The current research tries to recognize how the Inter-American Court of Human Rightscan influence in the legal and constitutional reforms in Latin American countries. It tries to understand what elements are required for those reforms to happen. It is stated that it requires human rights movements with knowledge of the Inter-American system and a favorable State context of at least one branch of the State. Finally, it was found that, in the cases studied, thecontext determines whether what the Inter-American Court says is applied or not. / La presente investigación apunta a conocer la manera en la que la Corte Interamericana deDerechos Humanos afecta reformas jurídicas y constitucionales en los países latinoamericanos. Se busca comprender qué elementos son importantes para que se presenten las reformas. Además, se plantea que, para que estas reformas se lleven a cabo, es requerida la conjunción de movimientos con conocimiento del sistema interamericano y un contexto estatal favorable en al menos una de las ramas tradicionales del Estado. Finalmente, se encontró que, en los casos reseñados, el contexto suele ser determinante para la aplicación de lo señalado por la Corte Interamericana.

La technique des obligations positives en droit de la Convention européenne des droits de l'homme / The positive obligations technique in Law of the European Convention on Human Rights

La Cour européenne des droits de l'homme a, en 1968, dès son cinquième arrêt au principal, établi que des droits civils et politiques pouvaient générer des obligations d'action à la charge des États. Cette affirmation venait remettre en cause la définition traditionnelle de ces droits. En effet, ils étaient classiquement considérés comme mettant à la charge des États uniquement des obligations négatives. En revanche, les droits économiques sociaux et culturels étaient présentés comme imposant seulement des obligations positives. Le juge européen a, depuis lors, mis au jour un nombre croissant d'obligations positives prétoriennes. Plusieurs techniques ont été développées pour ce faire. Cette étude vise à analyser ce que nous avons dénommé la technique des obligations positives, c'est-à-dire l'usage par la Cour des termes « obligations positives » ou « mesures positives ». Cette technique permet non seulement au juge européen de dégager des obligations d'action à la charge des États, mais également de reconnaître sa compétence pour contrôler l'exécution de ses propres arrêts, de conférer un effet horizontal à la Convention ou encore d'étendre la notion de juridiction au sens de l'article 1 CEDH. Elle est également un moyen de moduler son contrôle en permettant tantôt d'accorder une large marge nationale d'appréciation, tantôt de la réduire à néant. Cette diversification croissante de l'usage de la technique dans la jurisprudence européenne est toutefois source d'incohérences.La thèse défendue vise à démontrer que la technique des obligations positives est un outil d'adaptation de la norme juridique conventionnelle à l'évolution des États démocratiques et libéraux européens. / As early as 1968, the fifth merits judgment of the European Court of Human Rights established that civil and political rights could generate action obligations on the European States. This judgment was challenging the usual definition of those rights, which were traditionally considered as charging the public authorities with only negative obligations. In contrast, economic, social and cultural rights were positioned as imposing positive obligations on the public authorities. The European Court of Human Rights has since created an increasing number of positive obligations and several techniques were developed for this purpose. This study aims to explore the “positive obligations technique”, that is to say, the Court's use of the terms “positive obligations” or “positive measures”. This technique not only allows the Court judge to impose action obligations on the European States, also recognizes the Court judge's competence to monitor the implementation by the public authorities of its own decisions, to give a horizontal effect to the Convention and to extend the concept of "jurisdiction" within the meaning of Article 1 ECHR. This technique also permits to modulate the Court's control over the European States, granting a wide margin of appreciation or reducing it to nothing. The increasing diversification of the use of this technique in European case law is however a source of discrepancy.. This thesis aims to demonstrate that the technique of positive obligations is a tool for adaptation of the conventional norma to the changes of the democratic and liberal European States.

