Summary: Překlad a výklad MaHaRaLova responsa ve věci nadlerismu. Translation and Commentary on MaHaRaL's Responsum to an Issue of Nadlerism. Channa Šimonová Even 400 years after writing Maharal's Netivot olam his challenge to responsibility and fortitude is still current. My purpose was to translate Jisrael's enquiry and Maharal's response. I do not seek a exhaustive analysis Maharal's teaching's. I seek a most authentic translation. This I want get with my notes and interpretation. In the text I see three kind of literal styles: 1) poetical passages, which I do not poeticize, however they are still outstanding attribute of rabbinical correspondence, 2) "agadic" passages, which are ideal both for translation and interpretation, 3) halachic - juridical passages, which I interpret structurally. I hope, that I redound with my diploma thesis to extend awareness of Maharal's work.

1 The crime of defamation under Art. 184 Criminal Code Abstract This thesis deals with the wording and the role of the crime of defamation in criminal law. Since it is a minor offense due to the objective aspect of a criminal offense and the type of object it protects, and it has repeatedly been considered for removal from the Criminal Code for the last 15 years, the author posits whether the existing factual basis of defamation in criminal law is dispensable. The first chapter of this thesis deals with the fundamental right of preservation of human dignity, personal honor, and good reputation. The introduction and differentiation of the enumerated institutes are followed by a summary of the historical development of penal regulation regarding preservation of honor. It aims to record how the definition of the crime of defamation developed starting from the beginning of the First Republic to the present day, and at the same time to explore the most important reasons that led the legislators to retain the crime of defamation in the Criminal Code after the Velvet Revolution. From Victim to Perpetrator : A Feminist Critical Discourse Analysis of Swedish News Media in the Wake of MeToo

Four years after the Swedish MeToo-movement, ten women who publicly accused men of sexual violence have been convicted of the crime defamation. Framed as realizing questions of truth, sexual violence and the roles victim and perpetrator, the convictions have caused an extensive and polarized debate in Swedish news media. Based on a data-sample of newspaper articles from four of the major daily newspapers in Sweden, this study uses feminist critical discourse analysis to study the news media coverage of these defamation cases with the aim of investigating if patriarchal structures are reproduced in Swedish news media discourse on defamation in the wake of MeToo. The results show that patriarchal structures are in fact being reproduced – in three main ways. First of all, patriarchal structures are reproduced through the construction of truth as a subjective, internal and individual reality that gives men as a group an interpretative prerogative and privilege in making truth-claims, compared to women. Secondly, patriarchal structures are reproduced through the construction of sexual violence as a subjective experience rather than a fact. Men’s sexual violence towards women is depoliticized and de-gendered, rendering the gendered asymmetry of the violence invisible. Thirdly, patriarchal structures are reproduced through assigned roles of victim and perpetrator. Women who testify about rape are constructed as perpetrators of defamation rather than as victims of rape, while men are constructed as victims of defamation rather than as perpetrators of rape. The credibility of women who testify about rape is questioned as well as their legitimacy as victims of sexual violence. To conclude, the study shows that the news media discourse on defamation in the wake of MeToo reproduce patriarchal structures as it contributes to a systematic privileging of men as a group, and to a systematic disadvantaging of women as a group. / Fyra år efter den svenska MeToo-rörelsen har tio kvinnor som offentligt anklagade män för sexuellt våld blivit dömda för brottet förtal. Förtalsdomarna har fått omfattande medialt utrymme i svensk nyhetsmedia och har väckt en polariserad debatt. Domarna har i nyhetsrapporteringen framställts realisera frågor om sanning och sexuellt våld, samt frågor om vem som egentligen är offer och förövare i fallen. Baserat på ett material av nyhetsartiklar från fyra av de största rikstäckande tidningarna i Sverige studerar denna studie nyhetsrapporteringen om dessa förtalsdomar i syfte att undersöka om patriarkala strukturer reproduceras i den mediala diskursen om förtal i kölvattnet av MeToo. Resultaten visar att patriarkala strukturer reproduceras på tre olika sätt. För det första genom att sanning konstrueras diskursivt som en subjektiv och inre individuell verklighet, vilket ger män som grupp ett tolkningsföreträde och privilegium i att leverera sannings-utsagor jämfört med kvinnor. För det andra så reproduceras patriarkala strukturer genom att sexuellt våld konstrueras diskursivt som en subjektiv upplevelse snarare än en sanning. Mäns sexuella våld mot kvinnor avpolitiseras och avkönas vilket gör att den könsasymmetriska aspekten av våldet osynliggörs. För det tredje så reproduceras patriarkala strukturer genom hur rollerna offer och förövare tillskrivs. Kvinnor som vittnar om våldtäkt framställs som förövare av förtal snarare än som våldtäktsoffer, medan män konstrueras som offer för förtal snarare än som våldtäktsmän och förövare. Trovärdigheten hos kvinnor som vittnar om våldtäkt ifrågasätts liksom deras legitimitet som offer för sexuellt våld. Sammanfattningsvis visar studien att mediediskursen om förtal reproducerar patriarkala strukturer genom att den bidrar till ett systematiskt gynnande av män som grupp och missgynnande av kvinnor som grupp.

