The Victorian Volunteer Force on the central Victorian Goldfields, 1858-1883

During the 19th century, defence was a major issue in Victoria as indeed it was in other British colonies and the United Kingdom. To help defend themselves, self governing colonies throughout the Empire enlisted local citizens to serve as part time soldiers on a voluntary basis. The Victorian government in 1859 - 60 took a calculated risk in adopting a Volunteer Force to underpin the whole colonial defence scheme, particularly as the military effectiveness of the citizen soldiers was questionable due to the lack of any real discipline within the Force and the part time nature of the military service. Whilst the savings which resulted (from using Volunteers rather than expensive Imperial troops) were spent on building forts and purchasing ordnance to protect Port Phillip Bay, there were other advantages to be gained from the government decision. It harnessed the considerable groundswell of public patriotism and pride in the Empire to ensure the development of a colonial society with strong links to Britain. The Government also linked Volunteering, stability and patriotism together as part of a less obvious agenda for the goldfields. In a period of lingering unrest only a few short years after Eureka, the Volunteers provided a clear indication of government power and yet another sign (along with the judicial system, education, language) of the importance and expanse of British society. Should there be any civil unrest on the goldfields, the local Corps were ideally suited to the role of civil control. On a number of occasions, the Volunteer Corps were called out to maintain law and order. The thesis studies a major group of over 5,100 men on the goldfields over two decades, particularly with regard to their motives for joining the Volunteers and their demographics such as ages, occupations, addresses, activities and the networks between members. By addressing the Corps demographics it is possible to understand the role played by the Volunteers in the development of goldfields society.

Fientliga företagsförvärv har under en lång tid varit en del av den globala finansmarknaden och är numera inte främmande för de svenska aktörerna. Ett företagsförvärv blir fientligt när bolagets styrelse råder aktieägarna att avslå det framlagda budet. Är budet intressant för aktieägarna, som ofta strävar efter att maximera sin kapitalvinst, kan det dock lätt uppstå en intressekonflikt inom bolaget då styrelsen, till skillnad från aktieägarna, är snarare intresserad av att behålla sin makt och anställning. Detta kan resultera i att styrelsen blir frestad att vidta åtgärder för att förhindra uppköpet.   I samband med fientliga uppköpserbjudanden har det på den amerikanska aktiemarknaden utarbetats en rad försvarsåtgärder som kan vidtas av bolagsstyrelsen i syfte att försvåra eller förhindra ett företagsförvärv. På den svenska aktiemarknaden är vidtagande av åtgärder som har till syfte att förhindra eller försvåra att ett uppköpserbjudande framläggs eller genomförs icke tillåtna enligt 5 kap. 1 §             lagen om offentliga uppköpserbjudanden på aktiemarknaden (LUA). Motiveringen till detta förbud framkommer i bland annat Aktiemarknadsnämndens uttalande AMN 2005:47:”ett offentligt erbjudande anses vara en angelägenhet mellan målbolagets aktieägare och budgivaren, varför målbolagets styrelse inte ska tillåtas försämra förutsättningarna för att ett erbjudande lämnats”. Av denna anledning har styrelsen i ett målbolag som är ett aktiebolag en relativt svag position, då den beslutsfattande makten är hos de enskilda aktieägarna vid exempelvis antagandet av ett framlagt bud och hos bolagsstämman avseende vidtagande av eventuella försvarsmetoder. Dock har det genom AMN:s uttalanden framkommit i en rad praktiska fall att målbolagets styrelse hittat möjligheter att agera och i viss mån kringgå förbudet.   Uppsatsen är en komparativ studie med den svenska och amerikanska rättregleringen i fokus. Paralleller och samband dras även mellan det svenska, europeiska och engelska systemet. Syftet med arbetet är att undersöka svenska företagsledningarnas möjligheter och handlingsutrymme vid tillämpning av internationella försvarsmetoder för att avvärja ett oönskat uppköpserbjudande. I uppsatsen undersöks även de åtgärder som kan vidtas i ett preventivt syfte.   