O objetivo deste trabalho é analisar decisões da Corte Interamericana de Direitos Humanos que tratem do dever de os Estados investigarem e punirem os responsáveis por violações de direitos humanos. Considera-se que o Sistema Interamericano tem tido um papel de destaque no processo de desenvolvimento de uma norma internacional que determina a responsabilidade criminal individual por violações de direitos humanos. Mesmo com todas as mudanças políticas ocorridas nos países que aceitam a jurisdição da Corte IDH, esta pesquisa identifica que o direito penal tem sido um tema marcante na jurisprudência interamericana, tanto na apuração da responsabilidade estatal quanto na imposição de medidas de reparação. Mesmo assim, quando se comparam diferentes tipos de casos que lidam com a atuação da justiça criminal, paradoxos e lacunas na visão que a Corte Interamericana tem do direito penal começam a emergir. / The aim of this work is to analyze the decisions of the Inter-American Court of Human Rights dealing with the duty of States to investigate and punish those responsible for human rights violations. It is taking into account that the Inter-American System has had a prominent role in the development of an international standard establishing individual criminal accountability for human rights violations. Even with all the political changes in the countries that accept the jurisdiction of the IACHR, this research identifies that the criminal law has been a striking matter in the Inter-American jurisprudence, both in the establishment of state responsibility as the imposition of remedial actions. Still, when comparing different types of cases that deal with the criminal justice, paradoxes and gaps in how the Inter-American Court oversees the criminal law begin to emerge.

A presente dissertação tem por objetivo demonstrar a efetividade das decisões proferidas pela Corte Interamericana de Direitos Humanos, órgão judicial do Sistema Interamericano de Direitos Humanos. Para tanto, parte da premissa de que é possível se compreender tal atributo por meio de dois enfoques principais: um em sentido estrito, suplantado no cumprimento das decisões proferidas pela Corte Interamericana por parte dos Estados condenados, e outro de caráter mais abrangente, embasado, lato sensu, no impacto que sua jurisprudência opera no direito interno dos Estados Partes da Convenção Americana sobre Direitos Humanos, e, igualmente, como corpus iuris capaz de determinar padrões internacionais. Nesse contexto, examina-se ainda acerca dos limites do compliance como critério único para se caracterizar a efetividade das decisões proferidas pelo Tribunal. Defende-se, assim, que as decisões da Corte produzem efeitos que não podem ser representados necessariamente por números, e tal afirmativa se apóia na perspectiva de que este impacto existe até mesmo quando suas decisões não são cumpridas, ou o são de forma parcial, haja vista que os Estados são constantemente chamados para esclarecer acerca do status de cumprimento das sentenças nos processos em que foram condenados, o que acaba por catalisar as movimentações sociais internas nestes países. / This dissertation aims to demonstrate the effectiveness of the decisions handed down by the Inter-American Court of Human Rights, the judicial body of the Inter-American Human Rights System. Therefore, it starts from the premise that it is possible to understand this attribute through two main approaches: one in a strict sense, supplanted by the compliance with the decisions taken by the Inter-American Court by the States convicted, and another, more embracing, grounded on the impact that its jurisprudence operates in the domestic law of the States Parties of the American Convention on Human Rights, and also as a corpus juris capable to determine international standards. In this context, it also examines about the limits of compliance as a unique criterion to characterize the effectiveness of the decisions of the Court. It is argued, on the other hand, that the Court\'s decisions produce effects that can not necessarily be represented by numbers, and this statement is based on the perspective that this impact exists even when their decisions are not complied, or are partially complied, since States are constantly called to clarify about the status of implementation of the judgments in the cases in which they were condemned, which turns out to catalyze the internal social movements in these countries.

