respondeu a essa evolução. Será feita uma análise de direito comparado, demonstrando como a publicidade (especialmente a infantil) é regulada em outros países e na União Europeia. A partir daí, e justificando a regulação que hoje é dada à publicidade e a importância da discussão a respeito da publicidade infantil, será apresentada a influência que ela exerce sobre as crianças. A seguir, a par dessas informações e com base nos princípios informadores especialmente do Direito do Consumidor e do Direito da Criança, em claro diálogo de fontes, será respondido o problema, identificando se a criança é ou não mais vulnerável à publicidade que os outros consumidores. / This work has has its research problem the children’s hipervulnerability to advertising. Throgh an historic analysis from the current consumption society, the work aims to demonstrate how advertising has reached its current level of importance and how Law has responded to this evolution. It will be made an analysis of comparative law, demonstrating how advertising (specially child aimed) is regulated in other countries and in European Union. From then on, and in order to justify the regulation that is nowadays given to advertising and the importance of the discussion about advertising to children, it will be presented the influence that it has over children. With these informations in hands and based on the principles, especially the ones from Consumer Law and Rights of children, in a clear dialogue of sources, the problem will be answered, identifying wether children are or not more vulnerable to advertising than other consumers.

Dopady nového zákona o spotřebitelském úvěru na hypoteční trh / The effect of New Credit Consumer Law on mortgages

The goal of the diploma thesis is to show influence of the new Consumer Credit Law on mortgages in Czech Republic and its effect on real data. The thesis is dealing with issues of mortgages, shows types of mortgages and the possibility of repaid. Description of making deal between bank and client is written in next part of thesis. There are shown parameters like LTV, loan interest rate and RPSN as well as possibilities of insurance of client and secure of mortgage. Practical part of thesis shows difference between new and old Consumer Credit Law on real data, and shows effect on interest rate and number of contracts after effectiveness of the new law. There is written influence of new law on prices of resident estates. Last part of the thesis describes offers of mortgages of selected banks on Czech market.

Le droit de la consommation dans l'économie numérique : étude des déséquilibres de l'internet / Consumer law in the digital economy

L'objet de cette thèse est de pointer les difficultés rencontrées par le droit de la consommation lorsqu'il est confronté aux déséquilibres nés de l'usage des technologies de l'information, et de proposer des solutions cohérentes juridiquement et rationnelles sur le plan économique. Les terminaux connectés à l'internet deviennent de plus en plus nombreux. Le consommateur est amené à conclure régulièrement des contrats souvent très denses, aux enjeux difficiles à appréhender et presque systématiquement à dimension internationale. La matière de cette thèse est composée de tous les contrats conclus par le biais de l'internet à partir d'un terminal connecté, dont l'objet est une exécution totalement dématérialisée via les technologies de l'information. Ceci constitue l'économie numérique. Par le biais notamment de la règlementation relative aux clauses abusives, cette thèse s'intéressera particulièrement au sort des données à caractère personnel, à la géolocalisation, aux contenus protégés par la propriété intellectuelle et aux nombreuses restrictions d'utilisation dont ils font l'objet. Au travers de cette thèse, les insuffisances des différents corps de règles applicables aux contenus numériques (protection des données à caractère personnel, droit de la propriété intellectuelle, droit de la consommation) seront mises en évidence. Plusieurs propositions et synthèses seront envisagées au sein de cette thèse afin de remédier au mieux aux déséquilibres propres de l'économie numérique. / The aim of this Ph.D. is to highlight the difficulties encountered by Consumer law when it meets the use of information technologies, and to propose operating solutions in Law which might be rational under economy requirements. Connected devices become more and more common. The consumer is frequently asked to conclude very thick contracts, with stakes hard to comprehend and almost consistently with an international overture. The material of this Ph.D. is composed by all the contracts concluded through the internet from a connected device, whose object is a totally dematerialised execution via information technologies. This constitutes the digital economy. Thanks to the unfair terms regulation, this Ph.D. will focus on the becoming of personal data, the geolocation, the contents protected by Intellectual property and all the restrictions of use those contents are subjected to. Among this work, the deficiencies of the different rules applicable to digital contents (personal data protection, Intellectual property, Consumer law) will be emphasized. Many suggestions and reviews will be envisaged into this Ph.D. in order to solve to the best the specific unbalances of the digital economy.