La diffamation sur Internet : actualiser la responsabilité en droit civil et en common law au Canada

En cette ère que plusieurs surnomment le « Web 2.0 », les usagers se sont emparés avec enthousiasme des fonctions liées aux communications et au partage sur Internet, ce médium devenant ainsi une nouvelle plate-forme pour les enjeux liés à la vie privée et à la réputation. La diffamation constitue justement un des problèmes prédominants constatés en lien avec ce contenu électronique, plus particulièrement lorsqu’il est question de contenu généré par les utilisateurs. Face à cet outil permettant une diffusion et une intéractivité sans précédent, comment devons-nous aborder Internet au regard des règles de droit applicables au Canada en matière de diffamation? L’analyse juridique traditionnelle sied-elle aux nouvelles réalités introduites par ce médium? Le bijuridisme canadien nous impose d’étudier parallèlement les régimes de droit civil et de common law et ce, dans une optique comparative afin de comprendre les concepts et le fonctionnement propres à chacune des approches juridiques cohabitant au pays. Cette analyse nous permettra de mettre en lumière les particularités du médium électronique qui se révèlent pertinentes lorsqu’il est question de diffamation et qui font la spécificité des situations et des acteurs en ligne, distinguant ainsi Internet des modes de communications traditionnels que le droit connaît. Cette approche comparative permet de poser un regard critique sur chacun des régimes de droit en vigueur au Canada, considérant la réalité propre à Internet et au contenu généré par les utilisateurs, mais surtout, vise à promouvoir le développement de méthodes d’analyse véritablement ancrées dans le fonctionnement du médium en cause et susceptibles d’évoluer avec celui-ci. / In this era often called « Web 2.0 », users have jumped with enthousiasm on the functions of communications and sharing on the Internet, this medium becoming a new platform for issues relating to privacy and reputation. Defamation is one of the main concerns about electronic content, more specificially regarding user generated content (UGC). Dealing with this tool which enables an unprecedented dissemination and interactivity in communications, how should we treat Internet with regards to the legal rules applicable in matters of defamation in Canada? Does the traditionnal legal analysis fit the new reality introduced by this medium? Because of Canada’s bijuralism, we will study separately the civil law and common law regimes with a comparative method in order to understand the concepts and the functionning specific to each of the legal approaches cohabiting in Canada. It will allow us to identify the special features of the electronic media which stand out when confronted with matters of defamation and which caracterize the specificity of the online context and users, therefore distinguishing it from the traditionnal means of communication known by the law. This comparative analysis aims to take a citical look at each of the law regimes in effect in Canada, considering the reality of Internet and its user generated content. Mainly, this study aims to foster the development of analytical methods truly entrenched in the functionning of the medium concerned and likely to evolve therewith.