From Deficit to Dilemma: An Evaluation of the Contribution of Europe’s Supranational Courts to the Promotion of the Rights of Vulnerable Migrants

The thesis evaluates how effective the European Court of Human Rights and the Court of Justice of the EU have been in promoting the human rights of vulnerable migrants. It thereby pursues two objectives. Firstly, it questions legal scholarship that has identified certain rulings of the two courts as vital for migrant rights but which have not analysed their impact empirically. Secondly, it makes a methodological contribution to the evaluation of the effectiveness of international courts by proposing (and applying) an 'issue-based' methodology which assesses judicial bodies for their ability to resolve specific social and political problem. For these purposes, eight carefully selected 'key cases' are analysed in terms of three effectiveness types, namely law development, case-specific, and strategic effectiveness. The empirical materials used include interviews with 28 persons who were directly or indirectly involved in the selected key cases. Legal and empirical analyses show varying and complex results for the different cases, with some general trends emerging. Firstly, the case law of the courts is characterised by a significant inconsistency, resulting in a 'dilemmatic adjudication' that diminishes the impact of even rights-affirming judgments. Secondly, the 'case-specific' impact on the persons or the countries concerned remains contingent as governments and domestic courts manage to contain the ruling. Lastly, lawyers and NGOs increasingly use the courts in a strategic way, which can elevate impact on policy. The right to an independent and impartial tribunal is one of core elements of a fair trial. Therefore, it is vital to lay emphasis on this requirement. Independent and impartial tribunals are the cornerstone of a democratic and modern society respecting the rule of law. Effective fulfilment of this requirement promotes faith in courts, the judicial system and justice itself. Independent and impartial tribunals are a necessary prerequisite to protection of other rights. Although the right to an independent and impartial tribunal is enshrined in many international treaties, this requirement is not always met in practice. This problem is emphasised, inter alia, by the Council of Europe which adopted the Plan of Action on Strengthening Judicial Independence and Impartiality in 2016, due to unsatisfactory fulfilment of this requirement among European countries. [pt] A implementação das decisões da Corte IDH no Brasil é o tema central deste trabalho. O objetivo é compreender a aparente contradição entre os esforços despendidos pelos estados na assinatura de Tratados, bem como o desenvolvimento de regimes internacionais de proteção dos direitos humanos e sua correspondente ineficiência em cumprir internamente as sentenças prolatadas pela Corte IDH. Indutivamente, a primeira observação é a de que empiricamente não há uma continuidade entre as ordens jurídicas interna e internacional, obstaculizada exatamente pela atuação do estado. Por conseguinte, há a necessidade de estudar mais afundo a organização política do estado em si, na tentativa de encontrar uma justificativa para o recorrente bloqueio do estado no cumprimento das sentenças da Corte IDH, já que em nenhum dos casos houve a declaração expressa de cumprimento das sentenças. Por isso, exploram-se as considerações teóricas de Tilly (1996), segundo o qual os estados cursariam trajetórias políticas próprias, não necessariamente seguindo os mesmos passos da Europa. Além disso, em coerência com a argumentação teórica do autor, segundo a qual a guerra seria um importante catalisador de transformações políticas do estado, atribui-se especial importância aos desdobramentos históricos da Segunda Guerra Mundial, tendo em vista ser a última guerra mais importante com repercussões profundas e abrangentes.Associando as teses de Tilly com as transformações decorrentes da Segunda Guerra Mundial, é possível apontar teoricamente pelo menos dois fatores capazes de influírem no cumprimento das decisões das sentenças da Corte IDH. O primeiro deles está relacionado à incorporação de instituições, oriundas do modelo europeu de formação do estado, em circunstâncias bastante diferentes e o segundo associado à relação entre estado e população/povo/cidadãos. O objetivo passa a ser, então, compreender o problema inicialmente proposto, a partir do fundamento teórico apresentado. / [en] The implementation of the decisions of the IACHR in Brazil is the central theme of this work. The goal is to understand the apparent contradiction between efforts by states creating treaties and developing international regimes for the protection of human rights and their corresponding inefficiency in meeting internally the judgments issued by the Court. Inductively, the first observation was that empirically there is no continuity between the domestic and international legal systems, exactly hindered by the actions of the state. Therefore, it is necessary to study further deepen political organization of the state itself, as an attempt to find a justification for blocking of the state in compliance with the judgments of the IACHR, since in neither case were the express declaration of compliance sentences . Therefore the theoretical considerations of Tilly (1996) is explored, whereby the states would enroll own political careers, not necessarily following the same steps in Europe. Furthermore, in accordance with the theoretical arguments of the author, to which the war would be an important catalyst for policy change in state, it is possible to attribute special importance to the historical developments of World War II, in order to be the most important last war with deeper and more comprehensive impact . Associating with Tilly s theses changes resulting from the Second World War, it is theoretically possible to identify at least two factors that have influence in implementing the decisions of the judgments of the Court. The first one is related to the incorporation of institutions , derived from the European model of state formation in very different circumstances and the second associated with the relationship between state and population / people / citizens. After these findings, specific cases of condemnation against Brazil were analyzed as well as the measures taken one by one . The objective becomes, then, to understand the problem first proposed from theoretical foundation presented.