But to achieve, this it is necessary that the tariff and nontariff barriers are eliminated. It takes even these countries macroeconomic policies worked, toward a shared goal, namely the free trade of services, goods, manpower and capital and product markets. This, however, requires the harmonization of standards to be strengthened trade relations and consumption, and also the trust between peoples. Considering this, was chosen as study subject they Harmonization of Standards Consumer Protection within Mercosul. And it was intended, to verify that this walk is the issue of consumerism in Mercosul standards, which form the agreements made so far to the standards of the consumer, are harmonized among member countries. It was concluded that, despite advances, Mercosul remains incomplete. The harmonization of consumerism walk slowly, the barriers to their harmonize is in large part to Brazilian law, which appears as a complete law and can not in any way suffer regression, and is therefore necessary that the other member countries to reassess their laws, equating the Brazilian legislation, so that everyone can stride towards sustainable economic progress. / Mercosul, o mercado comum do sul, é ainda considerado um bloco econômico incompleto, que precisa harmonizar suas legislações, para que possa então alcançar uma integração regional plena. Mas para se chegar a isso, é preciso que as barreiras tarifárias e não tarifárias sejam eliminadas. É preciso ainda que as políticas macroeconômicas desses países sejam trabalhadas, visando um objetivo comum, ou seja, o livre comércio de serviços, de produtos, de mão-de-obra, capitais e produtos. Isso, porém, requer a harmonização de normas com a finalidade de fortalecer as relações comerciais e de consumo, e também a confiança entre os povos. Diante disso, escolheu-se como tema de estudo a Harmonização das Normas de Proteção ao Consumidor no Âmbito do Mercosul. Pretendeu-se, com isso, verificar em que pé se encontra a questão das normas consumeristas no Mercosul, quais acordos foram feitos até o momento para que as normas do consumidor sejam harmonizadas entre os Países-Membros. Concluiuse que, apesar dos avanços, o Mercosul continua incompleto. A harmonização das normas consumeristas caminha lentamente, os entraves para sua harmonização se devem em grande parte à lei brasileira, que figura como uma lei completa e não pode de forma alguma sofrer regressão, sendo portanto necessário que os demais Países-Membros reavaliem suas legislações, equiparando-as à legislação brasileira, para que todos possam caminhar a passos largos no sentido do progresso econômico sustentável.