Conselho Nacional de Desenvolvimento Científico e Tecnológico / Para que possa alcançar sua ratio essendi, isto é, promover a convivência pacífica, o Estado utiliza-se do Direito para realizar o controle social e, em última análise, acolher os cidadãos que vivem sob a sua regência. Neste sentido, o Direito Penal adquire especial importância, tendo em vista deter a incumbência de enunciar comportamentos especialmente ofensivos para a vida em sociedade, prevendo e fixando, para cada conduta criminosa, a aplicação de penas ou medidas de segurança. É certo, de igual forma, que este ramo é também a ultima ratio, ou seja, a última instância de proteção, razão pela qual só pode ser acionado a partir do fracasso ou ineficiência de todos os demais meios de resguardo judicial, eis que o poder punitivo investe, via de regra, contra o bem mais precioso do ser humano, quer seja, sua liberdade. Levando estes pressupostos em conta, assoma uma relevante inquietação: a honra, aspecto inerente à personalidade do homem, dadas as suas características dogmáticas, ainda merece a proteção do Direito Penal? Será que não existem outros meios aptos a trazer suficiente amparo legal? É a partir destas questões que se desenvolve a presente dissertação. Para tanto, buscar-se-á, em um primeiro momento, entender a maneira como os valores e interesses mais caros ao homem adentram na seara penal (teoria do bem jurídico). Após, empreender-se-á efetiva imersão no tema de pesquisa, buscando entender as bases que historicamente assentaram e determinaram a tutela jurídica da honra (bipartição metodológica), além de promover diagnóstico da guarida fornecida pelo Direito Civil e pelo Direito Penal, de modo a compreender se a honra civil difere da honra penal. Por fim, será feito uma análise crítica da honra enquanto bem jurídico penal, com o fito conclusivo de trazer apontamentos quanto aos horizontes futuros da tutela deste valor individual. / In order to achieve its essendi ratio, that is, to promote peaceful coexistence, the State uses the rule of law to perform social control and, ultimately, safeguard the citizens living under its rulership. In this sense, criminal law is particularly important seeing that it has the task of enunciating especially offensive behavior for life in society, besides providing and setting to apply, for each criminal conduct, penalties or security measures. It is true, too, that this branch is also the ultima ratio, the ultimate protection, which is why it can only be triggered as from the failure or inefficiency of all other judicial guard means, whereas the punitive power invests, as a rule, against the most precious of human rights, namely, their freedom. Taking these assumptions into account, looms a relevant concern: the honor, essential part of mens personality, given their dogmatic features, still deserves the punitive protection of criminal law? Are there no other means able to bring sufficient legal care? It is from these questions that this dissertation is developed. Therefore, it will be sought, at first, to understand how the most important values and dearest interests of man enter into criminal harvest (protected legal interest theory). Next, it will be undertaken an effective immersion in the research theme, seeking to understand the foundations that historically settled and determined legal protection of honor (methodological splitting), besides promoting an effective diagnosis of the shelter provided Civil Law and Criminal Law in order to understand if civil honor differs from penal honor. In our time, it has become easy to contribute to the general pool of knowledge: Tell somebody about events that have just happened and think yourself useful, publish a video of a crime and make history, put up a rumour and ruin someone’s career. My question is: Can we talk about counter-knowledge when it comes to news-contributors who are not journalists but have mobile phones from which they can send messages and photos? I will first outline why the idea of counter-knowledge is attractive, then sketch it as defined by French philosopher Michel Foucault. My third point is about ways of writing which produce counter-knowledge, before finally asking if sending an image can have the same effect.