Möjligheten till genomförandet av ett bolagsuppköp är ett nyckelmoment för skapandet av en effektiv värdepappersmarknad där svaga bolag upphör att existera och starka bolag har utvecklings- och tillväxtmöjligheter. Att avgöra vad som stämmer överens med god sed kan dock bli problematiskt, då regleringen på området är oerhört spridd och i viss mån inkoherent. Trots dessa svårigheter har det i praktiken genomförts ett antal företagsuppköp som har visat på att tillämpningen av försvarmetoder är i viss utsträckning möjlig om den går att motivera genom att bolagets eller/och aktieägarnas intressen tillgodoses. Enligt aktiebolagslagen (ABL) är föremålet för aktiebolagets verksamhet att ge vinst till fördelning för aktieägarna. Samtidigt är aktieägarnas förtroende centralt för väl fungerande värdepappersmarknader. En mer omfattande rätt för bolagsstyrelsen i målbolaget att fatta beslut om försvarsåtgärder skulle kunna skada dessa grundläggande ändamål med ABL och den börsrättsliga regleringen. På så sätt skulle en betydligt större makt hos bolagsstyrelsen kunna ha en skadlig effekt, då det är aktieägarnas vinster och förtroende som bör prioriteras. Genom att analysera samspelet mellan de bolagsrättsliga och börsrättsliga principerna och relevanta praktiska avgöranden går det att se att den nationella regleringen är konstruerad på bästa möjliga sätt för att upprätthålla en god sed på den svenska finansmarknaden, trots sina potentiella brister i sammanhanget. / Hostile takeovers have for a long time been a part of the global financial market and are nowadays not an unknown phenomenon on the Swedish stock market. A takeover attempt becomes hostile when the board of directors of the target advises the shareholders to reject the submitted bid. That particular situation can, however, easily become the reason for conflict of interests within the company. The bid can be valuable for the shareholders, who primarily seek ways to maximize their profit at the same time, as the members of the board of directors desire to keep their employment and position within the company. The board can therefore as a result be willing to take action in order to prevent the takeover.   During the mid-20th century, due to a takeover-wave, the American stock market developed a series of defence measures that could be used by the board in order to impede or prevent an acquisition. However, measures that are intended to prevent or impede a takeover offer are prohibited on the Swedish stock market under Ch. 5 § 1 in the Act on Public Takeover Offers. The justification for this prohibition is found in, inter alia, the Swedish Securities Council's (Aktiemarknadsnämnden) statement AMN 2005: 47 where they indicated that a public offer is considered to be a matter between the target company's shareholders and the bidder, why the offeree company should not be allowed to impair the prerequisites for an offer submitted. For this reason, management has a relatively weak position in Swedish corporations, since the decision-making power is not with the board but with the separate shareholders when it comes to accepting a potential bid or the shareholders’ meeting of the corporation when a decision must be made if measures should be enact in order to prevent a bid. However, the boards of directors in some target companies have found opportunities to act and to some extent circumvent the ban posed in the Act on Public Takeover Offers.   The thesis is a comparative study with Swedish and American legal regulations in focus. Parallels are also drawn between the Swedish, European and English systems. The aim is to investigate the ability of the board of directors in Swedish corporations to use different defence methods to fend off an unwanted takeover bid. The paper also examines the measures that can be taken before the bid and as a result have a preventive function.   The possibility of implementing a company takeover is a key element for the creation of an efficient financial market in which weak companies cease to exist and strong companies have development and growth potential. A determination on what actions can be consistent with good practice can be problematic, since the regulations in this area are extremely widespread and somewhat incoherent. Despite these difficulties, the legal practice in this area has shown that the application of the defence methods is to some extent possible if the board of directors focus on supporting the will to defend the company and / or shareholder interests. To give the board of directors extended powers could have a detrimental effect on profits and trust. By analysing the interaction between the principles in company law and securities law as well as some relevant decisions by the Swedish Securities Council, it is possible to see that the Swedish national regulation is designed in the best possible way to maintain good practices on the Swedish stock market despite some shortcomings.