For this reason, a critical approach on the subject of civil liability has been developed, which is analysed from juridical, economic and social viewpoints. The observation that no uniform position exists in either national doctrine or jurisprudence concerning the liability of the supplier in cases of development risk is seen as a regulatory gap, which ultimately undermines the defence of consumer interests. The work demonstrates, by putting forward concrete cases, the gains obtained when losses may previously have been limited, which allows for suppliers and society as a whole to manage this risk more effectively, either by taking out insurance or even by creating governmental or sector-based funds which are in a position to assume the risk of indemnifications, within the framework of established legislation. The examples which have been examined show that in Brazil cases of liability through development risk only succeeded in compensating those consumers who were affected, due to their participation in Social Security Systems, which implies that workers, as well as society as a whole, participated financially in constituting the capital used to compensate consumers in the case of consumer-related accidents. This demonstrates the extent to which it is necessary for the judicial system to adjust and create conditions for a differentiated treatment concerning consumer accident risk liability, aimed simultaneously at safeguarding the integral compensation of the affected consumer, while ensuring that the costs of this compensation are met by the supplier or potential insurance funds which it has helped to set up, as a matter of lawconsumo, mirando a garantire, allo stesso tempo, il risarcimento integrale per il consumatore danneggiato e che i costi, per tale risarcimento, siano attribuiti unicamente al fornitore o a eventuali fondi o assicurazioni costituiti con la sua partecipazione, giacché si tratta di una regola di giustizia / Esta tese analisa o problema da responsabilidade civil e o risco de desenvolvimento no Código de Proteção e Defesa do Consumidor (Lei no 8.078/90). Para isso, foi feita uma abordagem crítica sobre a temática da responsabilidade civil, a qual é analisada sob suas características jurídicas, econômicas e sociais. A constatação de que inexiste uniformidade de posicionamento na doutrina e jurisprudência nacionais no que se trata da responsabilidade do fornecedor em casos de risco de desenvolvimento é vista como uma lacuna regulatória, que acaba por fragilizar a própria defesa de interesses dos consumidores. O trabalho demonstra, com casos concretos, os ganhos obtidos quando os danos podem ser previamente limitados, o que permite aos fornecedores e a toda sociedade administrar melhor este risco, seja com a contratação de seguros ou mesmo com a criação de fundos governamentais ou setoriais, capazes de fazer frente à responsabilidade por eventuais indenizações, dentro dos limites e regras estabelecidos. Os exemplos analisados mostram que no Brasil os casos de responsabilidade por risco de desenvolvimento só foram capazes de indenizar os consumidores lesados em razão da participação dos Sistemas da Seguridade Social, o que implica dizer que toda a sociedade e os trabalhadores participaram, financeiramente, da composição do capital que indenizou consumidores em acidentes de consumo. Isso demonstra como é preciso que o sistema jurídico mude e crie condições para o tratamento diferenciado da responsabilidade por risco de acidente de consumo, visando garantir, ao mesmo tempo, o ressarcimento integral do consumidor lesado e que os custos deste ressarcimento sejam atribuídos somente ao fornecedor ou a eventuais fundos ou seguros constituídos com a sua participação, por ser uma regra de justiça

The analysis is about the general and specific consumer s rules for the private health sector, as well as statistics and case studies that demonstrate the growing membership of private health insurance by the Brazilian population as well as the constant violation of the rules imposed on the sector by the plans operators. Being the health a subject of public relevance although provided by the private sector, suffers strong supervision and regulation of the state, with specific regulatory agency, established. Then we analyze the quality of the supervision of the National Health Agency, as well as the judiciary in ensuring the right to health as a social right and the right of the consumer, which should result in the reduction of the demand for the judiciary about issues related to sector. / O presente trabalho apresenta uma análise do direito constitucional da saúde, posto como direito social, bem como, como direito do consumidor, quando prestado pela iniciativa privada de forma suplementar a prestação do serviço de forma direta pelo Estado. Analisam-se as regras consumeristas gerais e específicas para o setor da saúde privada, bem como estatísticas e estudos de caso que comprovam a crescente adesão da população brasileira aos planos de saúde privados, bem como a constante violação das regras impostas ao setor pelas operadoras fornecedoras dos planos. Sendo a saúde tema de relevância pública, ainda que prestado pela iniciativa privada, sofre forte fiscalização e regulação do Estado, contando com agência reguladora específica, instituída para tanto. Analisa-se então a qualidade da atuação da Agência Nacional de Saúde Suplementar, bem como do Poder Judiciário na efetivação do direito à saúde, como direito social e direito do consumidor, o que deveria ter como consequência a redução da judicialização das questões relacionadas ao setor.