Analysis of Qualified Immunity for Texas Public School Professional Employees as Interpreted by the Texas Courts

This dissertation analyzed Texas appellate court decisions relating to whether educators' actions were incident to or within the scope of duties and involved the exercise of judgment or discretion in cases involving defamation, motor vehicle exceptions, and excessive force in discipline exceptions. The questions addressed were: (1) How have the Texas appellate courts interpreted Texas Education Code Section 22.051 in litigation against teachers and school administrators for defamation? (2) How have the Texas appellate courts interpreted Texas Education Code Section 22.051 in litigation against teachers and school administrators for injury to students when plaintiffs have sued Texas educator under the motor vehicle exception to the educator immunity law? (3) How have the Texas appellate courts interpreted Texas Education Code Section 22.051 in litigation against teachers and school administrators under the excessive force in discipline exception to the educator immunity law? This dissertation utilized legal research as its methodology. Chapter 3 examines literature with regard to qualified immunity for Texas public school professional employees and discusses the limitations placed upon qualified immunity. Chapter 4 is a comprehensive study of the cases decided by Texas courts involving alleged defamation of students or others by teachers and school administrators. Chapter 5 is a comprehensive study of the cases decided by Texas courts involving the alleged negligent use of motor vehicles by professional public school employees. Chapter 6 is a comprehensive study of the cases decided by Texas courts involving the alleged use of excessive force in disciplining students. Chapter 7 discusses the findings of the analysis of cases as well as the implied limitations regarding qualified immunity of teachers and school administrators.

There are many different ways that the power of a word is expressed in the New Testament. In most cases, this power is bound to the person of Jesus Christ, and its outcome is positive. Through his word Jesus not only heals, exorcizes, and brings the dead back to the life, but he also curses. This thesis discusses the question, what the New Testament says about various imprecations, maledictions and many other negative appearances of a word and the demonstrations of its power. This thesis comprises an overall outline of the passages from the New Testament and their commentaries, which appear to be close to the selected theme. In the first part the thesis deals with the notion and relevance of a "word" and "human speech" for people and their relationship with God. In the second part, this thesis delves into the area of imprecations and maledictions. The third part is dedicated to promises and oaths. The fourth part aims to the theme of wrath and how its expressed in words in the texts of the New Testament, that are connected with the selected theme, including the commentaries. Bykomend hiertoe stel die Grondwet die vereiste van konstitusionele regverdiging vir beperkings op fundamentele regte. 'n Oorsig oor die regspraak in sowel die voorgrondwetlike - as na-grondwetlike bedeling, dui op 'n versuim deur die howe om behoorlik aandag te skenk aan die bewyspligtigheidsgevolge van die regverskynsels wat hulself in die lasterreg voordoen. In hierdie verhandeling word bewyspligtigheid in lastersake krities ondersoek om vas te stel of dit die reg korrek weerspieel en om 'n werkbare bewyslasformule vir lasteraksies in 'n konstitusionele litigasie te vind. Daar word voorgestel dat die probleem opgelos word deur 'n tweefase-benadering: Die eiser moet in die eerste fase die omvang van sy reg bewys en dat daarop inbreuk gemaak is. In die tweede fase moet die verweerder sy regverdigingsgronde bewys, asook dat dit konstitusioneel regverdigbaar is. / The civil law of defamation is marked by discord regarding onus of proof. A unique situation evidences itself: rebuttable presumptions of law concerning unlawfulness and animus iniuriandi are followed by various grounds of justification. In addition thereto the Constitution sets the requirement of constitutional justification for limitations on fundamental rights. An overview of case law in the pre-constitutional as well as the post-constitutional dispensation, indicates a failure by the courts to pay proper attention to the evidentiary consequences of the legal phenomena found in the law of defamation. In this dissertation onus of proof in defamation cases is critically examined to ascertain whether it reflects the law correctly and to find a workable "onus of proof" -formula for defamation cases in a constitutional dispensation. It is suggested that the problem be solved by a two stage approach: in the first phase, the plaintiff must prove the extent of his right and the encroachment thereof .