The criminal defences are of a very high importance especially in the context of health care services. They set the conditions under which health care services may be provided without any criminal sanction. Legislation regarding the criminal defences has been under constant development and the topic remains very actual nowadays. The thesis is divided into five chapters. First chapter introduces the reader the issue and explains the importance of dealing with criminal defences. Second chapter concerns general aspects of criminal defences and is divided into three parts. First of them deals with the term of unlawfulness, since the circumstances which are subject to this research, exclude the unlawfulness. Next part is dedicated to the legal regulation of defences and relations between them. Last part of first chapter explains philosophical and moral principles of acting within the scope of defences. Such principles are introduced both on a theoretical level and practical cases. Third chapter deals with particular criminal defences, including the defences which are not explicitly stated in the criminal code, and thoroughly explains issues related to them in its five parts. of my Master's degree thesis in English Lawful use of firearms The purpose of my paper is to draw attention to the lawful use of firearms in self- defence. The relation between the lawful use of firearms and self-defence is not explained sufficiently today. For example, it is not clear in what situations police officers have authority to act in self-defence and what their liability would be should they exceed the regulation of lawful use of firearms. The author offers possible solutions to this issue and describes their consequences. The paper is composed of three chapters. Introduction brings the reader into the issue. First chapter serves as an extension to the introductory part and defines basic terminology used in the paper such as defences, necessity, self-defence, dangerous offender, lawful use of firearms. Chapter Two deals with relevant international, constitutional and statutory legislation with a focus on the lawful use of firearms and its regulation. Chapter Three introduces basic knowledge from practice split into rulings and case studies. Author of this Master's degree thesis searched and chose the most relevant rulings with relation to the lawful use of firearms. Vallen i Västergarn / The rampart of Västergarn

In the small town of Västergarn on Gotland lies a rather impressive rampart, circa one kilometre long. Excavations of the area inside of the rampart, as well as excavations of the rampart itself, have yielded no conclusive answers regarding the dating and main purpose of the rampart and the settlement that supposedly lies within. This paper aims to shed some light on the date and purpose of the Västergarn rampart. This will mainly be done by a comparative study, where the Västergarn Rampart will be compared to other ramparts, one in Waterford and one in Birka. In this analysis the construction, mainly of the core construction of the ramparts, will be taken into consideration but aspects such as terrain and building material will also be considered. The results of earlier research in and around the Västergarn area will also be used to then come to a comprehensive theory regarding the dating and purpose of the Västergarn rampart.

These ants, and their mutualistic fungus gardens, are at risk from attack by parasitic microorganisms. To defend themselves and their mutualist, they have antimicrobial defences, such as substances secreted from their metapleural glands. As this defence is subject to selective pressures according to the risk of parasite attack, variations in the amount of defence may reflect variations in the risk. Meanwhile, there may be variation in the value of individual workers to the colony, dependent in part upon the area in which they work, and investment in their defences may also reflect this. In this study, the volume of the externally visible part (bulla) of the reservoir of the metapleural gland of workers was compared betwen species, colonies and tasks, to determine variations in defence strategies against pathogens. Additionally, colony sizes of a bacterial mutualist on the workers thoraxes, were estimated, looking for a possible relationship with metapleural gland bulla size. A total of eleven laboratory colonies were used, of four species of leafcutter ants: Atta laevigata (F.Smith, 1858), Atta sexdens rubropilosa Forel, 1908, Acromyrmex subterraneus brunneus (Forel, 1911) and Acromyrmex disciger (Mayr, 1887). Workers were collected from three areas of the colonies: foraging areas, symbiotic fungus gardens and the refuse deposits. Parameters measured were: the volume of the bulla of the metapleural gland, the weight of ants and an estimate of the olony sizes of the symbiotic bacteria. Analyses of covariance were conducted using individual mass as a covariate, to determine the contributions of a range of parameters in explaining variation in the size of this organ. The two species of Atta were found to have larger bulla when compared to the two species of Acromyrmex., probably reflecting not a greater degree of exposure to parasites but a strategy of greater investment in defences. Gardeners and foragers of the species A. laevigata and Ac. subterraneus brunneus had larger bulla than did waste workers, revealing a lower quality (in terms of parasite defence) of the waste workers. In this case, we expect that these individuals, being of lower quality, are allocated to more dangerous tasks, to die more rapidly. Acromyrmex subterraneus brunneus was the only species with visible colonies of the