OTC derivatives filling the gaps in investor protection

The dramatic growth of over-the-counter (OTC) derivatives in the last two decades and the ever-expanding range of financial derivative have triggered concerns as regards investor protection. These concerns have been exacerbated in recent times by phenomenal losses sustained by several large corporations (including municipalities), in the United States, Europe and Asia. This thesis seeks to evaluate the capacity of the existing regulatory framework in Australia to provide protection to participants trading in the OTC derivatives markets. The evaluation is carried out in three parts: first, by identifying the gaps in the Corporations Law regimes, second by determining the extent to which the general criminal and consumer laws are capable of stepping into the breach left open by the Corporations Law and third, by locating the gaps in the supervisory structure by identify the participants who are not subject to any form of supervision by the regulators. The examination conducted in this thesis of the regimes in Chapters 7 and 8 of the Corporations Law reveals a number of gaps in respect of investor protection. Significantly, the OTC derivatives market, which is by far the larger market compared to the on-exchange derivatives market, is generally unregulated by the Corporations Law. Comparative analysis between the sanctions provisions in Chapters 7 and 8 of the Corporations Law and those in the Crimes Act 1900 (NSW) and the Trade Practices Act 1974 (Cth) indicated that whilst these latter Acts have the potential to act as a substitute for some of the sanctions provisions in the Corporation Law, about half of the sanctions provisions under the Corporations Law regime has no equivalent provisions in these Acts. In consequence, some regulatory gaps remain. Gaps also occur in the supervisory structure as the surveillance by regulators of market participants is focused along institutional lines. The failure of the law to provide adequate protection to investors trading in the OTC derivatives markets is due primarily to an outdated, inflexible and inappropriate regulatory framework which, when originally constructed, was not intended to regulated the broad spectrum of financial derivatives. This thesis discusses the gaps and deficiencies in the Corporations Law regime and also discusses the recent recommendations made by the Wallis Committee and the Companies and Securities Advisory Committee as well as the proposals of the Treasury in relation to investor protection. It also provides some suggestions for law reform.

O objetivo principal é analisar a viabilidade de criação de legislação especifica sobre a matéria. No que tange a metodologia foi utilizada na fase de abordagem a pesquisa teórica de caráter exploratório e no procedimento fez uso do método bibliográfico. Empregou-se a técnica de pesquisa bibliográfica através de coleta do referencial teórico em artigos, revistas científicas, doutrinas, relatórios, leis, pareceres e decisões judiciárias. Assim, constata-se que no ordenamento jurídico não há um mecanismo plenamente eficaz para coibir tal conduta devido as dificuldades em detectar e fiscalizar este fenômeno. / The work part of the premise that a balanced environment is intergenerational law .To this end, it is the duty of the society, especially, businesses care this valuable right.The consumer has shown to be aware by choosing eco-friendly products, however, share of companies have used the ecological consciousness of the consumer to benefit through the false consciousness, called Greenwashing or"lavagem verde". The research is justified by the need to make an approach to this phenomenon by checking the consequences arising from this fraudulent practice for the consumer and the possible punishments on companies that make use of green marketing to promote themselves. The main objective is to analyze the specifies creating legislation feasibility . When it comes the methodology was used in theoretical research approach phase of exploratory character and made use of the bibliographical method procedure. It was the technique of bibliographical research through collection of theoretical papers, journals, reports, laws, doctrines, opinions and court decisions . Thus, it appears that the legal system there is no fully effective mechanism to restrain such conduct because of the difficulties in detecting and monitor this phenomenon.

Trata-se de dever que encontra fundamento na boa-fé, baseando-se na necessidade de tutela das legítimas expectativas do consumidor. O presente estudo objetiva a análise das características e correlações do dever de informar do fornecedor nas relações de consumo e as consequências de sua violação, como a não obrigatoriedade do conteúdo contratual desconhecido, o cumprimento forçado da oferta e a responsabilidade por vício e defeito de informação. / The duty to inform is multifaceted: it is at the same time right and duty and pervades the entire protective system of the Consumer Protection Code, radiating its effects since the pre-negotiation phase of the consumption relation. It arises from the good faith principle, the contractual trust and it is based on the need to safeguard the legitimate expectations of the consumer. The present study aims to address the characteristics and correlations of the supplier's duty to inform in consumer relations and the consequences of its violation, such as the non-compulsory contractual unknown content, the forced fulfillment of the offer and the liability for damages caused by lack or defect of information.
