The land system in 'black' urban and rural areas of the province of KwaZulu-Natal and the effect of the new land reforms thereon

The above topic deals with the land use planning, the land-tenure and the deeds registration systems, applicable in former black urban and rural areas of KwaZulu Natal. These areas are divided into three categories, namely: 1. black townships on former black land (former KwaZulu townships); 2. rural or tribal land; and 3. black townships on former white land (Development Aid (DDA) townships). The writer firstly explains how the above categories of land were created in terms of the 1913 and 1936 land laws and how the administration and control of the first two categories was taken over by the former KwaZulu Legislative Assembly in 1986 whilst administration and control of the last category remained with the South African Development Trust. The writer critically analyses different pieces of legislation relating to the land system in the abovementioned categories of land. The writer further critically analyses the new land laws and their effect on the said land system. / Law / LL.M.

À l’heure où l’on parle de « banalisation » du droit administratif, une réflexion sur ce qui fait spécificité de ce droit, son exorbitance, présente un intérêt renouvelé. Les prérogatives de puissance publique sont au cœur de cette problématique. Notre étude permet de démontrer que les prérogatives de puissance publique entrent dans la catégorie des notions fonctionnelles. Cependant, nos recherches ne nous permettent pas d’affirmer avec fermeté que les prérogatives de puissance publique sont une notion conceptuelle. Il n’y a pas de critère général des dites prérogatives, elles sont diffuses et contingentes. Elles n’ont pas un contenu abstraitement déterminé une fois pour toutes. Leur contenu vit au rythme des évolutions du droit administratif. Nous pouvons cependant, essayer de donner une définition socle, c’est-à-dire une définition qui regrouperait une grande majorité des prérogatives, sans pour autant les regrouper toutes. Les prérogatives de puissance publique seraient alors, dans leur majorité – idée de noyau dur – et non dans leur globalité, définies comme des moyens d’action ou de protection exorbitants du droit commun, résultant de la puissance publique, détenus par une personne chargée de l’action administrative, en vue de satisfaire l’intérêt général. Cette définition socle présente cependant certaines imprécisions. Il apparaît alors que les prérogatives ne sont pas dans leur globalité une notion conceptuelle. / At a time when administrative law has become « common place », it is with a renewed interest that one should to ponder about the specificity of this law, its outrageousness. The prerogatives of the public authorities are at the heart of this issue. Our study will show that the prerogatives of the public authorities are within the scope of the functional notions. However, despite our research, we cannot firmly assert that the prerogatives of the public authorities are a conceptual notion. No general criteria can define these prerogatives as they are diffused and contingent. They do not have an abstractly determined content once for all. Their content changes with the evolution of administrative law. We can, however, try to give a definition as a basis, that is to say a definition which would gather a majority of prerogatives, without including them all. The prerogatives of the public authorities would then be defined, for most of them – concept of hard core – and not in their totality, as outrageous means of action or of protection of the ordinary law, resulting from the public authorities, held by a person in charge of administrative action so as to satisfy the general interest. Yet, this definition as a basis contains some inaccuracies. That is why the prerogatives then are not a conceptual notion in their totality.