Securitization of Migration in Europe : Pushback practices and the Role of the European Court of Human Rights

An embedded case study investigating the ongoing securitization of migration in the EU from 2014-2020 and the role of legal institutions, in this case the European Court of Human Rights (ECtHR) in these processes. Securitization Theory is used in combination with Critical Legal Theory to create a framework that attempts to both illuminate the role of the functional actor in Securitization Theory further, and the impact securitization has on legal institutions. It provides explanations for sudden shifts in legal argumentation, especially in cases of high political relevance with the use of Critical Legal Theory. The case of N.D. & N.T. vs. Spain serves as an example of a functional actor providing two contrasting judgments on the same events within a short period of time and opens up discussions about political influences on legal institutions. Securitization and the framing of refugees as existential threats to European identity and culture is one of the many ongoing political processes related to the issue of migration and refuge in Europe. As the political landscape shifts and right-wing populist parties establish themselves in European Member States, illegal pushbacks have become common practice at the outer borders of the EU and are challenged both politically and legally. This study investigated cases of illegal pushbacks to renew criticism against the institutions engaging in and enabling the practice.

Syftet med uppsatsen är att utreda hur rätten till liv har ett samband med tvångsförsvinnande enligt den Inter-Amerikanska Domstolen om Mänskliga Rättigheter. För att uppnå uppsatsens syfte genomförs en rättsutredning kring gällande rätt, där en rättsdogmatisk metod och fallstudie applicerats. Uppsatsen kommer vidare att analyseras mot bakgrund av en rättsvetenskaplig teori, där relevant rättspraxis som den Inter-Amerikanska Domstolen om Mänskliga Rättigheter bemött samt en kortfattad genomgång av kontexters påverkan. Under utredningen av de konventionella källorna finns vissa krav för att uppfylla om en stat kan hållas ansvarig. Utifrån det och med de grova mänskliga rättighets kränkningarna staten utfärdat i åtanke, är bevisbördan och statsansvar av stor relevans för att klargöra sambandet mellan rättigheten och handlingen. Uppsatsen avslutas med att konkludera att det råder brister i hur den Inter-Amerikanska Domstolen om Mänskliga Rättigheter arbetar mot att förvara och skydda Mänskliga Rättigheter i fall som berör tvångsförsvinnande. / The aim of this paper is to evaluate how the right to life has a connection with the forced disappearance of persons, according to the Inter-American Court on Human Rights. In order to reach this purpose, a legal dogmatic approach and a case study is used, in the light of a legal theory. The research concerns relevant cases that the Inter-American Court on Human Rights has been confronted with, and, to clarify the contextual importance, a brief explanation on the surroundings is provided. With the grave human rights violations committed by State authorities in mind, the thesis shows that the standard of proof, and principle of state responsibility, becomes of importance, in order to be able to determine whether the right to life is violated in cases of forced disappearance. The essay will conclude that the issue prevails defectiveness in relation to preventing and protecting human rights in cases of forced disappearance of persons.