bacterial mutualist on the thorax. There was a positive relation between the size of this colony and the volume of the bulla of the metapleural gland. These variations in degrees of defence imply that the ants have different strategies to defend their colonies against pathogens and parasites. / Formigas cortadeiras apresentam interações complexas. Sendo que esta defesa está sujeita a pressão de seleção de acordo com o risco de ataque por parasitas, variações no investimento nela podem ser consequência deste risco. Ao mesmo tempo, pode haver indivíduos com diferentes valores para a colônia, dependendo em parte na área onde são encontradas, e podem ter maior ou menor investimento em defesas contra parasitas. Diante disso o trabalho propôs verificar a variação do volume do reservatório da glândula metapleural (bula) entre espécies, colônias e tarefas de formigas cortadeiras para verificar possíveis estratégias de defesas das operárias contra patógenos. Avaliou-se também a presença de uma bactéria mutualista, que é utilizada também como defesa contra parasitismo, e a possível relação entre esta e o volume do reservatório da glândula metapleural. Foram utilizadas um total de 11 colônias de quatro espécies de formigas cortadeiras, Atta laevigata (F.Smith, 1858), Atta sexdens rubropilosa Forel, 1908, Acromyrmex subterraneus brunneus (Forel, 1911) e Acromyrmex disciger (Mayr, 1887). Formigas foram coletadas de três áreas das colônias: as áreas de forrageamento, os jardins do fungo simbionte e o lixo. As informações tomadas foram: volume da bula da glândula metapleural, massa das formigas e uma estimativa do tamanho das colônias de bactéria mutualista. Análises de covariância foram utilizadas, com massa dos indivíduos como covariável, para determinar as contribuições de diversos fatores para explicar o tamanho desse órgão. Pelas análises obtidas, as duas espécies de Atta possuem bulas maiores em relação às duas espécies de Acromyrmex., provavelmente refletindo não uma maior exposição a parasitas mas uma estratégia de maior investimento em defesas. As jardineiras e as forrageadoras das espécies A. laevigata e Ac. subterraneus brunneus tiveram bulas maiores em relação às lixeiras, isto mostrando uma menor qualidade (em termos de defesas contra parasitas) das lixeiras. Neste caso, suponhamos que estes indivíduos, sendo de menor qualidade, são alocados a tarefas mais perigosas e morrerão rapidamente. Acromyrmex subterraneus brunneus foi a única que apresentou colônias de bactéria mutualista, dispostas no tórax. Houve uma relação positiva do tamanho desta colônia com o volume da bula da glândula metapleural. Essas variações nesses sistemas de defesas implicam que as formigas podem apresentar diferentes estratégias para defender o ninho contra patógenos e parasitas.

4 ABSTRACT Characteristic high helmets in Daphnia cucullata, which increase resistance of Daphnia against various invertebrate predators, can be induced by chemical cues released by these invertebrates but also by small-scale turbulence. I evaluated the response of D. cucullata to both factors in several clones originating from two riverine pools differing in their predator regime. In a large pool, the dominant invertebrate predator is the cladoceran Leptodora kindtii, and the Daphnia population there shows a typical cyclomorphosis. In the second (small) pool, Daphnia do not produce helmets, despite the presence of the phantom midge larvae Chaoborus flavicans. I compared phenotypic changes of Daphnia cucullata clones from these pools to Chaoborus kairomones and to a small-scale turbulence in laboratory experiments. Kairomones induced significantly longer helmets in clones from both pools; however, only clones form the large pool reacted also to turbulence. As all daphnids in the experiments responded to chemical cues from Chaoborus, I assume that either the kairomone dose under natural conditions in the small pool is too low to induce helmets or the phenotypic response of the local population is mediated by other factors. <p>As the number one cause of sick absenteeism and disability pension, musculoskeletal pain is considered a major health problem in Sweden and many other industrialized countries. Medical findings are often insufficient to explain the pain’s intensity or duration, and psychological factors are known to be important in understanding the aetiology and maintenance of pain. The current thesis examines the relationship between non-specific chronic musculoskeletal pain and cognitions, emotions and behaviours. In Study I, chronic pain patients were interviewed about pain experiences and the results indicated that some patients use psychological defences to deal with chronic pain. Study II was an experimental approach set up to study the association between chronic pain and selective memory. In a pictorial memory game, no differences were found between patients and controls in the neutral game. In the pain-related game patients decreased – and controls improved – their performance, a finding discussed in terms of cognitive avoidance. Study III used questionnaire and register data to examine the predictive value of psychosocial variables on sustained pain-related sick absenteeism and the results showed sense of mastery and recovery beliefs to be especially important. The studies are discussed in terms of emotional and defensive coping and it is suggested that defences can be related to excessive activity, which may increase the risk of future relapses. It was suggested that an increased acceptance of pain, at both an individual and a societal level – would favour rehabilitation and return-to-work for those suffering from persistent pain.</p>