Une question demeure récurrente : les divisions qui subsistent depuis le XVIè siècle entre Catholiques, Luthériens et Réformés sont-elles autant d’ordre anthropologique que théologique ? Cette problématique paraissant pouvoir être soutenue, il convenait alors de déterminer les différends anthropologiques, de les analyser et de se demander s’ils sont une entrave à la Κοινωνία. L’étude de la situation au XVIè siècle a permis de conclure que les concepts anthropologiques portés par une philosophie existentielle ont joué un rôle important dans la rupture au sein de l’Église d’Occident. Le retour sur la pensée de Pannenberg, Moltmann, Rahner, théologiens de trois confessions différentes, autorise à dire qu’au XXè siècle la vision de l’homme a toujours une incidence sur les concepts théologiques, mais les différences sont de moins en moins séparatrices et deviennent souvent des dons à partager. L’analyse de dialogues œcuméniques a mis en évidence que les différends anthropothéologiques ont été partiellement réconciliés et font l’objet d’accords, voire d’une déclaration commune sur la Doctrine de la Justification. Aujourd’hui, un défi reste à relever celui d’une déclaration sur le Ministère en vue du partage à la même table eucharistique. Une démarche de consensus différencié serait une aide à la recherche d’une pleine communion. / An issue has been ever recurring : are the discords which have been going on since sixteenth century between Catholics, Lutherans, Calvinists as much anthropological as theological ? As this question can be supported it seems suitable to determine these anthropological disagreements, analyse them and wonder whether or not they are obstacle to the Κοινωνία. A study concerning the situation during the XVIth century has allowed to conclude that the anthropological concepts conveyed by an existential philosophy have played a mojor role in the severing within the Western Church. The return on the thoughts developed by Pannenberg, Moltmann and Rahner, theologians of three different confessions, allows us to tell that in the XXth. century man’s vision has always an incidence on the theological concepts but are less and less separative and are often gifts to be shared. The analysis of ecumenical dialogues have clearly shown that theanthropological disagreements have been partly reconciled and are now subject to consensus, even a joint declaration on the doctrine of justification. Today we have to take up a challenge about a declaration on the ministry in order to share the body of Christ at the same table. A differing consensus method could be a help to find a complete communion.

A legal comparison of a notarial bond in South African law and selected aspects of a pledge without possession in Belgian law

A real security right improves a creditor’s chances of recovering a debt owed to him by the debtor. In the case of an ordinary pledge, the pledgor delivers physical control of his movable property to his creditor to serve as security for the repayment of the principal debt. The increasing value and use of movable property as an object of security coupled with technological advancement have resulted in many countries calling for legal reform of real security rights over movable property. In South Africa this led to the introduction of the Security by Means of Movable Property Act 57 of 1993 which makes provision for a pledge without possession. The Act regulates only special notarial bonds and does not apply to general notarial bonds. The real security right vests in the bondholder upon registration of the bond, provided that the movable property encumbered is described in a notarial bond in a way that makes it readily recognisable. The Act has substituted delivery with registration in the Deeds Registry. Registration of the notarial bond in the Deeds Registry is questioned as to whether it complies with the publicity principle. This is because movable property can be shifted from one place to another without any knowledge on the part of the creditor due to the inaccessible and costly registration system. The third party then receives the property subject to the real security right of the creditor. The substitution of delivery with registration is the controversial feature in this study. Linked to the legal problems regarding compliance with the publicity principle, is the description and identification requirement as provided for under the Act, the exclusion of general notarial bonds from the application of the Act, and the question of whether it is appropriate to regard special notarial bonds as pledges without possession. This study questions whether the current land registry system should be used for the registration of notarial bonds and suggests that a new system designed specifically for the registration of real security rights over movables be considered. I compare the position in the Belgian legal system as regards developments in real security rights over movables to identify possible solutions and recommendations for the South African approach. / Private Law / LL. L'opera esamina l'intervento pubblico nella gestione del rapporto di lavoro sotto il profilo storico e giuridico nelle tre fasi d'instaurazione, gestione e cessazione del rapporto. Si valorizza anche il ruolo specifico dei tre poteri legislativo, esecutivo e giudiziario, con particolare riguardo all'analisi sistematica del diritto amministrativo del lavoro. L'opera intende porre in luce gli elementi logici, giuridici ed assiologici di questo ramo del diritto del lavoro, per ricondurne le fattispecie esaminate ad un sistema coerente e razionale e per suggerirne sia un metodo d'analisi de iure condito sia una prospettiva per una lettura ed una proposta de iure condendo. / This work analyses how public powers affects labour relationships both from the historical and the juridical points of view. The three main phases of labour relationships beginning, management and end are examined separately. The specific contributions by the three public powers legislative, administrative and judiciary especially by the public administration, are also dealt with. The goal is to illustrate the logical, juridical and ethical elements of this branch of the labour law, in order to build a rational system for both the analysis de iure condito and the debate de iure condendo.
